This letter contains information from that visit that will help you become compliant with Chapter 108 of the Town of Barnstable Ordinance: Hazardous Materials. Enclosed are copies of Chapter 108: Hazardous Materials ordinance,the Toxic and Hazardous Materials On-Site Inventory form from the site visit, and a sample contingency plan that must be utilized at your facility. Please note the problems and observations identified at your place of business during the hazardous materials inspection and their orders or recommendations listed below. PROBLEMS: • Upon arrival, smoking was taking place inside one of the service bays by a customer. Under the Town of Barnstable Code 371: Smoking, "smoking shall be prohibited in all public places as of June 1, 1996". Under Code 371-8 Violations and penalties, "Any person(s) in charge of a public place or workplace,who fail(s)to comply with these regulations shall be subject to the following actions for each offense: (1) A warning shall be issued for a first offense. A fine of$100 may be issued for the second offense, $200 for a third offense, and$300 for any subsequent offense". • Place absorbent pads on top of the drums to catch any drips or releases immediately. Do not use shop rags as absorbents. • Contingency plan not posted in areas throughout the facility. Post contingency plan in areas throughout the facility that have high risk potential. (copy enclosed) • Small releases of petroleum products observed on floor inside service bay areas. Observed absorbents were used. Dispose of absorbents in a closed container. • Shop rags are not in metal can with lid. Excavation and floor drain closure operations were ' performed by Enviro-Safe Corporation of Sagamore Beach, MA. On August 30, 1995, Enviro-Safe Corp. excavated and exposed the exterior portions of the MDC ' oil/water separator (trap) on the western portion of the Midas property. One discharge pipe was observed at 6 feet depth below surface elevation, leading out from the south side of the MDC trap, directly into surrounding soils(see detail A). Soil samples were collected from 7.0 feet(S-IA) and ' 7.5 feet(S-1B)depth,below the outfall pipe, and field screened for the presence of Volatile Organic Compounds(VOC)by standard headspace methodology utilizing an H-NU Photoionization Detector ' (PID). Two soil samples were also collected from the base of a stormwater collection and distribution ' manhole,located adjacent to the MDC trap. Samples were collected from 7.0 feet(S-2A) and 7.5 feet (S-2B)from surface elevation in the earthen base of the manhole and field screened by PID. Manhole locations and sampling points are shown on the accompanying Site Plan and Detail A. Pursuant to UIC regulations (310 CMR 27.00), where the poten- tial exists for pollutants to enter an injection well (e.g. by means of a floor drain) and the presence of the pollutants causes or is likely to cause a violation of any Massachusetts Drinking Water Regula- tion or N&•hich adversely affects or is likely to adversely affect the health of persons, the use of the well is prohibited. With the exception of discharges authorized under the Department's Ground Water Discharge Permit program, the Department considers this prohibition to include the use of any injection well at facilities which have in the past or currently use, store, or otherwise manage hazardous materials and/or wastes as defined in 310 CMR 30.000 and 310 CMR 40.0000. Cast iron covers to grade. • Homemade sump by garage bay door to catch run-off from street. There are oil stains on grate. There is a hose connected to sump pump in basin that pumps run-off to gutter of street. Mike Upton stated that 5 gallon pail used as sump basin has holes with pea stone around it. • No industrial sinks in shop area that attach to septic. Possible Site Concerns (1) Septic system-Just because of long term use of toxic and hazardous materials. (2) Homemade sump basin-Possible route of entry of contamination into sub-surface. (3) Surface staining- Appear to be just that - on surface but again long-term use could have a affected subsurface.
