Therefore, this dwelling shall be secured and you shall ensure than no persons occupy the premises. 3) The main water valve, for the potable water coming into the dwelling, shall be turned-off. These orders were issued due to the fact that Health Inspector Donna Miorandi, R.S. observed violations at this property on January 31, 2014 and on March 14, 2014 which are considered as conditions deemed to potentially endanger or impair the health and safety of the occupants of the premises as cited within the State Sanitary Code, Section 105 CMR 410. 750 (F): Failure to maintain a sewage disposal system in operable condition as required by 105 CMR 410.150 Q:\WPFILES\ORDERSSoaresGeneralPattobDrive2014.doe (A)(1) and 410.300. You are also in violation of 310 CMR 15.00, The State Environmental Code, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage and the Town of Barnstable Code, specifically Section 310 CMR 15.303 (1)(a): Septic system is in hydraulic failure. Sewage was observed overflowing onto the ground on January 31, 2014 and March 14, 2014. This property is also in violation of the Town of Barnstable Code § 353-9 due to the discharge of sewage onto the ground. There is also an illegal discharge of grey water via a pipe directly onto the ground where the cesspool is already overflowing.
