The inspection of your septic system showed that your system has failed under the guidelines of 1995 TrME 5 (310 CMR 15.00) due to the following: Liquid depth in cesspool was less than 6 inches below invert pipe. Our records show that the system has been in a failed state for more than two years. You are ordered to hire a professional engineer or registered sanitarian to prepare a plan of proposed replacement septic system component(s). This plan is to be submitted to the Town of Barnstable Public Health Division Office(Regulatory Services, 200 Main Street, Hyannis), within (90) days receipt of this letter. The plan will bring the septic system into compliance with 310 CMR 15.00, The State Environmental Code, Title V. You are also ordered to upgrade or replace the septic system within six months (180) days of your receipt of this letter. Any person aggrieved by any order issued by the local approval authority may appeal to any court of competent jurisdiction as provided for by the laws of the Commonwealth. You have the option of requesting an adjudicatory hearing pursuant to 310 CMR 15.422 :Failure to comply w h this order will automatically result in a public hearing scheduled before the Board of Health.
