I will put a copy in the mail for you when I return to Hyannis on Thursday (meeting in Connecticut on Wednesday). I don't think it will fax well. I am not sure how old the "picture" is,but based on what I see our property is approximaely 150' wide and approximaely 400' long at its longest point. Because of the railroad tracks it is not a perfect rectangle. All of that is fenced in, or "protected" by the office building, with the exception of the small parking area in front of and to the west side of the office. Hope that helps. A question for you on the methanol barrels. The challenge I see is getting those full barrels into,-or over the sides of, a high spill containment area. I had a couple minutes to look through some safety catalogs we have. The yellow platform beneath the good barrels can be linked to similar platforms. If enough of those platforms, when linked, and providing they all fit in that small building, meet the 110% requirement.would..that.be_.okay.2...Might..end..up hav4ng.2_.barrels..sitting.an_fz.o£ least we could maneuver them. This letter contains information from that visit that will help you become compliant with the Town of Barnstable Ordinance Chapter 108: Hazardous Materials. Enclosed are copies of the Chapter 108: Hazardous Materials ordinance,an application for permit to store and/or utilize 111 gallons or more of Hazardous Materials, and a copy of the Toxic and Hazardous Materials On-Site Inventory form from the visit to your business. I have also enclosed an example contingency plan, a list of licensed waste haulers and a pamphlet of information for recycling. Please note the problems and the recommendations or orders identified at your place of business during the hazardous materials inspection: PROBLEM: ,, I • Three 55 gallon drums of methanol observed outdoors. ORDER: • In order to become compliant with the Town of Barnstable Ordinance Chapter 108: Ind �S Section 108-5A,you must store the hazardous materials indoors. They are currently i unprotected from the elements, accidental damage, leakage, which does not have 110% containment, and vandalism. n , • Per our conversation,please move the drums into the shed located adjacent to the current location of the drums. Within the shed,there must be 110%containment present to hold any spills or leakage. • Use a licensed hauler to remove or dispose of any hazardous waste or unused product from your place of business in accordance with the Massachusetts Hazardous Waste Management Act. See Chapter 108: Section 108-5C. PROBLEM: • Spill kit is outdoors and not free from the elements. RECOMMENDATION: //��� U • Place spill kit indoors with proper signage of its locati n. OMMENDATION: > • Ensure all Material Safety Data Sheets are present for each hazardous material on site. !\ \p5 This is part of the Right-to-Know Law. l� On Site Inventory Total Y v The Toxic and Hazardous Materials On-Site Inventory from March 22,2005 shows that you have approximately 149,373.25 gallons of toxic and hazardous materials being used or stored at AmeriGas, 193 Iyannough Rd.,Hyannis,MA(Please see enclosed Toxic and Hazardous Materials On- Site Inventory sheet). As a reminder,this is a maximum quantity that you currently have on site. If you arrange to get rid of any of these cylinders,the count would lessen,. but you also may acquire more as well The Board of Health has determined that the using, storing, generating and disposing of over 111 gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain an annual Hazardous Materials License. This license should be purchased within the next 30 days from the Town of Barnstable Town Offices, 200 Main Street,Hyannis,MA 02601 (application enclosed). Please refer to the Town of Barnstable General Ordinance: Chapter 108, Section 6-5 (A-H). A Contingency Plan must be submitted with your license application. Reviewing your contingency plan for hazardous materials spills and related emergencies (and its location throughout the store) is highly recommended at this time. Why are these recommendations being made for AmeriGas? • This information is intended to educate you, a business owner/operator in the Town of Barnstable,in order to keep your business operations in compliance with local, state and federal toxic and hazardous materials laws so that you can avoid future regulatory problems. Dear Mr. Dziedzina: Thank you for your time and cooperation during the hazardous materials follow up visit at AmeriGas Propane Company on May,5, 2005. This letter contains information from that visit that was found to be completed or still non compliant with the Town of Barnstable Ordinance Chapter 108:Hazardous Materials. Please note the problems and the recommendations or orders identified at your place of business during the hazardous materials inspection and the observations from May 5 2005: PROBLEM: • Three 55 gallon drums of methanol observed outdoors. ORDER: • In order to become compliant with the Town of Barnstable Ordinance Chapter 108: Section 108-5A,you must store the hazardous materials indoors. They are currently unprotected from the elements, accidental damage,leakage,which does not have 110% containment, and vandalism. • Per our conversation,please move the drums into the shed located adjacent to the current location of the drums. There is containment underneath the drums in the event of a spill or leak. They are free from the elements and accidental damage. • Two of the waste 55 gallon drums of methanol are pending removal. OBSERVATION May 5,2005: • Spill kit is located indoors, easily accessible and signed in its location. PROBLEM: • Eyewash stations are not signed. RECOMMENDATION: • Place a sign outside the door where the station is located. OBSERVATION May 5,2005: • Signage in place and a new temporary station is located in the storage garage. OBSERVATIONS: • Contingency plan and emergency numbers are posted in the facility that is accessible to all employees.
