This Ordinance was adopted to protect the public health and welfare,especially as it pertains to the public drinking water supply. The following is a description of the results of the Inventory(enclosed)and Inspection. MATERIALS INVENTORY AMOUNT AND PURPOSE: The Inventory of this site indicates the use or storage of approximately one-thousand,one-hundred and thirty-four(1,134)gallons of toxic and hazardous material.This material is used in the repair,stripping and coating of furniture performed at this site.Please be aware that the Town of Barnstable has determined that a minimum of one-hundred and eleven(111)gallons of toxic and hazardous materials requires an annual license. GENERAL STORAGE AREAS AND CONDITIONS: • The Production Room,houses a paint spray booth,and flammables cabinet. • The Chemical Storage Room,to the rear of the Production Room,houses the majority of paints, lacquers and stains. • The Stripping Room consists of hazardous waste storage,a solvent tank,caustic soda tank and oxalic acid tank.This room is reportedly explosion proof,is bermed and vented. SAFETY AND DOCUMENTATION: The required Material Safety Data Sheets were available and in a binder in the office.A Contingency Plan was not available nor was a Spill Kit. Manifest sheets for the proper transport of hazardous materials were also provided upon request. -2- Fire extinguishers were available and their inspection up to date. A License for Storing or Handling 111 Gallons or More of Hazardous Materials was posted on the Chemical Storage Room door. SITE FACILITIES: The facility floor is constructed of concrete,no floor drains were observed at the facility. The site building is served by town sewer and water. Any deficiencies which were discovered in the course of this inspection with regards to the Hazardous Materials Ordinance are described below. RECOMMENDED CORRECTIVE ACTIONS TO BE TAKEN: _ The Chemical Storage Room should be labeled at flammable. The call came in from Hyannis Fire. Fire Captain Farrenkopf met me at the site.about 8:30 and showed me where a sewer manhole cover had overflowed. About 20 minutes later WPC showed up with a drain router and started cleaning out the sewer line downstream from the overflow. Ed Engleson informed me that this had happened before due to the laundry by the clogged manhole. The routing worked and freed up the line, with a substantial amount of white rags attaching themselves to the end of the router. Once I came into work on Monday morning Eds' wife informed me that Ed had also found a large tin can after I left and they were cleaning up. Ed thinks this may have contributed to the clog. Operation-No person shall operate a facility constructed, substantially reconstructed,or altered pursuant to 310 CMR 7.02(1),(3),and(4) except in conformance with the requirements established therein and in conformance with the specific written plan approval requirements. 2. Recordkeeping-The facility owner/operator shall establish an on site recording system. All records shall be maintained up-to-date such that year-to-date information is readily available for Department examination. Recordkeeping shall, at a minimum,include: a) The initiation and completion dates for the proposed construction/reconstruction/ alteration. b) Malfunctions-A record of all malfunctions including,at a minimum: the date and time the malfunction occurred; a description of the malfunction and the corrective action taken;the date and time corrective actions were initiated; and the date and time corrective actions were completed and the facility returned to compliance. c) Records shall be maintained documenting the air contaminant emission analysis supporting the response to BWP AQ 01-B Section-E items la, lb, and 2. d) All records shall be kept on site for three(3)years from date of record and shall be made available to the Department upon request. 3. The Regional Bureau of Waste Prevention office must be notified by telephone or fax as soon as possible after the occurrence of any upsets or malfunctions to facility equipment, air pollution control equipment,or monitoring equipment that result in an excess emission to the air or a condition of air pollution. 4. The Department must be notified in writing within 30 days of commencement of construction and completion of this approved installation. 5. The Department may revoke,in accordance with 310 CMR 7.02(3)(k), any plan approval if the actual construction has not begun within two years from the date of issuance or if,during the construction,the construction is suspended for the period of one year or more. 6. Reporting-Any construction, substantial reconstruction or alteration, as described in 310 CMR 7.02(1), (3), and(4) at a facility subject to the reporting requirements of 310 CMR 7.12,shall be reported to the Department on the next required source registration. This approval may be suspended,modified,or revoked by the Department if, at any time,the Department determines that the facility is violating any condition or part of this LPA Approval. The Department shall be notified in writing before any modification of the facility such as a change in raw materials or an increase in production capacity that may increase emissions. 8. Opacity,exclusive of uncombined water, shall not exceed 10%at all times during all modes of operation,including startups and shutdowns. Visible emissions or opacity that exceeds the limits set forth in this approval shall be reported to the Department in writing or by fax within seven(7) days of the occurrence. 9. Noise from the facility during construction,initial startup and routine operation, including startups and shutdowns, shall not exceed the Department noise guidelines and shall not cause a condition of air pollution as defined in 310 CMR 7.01 and 7.10. 10. The facility shall be constructed and operated in a manner to prevent the occurrence of dust or odor conditions that cause or contribute to a condition of air pollution as defined in 310 CMR 7.01 and 7.09. 11. This Final Approval does not negate the responsibility of owner/operator of the referenced facility to comply with this or any other applicable federal, state, or local regulations now or in the future. Nor does this approval imply compliance with any other applicable federal, state,or local regulations now or in the future. 12. Emission Testing-The Department may,in accordance with Regulation 310 CMR 7.13, require source emission testing("stack testing"). All emission testing shall be conducted in accordance with the Department's Guidelines for Source Emission Testing and with 310 CMR 7.13. 13. Dip N' Strip shall take any and all measures necessary to ensure the operation of the equipment approved herein shall not result in visible emissions (i.e. zero percent opacity), exclusive of uncombined water vapor. These measures may include add-on pollution control equipment and/or shutdown of the equipment while corrective actions are being employed. This provision supersedes condition 8 of the General Conditions. 6. A detailed record keeping system shall be maintained to verify compliance with all conditions of this approval. 7. The facility shall be operated in strict accordance with the application approved herein. B. Hazardous Waste 1. Dip N Strip has failed to notify the Department of its hazardous waste activities by registering as a very small quantity generator(VSQG)in violation of 310 CMR 30.353(5). The regulation states: "A Very Small Quantity Generator shall register with the Department by notifying the Department in writing of its activity involving hazardous waste or regulated material." 2. Dip N Strip was using an incorrect EPA identification number for their current site on their hazardous waste manifest in violation of 310 CMR 30.31 l(1). The regulation states: "A generator who transports, or offers for transportation,hazardous waste for off-site treatment, storage, disposal or use, shall ensure that all required information has been provided in a complete and accurate manner and in compliance with 310 CMR 30.310 before the waste is transported off site. Failure to complete any applicable portion of the manifest in compliance with 310'CMR 30.000 and the directions on the manifest shall be a violation of,M.G.L. c. 2 1 C and of 310 CMR 30.000." 3. Dip N Strip's hazardous waste storage area was not labeled with a sign in noncompliance with 310 CMR 30.353(6)(h)which references 30.341(4). 4. Dip N Strip's hazardous waste storage area was not clearly marked(tape on floor or visible line) in noncompliance with 310 CMR 30.353(6)(h)which references 30.341(5). 5. Dip N Strip was storing four fifty-five (55) gallon containers of hazardous waste (paint solids) in the hazardous waste storage area, which were not labeled. This constitutes a condition of noncompliance with 310 CMR 30.353(6)(g), which references 310 CMR 30.682. 6. Dip N Strip was accumulating two fifty-five (55) gallon drums of hazardous waste (paint thinner and paint solids) as satellite drums, which were not labeled.
