NOTICE OF VIOLATIONS OF 310 CMR: 15.00 THE STATE
ENVIRONMENTAL CODE TITLE V: MINIMUM REQUIREMENTS FOR THE
SUBSURFACE DISPOSAL OF SANITARY SEWAGE AND TOWN OF
BARNSTABLE CODE & 353-9-DISCHARGE ONTO GROUND PROHIBITED.
On July 13, 2015, Health Inspector Timothy B. O'Connell, R.S. investigated a complaint
regarding sewage odors at the property owned by you located at 245 Lincoln Road,
Hyannis, MA. The following violations of 310 CMR 1.5.00, the State Environmental
Code, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage and
the Town of Barnstable Code were observed:
310 CMR 15.303(1) (a): Septic system is in hydraulic failure. Sewage stains were
observed on the ground from past overflowing of sewage from septic system.
Town of Barnstable Code & 353-9: Discharge of sewage onto the ground,

(1) You are directed to keep the on-site sewage disposal system pumped as many
times as necessary (daily if needed) to keep it from overflowing onto the ground.
(2) You are ordered to obtain a septic design engineer to design the repair plans for
the failed septic system at said location and apply for a septic permit with the
Health Division within thirty (30) days of your receipt of this letter.
(3) The .,septic system shall be installed in strict accordance with the approved
engineered plans within sixty (60) days of your receipt of this letter.

You are directed to correct the Town of Barnstable Code violation listed above
within fourteen (14) days of your receipt of this letter by registering dwelling unit

You may request a hearing before the Board of Health if written petition requesting same
is received within ten (10) days after the date the order is served.
Non-compliance will result in the issuance, of a non-criminal ticket citation of $100.
Each day's failure to comply with an order shall constitute a separate violation.

The property owned by you located at 245 Lincoln Rd.,Hyannis was inspected
On March 10, 2009 by Jaime Cabot, R.S. Health Inspector for the Town of Barnstable.
This inspection was conducted on the basis of the rental registration in accordance with
Chapter 170 of the Town of Barnstable Code.

designed to be opened from April lst to October 30th.
You may request a hearing before the Board of Health if written petition requesting same

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY
CODE II - MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND ARTICLE 51 OF THE TOWN RENTAL ORDINANCE.
The property owned by you located at 245 Lincoln Road, Hyannis, was inspected on
September 4, 2003 by David Stanton R.S., Health Inspector for the Town of Barnstable,
because of a complaint.
The following violations of the State Sanitary Code were observed:
105 CMR 410.500: Owner's Responsibility to Maintain Structural Elements. (Free
from chronic dampness) Mold was observed in several locations throughout the
dwelling. There was a strong musty odor present in the dwelling. Mold was observed in
the following locations: The basement walls, the bedroom closet, bathroom ceiling, and
on some objects in the basement.
105 CMR 410.351: Owner's Installation and Maintenance Responsibilities. Toilet
constantly runs. The tenant has turned off the water to it to keep it from constantly
running.
You are directed to correct the violations listed above within thirty (30) days of your
receipt of this notice, by removing the mold and the source of chronic dampness
causing the mold to grow in the dwelling, and by repairing the toilet so that the
water doesn't constantly run.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten(10) days after the date the order is served.
Non-compliance could result in a fine of $100.00 per violation. Each day's failure to
comply with an order shall constitute a separate violation.
Enclosed for your records is a copy of an indoor air quality report by Nauset
Environmental Services, Inc. that was submitted to the Board of Health. This was a
private investigation, not associated with the Board of Health. The tenant stated that you

have started doing some work, such as removing a tree that was close to the house and
providing them with a dehumidifier.

1. Basement walls were cleaned by experienced home maintenance person with
bleach/water solution, Lysol disinfectant and TSP. Walls were then rinsed well.
2. Bedroom closet was cleaned by same maintenance person with bleach/water
solution, TSP,and then rinsed. After this Lysol concentrate was applied. Finally,
the bedroom closet was painted with two coats of white, latex, mildew-proof
paint.
3. Bathroom ceiling was cleaned with Tilex mold/mildew remover.
4. Objects in basement were removed by previous tenant.
5. Toilet—a new one has been installed.

Re: Indoor Air Quality(IAQ) inspection at 245 Lincoln Dr. From.: Bill Vaughan
At the your request,Nauset Environmental Services,Inc. (NES)sent William M.Vaughan,PhD to
conduct an IAQ inspection of 245 Lincoln Dr. for possible mold problems on 5 June 2003. Your
request was prompted by a recent hospitalization for serious respiratory problems,possibly linked to
exposure to mold spores. This brief memo summarizes the observations and conclusions from this
inspection and describes visible conditions at the time of the inspection. NOTE: Many of the
comments related to water issues—humidity,leaks,drainage,seepage,etc.—since molds only thrive
if high humidity/moist conditions are maintained in a building or its shell_ MOISTURE MUST BE
CONTROLLED FIRST in order to control unwanted mold growth.
Exterior—In walking around the outside of the house,the following observations were made and,as
warranted, suggestions made:
• The gutters and downspouts are not functioning as needed. The gutters are not clean. The
downspouts are either clogged (leading to backup and soaking of the building structure) or
discharging near the foundation(a serious flaw for a porous concrete foundation).
♦ From the soaked shingles at the right front corner of the building there is evidence of backup
overflow there that is keeping the wall cavity wet/damp. (That corner backs on the front
bedroom closet where the most mold growth on the main floor was observed.)
♦ From the debris on the exterior of the left front gutter, there appears to be overflowing there as
well.
♦ The bottom of the downspout by the kitchen door is plugged with leaf debris. This situation
leaks to backup on that short gutter that can discharge water to the cement stoop that has a hole
in it for a former downspout which in turn directs water to the corner of the basement near the
stairway.
• The tree canopy hangs low over the house and precludes adequate ventilation and drying of the
building shell between rain events. [This situation also contributes extra debris to the gutters
requiring more attention to maintenance/cleaning.]
SUGGESTIONS —
Have all gutters and downspouts cleaned. Use a hose or broomstick to force debris out of
downspouts until each flows freely.

Have gutters cleaned 2-3 times a year— at least in the fall around mid-late December and
once in early spring.
Have diverters installed on all the downspouts to direct water at least three feet away from
the foundation, and preferable toward a downslope direction, away from the building.
Have the tree canopy pruned back heavily from over the roof on the front.
Basement- On entering the basement the following observations were made:
♦ There is a heavy musty odor that indicates the presence of many active mold colonies.
♦ There are many cobwebs,indicating a persistent damp condition that supports enough mold and
bacteria growth that small insects and Actinomycetes can thrive and provide food for the spider
population.
♦ There was puddling near the bulkhead, indicating leaks there.
♦ There is noticeable mold growth and general water staining in the front right comer of the
basement, under where the shingles were still soaked from recent rains.
♦ There was a dehumidifier, with manual discharge, operating at the backside of the basement.
Reportedly it had just been installed the afternoon before this inspection.
♦ There was little chance to observe to walls and basement due to the piles of furniture and other
objects throughout the basement. The organic matter in and on the pillows,upholstery and wood
surfaces provide food for mold colonies that can grow easily in the high humidity/damp
environment. While these objects provide surfaces and food to support growth,they prevent the
observation of leaks or damp areas in much of the basement.
♦ There were tan/brown stains and streaks on the wall under the kitchen stoop and near the
stairway that indicate prior leaks, how recent is unknown.
♦ The general basement area is undoubtedly providing many spores to the first floor as air current
move throughout the house.
SUGGESTIONS:
To obtain true dehumidification for the basement,this dehumidifier should be coupled with a
condensate pump to discharge collected water to an inside drain or outside several feet away
from,the foundation. It should be operated at least from May through October period every
year.
The bulkhead should be sealed to prevent water entry.
The contents should be removed so that possible additional leak areas can be observed and
corrective action taken. Individuals moving/handling these good will be exposed to very
high spore levels and should wear half face respirators suitable for asbestos/particle control.
NOTE: Any of the .furnishings that are in the basement will be heavily contaminated with
mold sores and even colonies.

Most of the soft goods(pillows,cushions, upholstery,etc.)will be nearly impossible
to adequately clean for use by anyone with any sensitivities or allergies.
- The hard goods may be able to be vacuumed on ALL sides with a HEPA filter-
equipped vacuum(HEPA=high efficiency particulate),which could capture and hold
the mold spores,rather than releasing them to the air. All their surfaces should then
be wiped with a 10-15%bleach solution(l/2-cup bleach to a quart of water).
- HEPA vacuum ALL surfaces in the basement to remove as many spore reservoirs as
possible. All such work should also involve use of half-face respirator protection!
First Floor—During a walk through of the first floor:
♦ There were no obvious indications of;visible mold growth in the various rooms. There was no
sign of mold growth over the sink where a tree reportedly fell and led to a leak several years ago_
There was no sign of heavy mildew in the bathroom. [NOTE: No fuunishings were pulled from
the exterior walls to see if mold growth had developed there,a possible growth area,especially
during the winter.
♦ There was heavy mold growth in the closet in the front bedroom,behind the area where stained
shingles were observed. This heavy growth is where Ms. Gomes' clothes are stored and is near
the head of the bed in her bedroom. NOTE:The coincidence of this interior observation of mold
growth along with the indications of exterior dampness probably means that the wall cavities are
also supporting mold growth. These source areas would have a major impact on spore levels in
the bedroom and hence on her exposure to spores,
SUGGESTIONS -
Remove and clean all the clothes and bedding in the bedroom, using an extra air fluff
cycle after the initial drying.
Use a mold mitigation contractor to follow generally accepted professional practices as
described by the New York City Department of Health

Carefully open the exterior wall cavities in the closet under isolated conditions,to
prevent release of mold spores to the living space.
Remove any mold-contaminated building material at least two feet beyond the
area of visible mold.
- HEPA vacuum ALL surfaces in the contaminated area.
Treat the exposed surfaces with a bleach or moldicide solution.
- Seal the surfaces with a shellac-based sealer.
- Reinstall drywall.
HEPA vacuum ALL the surfaces and furnishings in the bedroom. NOTE:The mattress
and box springs will probably not be adequately cleaned by even HEPA methods and
may need to be discarded if mold sensitivity is a serious health concern.
Since spores will have migrated throughout the first floor, HEPA vacuum ALL those
surfaces and furnishings prior to your reoccupancy as a highly sensitive person.
Any areas of mold growth that are revealed/exposed by the cleaning effort should be
carefully addressed according to the NYC DOH guidelines indicated above.

Attic: The attic could only be observed partially from the access hatch. From that limited vantage
point, there were no signs of large mold growth areas. Only small areas of potential growth were
observed over the general kitchen area. The attic appeared to be well vented.
SUMMARY: NES observed conditions that indicate a very moldy environment in this residence.
The conditions are not suitable to the continued health of anyone with any amount of mold
sensitivity unless.ALL the suggested actions provided above are successfully carried out. Even then,
potential pockets of mold spores may not be removed and may linger to continue to provide iritation.
The above discussion and recommendations are related to the conditions visually observable at the
times of NES's site visit and are thus limited to these activities. Future events and changes in the
condition and operation of the building will change the relative significance of recommendations and
their implementation and can not be considered part of the scope of this report.
