In that regard, we would like to inform you that the only relationship the Bank has with the property is as a mortgagee. The law is implemented through, regulations known as the Massachusetts Contingency Plan,310 CMR 40.0000 et seq. (the"MCP"). Through the MCP,the Department is currently regulating a release of hazardous material that has occurred at 242 Main Street, Barnstable,Massachusetts. The Department was first notified of the release on September 23, 1987. The Department does not currently have in its files appropriate documentation indicating that the release is being addressed in the timely manner that is required by the regulations. The Department's records indicate that you are the owner of the property where, the release occurred. As the owner of the property, you are a Potentially Responsible Party ("PRP") with potential liability for the release pursuant to Chapter 21E. The liability is "strict", meaning that it is not based on fault, but solely on your status as the owner of the property where the release occurred. This liability is also"joint and several", meaning that you may be held liable for the release and all response action costs incurred at the disposal site regardless of the existence of any other liable parties. The purpose of this Notice is to inform you of your legal responsibilities under State law for assessing and/or remediating the release. Enclosed with this Notice is a summary sheet outlining the potential liability issues associated with Chapter 21E. Additionally, this Notice is to inform you that the response actions required to address the release are overdue. Specifically, the MCP requires that either a Tier Classification, Response Action Outcome Statement or Downgradient Property Status Submittal be submitted to the Department within a predetermined timeframe. The Department's files indicate one of these documents was due to the Department by August 2, 1995. Bradley's Dry Cleaners 242 Main St.,Hyannis,MA July 14,2000-Page t ' 1.0 INTRODUCTION ' This Class B-1 Response Action Outcome Statement (RAO) is submitted on behalf of the Cape Cod Regional Transit Authority (CCRTA) for the former Bradley's Dry Cleaners property located at 242 Main Street, Hyannis, Massachusetts (Figure 1). Mr. Joseph Potzka, Administrator-CCRTA, is the acting administrator in regards to environmental matters at the site. Atlantic Environmental Technologies, Inc. (AET) has been retained by CCRTA to provide Licensed Site Professional (LSP) and engineering services. Historic assessments within the area of the site have indicated a confining layer at approximately ,,-,et below surface grade (BSG). Multiple assessments have been performed on the subject property. These assessments have indicated that impacted soil at the site is below all applicable cleanup standards. However, assessment results were not obtained during site file reviews and are not included in this report. This RAO is limited to the groundwater at the site which ' historically had been the environmental media of concern. In September of 1987, K-V Associates, Inc. (K-V) conducted an inspection of the site and completed a "Site Report Relative To Hazardous Materials" (KV-1987). The report stated that the site housed a laundromat and dry cleaning establishment from 1957 to 1987 with Bradley's Dry Cleaners operating the facility for the latter seven years. Historic dry cleaning of rugs was not conducted in a containment system, however, the dry cleaning of clothes was. Prior to a laundromat and dry cleaning facility, the site housed a registry of motor vehicles and later a bank. Cape and Vineyard Electric Co. once stored replacement equipment for the high voltage IL ' substation located at the rear of the site. As part of the 1987 investigation, three groundwater monitoring wells (MW1, MW2, MW3) ' were advanced to the water table and K-V collected groundwater samples from each well for organic compound analysis by EPA Method 601 & 602 (Figure 2). Laboratory results recorded detections of Tetrachloroethene (Perc) that required notification to the Department of Environmental Quality (DEQE). Bradley's Dry Cleaners ceased operations in the late 1980's and the ownership was changed to Cape Cod Bank & Trust (CCB & T). The site was then purchased from CCB & T by CCRTA in 1997. The site has remained vacant since the building was demolished in 1998. AET conducted groundwater monitoring activities on July 30, 1996 and analyzed groundwater samples for volatile organic compounds (VOCs) (AET 1996). At that time, the site was in a GW-1 area and recorded Perc concentration above GW-1 MADEP Cleanup Standards in wells MW-2 and MW-3. AET recommended further assessment be conducted at the site. CCRTA received a Notice Of Responsibility (NOR) from the Massachusetts Department of Environmental Protection (MADEP) on April 14, 2000 requiring either a Tier Classification, RAO, Downgradient Property Status Submittal be submitted the department for the site. AET supervised the installation of five depth-varied groundwater monitoring wells, located one existing groundwater monitoring well, and conducted groundwater assessment activities to assess groundwater quality at the site.. Laboratory VOC analysis recorded a detection of Perc in I ' RAO:RTN 4-0477 ���'���'�® Fmr.Bradley's Dry Cleaners ' 242 Main St.,Hyannis,MA July 14,2000—Page 2 ' only well MW-2 (existing well) that was below the MADEP Method 1 GW-3 Cleanup Standard. The groundwater classification at the site has changed from GW-1 to GW-3 due to the reclassification of groundwaters in Highly Urbanized Land Use or Populated Areas by MADEP in the late 1990's(Figure 3). ' Based on the June 2000 groundwater sampling results and MADEP groundwater reclassification, it is AET's professional opinion that the Tetrachloroethene (Perc) contamination in the groundwater at the site is below the MADEP Method 1 GW-3 Cleanup Standard (Table 1). Therefore, a condition of No Significant Risk exists in regard to the groundwater and a RAO can be completed for the site. ' 1.1 Statement of Compliance ' This RAO is considered a Class B-1 RAO per 310 CMR 40.1045 (1) and has been prepared in conformance with 310 CMR 40.1000. Class B RAOs apply to disposal sites where it is determined, as a result of assessment, that a level of No Significant Risk exists and therefore, no remedial actions are necessary. All analytical data was collected in conformance with 310 CMR 40.0000 inclusive and any appropriate MADEP guidance documents. 2.0 SITE DESCRIPTION 2.1 Site Description ' The vacant site is approximately 1/2 of an acre in size unpaved in the area of the former building with all other areas covered by asphalt (Figure 2). The property is located in a commercial area of Hyannis, Massachusetts. Municipal water and sewer service the area. 2.2 Critical Exposure Pathways (CEPS) ' According to the Barnstable Board of Health and Environmental First Search maps of Hyannis, MA (Appendix A), no schools, registered daycare centers, hospitals, nursing homes or other facilities of exceptional concern are located within'/4-mile of the subject property. 2.3 Surrounding Receptors According to the Environmental First Search maps, Lewis Bay is located approximately 1,500- ' feet south/southeast of the site, a Public Water Supply Zone is located approximately 700-feet north of the site, and the site is located in a Medium Yield Potentially Productive Aquifer Sole Source Aquifer (Cape Cod). However, according to the October 27, 1999 MADEP BWSC ' RAO:RTN 4-0477 Fmr.Bradley's Dry Cleaners i ' MAtiantic® 242 Main S,Hyannis,MA July 14,2000—Page 3 Priority Resource Map, the site is located in a Non-Potential Medium Yield Drinking Water Source Area(Figure 3). 2.4 Geology/Hydrogeology The site is located along the glacially modified coastal plain of southern Massachusetts (Cape Cod). Site topography is flat, with a surface elevation approximately 30-feet above mean sea ' level (msl). Subsurface soils consist of medium to coarse sand and gravel with high permeability. Depth to groundwater at the site is approximately 22-feet BSG with groundwater flow to the south/southwest towards Lewis Bay(K-V, 1987). 2.5 Groundwater Classification Base upon review of the BWSC Priority Resource Map for Hyannis (Non-Potential Drinking Water Source Area), -depth to groundwater greater than 15-feet BSG, and no residential dwellings within 30-feet of the site, the groundwater at the site is classified as GW-3. Groundwater category GW-3 applies to all groundwater in Massachusetts that could potentially discharge to surface waters. 3.0 IRA RESPONSE ACTIONS No Immediate Response Actions (IRA) were conducted at the site in regard to the Perc contamination initially detected in the groundwater sampling activities conducted in 1987. 4.0 ANALYTICAL DATA ' Groundwater samples collected by AET in June 2000 were submitted to Groundwater Analytical (Groundwater) of Buzzards Bay, Massachusetts, in accordance with applicable MADEP ' protocols and analyzed for Volatile Organic Compounds (VOCs) to better determine groundwater quality (Appendix B). VOC analysis was conducted due to the historic use of the property and groundwater contamination previously detected. 4.1 Historic Sampling Historic assessments within the area of the site have indicated a confining layer at approximately 50-feet BSG. Multiple assessments have been performed on the subject property. These ' assessments have indicated that impacted soil at the site is below all applicable cleanup standards. ' RAO:RTN 4-0477 m Fr.Bradley's Cleaners ' LDLitlanti 242 Main St,Hyannis,MA July 14,2000-Page 4 ' According to information obtain during a site file review at MADEP, K-V conducted groundwater sampling of the shallow aquifer and detected, concentrations of Perc in the groundwater as part of a 1987 site investigation (K-V, 1987). Three wells were installed to a maximum of 24-feet BSG (MW1, MW2, MW3) and sampled with concentrations of 13.5 parts per billion (ppb), 4.5 ppb, and 176.3 ppb recorded respectively (Figure 2). Only MW3 recorded Perc above DEQE reportable standards. K-V soil boring logs noted "no unusual staining or odors" in the soil samples collected during monitoring well advancement. A Soil Vapor Survey conducted by K-V, using a combustible gas detector, in the vicinity of a former 1,000-gallon #2 ' fuel oil underground storage tank (UST), did not record combustible vapors in the five areas surveyed. Furthermore, three soil samples were collected from the area the Cape and Vineyard Electric Co. once stored electrical equipment. Sample results did not record detections of ' Polychlorinated Biphenyls(PCBs) (K-V, 1987). In August of 1996, AET conducted groundwater sampling of the three existing monitoring wells screened in the shallow aquifer. VOCs analysis conducted by Groundwater recorded Perc concentrations of 0.7 ppb, 5 ppb, and 11 ppb in wells MWl, MW2, and MW3 respectively (AET, 1996). At that time, groundwater at the site was classified as GW-1 with a MADEP Perc ' Cleanup Standard of 5 ppb. Therefore, wells MW2 and MW3 were above the MADEP Cleanup Standard of 5 ppb. 4.2 Recent Sampling ' During a site visit on May 25, 2000, AET could locate only monitoring well MW2. On June 13, 2000, AET supervised the advancement of five additional groundwater monitoring wells to better determine groundwater quality at the site and conducted well development according to MADEP protocol (Figure 2). The wells were advanced to varied depths, MW-lA to 45-feet BSG, MW-2A to 35-feet BSG, MW-3A to 25-feet BSG, MW-4A to 35-feet, and MW-5A to 45- feet BSG based on the "sinking" nature of Perc in groundwater. This would allow AET to ' sample the shallow, mid, and deep aquifers above the confining layer (50-feet BSG). Well MW2 (25-feet BSG) was inspected and developed for assessment purposes. On June 20, 2000 AET gauged, purged and collected groundwater samples for Halogenated Volatile Organics from the six monitoring wells. The AET Monitoring Well Sampling Log is ' located in Appendix C. Sampling results are compared to MADEP GW-3 Cleanup Standards in Table 1. Sample MW2 recorded a detection of Perc at 5 ppb, well below the GW-3 Cleanup Standard (5,000 ppb). No other samples recorded a detection of any analyzed Halogenated ' Volatile Organic compounds. 5.0 REMEDIATION WASTE MANAGEMENT No remedial actions/wastes were undertaken/generated at the site in regard to the groundwater contamination which was initially detected in 1987. RAO:RTN 4-0477 leaners t1tlantk 242 Main St.,Hyannis,ey's Dry A ' July 14,2000—Page 5 6.0 RAO COMPLETION STATEMENT/CONCLUSION It is AET's professional opinion that the condition that gave rise to MADEP notification on September 23, 1987 under RTN 4-0477 has stabilized at the site. Groundwater contamination, hazards to health, safety, public welfare and the environment have been eliminated without the ' operation and maintenance of an active remedial system. Furthermore, an Activity and Use Limitation (AUL) is not required to maintain a condition of NO SIGNIFICANT RISK in regard to the groundwater at the site. Therefore, a Class B-1 Response Action Outcome of NO ' SIGNIFICANT RISK has been met pursuant to 310 CMR 40.1045 (1) and that No Further Action is required. Program Overview Groundwater Analytical conducts an active Quality Assurance program to ensure the production of high quality, valid data. This program closely follows the guidance provided by Interim Guidelines and Specifications for Preparing Quality Assurance Project Plans, US EPA QAMS-005/80 (1980), and Test Methods for Evaluating Solid Waste, US EPA, SW-846, Update III (1996). ' Quality Control protocols include written Standard Operating Procedures (SOPS) developed for each analytical method. SOPS are derived from US EPA methodologies and other established references. Standards are prepared from commercially obtained reference materials of certified purity, and documented for traceability. Quality Assessment protocols for most organic analyses include a minimum of one laboratory control sample, one method blank, one matrix spike sample, and one sample duplicate for each sample preparation batch. All samples, standards, blanks, laboratory control samples, matrix spikes and sample duplicates are spiked with internal standards and surrogate compounds. All instrument sequences begin with an initial calibration verification standard and a blank; and excepting GC/MS sequences, all sequences close with a continuing calibration standard. GUMS systems are tuned to appropriate ion abundance criteria daily, or for each 12 hour operating period, whichever is more frequent. Quality Assessment protocols for most inorganic analyses include a minimum of one laboratory control sample, one method blank, one matrix spike sample, and one sample duplicate for each sample preparation batch. Standard curves are derived from one reagent blank and four concentration levels. Curve validity is verified by standard recoveries within plus or minus ten percent of the curve. LB. Definitions Batches are used as the basic unit for Quality Assessment. A Batch is defined as twenty or fewer samples of the same matrix which are prepared together for the same analysis, using the same lots of reagents and the same techniques or manipulations, all within the same continuum of time, up to but not exceeding 24 hours. Laboratory Control Samples are used to assess the accuracy of the analytical method. A Laboratory Control Sample consists of reagent water or sodium sulfate spiked with a group of target analytes representative of the method analytes. Accuracy is defined as the degree of agreement of the measured value with the true or expected value. Percent Recoveries for the Laboratory Control Samples are calculated to assess accuracy. Method Blanks are used to assess the level of contamination present in the analytical system. Method Blanks consist of reagent water or an aliquot of sodium sulfate. Method Blanks are taken through all the appropriate steps of an analytical method. Sample data reported is not corrected for blank contamination. Surrogate Compounds are used to assess the effectiveness of an analytical method in dealing with each sample matrix. Surrogate Compounds are organic compounds which are similar to the target analytes of interest in chemical behavior, but which are not normally found in environmental samples. The law is implemented through regulations known as the Massachusetts Contingency Plan,3 10 CMR 40.0000 et seq. (the"MCP"). Through the MCP, the Department is currently regulating a release of hazardous material that has ' occurred at 242 Main Street, Barnstable, Massachusetts. The Department was first notified of the release on September 23, 1987. The Department does not currently have in its files appropriate documentation indicating that the release is being addressed in the timely manner that is required by the regulations. The Department's records indicate that you are the owner of the property where the release occurred. As the owner of the property, you are a Potentially Responsible Party ("PRP") with potential liability for the release pursuant to Chapter 21E. The liability is "strict", meaning that it is not based on fault, but solely on your status as the owner of the property where the release occurred. This liability is also"joint and several", meaning that you may be held liable for the release and all response action costs incurred at the disposal site regardless of the existence of any other liable parties. The purpose of this Notice is to inform you of your legal responsibilities under State law for assessing and/or remediating the release.
