McKean,RS,CHO Director of Public Health 200 Main Street Hyannis,MA 02601 RE: Tirrell Radiator,558 Bearse's Way—Outstanding Compliance with Article 39, Control of Toxic and Hazardous Materials Dear Tom: I am writing to inform you of the outstanding compliance and cooperation from Tirrell Radiator at their follow-up hazardous materials inspection/site visit on September 1,2004. They should be recognized as a business that has gone above and beyond what was expected in order to comply with state and local hazardous materials handling,storage and disposal regulations. In less than one month,the staff at Tirrell Radiator improved their shop conditions and reversed all violations discovered at their initial hazardous materials inventory and inspection on August 3, 2004. At the initial inspection/inventory on August 3,2004,several serious problems and violations were identified at this place of business. Tirrell Radiator is an official Antifreeze Recycling Drop Off Point for Barnstable County. Finding numerous violations weakened their good standing as a public recycling location. The manager,Mr. Peter Mello, and his staff took action in order to come into compliance and lead by example in the Town of Barnstable. I would like to point out the numerous improvements they have made in just twenty eight days from their first inspection: • Promptly paid their Hazardous Materials Storage and Handling permit on 8-9-04. • Sent in their new Contingency Plan,revised and corrected it;then promptly faxed the new copy to the Public Health Division. • Posted their Contingency Plan in their shop for reference during a spill emergency. • Antifreeze Recycling Area: Placed catchment containers under nozzles to prevent releases,constructed a large secondary containment"tray"made from an old antifreeze r container to be placed under the antifreeze recycling drums(one antifreeze recycling container already has a secondary containment/spill pallet). • One pallet of Speedy Dry has been ordered. Speedy Dry is now in use in the shop area. Spills and draining hazardous materials from vehicles are being increasingly cleaned and prevented. • Contracted with New England Environmental Services(NEES)to take spent Speedy Dry. (This is rarely done in most shops and a significant method of proper hazardous waste disposal) • Obtained a Spill Containment Kit—located in the Antifreeze Recycling Area. • Hazardous Waste Disposal: Unidentified waste will be picked up by NEES, four 55 gallon drums of waste antifreeze has been pumped by NEES,four drums of waste solvent will be picked up by NEES,one drum of waste solvent/antifreeze picked up by NEES. • All manifests/documentation of hazardous waste pickups are now on site. • All Material Safety Data Sheets(MSDS)of all chemical based products in the shop are updated/obtained and on site. • They are working on reducing their LQG status. Committed to not letting hazardous waste accumulate again to LQG status. • Labels for hazardous waste containers being obtained from NEES. • Junk pile in hazardous waste area reduced and organized. Old radiators/parts are now stored on a pallet for scrap collection and recycling. • Making pathway through hazardous waste area to prevent a fire hazard. • Fire extinguishers now all serviced and current. From the first inspection,the staff at Tirrell Radiator has had a cooperative attitude and a sincere desire to be compliant with the Town of Barnstable's hazardous materials regulations. All the orders given to Peter Mello to bring this business into compliance were followed through in detail. This is their very busy season and many of these improvements have cost them thousands of dollars. Despite this fact,they did not hesitate to bring their business into compliance with every order and recommendation given to them without any protest or complaint. The staff at Tirrell Radiator should be recognized and congratulated on their success and outstanding achievements. Because of their swift action,they are helping to prevent contamination of Barnstable's public health,environment and existing and future drinking water supply. Evacuate the entire area, if necessary. 2. Shut off valves, pumps, and electrical equipment as appropriate. 3. Remove or restrict any potential ignition source from the area if the material is flammable. 4. Cover or dike all existing sumps, and storm drains if not already covered. 5. Contain the spill by use of absorbent socks/booms, then apply appropriate absorbant material or additional socks/booms. Contact spill response frets if necessary for assitance. 6. Remove all absorbed material or contained liquid and package in- approved DOT container. Used absorbent materials should be packaged separately from liquids. 7. Label all containers with the type of waste and the start date of accumulation. 8. Notify the appropriate agencies. (Number listings to the right of this plan) 9. This letter contains information from that visit that will help you, as a business owner/manager,become compliant with hazardous waste regulations. Enclosed are copies of Article 39: Control of Toxic and Hazardous Materials ordinance and a copy of the Toxic and Hazardous Materials On-Site Inventory form from the visit to your shop. Please note the problems identified at your place of business during the hazardous materials inspection and their corresponding recommendations listed below: PROBLEM: • You are in violation of Section 9-1 of Article 39: Control of Toxic and Hazardous Materials,which states, "The release of any hazardous materials and/or acutely hazardous materials upon the ground, or into any surface...within the Town of Barnstable,is prohibited." • Hazardous materials,particularly Antifreeze,were observed being released/spilled onto the floor with very little catchment to control these releases. • There were numerous spills of antifreeze on the floor of your shop and an insufficient amount(none observed)of absorbent material(Speedy-Dry, absorbent pads)used to contain/clean up these releases. • On a previous inspection in 1997,your business was instructed by the Public Health Division to use"Speedy Dry &rags for spills",yet this order has been ignored. • The floor of your shop is extremely dirty with stains and antifreeze puddles that show spill containment and clean up has not been in use at your place of business. r !V-e6 ORDER: • Section 5-2 of Article 39 states,"Provisions shall be made to contain the product(i.e. hazardous materials)in the case of an accidental release." • Starting immediately,consistently use proper spill containment pans/trays under:411 • vehicles when hazardous materials are drained from them. • Please use_spill under all container of used/recycled Antifreeze in your recycling + area. ` • Place a large portion of Speedy Dry on the spills in your shop and DO NOT REUSE thj§,� absorbent material. • Absorbent materials should be cleaned off the shop floor and disposed of DAILI.— • DO NOT use soap and water to clean spills of Antifreeze from your shop floor. • Spills or releases of Antifreeze must be controlled because it is especially toxic and can cause irreversible health problems or death. PROBLEM: The following hazardous wastes are currently stored in your shop and need to be disposed of as soon as possible: • One tank: Approximately 150 gallons of unidentified hazardous waste • Four 55 gallon drums of waste Antifreeze in your Antifreeze recycling arevS • Four rusting 55 gallon drums of waste solvent Vr • One rusting 55 gallon drum of waste solvent/antifreeze which ds a cap or it ORDER: • Long term storage of these hazardous wastes violates Section 5-3 of Article 39. • Please remove and dispose of these hazardous wastes in accordance with the Massachusetts Hazardous Waste Management Act,CH 704 of the Acts of 1979. • The Accumulation Time Limits(without a permit)for Large Quantity Generators is 90 days from the date the waste was generated. The EPA may grant 30 days for unforeseen, cF*7 �f temporary, and uncontrollable circumstances. uk PROBLEM: • New England Environmental Services removes your waste Antifreeze but there is ncy paperwork that documents any disposal of this hazardous waste in 2004. . v • At ur_ins ection today,you produced no documentation to show yo waste o' rid e o t.ar properly disposed of,when they are disposed of,and where thnaterial i proper hazardous waste disposal by a licensed hauler. ORDER: %,'Q� • Section 5-3 of Article 39 states, "Wastes containing acutely hazardous materials and/or hazardous materials...shall be removed and disposed of in accordance with the `� Massachusetts Hazardous Waste Management Act, Ch. 704 of the Acts of 1979Lhauler " • Starting immediately,please obtain waste hauling documentation and.retain ous material disposal records and manifests from NEES,and the hazardous wastho takes your oil and solvent wastes. • All recor s pertaining to amounts,removal and disposal of toxic or hazardous wastes need to be retained onsite for no less than five years by the hazardous materials registration holder(i.e. Tirrell Radiator)so the Public Health Division,MADEP or EPA can review these records at any time. This must be done in accordance with section 12-3 of Article 39. i 9 PROBLEM: • Your Hazardous WASTE total from today's inventory and inspection is 1,040 gallons (including the four 55 gallon drums"that will be disposed of in the next three weeks"). • This unusually large amount of hazardous waste qualifies your business as a Large Quantity Generator(LQG)of Hazardous Waste. ORDER: • The RCRA Generator Requirements for Large Quantity Generators are not being met by your place of business. The list of LQG requirements were given to you at your inspection today(copy enclosed)and should be taken very seriously and complied with if you choose to remain a Large Quantity Generator. • If you do not want to be categoAed as a Large Quantity Generator or have to adhere to the federal requirements of this title(please refer to the highlighted section of your enclosed copy of RCRA Generator Requirements),it is recommended that you bring your hazardous waste total down to 293 gallons or less per month. • Proper identification and consistent disposal of hazardous wastes in your shop is require in order to accomplish becoming a Very Small or Small Quantity Generator. PROBLEM: 5e�� Waste oil,waste antifreeze and waste solvent b and tanks are not labeled correct. They o not indicate the health hazard they can have. RECOMMENDATION: Please label all hazardous waste storage barrels and tanks"TOXIC"and"HAZARDOUS WASTE",in addition to the type of waste contained. This should be completed immediately. PROBLEM: • There is a large junk pile of old radiators and clutter next to your waste solvent tank/drums. if P/j • There is a fire extinguisher in your shop area at needs to be serviced ORDER: These items stored in a pile are a fire hazard in your shop. Please remove this junk pile as soon as possible. Please service the fire extinguisher as soon as possible. PROBLEM: • Large Quantity Generators are required by federal law to provide RCRA(Resource Conservation&Recovery Act)Personnel Training to their staff. • The Town of Barnstable also requires businesses who register their hazardous materials to submit a contingency plan prior to obtaining their Hazardous Materials Storage and Handling Permit(TOB General Ordinance,Article 39, Sect. 6-5,A,B,C,D,E). ORDER: �n I • Please plan and execute Spill Control&Emergency Response Training for your staff as soon as possible. 5 • Please design and submit an Emergency Contingency Plan for spill preparedness and response within the next 30 days (sample copy enclosed). This plan should be posted and visible in your shop and office areas. On Site Inventory Total The Toxic and Hazardous Materials On-Site Inventory from August 2,2004 shows that you have approximately 2,315 gallons of toxic and hazardous materials being used, stored, generated and disposed of at Tirrell Radiator(Please see enclosed Toxic and Hazardous Materials On Site Inventory sheet). i The Board of Health has determined that the using,storing,generating and disposing of over 111 gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain an annual Hazardous Materials License. This license should be purchased within the next 30 days from the Town of Barnstable Town Offices,200 Main Street,Hyannis,MA 02601 (application enclosed). Why are'these recommendations being made for Tirrell Radiator? • This information is intended to educate you,a business owner/operator in the Town of Barnstable,in order to keep your business operations in compliance with local,state and federal toxic and hazardous materials laws so that you can avoid future regulatory problems. • Complying with the Control of Toxic and Hazardous Materials ordinance (Article 39)can prevent contamination of Barnstable's existing and future drinking water supply,prevent environmental contamination which can bankrupt site owners,lower or destroy land values,drive out residents and industry,depress local economies and endanger public health. As a follow up to the site visit and inventory completed on Monday,August 2,2004,a representative from the Public Health Division will re-visit your business during the next 30 days to further advise you on your compliance. This letter contains information from that visit that will help you, as a business owner/manager,become compliant with hazardous waste regulations. Enclosed are copies of Article 39: Control of Toxic and Hazardous Materials ordinance and a copy of the Toxic and Hazardous Materials On-Site Inventory form from the visit to your shop. Please note the problems identified at your place of business during the hazardous materials inspection and their corresponding recommendations listed below: PROBLEM: • You are in violation of Section 9-1 of Article 39: Control of Toxic and Hazardous Materials,which states, "The release of any hazardous materials and/or acutely hazardous materials upon the ground, or into any surface...within the Town of Barnstable,is prohibited." • Hazardous materials,particularly Antifreeze,were observed being released/spilled onto the floor with very little catchment to control these releases. • There were numerous spills of antifreeze on the floor of your shop and an insufficient amount(none observed)of absorbent material(Speedy-Dry, absorbent pads)used to contain/clean up these releases. • On a previous inspection in 1997,your business was instructed by the Public Health Division to use"Speedy Dry &rags for spills",yet this order has been ignored. • The floor of your shop is extremely dirty with stains and antifreeze puddles that show spill containment and clean up has not been in use at your place of business. r ' a ORDER: • Section 5-2 of Article 39 states, "Provisions shall be made to contain the product(i.e. hazardous materials)in the case of an accidental release." • Starting immediately, consistently use proper spill containment pans/trays under all vehicles when hazardous materials are drained from them. • Please use spill pallets under all container of used/recycled Antifreeze in your recycling area. • Place a large portion of Speedy Dry on the spills in your shop and DO NOT REUSE this absorbent material. • Absorbent materials should be cleaned off the shop floor and disposed of DAILY. • DO NOT use soap and water to clean spills of Antifreeze from your shop floor. • Spills or releases of Antifreeze must be controlled because it is especially toxic and can cause irreversible health problems or death. PROBLEM: The following hazardous wastes are currently stored in your shop and need to be disposed of as soon as possible: • One tank: Approximately 150 gallons of unidentified hazardous waste • Four 55 gallon drums of waste Antifreeze in your Antifreeze recycling area • Four rusting 55 gallon drums of waste solvent • One rusting 55 gallon drum of waste solvent/antifreeze which needs a cap on it ORDER: • Long term storage of these hazardous wastes violates Section 5-3 of Article 39. • Please remove and dispose of these hazardous wastes in accordance with the Massachusetts Hazardous Waste Management Act, CH 704 of the Acts of 1979. • The Accumulation Time Limits(without a permit)for Large Quantity.Generators is 90 days from the date the waste was generated. The EPA may grant 30 days for unforeseen, temporary, and uncontrollable circumstances. PROBLEM: • New England Environmental Services removes your waste Antifreeze but there is no paperwork that documents any disposal of this hazardous waste in 2004. • At your inspection today,you produced no documentation to show your waste oil and waste solvent are properly disposed of,when they are disposed of,and where the material is taken for proper hazardous waste disposal by a licensed hauler. ORDER: • Section 5-3 of Article 39 states,"Wastes containing acutely hazardous materials and/or. hazardous materials...shall be removed and disposed of in accordance with the Massachusetts Hazardous Waste Management Act,Ch. 704 of the Acts of 1979." • Starting immediately,please obtain waste hauling documentation and retain all hazardous material disposal records and manifests from NEES, and the hazardous waste hauler who takes your oil and solvent wastes. • All records pertaining to amounts,removal and disposal of toxic or hazardous wastes need to be retained onsite for no less than five years by the hazardous materials registration holder(i.e. Tirrell Radiator) so the Public Health Division,MADEP.or EPA can review these records at any time. This must be done in accordance with section 12-3 of Article 39. tir PROBLEM: • Your Hazardous WASTE total from today's inventory and inspection is 1,040 gallons (including the four 55 gallon drums "that will be disposed of in the next three weeks"). • This unusually large amount of hazardous waste qualifies your business as a Large Quantity Generator(LQG) of Hazardous Waste. ORDER: • The RCRA Generator Requirements for Large Quantity Generators are not being met by your place of business. The list of LQG requirements were given to you at your inspection today(copy enclosed)and should be taken very seriously and complied with if you choose to remain a Large Quantity Generator. • If you do not want to be categoriiied as a Large Quantity Generator or have to adhere to the federal requirements of this title(please refer to the highlighted section of your enclosed copy of RCRA Generator Requirements),it is recommended that you bring your hazardous waste total down to 293 gallons or less per month. • Proper identification and consistent disposal of hazardous wastes in your shop is required in order to accomplish becoming a Very Small or Small Quantity Generator. PROBLEM: Waste oil,waste antifreeze and waste solvent barrels and tanks are not labeled correctly. They do not indicate the health hazard they can have. RECOMMENDATION: Please label all hazardous waste storage barrels and tanks"TOXIC"and"HAZARDOUS WASTE",in addition to the type of waste contained. This should be completed immediately. PROBLEM: • There is a large junk pile of old radiators and clutter next to your waste solvent tank/drums. • There is a fire extinguisher in your shop area that needs to be serviced. ORDER: These items stored in a pile are a fire hazard in your shop. Please remove this junk pile as soon as possible. Please service the fire extinguisher as soon as possible. PROBLEM: • Large Quantity Generators are required by federal law to provide RCRA(Resource Conservation&Recovery Act)Personnel Training to their staff. • The Town of Barnstable also requires businesses who register their hazardous materials to submit a contingency plan prior to obtaining their Hazardous Materials Storage and Handling Permit(TOB General Ordinance,Article 39, Sect. 6-5,A,B,C,D,E). ORDER: • Please plan and execute Spill Control&Emergency Response Training for your staff as soon as possible. • Please design and submit an Emergency Contingency Plan for spill preparedness and response within the next 30 days (sample copy enclosed). This plan should be posted and visible in your shop and office areas. On Site Inventory Total The Toxic and Hazardous Materials On-Site Inventory from August 2,2004 shows that you have approximately 2,315 gallons of toxic and hazardous materials being used, stored,generated and disposed of at Tirrell Radiator(Please see enclosed Toxic and Hazardous Materials On Site Inventory sheet). The Board of Health has determined that the using,storing,generating and disposing of over 111 gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain an annual Hazardous Materials License.
