The property operated by you, Mr. Ed Santoro, located at 409 Iyannough Road\Rt. 28, Hyannis was observed by David W. Stanton, RS, Health Inspector for the Town of Barnstable, during a routine inspection and\or an order from the Health Director, Thomas McKean on September 5, 2006. The following violation of Section 353-5 of the Town of Barnstable Code was observed: • Outdoor rubbish and garbage storage area was visible to neighbor's and\or public view. It is the official interpretation from the Health Director, Thomas McKean that"outdoor rubbish and garbage storage areas" shall include dumpsters and refuse barrels. "Outdoor rubbish and garbage storage areas" do not include grease dumpsters\barrels or cigarette containers. You are ordered to comply with this Code by: Completely screening in the outdoor rubbish and garbage storage areas within sixty (60) days of your receipt of this order letter. You may request a hearing before the Board of Health if written petition requesting same is received within ten (10) days after the date the order is served. Please be advised that failure to comply with an order will result in a fine of$100.00 and\or revocation of your Health Department permit(if applicable.) Every Dumpster and refuse barrel is considered a separate violation. Each day's failure to comply with an order shall constitute a separate violation. This Ordinance was adopted to protect the public health and welfare,especially as it pertains to the public drinking water supply. The following is a description of the results of the Inventory(enclosed)and Inspection. MATERIALS INVENTORY AMOUNT AND PURPOSE: The Inventory of this site indicates the use or storage of approximately nine-hundred and five(905) gallons of toxic and hazardous material.This material is used in vehicle repair and maintenance. Please be aware that the Town of Barnstable has determined that a minimum of one-hundred and eleven(111) gallons of toxic and hazardous materials requires an annual license. GENERAL STORAGE AREAS AND CONDITIONS: • A single garage bay contained shelving for quart bottles of motor oil as well as unopened cases of motor oil on the floor.The bay floor was partially covered with flattened cardboard boxes used to absorb vehicle fluid leaks. • The"Oil Room"housed two(2),two-hundred and seventy-f five(275)gallon tanks for the storage of new motor oil,one(1) two-hundred and seventy-five(275)gallon tank for waste oil,a two(2) compartment three-hundred(300)gallon tank containing new motor oil and automatic transmission fluid,two(2),twenty(20)pound cans of gear oil,a fifty-five(55)gallon drum for waste antifreeze,a single two-hundred and twenty(220)gallon tank of antifreeze and one of windshield washer fluid,and a fifty-five(55)gallon drum used to collect the oil from used oil filters,and shelving to store individual consumer sized containers of power steering fluid, emission cleaner and miscellaneous lubricants. The majority of the cement floor of this room appeared to be saturated with oil and a build up of speedy dry was noted around the oil filter collection drum. In addition puddling of oil was noted on the top of the three-hundred gallon tank. r -2 • The main garage housed a Safety Kleen parts cleaning station and used battery storage.Wheeled collection cans are used in this area for vehicle fluids.Adjacent to a side door of the main garage were half a dozen used gas cylinders. • A storage room adjacent to the main garage housed the metal,self closing bin for oily rags. The rags are sent out to a commercial laundry. The Retail Area housed thirteen(13)new batteries. • Outside of the main garage, in a fenced in area were two additional lifts which are used as necessary. Several empty plastic gasoline containers were noted.Adjacent to this area were several trailer trucks which are used as parts storage. A basement room housed separate shelving for miscellaneous paints and vehicle cleaners. This room,which is located directly below the"Oil Room",had a wide oil stain running the height of the wall and a saturated absorbent pad on the floor. Shelving on the opposite wall also show signs of oil accumulation. SAFETY AND DOCUMENTATION: The required Material Safety Data Sheets were available and in a binder in the office.A Contingency Plan and a Spill Kit were available in the Oil Room. Manifest sheets for the transport of hazardous materials and used oil were also provided upon request,Safety Kleen is the licensed hauler of record. An outdated 2006-2007 License"FOR STORING OR HANDLING 111 GALLONS OR MORE OF HAZARDOUS MATERIALS"was posted in the facility. SITE FACILITIES: There were no floor drains observed at the facility. The site building is served by an on septic system. Any deficiencies which were discovered in the course of this inspection with regards to the Hazardous Materials Ordinance are described below. CORRECTIVE ACTIONS TO BE TAKEN: The two-hundred and seventy-five(275)gallon tank of waste oil must be labeled with the words, -b-1'-, -p- "REGULATED RECYCLABEL MATERIAL","USED OIL"AND"TOXIC"and the date on which accumulation began in letters/numbers at least one inch(P)high. /12 An additional copy of the Contingency Plan is to be located near a telephoner ` Due to their combustibility discontinue the use of flattened cardboard boxes as an absorbent pad for oily ` spills. Gas cylinders shall be securely stored. A 2007-2008 Application for permit to store and/or utilize more than 111 gallons of hazardous pl"_utsus . materials"(enclosed)and associated fee is to be completed and submitted to the Town. Spills from activities in the Oil Room appear to be the origin of the oil staining in the basement. The entire floor of the Oil Room(including the floor under the raised oil tanks)shall be cleaned(using speedy dry and sweeping)to the point where there is no obvious free liquid spillage or accumulated speedy dry. �f _ The basement wall and floor shall also be cleaned. Continued routine and immediate spill clean-up in the `,1 r -3 - Oil Room should eliminate oil from entering the basement in the future,and will enable you to detect any tank leaks. A 2007—2008 License had been obtained prior to the original Inspection. The floor of the Oil Room,the basement floor and wall were clean.In addition, leaks in the Oil Room floor were repaired and the basement wall had been painted. This letter contains information from that visit that will help you become compliant with Chapter 108 of the Town of Barnstable Code: Hazardous Materials. Enclosed are copies of the Chapter 108 Code: Hazardous Materials and the Toxic and Hazardous Materials On-Site Inventory form from the site visit. Please note the problems and observations identified at your place of business during the hazardous materials inspection and their correspondinjz orders or recommendations listed below: PROBLEMS: • An open container/catch pan of hazardous materials located inside the facility. Leaving open spill pans and on the floor or among shop clutter can cause an accidental release (spill). ORDER: • Please drain the catch pan more frequently PROBLEMS: • Contingency plan not posted in areas throughout the facility. ORDER: • Post contingency plan in areas throughout the facility near all telephones. A sample contingency plan is enclosed. PROBLEMS: • 3 (three) 55 gallon drums are located outdoors without properly being stored under the Hazardous Materials Code. P . ORDER: • If the drums are to remain outdoors,they will need containment of 110%and a roof installed to prevent the drums from rusting. If the drums are placed indoors,they are not required to have 110%containment, although recommended. PROBLEMS: • Cylinders are not chained. ORDER: • Please chain all cylinders OBSERVATIONS: • Place absorbent pads and/or speedy dry on releases as soon as they occur. Clean up the materials once all products have been absorbed and dispose of properly.Do not use shop rags or cardboard as absorbents. On Site Inventory Total The Toxic and Hazardous Materials On-Site Inventory from July 10, 2006 shows that you have approximately 1302 gallons of toxic and hazardous materials being used,stored, generated and disposed of at Meineke Muffler,409 Iyannough Road,Hyannis,MA(Please see enclosed Toxic and Hazardous Materials On Site Inventory sheet). Please note the problems and observations identified at your place of business during the hazardous materials inspection and their corresponding orders or recommendations listed below: PROBLEMS: • An open container/catch pan of hazardous materials located inside the facility. Leaving open spill pans and on the floor or among shop clutter can cause an accidental release (spill). ORDER: • Please drain the catch pan more frequently PROBLEMS: • Contingency plan not posted in areas throughout the facility. ORDER: • Post contingency plan in areas throughout the facility near all telephones. A sample contingency plan is enclosed. PROBLEMS: • 3 (three)55 gallon drums are located outdoors without properly being stored under the Hazardous Materials Code. x- ORDER: • If the drums are to remain outdoors,they will need containment of 110% and a roof installed to prevent the drums from rusting. If the drums are placed indoors,they are not required to have 110%containment, although recommended. PROBLEMS: • Cylinders are not chained. ORDER: • Please chain all cylinders OBSERVATIONS: • Place absorbent pads and/or speedy dry on releases as soon as they occur. Clean up the materials once all products have been absorbed and dispose of properly.Do not use shop rags or cardboard as absorbents.
