Griffin 630 Barnstable Road Hyannis, MA 02601 Dear Mr. Griffin, On February 14, 2006,the Health Division sent a letter regarding the.removal of Underground Storage Tanks (UST). The letter indicated that, "The Town of Barnstable, Health Department, has completed the research on your parcel 311-104 and concluded that the Underground Storage Tanks of Gasoline, which were tested in 2003 and 2005, have passed. Since the tanks are located inside the Zone of Contribution and meet the construction requirements, testing shall be completed at two-year intervals per Town of Barnstable Code, Chapter 326-8(E). Copies of the.testing data shall be submitted to the Health Department upon completion of the tests. At the first failure of testing, the tanks shall be removed". Prior tests indicate the tanks have passed however; according to the Town of Barnstable Code, Chapter 326-8(E),these tanks shall be tested in 2007 and copies of the testing data shall be submitted to the Health Department. Pursuant to UIC regulations(310 CMR 27.00),where the potential exists for pollutants to enter an injection well (e.g. by means of a floor drain) and the presence of the pollutants causes or is likely to cause a violation of any Massachusetts Drinking Water Regulation or which adversely affects or is likely to adversely affect the health of persons, the use of the well is prohibited. With the exception of discharges authorized under the Department's Ground Water Discharge Permit program, the Department considers this prohibition to include the use of any injection well at facilities which have in the past or currently use, store, or otherwise manage hazardous materials and/or wastes as defined in 310 CMR 30.000 and 310 CMR 40.0000. This form shall serve as notice to the DEP of the elimination of the use of an unauthorized injection well. The structural option which has been chosen to bring the system into compliance should be noted under item I. Submit all information and attachments for that option, as well as for item II, as noted. Your letter states that Griffin Realty Trust leased the above-referenced property (the "Site") and purchased the hanger bay in 1982 . Since Griffin Realty Trust purchased the hanger bay, waste oil and solvents have been i collected for disposal by Safety Kleen, the septic system has been deactivated and sanitary waste is now routed to the municipal sewer system. In addition, the oil/water separator has been replaced and the MDC holding tank has been cleaned. Your letter also states that assessment activities will . be conducted in the vicinity of the leach pits . Your letter concludes by stating that there is no evidence of a release of hazardous materials at the site during Griffin Aviation Services operation of the hanger bay. In addition, you stated that the material identified in the leach pit above reportable concentrations was present prior to your lease of the property. Please be advised that due to your status as present owner and operator, Griffin Aviation Services-is a Potentially Response Party ("PRP") pursuant to ,Massachusetts General Law (M.G.L. ) c.21E, Section 5, and is liable for response action costs at the site. The Department also has . reason to believe that one or more response actions are required at the site. The Massachusetts Oil and Hazardous Material Release Prevention and Response Act, M.G.L. c.21E, and the MCP, 310 CMR 40. 0000, require the performance of response actions to prevent harm to health, safety, public welfare and the environment which may result from this release and govern the conduct of such actions. The purpose of this Notice is to inform you of your legal responsibilities under State law for assessing and/or remediating the release at this property. For purposes of this Notice of Responsibility, the terms and phrases used herein ''shall have the meaning ascribed to such terms and phrases by the MCP unless the context clearly indicates otherwise. 20 Riverside Drive • Lakeville,Massachusetts 02347 • FAX(508)947-6557 • Telephone (508) 946-2700 -2- STATUTORY LIABILITIES The Department has reason to believe that you (as used in this letter, "you" refers to Griffin Aviation Services) are a Potentially Responsible Party ("PRP") with liability under M.G.L. c. 21E, § 5, for response action costs. Section 5 makes the following parties liable to the Commonwealth of Massachusetts: current owners or operators of a site from or at which there is or has been a release or threat of release of oil and/or hazardous material; any person who owned or operated a site at the time hazardous material was stored or disposed of; any person who arranged for the transport, disposal, storage or treatment of hazardous material to or at a site; any person who transported hazardous material to a transport, disposal, storage or treatment site from which there is or has been a release or threat of release of such material; and any person who otherwise caused or is legally responsible: for a release or threat of release of oil or hazardous material at a site. This liability is "strict, " meaning it is not based on fault, but solely on your status as an owner, operator, generator, _ transporter or disposer. It is also joint and several, meaning that. each person who falls within one of these categories may be held liable for all response action costs incurred at the site, regardless of the existence of any other liable parties. The MCP requires responsible parties to take necessary response actions at properties where there is or has been a release and/or threat of release of oil and/or hazardous material. If you do not take the necessary response actions, or fail to perform them in an appropriate and timely manner, the Department is authorized by M.G.L. c. 21E to perform the work. By taking such actions, you can avoid liability for response action costs incurred by the Department in performing these actions and any sanctions which may be imposed for failure to perform response actions under the MCP. You may be liable for up to three (3) times all response action costs incurred by the Department. Response action costs include, without limitation, the cost of direct hours spent by Department employees arranging for response actions or overseeing work performed by persons other than the Department or its contractors, expenses incurred by the Department in support of those direct hours, and payments to the Department's contractors. (For more detail on cost liability, see 310 CMR 40. 1200: Cost Recovery. ) I The Department may also assess interest on costs incurred at the rate of twelve percent (12%) , compounded annually. To secure payment of this debt, the Commonwealth may place liens on all of your property in the Commonwealth. To recover the debt, the Commonwealth may foreclose on these liens or the Attorney General may bring legal action -against you. -3- E In addition to your liability for up to three (3) times all response action costs incurred by the Department, you may also be liable to the Commonwealth for damages to natural resources caused by the release. Civil and criminal liability may also be imposed under M.G.L. c. 21E, 5 11, and civil administrative penalties may be imposed under M.G.L. c. 21A, 5 16, for each violation of M.G.L. c. 21E, the MCP or any order, permit or approval issued thereunder. If you are an RP and you have reason to believe that your performance of the necessary response actions is beyond your technical, financial or legal ability, you should promptly notify the Department in writing of your inability in accordance with Chapter 21E, subsection 5(e) , and '310 CMR 40.0172 . If you assert and demonstrate in compliance therewith that performing or paying for such response action is beyond your ability, subsection 5 (e) provides you with a limited defense to an action by the Commonwealth for recovery of two to three times the Department's response action costs and 310 CMR 40. 0172 provides you with a limited defense to the Department's assessment of civil administrative penalties. You should be aware that you may have claims against third parties for damages, including claims for contribution or reimbursement for the costs of cleanup. Such claims do not exist indefinitely but are governed by laws which establish the time allowed for bringing litigation. The Department encourages you to take any action necessary to protect any such claims you may have against third parties. ACTIONS REQUIRED Additional submittals are necessary with regard to this release from the leach pits and may include but not be limited to, the filing of a written Immediate Response Action (IRA) Plan, IRA Completion Statement, a Phase II - Comprehensive Site Assessment r Report and/or a Response Action Outcome (RAO) Statement. Specific approval is required from the Department for the implementation of all IRAs and Release Abatement Measures. Assessment activities consisting of the construction of a fence and/or the posting of signs are actions that are exempt from this approval requirement. The . MCP requires persons undertaking response actions to perform Immediate Response Actions in response to sudden releases, Imminent Hazards and Conditions of Substantial Release Migration. In accordance with 310 CMR 40. 0426, an Imminent Hazard Evaluation shall be performed as part of an IRA within fourteen (14) days of obtaining knowledge of such a condition and shall be submitted to the Department within sixty (60) days. This site shall not be deemed to have had all the necessary and required response actions taken unless and until all substantial hazards presented. by the release and/or threat of -4- release have been eliminated and. a level of No Significant Risk exists or has been achieved in compliance with M.G.L. c.21E and the MCP. The MCP requires persons undertaking response actions at a site to submit to the Department an Response Action Outcome Statement prepared by a Licensed Site Professional upon determining that a level of No Significant Risk already exists or has been achieved at the site. The Department encourages parties with liabilities under M.G.L. c. 21E to take prompt action in response to releases and threats of release of oil and hazardous materials. By taking prompt action, you may significantly lower your cleanup costs and avoid---the -hLiposition of, or reduce the amount of, certain fees payable under 310 CMR 4. 00. The Department requests that you submit written documentation within ten (10) days of receipt of this Notice indicating whether or not you intend to undertake response actions at this disposal site pursuant to 310 CMR 40.0000.
