If, for any reason , construction ceases for a period longer than 24 hours during this phase of construction , the excavation shall be stabilized with .hay or other suitable material which shall be removed from the site when construction resumes . Concrete shall be pumped from the landward side of the proposed structure only . d. Excavation of septic system shall be undertaken concurrent with other excavation on site and be stabilized in same manner . e . Once excavations are backfilled and final grades are realized , site should be stabilized with hay spread by hand . This hay shall be removed from the site after planting has been completed . f. Crushed stone driveway shall be constructed as soon as final grading has been completed . This driveway shall be utilized as sole access to structure for subsequent construction activities . g . Exterior of the proposed structure shall be completed before any interior work is undertaken to facilitate revegetation of site which ..shall commence upon completion of exterior construction . h . All subsequent work shall take place either in the interior of the proposed structure or landward of said structure. i . Conservation Commission shall be informed by • the on site engineer or construction supervisor at the time each phase of the construction is begun . 6 , All .roof runoff must be channelled into downspouts and directed into dry wells which are to be located on the landward side of the proposed dwelling. 7 . All areas disturbed during construction must be stabilized 'immediately against erosion and revegetated in the following i manner : a. All -planting shall be supervised by a professional landscaper or equivalent . Applicant shall strictly adhere to "Planting Plan" attached (or some plan mutually agreed upon by the applicant and Conservation Commission which may be submitted by the applicant ' s professional landscaper at a latzr date) . i 1 'i b. Planting shall commence immediately upon completion of the exterior of the structure as detailed in t;ne ;., Work Protocol . C . Areas between plantings shall be stabilized with suitable material in sufficient quantity to pre,ient 1 erosion . This stabilizing material shall be maintained for at least three years and shall not ' e of a type which can be roved about by normal .rind velocities . It shall be the applicant 's responsibility to remove any of this material from abutter 's property, should this situation occur . d . All plantings shall be maintained and replaced if necessary to maintain densitie& as indicated on the Planting Plan. 8 . The proposed driveway is to be constructed of a pervious material such as crushed stone or gravel . Asphalt is prohibited . 9 . The project engineer and contractors must be advised of the conditions of this Order prior to the commencement of work. The applicant is responsible for compliance with these conditions . , 10 . A site plan shall be submitted to the Conservation Commission and DEQE which shall be of the same scale as the referenced plan which shall include final grades (i .e . detail of the expected topography of the site after the proposed structure is built ) . This plan shall be certified under the stamp and signature of a professional land surveyor or engineer registered in Massachusetts . 11 . The Construction/Planting Protocol , as described above , - shall be strictly adhered to by the Applicant , whose responsibility it is to insure that the workmen on the site fully comprehend -their contents. 12 . All refuse shall be removed from the site on a daily basis . 13 : Any deck that is built shall not extend, in any form, into the designated Dune Area . No posts or other structural supports shall be allowed beyond the staked hay bales which define-'the work limit . 14 . No work shall commence until the applicant has obtained a valid permit from the Board of Health for the proposed septic system. 15 . No coastal engineering structures shall be permitted at any time in the future on any coastal dune on the site . Leitner : I am writing at the request of a group of abutters of the Barnstable property of Eugene Mahoney. The above referenced permit granted to Mr . Mahoney to construct a septic system on his Barnstable property has expired . The abutters are concerned that the expired permit was granted without the knowledge or consideration by the Board of Health of the fact that the septic system is proposed to be constructed in a coastal bank. It is the abutters belief that because of the location of the septic system and the sandy soil types , there will be insufficient travel time to allow for the pollutants discharged from the system to be renovated prior to entering the ground water and reaching the ocean. We have retained an expert consultant who supports our contentions with respect to the inadequacy of the proposed treatment system and the inadvisability- of locating such in a coastal bank. For your information , I have attached the testimony of our consultant which was filed with DEQE in connection with a wetlands application . I got some background on this property. 1984 Building permit applied for 1988 Assessors listed this building as being built 1989 Town installed sewer system 1994 Certificate of occupancy issued 6/28/00 Sewer permit applied for 9/2000 Sewer connection made I'm not sure but I believe there were 2 to 3 notices sent to property owners in this sewer area (Sewer Contract#5).
