The property owned by you located at 57 Lewis St., Hyannis was inspected on July 31, 2009 by Jaime Cabot, R. S. Town of Barnstable Health Inspector because of a complaint. The following violations of the State Sanitary Code were observed: 105 CMR 410.450-Means of Egress: two illegal bedrooms were observed in the basement without proper emergency exits. 105 CMR 410.500—Owner's Responsibility to Maintain Structural Elements: Chronic dampness, no dehumidifier provided for basement rooms and staining was observed on bathroom walls. Automatic door closer missing on front storm door. 105 CMR 410.482 Smoke Detectors and Carbon Monoxide Alarms: Carbon Monoxide Detectors not maintained. 105 CMR 410.551- Screens for windows: No screens provided for open able windows in the dwelling. 105 CMR 410.351 (A) - Owners Installation and maintenance responsibilities: Lower level bathroom shower backs up when toilet flushed. Thermostat for the heating system is damaged. 105 CMR 410.501 —Weathertight Elements: There are broken windows in the kitchen and bedroom. 105 CMR 410 .451-Egress obstructions: Door to Cellar screwed shut, objects obstructing cellar stairs. 105 CMR 410..503- Protective Railings and Walls: No railing provided for cellar stairs. 105 CMR 410.190-Hot Water:Hot water temperature was observed at 137 Deg. F. 105CMR 410.620- Curtailment Prohibited: Burners for electric stove had been removed. The following violations of the Town of Barnstable Code were observed: 170-4—Certificate of Registration: Rental property is not-registered with Town of Barnstable Health Department. You are directed to correct the violations listed above within (24) twenty-four hours of your receipt of this notice by installing smoke detectors in accordance with Mass Fire Codes. You are directed to begin repairs to correct the violations listed above within seven (7) days of your receipt of this notice by repairing the damaged thermostat, replacing the missing burners for the stove, replacing the broken windows, and adjusting the hot water temperature to between 110 Deg. F. and 130 Deg. F. You are directed to correct all other violations listed above within thirty (30)days of your receipt of this notice. You are ordered to immediately cease using the basement rooms as bedrooms and to register the rental property with Board of Health within ten (10) days of your receipt of this notice. You may request a hearing before the Board of Health if written petition requesting same is received within ten(10) days after the date the order is served. This listing is composed of those items which are deemed to always have the potential to endanger or materially impair the health or safety, and well-being of the occupants or the public. Because Chapter II, 105 CMR 410.100 through 410.620 state minimum requirements of fitness for human habitation, any other violation has the potential to fall within this category in any given specific situation but may not do so in every case and therefore is not included in this listing. Failure to include shall in no way be construed as a determination that other violations or conditions may not be found to fall within this category. Nor shall failure to include affect the duty of the local health official to order repair or correction of such violation(s) pursuant to 105 CMR 410.830 through 410.833 nor shall failure to include affect the legal obligation of the person to whom the order is issued to comply with such order. (A) Failure to provide a supply of water sufficient in quantity, pressure and temperature, both hot and cold,to meet the ordinary needs of the occupant in accordance with 105 CMR 410.180 and 410.190 for a period of 24 hours or longer. (K) Roof,foundation, or other structural defects that may expose the occupant or anyone else to fire, burns, shock, accident or other dangers or impairment to health or safety. (L) Failure to install electrical, plumbing, heating and gas-burning facilities in accordance with accepted plumbing, heating, gas-fitting and electrical wiring standards or failure to maintain such facilties as are required by 105 CMR 410.351 and 410.352, so as to expose the occupant or anyone else to fire, burns, shock, accident or other danger or impairment to health or safety. (M) Any defect in asbestos material used as insulation or covering on a pipe, boiler or furnace which may result in the release of asbestos dust or which may result in the release of powdered, crumbled or pulverized asbestos material in violation of 105 CMR 410.353. ' (N) Failure to provide a smoke detector required by 105 CMR 410.482. 1 (0) Any of the following conditions which remain uncorrected for a period of five or more days following the notice to or knowledge of the owner of said condition or conditions: (1) Lack of a kitchen sink of sufficient size and capacity for washing dishes and kitchen utensils or lack of a stove and oven or any defect that renders either inoperable. ; f (2) Failure to provide a washbasin and shower or bathtub as required in 105 CMR 410.150(A)(2)and 410.150(A)(3)or any defect which renders them inoperable. Last inspected by Building staff in Sept. 2009. See exit order on file for basement bedrooms. On this date: Living Room • Found living room was simply but sparsely furnished with seating area and TV. • A broken window was on the living room floor. • Male resident indicated he replaced it and pulled back curtain to display new window. • Kitchen was not furnished. • Refrigerator had remnants of a locking mechanism on the side and door. • The freezer door did not close all of the way. • Power was on but with doors ajar • Whatever was inside of the freezer and fridge had long ago spoiled. • Kitchen did not look like any food preparation was occurring. • There were no dirty dishes, take out containers or food items. • Kitchen door had no lock and was not secured. First Floor Bedrooms • Found two bedrooms on first floor; each had mattresses on the floor and personal effects. • These bedrooms were not cluttered nor especially dirty. • The window in one room was open—likely to vent some of the overwhelming heat. Second Floor Bedrooms • Upstairs there were two more bedrooms. • These two rooms were not as neat as the two on the first floor and had clothing and items scattered about. • Both of the upstairs rooms had built-ins and mattresses on the floor. • One room had evidence of a child's bed and stuffed animal. • Occupants assured me multiple times that no child is in residence and that the belongings ate from when the female tenant lived here with Ernie. • The second floor bedroom at the top of the stairs on the right also provided a hiding space for the former tenant, Ernie Pillsbury. o He had removed a panel at the base of the built-in and would secret himself in the crawl space behind the cabinet unit whenever the police would come looking for him. Ernie Pillsbury—Former Tenant • He is reported both by the current occupants (including his former girlfriend) and the police to have a drinking problem. • Previous history included reports of drug activity at this location. • Ernie is said to live elsewhere but periodically comes back. • Ernie Pillsbury has a child with one of the current occupants. • That child is living in RI. • Ernie is accused of collecting rent from the current occupants even though he has no stake in the ownership of the property. • All parties continue to describe Ernie Pillsbury as a former tenant. Basement Apartment • The cellar staircase was littered with debris at the bottom of the stairs. • There was a blood smear on the wall from the raid the previous night during which Ernie was taken out. • There were clothes, mattresses, and pillows all over the floor. • Two bedrooms in the basement had deficient egress. • The closet in one bedroom had a line for canned goods on the shelf. o We did not check to see if contents matched label. • The kitchen sink and stove was missing but some of the cabinets remained in place. • The mechanical room was vented as a result of a missing door and opening into the other side of the wall. • Dried feces were smeared over the bathroom floor. • The current occupants stated that nobody lives or stays downstairs and hasn't for about 2 years. (I would say 1 yr as I inspected property 1 year ago Sept and remember that it looked like someone was still living in the basement—a locked bedroom door). • The current occupants stated that former residents would just throw their unwanted belongings downstairs. • See photos on file. Utilities and General Notes • Found no operating smoke detectors • Found no operating CO detectors Found no operating thermostats • House about 90 degrees—outside reported 52 degrees at noon • Occupants stated they reinstall thermostat dial and manually manipulate to regulate heat. • Windows were open to cool area. • Electric bill is in name of an unidentified female who was not present. Ownership • Researched deed and foreclosure and found no change or evidence of f/c process as of this date. • 1 remembered that the owner's family had a family apartment at 196 Craigville Beach Rd. • I check that file and found names and phone numbers • Those telephone numbers were no longer in service but I did find Thiago Souto Gilber's brother's work number at the Urban Zone. • I was given a current cell number for Thiago and was able to contact him on this date at 774-836-6852 • He stated his brother; Gilber Souto is in Brazil and has been out of the country for more than a year. • I was informed that Giber has apparently walked away from the property and has not made any payments to the bank for over a year. • I told him to check the status of the f/c with his brother and to let me know. • I left my office number and told him to make sure he called me back. • I informed him that I did not want to have to bother his parents. • Thiago promised to call me back Town of Barnstable Regulatory Services BARNSTABLE Thomas F. Consequently, a list of violations was complied by Health Inspector, Jaime Cabot and I was called in to confirm the status of the property's obvious two-family use. My inspection revealed two bedrooms in the basement lacking proper egress in addition to a complete kitchen and full bath. Local Inspector Paul Roma was summoned to assess the egress matter and later issued an exit order for both basement bedrooms. This order prohibits sleeping in those rooms due to deficient egress. Your tenants were advised accordingly. A copy of both the exit order and the inspection report was left with the residents before we left the site. At this juncture, it is my duty to inform you that you are required to restore this property to a single family home. A building permit is necessary to ensure that the work is inspected and complies with all governing codes. Staff at 200 Main Street will be happy to facilitate your application and answer any questions you may have regarding the permitting process. You may also contact me directly at 508-862- 4027 in order to discuss the zoning issue under Chapter 240-11 restricting the use of the subject property. Barnstable Health Division finds that the dwelling is unfit for human habitation. Pursuant to M.G.L. c. 127B and 105 CMR 410.831 (D), the Health Department further finds that the conditions within the dwelling are such that the danger to the life or health of the occupant of the subject dwelling is so immediate that no delay may be permitted in making this finding The following violations of 105 CMR 410.00, State Sanitary Code I][: Minimum Standards of Fitness For Human Habitation were observed: 105 CMR 410.750: Conditions Deemed to Endanger or Impair Health or Safety (I) "Failure to comply with any provisions of 105 CMR 410.600, 410.601, or 410.602 which results in any accumulation of garbage,rubbish,filth or other causes of sickness which may provide a food source or harborage for rodents,insects or other pests or otherwise contribute to accidents or to the creation or spread of disease. There was a large.accumulation of debris, rubbish, filth and other causes of sickness present in basement of residence. Observed, what appeared to be, excrement on floor of basement bathroom. 105 CMR 410. 351: Owner's Installation and Maintenance Responsibilities Sections of walls missing and existing walls have numerous holes in them. Heating system and electrical system is not functioning properly. Numerous broken windows observed. 105 CMR 410. 482: Smoke Detectors and Carbon Monoxide Alarms No functional carbon monoxide alarms or smoke detectors present in residence. .Based upon these findings any and all occupants are hereby ordered to vacate and the landlord/owner is ordered to secure the subject dwelling within 48 hours of receipt of this order. If any person refuses to leave a dwelling or portion thereof, which was ordered vacated, they may be forcibly removed by the local Board of Health (M.G.L. c. 127B), or by local police authorities at request of the Board of Health. Furthermore,anyone who fails to comply with any order of the Board of Health may be subject to fines of not more than $500. On this date: Living Room • Found living room was simply but sparsely furnished with seating area and TV. • A broken window was on the living room floor. • Male resident indicated he replaced it and pulled back curtain to display new window. • Kitchen was not furnished. • Refrigerator had remnants of a locking mechanism on the side and door. • The freezer door did not close all of the way. • Power was on but with doors ajar • Whatever was inside of the freezer and fridge had long ago spoiled. • Kitchen did not look like any food preparation was occurring. • There were no dirty dishes, take out containers or food items. • Kitchen door had no lock and was not secured. First Floor Bedrooms • Found two bedrooms on first floor;each had mattresses on the floor and personal effects. • These bedrooms were not cluttered nor especially dirty. • The window in one room was open—likely to vent some of the overwhelming heat. Second Floor Bedrooms • Upstairs there were two more bedrooms. These two rooms were not as neat as the two on the first floor and had clothing and items scattered about. • Both of the.upstairs rooms had built-ins and mattresses on the floor. • One room had evidence of a child's bed and stuffed animal. • Occupants assured me multiple times that no child is in residence and that the belongings are from when the female tenant lived here with Ernie. • The.second floor bedroom at the top of the stairs on the right also provided a hiding space for the former tenant, Ernie Pillsbury. l o He had.removed a panel at the base of the built-in and would secret himself in the crawl space behind the cabinet unit whenever the police would come looking for him. y Ernie Pillsbury—Former Tenant • He is reported both by the current occupants (including his former girlfriend) and the police to have a drinking problem. • Previous history included reports of drug activity at this location. • Ernie is said to live elsewhere but periodically comes back. • Ernie Pillsbury has a child with one of the current occupants. • That child is living in RI. • Ernie is accused of collecting rent from the current occupants even though he.has no stake in the ownership of the property. • All parties continue to describe Ernie Pillsbury as a former tenant. Basement Apartment • The cellar staircase was littered with debris at the bottom of the stairs. • There was a blood smear on the wall from the raid the previous night during which Ernie was taken out. • There were clothes, mattresses, and pillows all over the floor. • Two bedrooms in the basement had deficient egress. • The kitchen sink and stove was missing but some of the cabinets remained in place. • The mechanical room was vented as a result of a missing door and opening into the other side of the wall. • Dried feces were smeared over the bathroom floor. • The current occupants stated that nobody lives or stays downstairs and hasn't for about 2 years. (I would say 1 yr as I inspected property 1 year ago Sept and remember that it looked like someone was still living in the basement—a locked bedroom door). • The current occupants stated that former residents would just throw their unwanted belongings downstairs. • See photos on file. Utilities and General Notes • Found no operating smoke detectors • Found no operating CO detectors • Found no operating thermostats • House about 90 degrees —outside reported 52 degrees at noon • Occupants stated they reinstall thermostat dial and manually manipulate to regulate heat. • Windows were open to cool area. • Electric bill is in name of an unidentified female who was not present. Ownership • Researched deed and foreclosure and found no change or evidence of f/c process as of this date. • I remembered that the owner's family had a family apartment at 196 Craigville Beach Rd. • I check that file and found names and phone numbers • Those telephone numbers were no longer in service but I did find Thiago Souto Gilber's brother's work number at the Urban Zone. r f i • I was given a current cell number for Thiago and was able to contact him on this date at 774-836-6852 • He stated his brother; Gilber Souto is in Brazil and has been out of the country for more than a year. • I was informed that Giber has apparently walked away from the property and has not made any payments to the bank for over a year. • I told him to check the status of the Vc with his brother and to let me know. • I left my office number and told him to make sure he called me back. • I informed him that I did not want to have to bother his parents. • Thiago promised to call me back
