Dear Ms. Collins:
You are granted permission to add pizza to your menu. A conditional variance
was previously granted by the Board of Health in regards to using a grease
recovery device in Lieu of the required minimum 1000 gallon grease interceptor.
The variance is granted with the following conditions:
(1) A grease recovery device (GRD) shall be installed in accordance
with the State Plumbing Code.
(2) The menu is restricted to pizza and other food items listed on the
submitted menu received December 21, 2004. No other foods may
be served at this site.
(3) The grease waste from the grease recovery device shall be
disposed of properly .
(4) This variance decision letter shall be posted on the wall adjacent to
the food service permit in an easily accessible location for viewing
by an agent of the Board of Health anytime inspections are
conducted.
Recall that you,were also granted temporary permission to install no more than
20 seats at 448 Main Street, Hyannis with the following conditions.
(1) The chairs and tables shall be at least ten (10) feet from the front
sidewalks and other public access ways. Plants, fencing, or some other
marker must be installed to clearly indicate the location of the 10 feet
setback.

(2) Patrons shall have access to the conveniently located bathrooms. Signs
must be installed to indicate the location of the toilet facilities.
(3) Screens shall be provided at all windows and doorways. All other
regulations contained in 105 CMR 590.000: State Sanitary Code, Chapter
X - Minimum Sanitation Standards for Food Establishment and of Town of
Barnstable Board of Health sanitation regulations shall be strictly adhered
to.
(4) Rodent refuse containers shall be provided with tight-fitting lids. This
variance may be revoked anytime unsanitary conditions are observed.
These variances are not transferable, and will be voided if the establishment has
a change of use, change of ownership, or leased to a party other than the
applicant.
