The developers intent is to convert the pre-existing blighted brick structure which previously housed 60,000 square feet of nursing home use into a mixed-use development of 42 residential units and 20,000 square feet of medical/professional office space. The project will require the extensive rehabilitation of the existing brick structure and adding an additional floor. The renovations proposed intend to make the building conform to the requirements as provided for in the Design Infrastructure and the architectural features incorporated are those which are included in the Design Infrastructure Plan and the ordinances of the Town of Barnstable. In addition to,the renovation of the main structure, the developer proposes the destruction of two post World War II residential buildings each containing two separate units for a total of four residential units as well as the destruction of two out buildings. The purpose for the destruction of these buildings is to provide access onto School Street designed to minimize traffic on Lewis Bay Road. These buildings are also in a blighted condition and their removal will improve the quality of the neighborhood. The overall plan of the developer is to take the site which is currently blighted and convert it into a state of the art, mixed-use development with moderate price to high-end development residential units and the creation of high-end medical office/professional office space. The redevelopment of the site will likely result in the lessening of traffic congestion, increased property values and increased tax revenues for the town of Barnstable. 1 4 P Plan Submissions: All Plans submitted with an application shall comply with the requirements of Section 240-102 of the Zoning Ordinance. In addition, the following shall be provided: • Twelve (12) copies of the completed application form, each with original signatures. • Eight (8) copies of a 'wet sealed' certified property survey(plot plan) and twelve (12) reduced copies (8 1/2" x 11" or 11" x 17") showing the dimensions of the land, all wetlands, water bodies, surrounding roadways and the location of the existing improvements on the land. • Twelve (12) copies of a proposed site improvement plan and building elevations and layout as may be required plus twelve (12) reduced copies (8 1/2" x 1 V or 11" x 17") of each drawing. The Board of Health Prohibition of Smoking Regulation prohibits smoking in all public places. Public place is defined as follows: "An enclosed, indoor area that is open to and used by the general public, including but not limited to the following facilities: educational facilities, clinics, nursing homes, elevators, stairwells, lobbies and entranceways accessible to the public, hotels and motels, public restrooms; laundromats, hair salons ..." You testified that the Greenery at Hyannis is a home, not a public building. You also testified that this building is being used as a "nursing home." The Board of Health Regulation specifically lists a "nursing home" as a public place within the Board of Health Regulation Section III, Definitions. Therefore, your request for a variance is not granted. Sincerely yours, SSusan G.
