FINDING THAT THE DWELLING LOCATED AT 225 HINCKLEY ROAD,
HYANNIS IS UNFIT FOR HUMAN HABITATION AND DETERMINATION OF
POTENTIAL IMMEDIATE DANGER
The property owned by you located at 225 Hinckley Road, Hyannis was inspected on
June 19, 1996 by Christina Kuchinski, R.S. Health Inspector for the Town of Barnstable
because of a complaint. The following violations of the Town of Barnstable Rental
Ordinance Article 51 and the State Sanitary Code,Article II were observed:
410.482: The smoke detector in the basement and mudroom areas were not
functioning.
410.190: The hot water heater had an open line that needed to be capped. Hot
water was not be provided to the tenants due to the inoperable water
heater.
410.351: The electric panel in the basement contained 330 amp fuses. The
maximum amperage fuses allowed in this electrical panel shall be only 15
amps according to Robert Weston,the Town of Barnstable Wiring
Inspector.
410.351: The garage area electric panel contained six circuits on only three fuses
according to Robert Weston, the Town of Barnstable Wiring Inspector.
410.100: The electric stove provided in the kitchen had no cord/plug. Also,there
was no electric outlet provided in the area to plug the stove into. The
stove was also missing the right front burner, drip pans, and stove rings.
410.200: The living room baseboard heat pipe was leaking and the carpet in that
area was soaked with water.

410.200: The baseboard heat cover in the kitchen was extremely dented and falling
off.
410.200: The baseboard heat cover in bedroom located next to the laundry room
was missing.
410.200: The baseboard heat cover in the bathroom was rusted and paint was
peeling off.
410.504 (A). The kitchen linoleum was worn down to the sub floor in several locations.
410.351: The kitchen light fixture was not secured to the ceiling.
410.351: The light fixture in the refrigerator made crackling sounds when the door
was opened and the light bulb would flicker on and off.
410.500: Twelve ceiling tiles in the laundry room were missing and several others
were detached from the ceiling boards.
410.351: The tub and bathroom sink faucets were leaking water.
410.351: The toilet flush mechanism was not functioning properly as the water
continuously ran according to Edward Jenkins,the Town of Barnstable
Plumbing Inspector.
410.500: There was a large hole in the bathroom wall near the door.
410.500: The rear left side bedroom had a hole in the wall and peeling paint on the
door.
410.500: The rear right side bedroom had peeling wall paint.
410.500: The rear left side bedroom had a window with cracked glass.
410.500: The front entrance threshold had rotted wood.
410.552: The side entrance storm door was not provided with a screen.
410.552: The self closing device was not attached to the side entrance storm door.
410.551: Screens were not provided at several windows.
410.500: The carpeting throughout the house was heavily stained and mildewed.

410.351: Open gas pipe (uncapped)behind the electric stove.
410.500: There was a hole in the laundry room wall where an old dryer vent went
through. This is a possible entrance area for rodents and insects.
410.351: The smoke pipe leaving the water heater was completely rusted through
which was an indication of the chimney not functioning properly
according to Richard Burnham,the Town of Barnstable Plumbing
Inspector.
410.351: The tub drain and the toilet were leaking water through the floor and into
the basement.
410.500: No down spout provided for the storm gutter located at the side porch.
410.452: The door to the bulkhead was a rotted piece of plywood which was not
attached to the door frame hinges.
You are directed to correct the violations of 410.482, 410.190, and 410.351 within
twenty-four (24) hours of receipt of this notice by correcting five conditions as follows:
(1) by installing operational smoke detectors, (2) by installing the proper amperage fuses
in the electrical panel in the basement, (3) by installing the correct number of circuits to
the fuses of the electrical panel in the garage, (4) by capping the open line on the hot
water heater, and (5) by replacing the smoke pipe above the hot water heater. If the
dwelling is no longer occupied, these violations must be corrected prior to re-occupancy
of any persons.
These violations 410.482, 410.90, and 410.351, are also listed under 105 CMR 410.750
and are deemed conditions which may endanger or impair the health, safety, and well-
being of any person occupying the premises. Therefore, I find that this dwelling is unfit
for human habitation.
You are also directed to correct the remaining above listed violations within seven (7)
days of receipt of this notice. If the dwelling is no longer occupied, these remaining
violations must be corrected prior to re-occupancy of any persons.
You may request a hearing if written petition requesting same is received by the Board of
Health within seven (7) days after the date order is received. However, this violation
must be corrected regardless of any request for a hearing.
Please be advised that failure to comply with an order could result in a fine of not more
than $500. Each separate day's failure to comply with an order shall constitute a separate
violation.

Re-inspection:August 7, 1996
1.Linoleum floor covering in the bathroom had curled up around the edges near the walls and
bathtub.Asked Jose to reglue or tack down so that moisture/water from the tub did not get under the
linoleum and rot out the floor.
2.Cracked glass panes in kitchen,livingroom and rear left bedroom windows(3 panes and one storm
window).
3. Side entrance storm door had been removed.Need screen door for ventilation from April 1 to October
30th each year.
4.Refrigerator was not plugged in and light bulb was gone.Could not check to see if fixture inside was
functioning.Jose said that he would have electrician check it.
5. See enclosed copy for other circled items that will tentatively be inspected on Monday,August 12, 1996.

PRESS RELEASE 6/26/96
Jeff Lyon today released four refund checks in the names of
Alan Glynn, Jason McHugh, Eamon Larkin, and Bryan O' Sullivan
through his attorney, Mandy Curry of Yarmouth. The checks
were originally written last Tuesday, June 16, and were to
have been given to the renters at ?PM that day. Instead they
went to the press .
Despite having a signed lease, a punch-list of the tasks
the students agreed to do, for pay, and an acceptable
property, Lyon released the cheeks to minimize the ad-homonym
attacks by their liberal arch-rival , the Cape Cod Times.
The July issues of Lyon' s two publications will address the
blatent hypocrisy of a Cape Cod Times which puts the story of
the Whitewater convictions ( representing millions of stolen
dollars) on page 5 , the story of the white House's abuse of
700 Republican FBI files ort pate C-13 , and yet runs this
landlord-tenant dispute on Page One for days on end.

410.750: Conditions Deemed to Endanger or Impair Health or Safety
The following conditions, when found to exist in residential premises,
shall be deemed conditions which may.endanger or impair the health, or safety
and well-being of a person or persons occupying the premises. This listing
is composed of these items which•are deemed to always have the potential to
endanger or materially impair the health or safety, and well-being of the
occupants or the public. Because Chapter 1I, 105 CMR 410.000 through 410.499
state minimum requirements of fitness for human habitation, any violation has
the potential to fall within this category in any given situation but may not
do so in every case and therefore cannot be included in this listing. Failure
to include shall in no way'_be construed as.a determination that other
violations may not be found to fall within this category. Nor shall failure
to include affect the duty of the local health official to order repair or
correction of the violation(s) pursuant to 410 CMR 416.830 through 410.833
nor shall it affect the legal obligation of the person to whom the order is
issued to comply with such order.
(A) Failure to provide a supply of water sufficient in quantity, pressure
and temperature, both hot and cold, to -meet the ordinary needs of the occupant
in accordance with 105 CMR 410.180 and 410.190 for a period of 24 hours or
longer.
(B) Failure to provide heat as required by 105 C.*SR 410.201 or improper
venting^or use of a space heater or water heater as prohibited by 105 CMR
410.200(B) and 410.202.
(C) Shut-off and/or failure to restore electricity or gas.
(D). • Failure to supply the electrical facilities required by 105 CMR 410.250(B),
410.251(A), 410.253(A), 410.253(B) and the lighting in common area required
by 105 CMR 410.254.
(E) Failure to provide a safe supply of-water.
(F) Failure to provide a toilet and maintain a sewage system in operable
condition as required by 105 CMR 410.150(A)(1) and 410.300.
(GI Failure to provide adequate exits, or the obstruction of any exit,
passageway or common area caused by an object, including garbage or trash,
which prevents egress in case of an emergency 105 CMR 410.450 and 410.451.
(H) Failure to comply with the security requirements of 105 CMR 417).480(D).
(I) Failure to comply with any provisions of 105 CMR 410.600 through 410.602
which results in any accumulation of garbage, rubbish, filth or other causes
of sickness which may provide a food source or harborage for rodents, insects
or other pests or otherwise contribute to accidents or to the creation or
.. spread of disease.
(J) The presence of lead-based paint on a dwelling or dwelling unit in
violation of the Massachusetts Department of Public Health Regualtions for
Lead Poisoning Prevention and Control 105 CMR 460.000.
(R) Roof, foundation, or other structural defects that may expose the
occupant or anyone else to fire, burns, shock, accident or other dangers or
impairment to health or dafety.
(L) Failure to install electrical, plumbing, heating and gas-burning
facilities in accordance with accepted plumbing, heating, gas-fitting and
electrical wiring standards or failure to maintain such facilities as
are required by 105 CMR 410.351. and 410.352 so as to expose the occupant
or anyone else to fire, burns, shock, accident or other danger or impairment
to health or safety. 1-
(M) Any of the following conditions which remain uncorrected for a period '"`''
of five or more days following the notice to or knowledge of the owner
of said condition or conditions:
(1) lack of a kitchen sink of sufficient size and capacity for
washing dishes and kitchen utensils or lack of a stove and oven
or any defect that renders either operable.
(2) failure to provide a washbasin and a shower or bathtub as required
in 105 CMR 410.150(A)(2) ind A10.150(A)(3) and_any defect which
renders them inoperable.
(3) any defect in the electrical, plumbing, or heating system which makes
such system or any part thereof in violation of generally accepted
plumbing heating,• gas-fitting, or electrical wiring standards
that do not create an immediate hazard.

stairway, porch balcony, roof or similar place as required by
105 CMR 410.503(A) and 410.503(B).
(5) failure to eliminate rodents, cockroaches, insect infestations and
other pests as required by 105 CMR 410.550.
(N) Amy other violation of Chapter II not enumerated in 105 CMR 410.750(A)
through (M) shall be deemed to be a condition which may endanger or materially
impair the health or safety and well-being of an occupant upon the failure of
the owner to remedy said condition within the time so ordered by the board

(2) failure to. provide a washbasin and a shower or bathtub as required
in 105 CMR 410.150(A)(2) and 410.150(A)(3) and any defect which
renders them inoperable.

such system or•any part thereof in violation of generally accepted
plumbing heating,. gas-fitting, or electrical wiring standards

410.750: Conditions Deemed to Endanger or Impair Health or Safety
The following conditions, when found, to exist in residential premises,
shall be deemed conditions which may endanger or impair the health, or safety
and well-being of a person or persons occupying the premises. This listing
is composed of these items which are deemed to always have the potential to
endanger or materially impair the health or safety, and well-being of the
occupants or the public. Because Chapter 11, 105 CMR 410.000 through 410.499
state minimum requirements of fitness for human habitation, any violation has
the potential to fall within this category in any given situation but may not
do so in every case and therefore cannot be included in this listing. Failure
to include shall in no way be construed as.a determination that other
violations may not be found to fall within this category. Nor shall- failure
to include affect the duty of the local health official to order repair or
correction of the violation(s) pursuant to 410 CMR 410.830 through 410.833
nor shall it affect the legal obligation of the person to whom the order is
issued to comply with such order.
(A) Failure to provide a supply of water sufficient in quantity, pressure
and temperature, both hot and cold, tomeet the ordinary needs of the occupant
in accordance with 105 CMR 410.180 and 410.190 for a period of 24 hours or
longer.
(B) Failure to provide heat as required by- 105 OIR 410.201 or improper
venting or use of a space heater or water heater as prohibited by ,105 CMR
410.200(B) and 410.202.
_(C) Shut-off and/or failure to restore electricity or gas.
(D) Failure to supply the electrical facilities required by 105 CMR 410.250(B),
410.251(A), 410.253(A), 410.253(B) and the lighting in common area required
by 105 CMR 410.254.
(E) Failure to provide a-safe supply of water. T
(F) Failure to provide a toilet and maintain a .sewage system in operable
condition as required by 105 CMR 410.150(A)(1) and 410.300.
(GI Failure to provide adequate exits, or the obstruction of any exit,
passageway or common area caused by an object, including garbage or trash,
which prevents egress in case of an-emergency 105 CMR 410.450 and 410.451.
(H) Failure to comply with the security requirements of 105 CMR 4110.480(D).
(I) Failure to comply with any provisions of 105-CMR 410.600 through 410.602
which results in any accumulation of garbage, rubbish, filth or other causes
of sickness which may provide a food source or harborage for rodents, insects
or other pests or otherwise contribute to accidents or to the creation or
spread of disease.
(J) The presence of lead-based paint on a dwelling or dwelling unit in
violation of the Massachusetts 'Department of Public Health Regualtions_for
Lead Poisoning Prevention and Control 105 ,CMR 460.000.
(K) Roof, foundation, or other structural defects that may expose the
occupant or anyone else to fire, burns, shock, accident or other dangers or
impairment to health -or dafety. _
(L) Failure to install electrical, plumbing, heating and gas-burning
facilities in accordance with accepted plumbing, heating; gas-fitting and
electrical wiring standards or failure to maintain such facilities as
are required by 105 CMR 410.351 and 410.352 so as to expose the occupant
or anyone else to fire, burns, shock, accident or other danger or impairment
to health or safety.
(M) Any of the following conditions which remain uncorrected for a period .
of five or more days following- the notice to or knowledge of the owner
of said condition or conditions:
(1) lack of a kitchen sink of sufficient size and capacity for
washing dishes and kitchen utensils or lack of a stove and oven
- or any defect-that renders either operable.
(2) failure to provide a washbasin and a shower. or bathtub.as required
