Therefore, Mr. Jaxtimer has asked that I review the attached plan and secure a Board of Health Permit for his property at Ferndock and Old Yarmouth Road. I offer the following comments on the Plan: Design Calculation: The plan shows a total design flow per Title 5 for two buildings to be 367 GPD. The 330 Rule calculates out to 521 GPD for this 1.58 acre parcel. Therefore, the site complies with the 330 Rule. The proposed leaching capacity is shown using bottom area only and this calculates out to a capacity of 355 GPD. However, as per Title 5 310CMR 15.251(C), trench side wall area is permitted for calculating total available daily flow. The actual total flow for the 2 proposed 2 foot deep x 30 foot long x 4 foot wide leaching trenches is 378 GPD. The Town's 250 Rule does not apply to this property. Plan View: The Plan itself shows the two proposed trenches located under a proposed gravel drive without a notation for venting the system. Given that the drive is proposed as pervious,{Title 5 310CMR 15.241 allows for this detail. However, to Members of American Society of Civil Engineers, Boston Society of Civil Engineers y 's 'i eliminate future problems, good practice calls for either moving the system forward 20 feet under the lawn or to vent Conclusion: The Site complies with the 330 Rule. The system is adequately designed albeit this is not clearly shown on the Plan. Lastly, good practice calls for the system to be moved out of the drive or vented. The Underground Injection Control (UIC) Program regulates subsurface discharges of industrial and commercial wastes and wastewaters (310 CMR 27 . 00) . Discharges to the ground are also regulated by Water Pollution Control (310 CMR 15. 00, 314 CMR 5. 00 & 6. 00) and Hazardous Waste (310 CMR 30. 0) . Storm water dry wells, septic systems and leaching pits are examples of common "injection wells" which are regulated by the UIC Program. All discharges to floordrains, sinks or other points of disposal, which are plumbed to "injection wells" must meet water quality discharge standards (310 CMR 15. 00 and 314 CMR 5. 00) . MDC traps or separators do not sufficiently remove wastes for discharges to meet required ground water quality discharge standards. Facilities which handle hazardous materials or wastes and have points of disposal which receive 'or could receive those wastes must: 1. be connected to a sewer system after treatment, 2 . be plumbed to a holding tank which is pumped and hauled by a lisenced hauler to a municipal waste water treatment plant or hazardous disposal facility, or 3 . have an approved discharge permit. If your facility does have points of disposal which receive or could receive hazardous wastes but does not comply with 1, 2 , or 3 , then your facility is in violation of the regulations mentioned above. -You must take action to comply by applying to DEP, Division of Water Pollution Control, for one of the above. I asked him why Jet Stream is allowed to have it ' s holding tank waste disposed at the WWTP and why P & B Bus Company would have to meet all the VOC drinking water standards prior to discharging to the town sewer. He answered that the main difference is direct discharge (proposed by P & B Bus) versus testing of the truck loads prior to discharge (Jet Stream) . Direct discharges cannot be continuously monitored. He is also concerned that a compound could knock-out the treatment plant. Based on my discussion with Russell, I recommend that the Board reconsider approval of Barnstable Bus Company' s proposed design of the MDC trap/holding tank system. You were sent letters dated December 4, 1989, February 15, 1990 and June 27, 1990, directing you to submit engineered plans of a closed loop system, holding tank system, or any other industrial waste containment system to the Board of Health. To date we have not received any containment plans. On July 13, 1990, you told Thomas McKean the buses are taken to "Jet-Stream" located at Cit Avenue, Hyannis, to be washed. Jet Stream personnel informed Mr. McKean on that same day, that no buses have been washed at this establishment for at least the past six (6) months. On July 24, 1990, Patrick Kidwell of Barnstable Bus Company stated to Mr. McKean via telephone that the buses are no longer washed because schools are closed for the season. You are directed to furnish the Board of Health a copy of a written contract with a licensed or permitted. bus washing facility prior to September 1, 1990. Also, anytime the contract is renewed, you shall furnish the Board of Health a copy of the written contract with a licensed or permitted bus washing facility. Also enclosed are letters from and, to A.M. Wilson Associates. The Company is located at Ferndoc Road, Hyannis, Ma., in close proximity to Barnstable Water Company supply wells. It is our opinion that the company should not continue to discharge contaminants into or onto the ground unless, a groundwater discharge permit is obtained. A hearing was held on April 21, 1987, at the request of Scudder and Taylor, the owners of the Bus Company. Ms. Arlene Wilson, their Environmental. Consultant, stated they would discontinue steam cleaning the bus engines and, that they would contract for this service. This seems unlikely because In all probability, there is no facility on crape Cod, with a groundwater discharge permit allowing this type of operation. Ms. Wilson stated they would like to continue washing buses using bio-degradable soap. Ms. Wilson further stated, that she had been in contact with Plitt Ripa at D.E.Q.E., in Lakeville and, stated lie would cone down and evaluate their operation. Mr. Ripa informed me that this was not true. fie told me that he had talked to Mark Pare who was awaiting a call from Nancy Leitner, our inspector. Unfortunately, his office is being moved this week and, we have been unable to reach him by phone. We do request your assistance in this matter so crucial to the protection of our groundwater. It is our opinion that the company should not continue to discharge contaminants into or onto the ground unless, a groundwater discharge permit is obtained. A hearing was held. on April 21, 198,7, at the request of Scudder and Taylor, the owners of the Bus Company. 14s. Arlene Wilson, their Environmental Consultant, stated they would discontinue steam cleaning the bus engines and, that they would contract for this service. This seems unlikely because in all probability, there is no facility on Cape Cod, with a groundwater discharge permit allowing this type of operation. Ms. Wilson stated they would like to continue washing buses using blo-degradable. soap. Ms. Wilson further stated, that she had been in contact with Phil Ripa at D.E.i).E., in Lakeville and, stated lie would come dawn and evaluate their operation. Air. Ripa informed me that this was not true. He told me that he bad tallied to 1.iark Pare who was awaiting a call from Nancy Leitner, our inspector. A hearing was held on April '21, 1987, at the request of Scudder and Taylor, the owners of the Bus Company. Ids. Arlene Wilson, their Environmental Consultant, stated they would discontinue steam cleaning the bus engines and, that they would contract for this service. This seems unlikely because in all probability, there is no facility on Cape Cod, with a groundwater discharge permit allowing this type of operation. Ms. Wilson stated they would like to continue washing buses using blo-degradable soap. Please be advised' that apparently all of your clients have,been in -violation of 314 C14k 5.00, since October 15,, 1983; in that they discharge industrial waste onto the ground'or into, the groundwater: Chapter -21, Section 42., of the General Laws, state that such discharge makes the discharger.. subject to a 'daily fine of $10,000:00.. In addition, they also appear to be in violation of Sebtion 4 of Article XXXIX,. Control of Toxic, and Hazardous Materials of the Towns Charter and General By-La%Vs. Violators of this. By-Lew are subject to a,fine of $200.00, daily. The violations were explained to -your. clients by our inspector and specific recommendations for corrective.action were given. Your time-table for action does not appear acceptable. Your clients. should not continue to discharge without, a permit unless, you have a temporary or permanent plan to protect our ground water. We have also contacted the head of the ground water,discharge permit section of the Department of.Environmental Quality Engineeiing"'and, the SEA Camp DEQB representative.
