Hi Bab's. I checked our files and then reviewed it with Bob Burgmann. He believes the line going down the right'of
way is a private line and therefore is not considered a public sewer line. If the owners of this parcel wanted to
connect, there is the possibility_ However, since it is a private line,we cannot require the connection. I'll put a copy
of this letter in file in the event you stumble across it in the future.

It has come to my attention that you have made a connection to the Town's wastewater
collection system without the benefit of first obtaining the required permit from this
office. Please contact this office immediately to remedy this violation of the Town's
regulations.
Your license to make connections to the Town's wastewater collection system is hereby
suspended until April 1, 2003. Any further violations of the regulations could result in
permanent revocation of your license to make connections to the Town's system.

Dear Ms. Fitzgerald,
Thank you for your letter dated March 28, 2003. The same day we received your letter,
Mr. Daley, our septic system information coordinator, attempted to reach you. However
he was unable to locate a telephone number for you. The next day,he drove to your
home in an attempt to talk to you directly;however no person(s) answered the door. Mr.
Daley was then instructed to mail you a notice regarding our five percent interest rate
twenty year betterment loan program available through Town-funds. This loan program
is available to homeowners for both septic system upgrades and for connecting homes to
town sewer. A copy of the yellow flyer is attached.
Several years ago,the Board of Health adopted a policy to require the Public Health
Division staff to enforce Massachusetts General Law, Chapter 83, Section 11 which
requires all buildings and homes to be connected to public sewer where properties abut
sewer lines. This policy was adopted to protect the groundwater and drinking water
resources from contaminants such as total nitrogen,bacteria, and viruses. These
contaminants are discharged from persons in their homes through plumbing fixtures into
onsite septic systems, where it leaches down into the groundwater table. Whereas if your
home is connected to a public sewer line,the wastes would be transported through piping
to the Town's sewage treatment plant facility where the wastewater would be properly
treated.
In regards to the greenhouse,Mr. Daley informed Building Inspector Ralph Jones who
went out to the site to investigate whether or not there were any building code or zoning
regulation violations. We were later informed that there were no building or zoning
violations there. w
In regards to your driveway being blocked by your neighbor, I suggest that you telephone
the Police Department to inform them of the public safety issues which you indicate in
your letter.
In response to your questions listed on page two of your letter:
1. The list of what addresses require connection to town sewer are furnished to me
routinely from the Department of Public Works, Water Pollution Control Division
personnel. I telephoned the DPW Water Pollution Control Division Office to seek an
answer to this question of what occurred that caused the written sewer connection order
letter to being written to you specifically. I was informed that the DPW personnel
routinely research and update files to identify who has and who has not connected their
homes to public sewer. In 1944, a sewer line was constructed on Louis Street and a stub
was left in front of the driveway accessing your property at that time for future connection
to the line. In 1983, a sewer line was constructed within the private way with a"Y" at the
end with the intention of providing a connection point for your property. The home
located directly across from your home was then connected to that sewer line in 1990.
Three months ago,when it was discovered by the DPW worker that your home and
several others in the Hyannis area were not connected to public sewer,the DPW worker
sent me a list of the names/addresses and requested standard order letters be sent out.
2. The Massachusetts General Law, Chapter 83, Section 11 which requires all buildings
and homes to be connected to public sewer where properties abut sewer lines. Several
years ago,the Board of Health adopted a policy to require Public Health Division staff to
strictly enforce this requirement. You may request a variance from this Board of Health
requirement to connect to public sewer. A variance request form is attached. Once you
complete the form,please also attach a copy of your 2002 W2 statement and mail it back
to us at : 200 Main Street Hyannis,.Ma 02601.
You are also eligible to apply for financial assistance in the form of a 5% interest rate
twenty-year repayment betterment loan. Attached is a flyer regarding this program.
3. In regards to the neighbor's greenhouse, the Building Division enforces the State
Building Code and zoning ordinances. You may contact the Building Division Office at
508 862-4038 to inquire about the greenhouse construction and permit requirements.
4. In regards to your question of whether there is a requirement to notify abutters when a
person proposes to construct a greenhouse without repairing the private way, the Building

Dear Mr. Mckean,
I am in receipt of the above named unsigned certified letter.
I am still in the state of shock. Certified letters usually have
unwelcome or unpleasant news to impart. I worried all night what
could it be (not at home for initial delivery) . It was indeed
most unpleasant and worrisome news ! Your letter states that
lines were extended "because of the density and size of lots in
the area and potential serious health problems"? Well Mr .
Mckean, logically speaking this density and size of the lots has
been existing for cerca 54 years . There has been no building up
nor houses constructed here since 1949 and suddenly after all
this time (54 years) it is decided that this is a dense area with
potential health problems? I am at a loss to see the connection?
I am a senior with a very low fixed income. I can barely pay
the $5 every month toward the payoff of a medical bill much less
pay for a sewer connection and a yearly fee thereafter!
I have the tiniest house in the immediate area (1 bedroom) and
have had my Cesspool checked twice in the past years with no
problems . I also, clean it with Ridex on a monthly basis .
Well , there is no way on earth I could ever afford a sewer
connection nor future yearly fees . Therefore, . I cannot comply
with your order. And would appreciate knowing the consequences
for me? And what are the laws relating to this order?
I just thought. . . .could this order have anything to do with my
next door neighbour? Since, October 30 , 2002 , her son has turned
this little Private Way' s Common Driveway into a watery and muddy
ditch inorder to construct an orchid greenhouse. We were never
informed by him nor the town. I cannot believe that constructing
a Greenhouse in this small area was ever approved. This man,
does not live here, does not own property here nor pay PROPERTY
TAXES here! ! Already, I have received mail for his busness
"VILLAGE ORCHIDS" ! ! 'This is incredible.
I have had to put up with a great deal from these neighbours .
Never knew. till 1998 that I was dependent on electricity, not on
Commelectric but on this neighbours private pole. In 1997
because of her carlessness (overgrowth branches of her trees cut
the electricity to 4 homes (including her own) which she
repaired. However, it occurred again in 2000. Unfortunately,
this time just to my home and Commelectric, had to turn off my
electricity saying it was Hazardous and could burn down my home.
She refused to repair it! To make along story short I .was
without Electricity, Heat and Hot Water for 6 months ! I contended
that Commelectric, according to its own tecnicians , . was neligent
in supplying power to her below standard pole! ! Still is ! !

because of the stress and cold I ended up at Cape Cod Hospital
Emergency diagnosed with High Blood Pressure, an Enlarged Heart
and Diabetis . That Mr. Mckean, is a serious health problem?
Over the years , my neighbour ' s son has used the Common Driveway
as a parking lot for his fire wood (up against my fence)
resulting in 2 sections falling down. He also, parked his boat
for years here even when living elswhere. His friends car was
parked there for over 2 months . During the current construction,
a worker hit my power line twice and the crane. worker damaged my
fence _(denied it & was very insulting) and when I complained to
the son I was told" stop complaining they are shitty
fences" . . .and we don't want to talk about fences do we" !
Over the years the mother, often parked on the Common Driveway,
(although her entrance is in the rear on the Verizon Parking Lot)
blocking my driveway ( I have no car) or blocking my newspaper
tube (Times delivery often justifiably complained) . I try to
avoid these people but that is not always possible. Their
relatives built these homes and they act as if they own this
Driveway. As I said, the entrance to her home is on the
Telephone Co' s Parking Lot, something I always found. strange! !
My biggest problem here is the blocking of my little driveway or
parking on the Common Driveway. If I ever need an ambulance or
fire truck, I worry about them being blocked in an emergency.
That Mr. Mckean is potential health problem. But nobody cares ! !
I would appreciate knowing the following:
1. What has occurred that caused your order given that nothing
here has changed in 54 years? No new houses constructed? etc!
2. I would appreciate knowing the consequences of I not being
able to afford your order of a sewer connection nor yearly fees
thus unable to comply with said order. What is the law, rules
or regulations regarding non-compliance with said order?
3. I would also appreciate knowing, how someone, not living here,
not owning property here and not paying. property taxes here can
build a Greenhouse here in such a small area.
4. Is there a law that states all homeowners should be notified?
His mother ' s fence was removed almost 5 months ago and he and
other trucks are still in and out of this small Private Way.
After 5 months the Driveway is still a mess and has not been
repaved. Someone wrote a letter of complaint about all this ,
erroneously thinking it was I who caused all this mess ! !
And now this troublesome, non-neighbour, non-homeowner and
none-property taxpayer, has taken over this small private way!
Perhaps initiating your order and causing me stress and worry! !
For a man not living here nor owning property here, he seems to
have more rights than I , who do? Do I have any rights?
Something is rotten in Denmark! !
Sorry for this long letter but I am really upset by the injustice
of it all ! Hoping to hear from you soon, I remain

BOARD OF HEALTH VARIANCE DECISION
On or about March 11, 2003, the Petitioner, Breda Fitzgerald, received an order
from the Board of Health to connect her premises Located at 63A Louis Street,
Hyannis, Ma, listed as Parcel 206 on Assessor's Map 309, to the public sewer.
Due to her limited income, the Petitioner applied for a variance to waive the
requirement that the building be connected to the Town of Barnstable sewer.
Based upon the application for a variance and other information submitted,.the
Board of Health finds as follows:
1. The Petitioner stated that the on-site sewage disposal system
located on the subject premise is currently functioning properly.
2. The petitioner is experiencing financial hardship.
3. If the Petitioner is required to incur the costs attendant to connect to
the Town of Barnstable sewer, she will be forced to forego basic
necessities causing her severe hardship.
4. Based on the representations-by the Petitioner that her on-site
sewage disposal system is functioning properly, the Board of
Health finds that the risk of environmental damage will be
acceptable if the Board of Health temporarily waives the
requirement that the subject premises be connected to the Town
sewer, until such time as said on-site sewage disposal system fails
- -
to-function;
WHEREFORE, the Board of Health, grants the Petitioner a variance, waiving the
requirement for the aforementioned Petitioner that the subject premises located
at 63A Louis Street, Hyannis, MA. be connected to the Town of Barnstable
sewer, subject to the following conditions:
1. This variance shall expire within 3 years from the date of issuance.
2. Nothing in this variance shall be construed as limiting the Board of
Health's power to revoke this variance should it determine that the
onsite sewage:disposal system is malfunctioning.

of Deeds within thirty (30) days from the date of issuance of said

Dear Mr. McKean,
I a-n in receipt of your above dated letter after 2z months of
awaiting a -response to Tny March 28th letter and having to write
C to Mr. Geiler. I am also in receipt of the following:
1. The Betterment .Loan ( 5 0 ) Info Sheet 2. Variance Request ,corm.
Regarding a 'sir. Daley attempting to reach me by phone and
visiting my home unannounced. At this particular time, aleither
is acceptable. What prevented him from droping ;me a note then or
anytime t1lereafter? Please no unannounced surprise visits.
Meanwhile, a few comments on the contents of your letter.
NEIGHBOR"S GREENHOUSE: It is his gre,enhouse but he i;3 not my
neighbor. . . .he lives elswhere. I would have thought when
granting this questionable permission to co:zstruct a second huge
:greenhouse in such a small private area, that traffic flow ;could
be ta'.,cen i-ato account. Obiviously not! ! I wonder why?
65A SEWER CONNECTION OF 1990: It does not abutt my Septic Tank.
It is further down the Common Driveway across from my driveway.
Back to the basis of you issuing me a DIRECTIVE! TheVe has been
no buildup .-nor change in density in this private way for more
than 50 years! It was :ny neighbor ' s son and those who incredibly
gave hits permission to build said huge Greenhouse who activated
this unjust Directive. Its making me even sicker than I am! !
Most of the questions I have asked s!zould have beet asked before
and not after the fact. . .but alas , neither myself nor neighbors
merited the courtesy (if riot the legal right) o` being informed.
Its not su-opposed to be like that in a free and open society! !
I am enclosing th:e signed and dated Variance Request along with,
as requested, my 2002 W•-2 Form which you will see is very low
inco_ne. With the state of my health, age and lack of
transportation (no car) it was my one and only job.

QUESTIONS AND REQUESTS
1. BETTERMENT LOAN (%5) INFO SHEET:
Said sheet states it is For town sewer connection or to upgrada a
failed Septic System. I do not have a failed Septic System?
As I can barely pay the monthly $.5 toward my Hospital Bills ,
I most certainly cannot afford to take out any loan be it
at 1% or 5% for the .next 20 years way beyond my life expectancy! !
All this because of a man who does not live here, own property
here nor pay taxes here, indeed as his current wife owns their
own home, I Suess he does 't pay any taxes at all to this town.
But he gets to build property here without any legal rights?
I wouldn' t be in this stressfull situation if it were .not for him
and the person(s ) who granted him ?ermiss.iorl to build a second
giant Greenhouse on this small Private Way! !
Again, I aslt w?nat other:, have asked. . . .how was he granted
permission. . . .on what basis. Would like a copy. Thanks
2. TRAFFIC FLOW AND PARKING ON OUR PRIVATE WAY:
Said son of a neighbor, does not block traffic to this Private
Way. What he does and is doing is to use our little Private Way
as if it were a main street, vans and trucks in and out all day
and doors banging. He also uses the tend of our COMMON DRIVEWAY
(by his mother ' s rear gate) as his very Own parking space.
This section at end of the Common Driveway (behind my fence) has
always ( 21 years) been reserved for owners or residents extra
visitors cars , trucks or vans etc. that duo not fit in our own
small driveways ! Now, because of our neighbor ' s son and those
who granted him permission ( is he an acq+za.intakice or friend? )
we resident taxpayers are deprived of this space.
He parks his vain daily there -and those of his visitors till
nearly 6pm. daily! ! ! As he is in and out all day and because of
this the remaining common driveway must be free between 9-6pm For
him to drive in and out unhindered! Incredible, he ' s taken over!
He keep:., hanging and removing his sign "VILLAGE ORCHIDS FOR SALE
DR RENT" this sign has brought more people and traffic to this
tiny Private Way! ! How is this possible? Grant a questionable
Permit (under false pretenses? ) only for it to be sold or rented
to other non-resident, non-homeowner, non ta_cpay-ng strangers !
Sounds like a case for legal and civil rights experts?
Also, the Common Driveway was not properly _epaved Its a mass !
3. VARIANCE REQUEST FORM: Its enclosed. Signed and dated.
However, I do not understand the 2 Variance Questions
(re Regulation and Reason) and have left them blank.
Please let me knew as soon as possible if it has been approved
and if so, what would be its significance. Thank you.
4. 2002 W-2 EARNINGS SUMMARY: Enclosed as regaestred.
As I: stated, health, age and lack of transportation (no car) area

RE: ORDER TO CONNECT TO PUBLIC SEWER SYSTE
Dear Mr. Mckean,
I am in receipt of the above named unsigned certified letter.
I am still in the state of shock. Certified letters usually have
unwelcome or unpleasant news to impart. I worried all night what
could it be (not at home for initial delivery) . It was indeed
most unpleasant and worrisome news ! Your letter states that
lines were extended "because of the density and size of lots in
the area and potential serious health problems"? Well Mr .
Mckean, logically speaking this density and size of the lots has ,
been existing for cerca 54 years . There has been no building up
nor houses constructed here since 1949 and suddenly after all
this time ( 54 years ) it is decided that this is a dense area with
potential health problems? I am at a loss to see the connection?
I am a senior with a very`'low fixed income. I can barely pay
the $5 every month toward the payoff of a medical bill much less
pay for a sewer connection and a yearly fee thereafter!
I have the tiniest house `in the. immediate area ( 1 bedroom) and --
have had my Cesspool checked twice in the past years with "no
problems . -I also; clean it =`with Ridex on a monthly basis .
Well, there is no way on 'earth I could ever afford a sewer
connection nor future yearly -fees . Therefore, I cannot comply ,
with your order. And would appreciate knowing the consequences
for me? And what are the laws relating to this order?
I just thought. . . .could this. order have anything to do with my
next door neighbour? Since, October 30 , 2002 , her son has turned
this little Private. Way ' s Common Driveway into a watery and muddy
ditch inorder to construct an orchid greenhouse. We were never
informed by him nor the town. I cannot believe that constructing
a Greenhouse in this 'small area was ever approved. This man,
does not live here, does not own property here nor pay PROPERTY
TAXES here! ! Already, I have received mail "or his busness
"VILLAGE ORCHIDS" ! ! This is incredible.
I have had to put up with a great deal from these neighbours .
Never knew till 1998 that I was dependent on electricity, not on
Commelectric but on this neighbours private pole. In 1997
because of her carlessness (overgrowth branches of her trees cut
the electricity to 4 homes ('including her own) which she
repaired. . However,- it occurred again in 2000. Unfortunately ,
this time just to my home and Commelectric had to turn off my
electricity saying it was Hazardous and could burn down my home.
She refused to repair it! To make along story short I was
without Electricity, Heat and Hot' Water for 6 months ! I contended
that Commelectric, according to its own tecnicians , was neligent
in supplying power to her below standard pole! ! Still is ! !

Because of the stress.. and cold I ended up at Cape Cod Hospital
Emergency diagnosed with High Blood Pressure, an Enlarged Heart
and Diabetis . That Mr. Mckean, is a serious health problem?
Over the years, my neighbour ' s son has used the Common Driveway
as a parking lot for his fire wood (up against my fence)
resulting in 2 sections falling down. He also, parked his boat
for years here even when living elswhere. His friends car was
parked there for over 2 months . During the current construction,
a worker hit my power. line twice and the crane worker damaged my
fence (denied it &' was very insulting) and when I complained to
the son I was told" stop complaining they are shitty
fences" . . .and we don 't want to" -alk about fences do we" !
Over the years the mother, often parked on the Common Driveway ;
(although her entrance is in the rear on the Verizon Parking Lot)
blocking my driveway ( I have no car) or blocking my newspaper
tube (Times delivery often justifiably complained) . I try to
avoid these people but that is not always possible . Their
relatives built these, homes and they act as if they own this
Driveway. As I said, the entrance to her home is on the
Telephone Co' s Parking Lot, something I, always found strange! !
My biggest problem here is the blocking of my little driveway or
parking on the Common Driveway. If I ever need an ambulance or
fire truck, I worry about them being blocked in an emergency.
That Mr. Mckean is potential health problem. But nobody cares !-!
I would appreciate knowing the following: 111. What has occurred that caused your order given that nothing .
here has changed in 54 years? No new houses constructed? etc!
2. I would appreciate knowing the consequences of I not being
able to afford your order of a sewer connection nor yearly fees
thus unable to comply with said order. What is the law, rules
or regulations regarding no with said order?
3. I would also appreciate knowing, how someone, not living here,
not owning property here and not paying property taxes here can
build a Greenhouse here in such a small area.
4. Is there a law that- states all homeowners should be notified?
His mother ' s fence wa-s removed almost 5 months ago and he and
other trucks are still in and out of this small Private Way.
After 5 months the Driveway ,is' still a mess and has not been
repaved. " Someone wrote a letter of complaint about all this,
erroneously thinking it was. I who caused all this mess ! !
And now this troublesome, non-neighbour, non-homeowner and
none-property taxpayer, °has taken over this small private way!
Perhaps initiating your' order. and causing me stress and worry! !
For a man not living here nor owning property here, he seems to
have more rights than I , who do? . Do I have any rights?
Something is rotten in Denmark! !
Sorry for this long letter but I am really upset by the injustice
of it all ! Hoping to hear from you soon, I remain

second floor Hearing Room, 367 Main Street Hyannis. You indicated that you would not
be able to attend the meeting. The Board members had no other information to review

I have forwarded my recorded variance of 8/15/03 to Dr. Miller .
$75.00 is a substancial expense given my low income.
By chance I happened. to see (a tv rerun?) of your 7/15/03 Board
Meeting on local access tv. I was shocked and humiliated to see
and hear Dr. Miller reading out loud on Channell 18 , the letter I
wrote to you. It .was taped. I had no idea it would be on TV!
Another little matter you neglected to inform me about! I can
only imagine what further humiliation I would have had to endure
before this 3 . man committee, had I on
in person?
Why oh why did you hand over to Dr. Miller on tv my personal
letter( s ) to you containing my private financial situation among
other things for him to read out loud on television before the
public audence in attendance and those watchincit on tv?y?
Why me? My personal financial situation is personal and is not
the business of town residents?, However, your actions made it
so! It was painfull and humiliating to watch!
As if the aforementioned were not enough, Dr. Miller read my
private letter to you, with a smirk on his face and in a ,
sarcastic manner commented on all -my letters to you! !
You both then discussed my financial situation, age and health ,in
front of those present and the entire television audience!
How -dare you both. The arrogance of power is� . . . . .
My letters to you were not fog �)u___.i� ion This public
humiliation you both have .caused me will long remain with me! !
You and Dr. Miller have done me a great injustice and have added
greatly to my stressful) predicament!
The contents of my correspondence to you could have been, should
have been discussed beforehand in private and not on television.
It also seems , that the Committee ' s decision was made on the
spot, while reading my letter on television and not beforehand.
Why? I find this extremely disconcerting!
All this humiliation, - questionable directives , expenses , letter
writing because of questionable permission given to construct a
second. huge GREENHOSE, by a non--president of this tiny way by a
non-property owner of this private way., by a non-property tax
payer of this private way (indeed has he ever paid any property
taxes to the town of Barnstable? ) and who now has hung a
"FOR SALE OR RENT" sign? Something is rotten in Denmark???
