NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY CODE
II-MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION AND THE
TOWN OF BARNSTABLE CODE, CHAPTER 170, SECTION 7.
The property owned by you located at 83 Lafrance Ave., Hyannis, was inspected on May'11,
2006,by Donna Z. Miorandi, RS;'Health Inspector,for the Town of Barnstable,because of a
complaint. "
The following violations of the State Sanitary Code were observed:
105 CMR 410.251: KITCHEN ELECTRICAL OUTLETS
Two wall-type convenience outlets must be provided in convenient locations. Much equipment
in the kitchen connected to extension cords.
105 CMR 410.501: Weathertight Elements
Broken windowpane in the bedroom and enclosed porch.
105 CMR 410.5534 Installation of Screens. The owner shall provide and install screens as
required in 105 CMR 410.551 and 410.552 so that they are in place during the period
between April first to October 30th, both inclusive,in each year.
There are no screens on many of the windows or the doors.

105 CMR 410.482: Smoke Detectors i
No operable smoke detectors throughout the whole dwelling.
105 CMR 410.000: Carbon Monoxide Alarms.
No carbon monoxide alarms throughout the dwelling. As of March 31, 2006 all residential
dwellings heated with fossil fuels (oil, gas, wood, coal, etc)must have CO alarms.
105 CMR 410.351: Owner's Installation and Maintenance Responsibilities.
The owner shall install in accordance with accepted plumbing, gasfitting, and electrical wiring
standards, and shall maintain free from leaks, obstructions or other defects. The oven is
inoperable and there are many electrical cords transgressing doorways. The vents in the
bathrooms are inoperable.
105 CMR 410.480 (D) & (E): Locks.
Every entry door of a dwelling unit or rooming unit shall be capable of being secured from
unlawful entry. Every openable,exterior window shall be capable of being,secured.
1.05 CMR 410.201: Temperature requirements.
The owner shall provide heat in every habitable room to at least 68 degrees Fahrenheit between
7:00 a.m. and 11:00 p.m. and at least 64 degrees between 11:01 p.m. and 6:59 a.m. every day
other than during the period from June 15th to September 15th. The temperature shall at no time
exceed 78 degrees Fahrenheit during the heating season. The thermostat is currently locked at
55 degrees Fahrenheit.
105 CMR 410.600 (A) & (C): Storage of Garbage and Rubbish. The owner of any dwelling
that contains three or more dwelling units shall provide as many receptacles for the storage of
garbage and rubbish as are sufficient to contain the accumulation before final collection.
Garbage and rubbish shall be put out for collection no earlier than the day of collection.
105 CMR 410J80: Natural and Mechanical Ventilation The owner shall provide for each
habitable room, and room containing a toilet; bathtub or shower, ventilation to the outdoors
consisting of: (A) windows, skylights, doors or transoms in the exterior walls or roofs that can
easily be opened^to a minimum of 4%of the floor,area of that habitable room or room containing
toilet,bathtub,or shower,provided,that a'skylight which if open exposes the interior of the
dwelling to direct rainfall shall not satisfy this requirement; or(B) Mechanical ventilation
capable of exhausting air for a habitable room at 2 changes per hour or bathroom at 5 changes per
hour,
You are directed to correct the above violations of 410.351; 410.000 and 410.482 within 24
hours of receipt of this notice.
170-7 of the Town of Barnstable Code: Owner\Property Manager's name, address and,
telephone number were not posted.
§ 170-7 of the Town of Barnstable Code specifically reads as follows:
An owner of a dwelling which is rented for residential use,who does not reside therein and who
does not employ a manager or agent for such dwelling who resides therein, shall post and
maintain or cause to be posted and maintained on the exterior of such dwelling within five feet of

the main entrance or within five feet of the mailbox(es), at least four feet and not greater than six
feet above ground level, a notice constructed of durable material, not less than 20 square inches
in size,bearing his/her correct name,address and telephone number. If the owner is a realty trust
or partnership, the name, address, and telephone number of the managing trustee or partner shall
be posted. If the owner is a corporation, the name, address, and telephone number of the
president of the corporation shall be posted. Where the owner employs a manager or agent who
does not reside in such dwelling, such manager's or agent's name, address, and telephone number
shall also be included in the notice.
You are directed to correct all of the above remaining violations within five (5) days of
receipt of this notice.
You may request a hearing before the Board of Health if written petition requesting same is
received within ten(10) days after the date the order is served.
Non-compliance could result in a fine of up to $100.00 per violation. Each days failure to
comply with an order shall constitute a separate violation.
-In addition, Federal Regulations require that in buildings with three or more units,there
must be one Federal Postal mailbox per apartment, and it must be locked and maintained
in good repair.
