Fire Escape Unit 11 & 12
557& 559 Main St. Hyannis, MA
I have been retained as a Registered Structural Engineer to inspect Unit 11&12 fire
escapes at a property located at 555-559 Main St., Hyannis, MA in accordance with
section 102.2.2.4 of the Massachusetts Amendments to the International Building
Code.The inspection is the result of a letter from the Barnstable Regulatory Services
to AD Realty Trust dated Oct. 9, 2015, item#3.
I visited the site on Nov 30, 2025 with a representative of the owner. The subject fire
escapes are located on the right hand side of the house adjacent to one another and
share a common landing area at the base of the stairs. (photo#1). The fire escape is
constructed of steel members and for the most part appear to be structurally sound.
However,there area feting areas of concern that should be addressed as follows:
1. The landing area (approximately 31/2 ft.x 31/2 ft.at the top of one of the fire
escapes has holes rusted through the metal landing (photos#2,3, & 4).
I recommend a new metal plate be installed on top and tack welded to the
existing landing (photo#2,3, & 4).
2. The common landing at the base of the two fire escapes has similar holes
rusted through (photo #5). I recommend a new metal plate be installed on top ,
and tack welded to the existing landing
3. The railing at the base of one fire escape has become loose and should be tack
welded back into place (photo 6).
4. Once these repairs are made, I recommend both fire escapes be wire brushed
and painted two coats of a good quality rust inhibiting paint to reduce further
deterioration of the steel members.

During our attempt to rectify the discrepancies that were noted in your 5 year inspection of 557-559
Main St,we were unable to successfully identify the cause of issues pertaining to the wall and floor of
unit 1. Our Structural Engineer was unable to access the floor and wall structure without a significant
amount of demolition to the unit_ The current tenant has been served with a notice to vacate within 30
days. After the tenarrt vacates the property the Complete Home Group will take all necessary steps to
identify and repair all issues noted in your report. A D Realty Trust is in the process ofattemptingto
assist the current resident with other living arrangements.

reside,and have found several problems which include structural deficiencies that need
immediate attention.

Multi family 5 year inspection.
On October 6, 2015 the building department performed an inspection according to section
110.7 of the Massachusetts State Building code. During this inspection several
deficiencies where observed that must be addressed immediately.
1) The stairs leading from the second floor of unit 8 must have a proper handrail
installed. The stairs are also unstable and must be braced accordingly.
2) The closet under the stairs outside of unit 9 must be sheetrocked.
3) The fire escape/metal stairs outside of units 11 and 12 must be inspected by a
registered design professional according to section 102.2.2.4 of the Massachusetts
amendments to the International Existing Building Code.
4)A structural inspection of the front wall and living room floor at unit 1 must be
performed either in conjuction with this office or by a structural engineer.
5) The exposed wires in the living room of unit 1 must be addressed.
Please contact this office by October 23 to either apply for the necessary permits or
schedule the inspections addressing these issues.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY
CODE II — MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND THE TOWN OF BARNSTABLE CODE CHAPTER 170.
The property owned by you located at 557 Main Street (Units 8 , 9 11, 12 and 1),
Hyannis, was inspected on October 6, 2015 by Timothy B. O'Connell, R.S., Health
Inspector for the Town of Barnstable. This inspection was conducted in accordance with
the 2006 Barnstable rental registration ordinance requiring yearly inspections of all rental
properties.
The following violations of the State Sanitary Code were observed:
105 CMR 410.503: Protective Railings and Walls:
• The stairs leading from the second floor of unit 8 must have a proper handrail
installed. The stairs are also unstable and must be braced accordingly. '
105 CMR 410.500:* Owner's;Responsibility to Maintain Structural Elements:
• The closet under the stairs outside of unit 9 must be sheet rocked. -
105 CMR 410.452: Safe Condition:

105 CMR 410.351: Owner's installation and Maintenance responsibilities:
• The exposed wires in the living room of unit 1 must be addressed.
You are directed to correct State Sanitary Code violations listed above within
fourteen (14) days of your receipt of this notice.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten(10) days after the date the order is served.
Non-compliance will result in a fine of $100.00 per violation. Each day's failure to
comply with an order shall constitute a separate violation.
Should you have any questions regarding the above violations, please contact the Town
Health Division and ask to speak with the inspector who performed the inspection.

requirements of 105 CMR 123.000 and of 21 CFR 1040.20, proper use of
USFDA Recommended Exposure Schedule, photosensitizing agents such as
foods, cosmetics, and medications that may produce an abnormal or
increased skin sensitivity, skin type determination, recognition of
injuries from overexposure to Uv radiation, manufacturers procedures.

Uv radiation, acute and chronic exposure, biological effects, and health
risks, electromagnetic spectrum with photobiology and physics within the

_ 5. RECORDS : Written statement of warning as described in 105 CMR
123.003(A) (1) handed to each customer each time device is used which is
signed acknowledging that he/she has read and has understood the warning
statement, prior written consent of a parent or legal guardian for
persons 14 to 17 years of age, consent form and accompaniment by a
parent or legal guardian for persons under 14 years of age, records kept
for 12 months for each customers total number of visits and tanning
times, copies of license application and license information.
6. INJURY REPORTS: Submitted to the Board and to the Department with
a copy to the injured person or complainant.
7. SANITATION : Access to toilet and handwashing facilities, liquid
soap provided, paper towels provided, receptacle provided, safe supply
of drinking water provided, towels provided, disinfection of toilet
facilities, disinfection of surfaces in contact with customers,
ventilation provided in each device, interior of facility maintained in
good repair in a safe, clean sanitary condition free from rubbish.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY
CODE II — MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND THE TOWN OF BARNSTABLE CODE CHAPTER 170.
The property owned by you located at 559 Main Street (Unit# 7), Hyannis, was inspected
on November 9, 2016 by Timothy B. O'Connell, R.S., Health Inspector for the Town of
Barnstable. This inspection was conducted in ,regards to a complaint received at the
Barnstable Health Division.
The following violations of the State Sanitary Code were observed:
105 CMR 410.300: Sanitary Drainage System Required: ,
A structural inspection of the manhole which connects said dwelling unit to The
Town of Barnstable sewer system was conducted during this inspection. The
manhole was4illed with rocks, sand and.other debris. These debris are.impeding
required flow to outlet pipe in this manhole.
105 CMR 410.351: Owner's installation and Maintenance responsibilities:
• The fixtures within the bathroom (sink, shower and toilet) do not drain in a
reasonable time.
You are directed to correct State Sanitary Code violations listed above within seven
(7) days of your receipt of this notice by,cleaning manhole with septic vac -truck and
by jetting sewer.lines from dwelling unit to the manhole; by clearing all waste lines
in dwelling unit. .
You may request a hearing before the Board of Health if written petition requesting same
is received within ten (10) days after the date the order.is served. Non-compliance will
result in a fine of$100.00 per violation. Each day's failure to comply with an order shall' .
constitute a separate violation. Should you have any questions regarding the above
violations, please contact the Town Health Division and ask to speak with the inspector

A structural inspection of the manhole which

I met with owner rep at site. He stated line in
house was snaked but sink was still not draining
well.I explained what we needed done at site and
he agreed to relay message to owner. I also
explained if this is not done within a week.Tickets
will be issued.

As of 12-29-16 work has began on manhole
connection.There were multiple delays due to dig
safe snafu's and pre cast ordering of new man
i hole.

On'or around 1-2-17 vac truck had sucked out
l man hole and jetted line from man hole to apt.
Excavator contactor called and said this was
complete and drains should be working. I then
talked with Paul from Hosttereter Co's and he
stated occupant had not be letting maintenance
staff into apt to check if this has solved the
problem.
