Woodbridge,New Jersey 07095 RTN#4-21891 NOTICE OF RESPONSIBILITY M.G.L. c. 21E,310 CMR 40.0000 ATTENTION: Mr.Michael Matri On April 21, 2009 at 1:30 pm the Department of Environmental Protection ("MassDEP ") received oral notification of a release and/or threat of release of oil and/or hazardous material at the above referenced property which requires one or more response actions. During a test of an Underground Storage Tank(UST), five (5) gallons of gasoline was observed.in the interstitial space between then inner and outer walls of the double-wall UST. It was observed that a release of greater than 0.05 gallons per hour from the inner wall of the double-wall UST was likely which constitutes a 72-hour reporting condition in accordance with 310 CMR 40.0314. The Massachusetts Oil and Hazardous Material Release Prevention and Response Act,M.G.L. c.21E, and the Massachusetts Contingency Plan (the "MCP"), 310 CMR 40.0000, require the performance of response actions to prevent harm to health, safety,public welfare and the environment which may result from this release and/or threat of release and govern the conduct of such actions. The purpose of this notice is to inform you of your legal responsibilities under State law for assessing and/or remediating the release at this property. For purposes of this Notice of Responsibility, the terms and phrases used herein shall have the meaning ascribed to such terms and phrases by the MCP unless the context clearly indicates otherwise. MassDEP has reason to believe that the release and/or threat of release which has been reported is or may be a disposal site as defined by the M.C.P. MassDEP also has reason to believe that you(as used in this letter, "you" refers to Hess Corporation) are a Potentially Responsible Party (a "PRP") with liability under M.G.L. c.21E §5, for response action costs. This liability is "strict",meaning that it is not based on fault,but solely on your status as owner, operator,,generator,transporter, disposer or other person specified in M.G.L. This liability is also "joint and several",meaning that you may be liable for all response action costs incurred at a disposal site regardless of the existence of any other liable parties. MassDEP encourages parties with liabilities under M.G.L. c.21E to take prompt and appropriate actions in response to releases and threats of-release of oil and/or hazardous materials. By taking prompt action,you may significantly lower your assessment and cleanup costs and/or avoid liability for costs incurred by MassDEP in taking such actions. You may also avoid the imposition of, the amount of or reduce certain pen-nit and/or annual compliance assurance fees payable under 310 CMR 4.00. Please refer to M.G.L. c.21E for a complete description of potential liability. For your convenience, a summary of liability under M.G.L. c.21E is attached to this notice. You should be aware that you may have claims against third parties for damages,including claims for contribution or reimbursement for the costs of cleanup. Such claims do not exist indefinitely but are governed by laws which establish the time allowed for bringing litigation. MassDEP encourages you to take any action necessary to protect any such claims you may have against third parties. At the time of oral notification to MassDEP, the following response actions were approved as an Immediate Response Action(IRA): • Continued assessment. • All Remediation Waste must be properly stored/handled and disposed of within 120 days from the date of generation per 310 CMR 40.0030., ACTIONS REQUIRED Additional submittals are necessary with regard to this notification including, but not limited to, the filing of a written IRA Plan, IRA Completion Statement and/or a Response Action Outcome (RAO) statement. The MCP requires that a fee of$1,200 be submitted to MassDEP when an RAO statement is filed greater than 120 days from the date of initial notification. Specific approval is required from MassDEP for the implementation of all Immediate Response Actions (IRAs)pursuant to 310 CMR 40.0420. Release Abatement Measures may not be conducted until a RAM Plan is submitted pursuant to 310 CMR 40.0443. Assessment activities, the construction of a fence and/or the posting of signs are actions that are exempt from this approval requirement. In addition to oral notification, 310 CMR 40.0333 requires that a completed Release Notification Form(BWSC-103,attached)be submitted to MassDEP within sixty(60)calendar days of April 21,2009. You must employ or engage a Licensed Site Professional (LSP) to manage, supervise or actually perform the necessary response actions at this site. You may obtain a list of the names and addresses of these licensed professionals from the Board of Registration of Hazardous Waste Site Cleanup Professionals by calling'(617) 556-1091 or visiting hgp://www.state.ma.us/lsp. MassDEP has Bryan Snow with Envirotech listed as the LSP of record for this release. Unless otherwise provided by MassDEP,potentially responsible parties("PRP's")have one year from the initial date of notification to MassDEP of a release or threat of a release,pursuant to 310 CMR 40.0300,or from the date MassDEP issues a Notice of Responsibility;whichever occurs earlier,to file with MassDEP one of the following submittals: (1) a completed Tier Classification Submittal; (2) an RAO Statement or, if applicable, (3) a Downgradient Property Status. The deadline for either of the first two submittals for this 3 disposal site is April 21, 2010. If required by the MCP, a completed Tier I Permit Application must also accompany a Tier Classification Submittal This site shall not be deemed to have had all the necessary and required response actions taken unless and until all substantial hazards presented by the release and/or threat of release have been eliminated and a level of No Significant Risk exists or has been achieved in compliance with M.G.L.c.21E and the MCP. State •Incident Date nation Incident Number r/1� Exposure Change Supplemental — r`2`Remarks .- _ 317 Falmouth rd/Rt 28 (Airport Rotory to Bearses Way) Received a call from Barnstable Police reporting a motor vehicle crash, unknown injuries, with a car leaking gas. A-828 and E-823 responded. E-823 crew consisted of Lt. Lanman, FF's.: Shopshire, Simkins, and Ddlinau. Upon our arrival the scene consisted of a Scion coupe MA reg. 13 WL64 in the entrance area of the Christy's gas station and convenience store. While entering the property the car had crossed the median divider at the Falmouth Road entrance. The keep right sign was snapped off and the remainder of the sign post had punctured the oil pan as well as the gas tank of the car. The car was leaking gas from it's tank A-828 arrived on scene prior to E-823, immediately following their initial assessment of the driver, they used speedi-dry to dike around the storm drain that the gas was flowing towards. Paramedic Talin estimates that a small amount ( < 1 gallon ) went into the drain. The car's driver, Jose Luis Huete-Rojas, stated that the gas tank was about 2/3 full, approximately 879 gallons. Mr. Huete-Rojas was not injured. E`823.was positioned to block the Falmouth Road entrance and crew was put to work putting down additional speedi-dry on the spill and diking around the car to stop the flow of gas toward the storm drain, alongwith covering 3-4 quarts of motor oil from the engine..Dispatch was given a report of the situation and'additional speedi-dry was requested along with notification to the Board of Health. C-803 with Capt. -C Farrenkopf.arr ved with the requested absorbent and. C-802 with Deputy Melanson also arrived to assess the situation. Mrt Donald Desmarais, Barnstable Public Health 'Division; arrived on scene and was informed of the srtuation;,He stated that he would notify MA. DEP to inquire if further action was needed. The battery of the car was disconnected and once the flow of gas subsided the car was loaded on to a Davis Towing ramp truck and removed from the scene. The speedi-dry was cleaned up and removed from the scene wttl the car. As a. further measure, some Jan-Sole was poured into the storm drain. E-823 returned to quarters at 0840. While returning to quarters we came upon a woman who had slipped and fallen on the ice at the intersection of Winter and Charles Streets. WHEN HE REALIZED THIS, HE DROVE OVER TO THE DRAIN, WHICH APPEARS TO BE TIGHT (THE OWNER CALLED LATER TO SAY THAT IT IS AND OIL WATER SEPARATOR DRAIN) AND DUMPED SOME OF THE GASOLINE\DIESEL MIXTURE INTO THE DRAIN. IT IS UNKNOWN HOW MUCH WAS REMOVED FROM THE VAN. THE VAN WAS TOWED AWAY TO PREVENT ANY FURTHER PROBLEMS. THERE WERE A COUPLE OF SMALL SPILLS ON THE GROUND IN THE WOOD CHIPS. THE WOOD CHIPS AND SOIL TO BE REMOVED AND DISPOSED OF PROPERLY. CYN ENVIRONMENTAL (800- 242-5818) IS THE CONTACT FOR CHRISTYS. CYN WAS CONTACTED BY THE 1 Health Complaints 05-Nov-04 CHRISTYS MANAGER ONSITE (KEN CAMILLE-CELL (508) 317-7140) CYN ENVIRONMENTAL IS PUMPING OUT THE GASOLINE\DIESEL MIXTURE. DS TOLD KEN THAT THEY SHOULD REALLY HAVE A CONTINGENCY PLAN ONSITE FOR ANY SITUATIONS THAT MAY ARRISE. KEN SAID HE IS FAIRLY NEW TO THE JOB. THEY DIDN'T HAVE ANYTHING ONSITE ABOUT DRAINAGE AT THIS LOCATION. OWNER CALLED AND SAID IT WAS AN OIL WATER SEPARATOR THERE. CHRISTYS IS CONNECTED TO TOWN SEWER ACCOUNT#4242. PHOTOS ATTACHED. ON 11/2/04, DS CONDUCTED A FOLLOW UP INVESTIGATION IN THE MORNING, THEY WERE STILL AWAITING FOR CYN ENVIRONMENTAL TO PUMP OUT THE OIL WATER SEPARATOR. DS CONDUCTED ' ANOTHER FOLLOW UP INVESTIGATION IN THE AFTERNOON, CYN ENVIRONMENTAL HAD PUMPED OUT THE OIL WATER SEPARATOR, AND HAD LEFT TWO 55 GALLON DRUMS ON SITE WITH WASTE TO BE REMOVED. The variance was requested because the Barnstable DPW had denied Southland's request to tie into the existing sewer force main in Bearse's Way. No gravity sewer existed within 3000 feet of the site, and the proposed alteration consisted of only approximately 130 gallons per day being added into a reconstructed system on the site.
