HEALTH REGULATIONS, NUISANCE CONTROL REGULATION NO. 1
The property owned by you located at 72 North Street (rear)Hyannis, MA was visited
on May 30, 2013 by Thomas McKean C.H.O., Director of Public Health for the Town of
Barnstable because of a complaint.
The following violations of the Town of Barnstable Board of Health Regulations, .
Nuisance Control Regulation No. l.were observed:
Nuisance Control Regulation No. 1, Part VII, Section 1.00:
Piles of discarded blankets, pillows, loose clothing, backpacks, bags and other debris
observed on the ground beneath the stairwell behind the building. Also there was a foul
odor detected in this area during the investigation.
You are directed to correct the violation by removing all of these discarded items from
the property within twenty four (24) hours of receipt of this notice.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten (10) days after the date the order is served. However, these
violations must be corrected within twenty four hours regardless cf any request for a
hearing.
Non-compliance will result in a fine of$100.00 per violation. Each day's failure to
comply with an order shall constitute a separate violation.
Should you have any questions regarding the above violations, please contact the Town
Health Division and ask o eak with the inspector who performed the inspection.

Dear Mr. Hahesy,
Thank you for your letter dated May 291h regarding the troublesome situation next door to
the Federal Building at North Street. You indicated the area behind 72 North Street has
become a make shift homeless shelter during the daytime hours with people sleeping on
the side of building, leaving their personal belongings under the stairwell, and engaging
in unhealthy activities. You also indicated that there a large amounts of clothing, trash
and other debris underneath the stairwell at the closed restaurant site (former steak
house).
I visited the site on Thursday May 30`h and viewed the piles of blankets, clothes, trash,
abandoned backpacks, and junk which you referred to in your letter. A foul odor
emanated from that particular area. This is clearly a violation of the Town of Barnstable
Code [Nuisance Control Regulation].
An order letter was immediately sent out from this Office to the owner of the property on r
that same day to clean-up and remove the debris from the site. I will follow-up with the
owner next week after he receives the order letter and I will re-check the site.

I am notifying you in writing of what has become an increasingly troublesome situation with 72
North Street in Hyannis. My insurance agency is located next door to 72 North Street in the
Federal Building on the second floor. Since the Steak House restaurant closed earlier this year,
the stairwell located on the side of 72 North Street has become a make shift homeless shelter
during the daytime hours. People have been sleeping on the side of the building, leaving their
personal belongings under the stairwell, doing drugs and drinking alcohol on a regular basis. The
owner of our building has called the police several times to voice his concerns and also to report
several instances that have taken place in this area. The Barnstable PD has responded, but they
continue to tell us that there is not anything they can do and we needed to contact the Board of
Health. I believe your department has already received at least two complaints with this address,
but nothing has been done. Today the situation reached a new low, as two people were engaging
in"sexual activity" on the stairs on the side of the building. The BPD were called and I believe
an arrest was made. Mind you,this was during daytime hours while people were working with
windows facing this direction, not to mention people walking and driving by_
At this point, it is quite obvious that this alley way and stairwell has become very popular with
people who stay at the nearby homeless shelter, If you were to come by this address and see the
large amounts of blankets,'bags, clothes, bottles, cigarettes,trash and junk, you would see for
yourself the despicable condition this area is in. On at least two occasions our mail carrier has
contacted the building owner; Ed Richardi about this situation. He has done nothing about this
area of the property and apparently does not care about this building any longer, as it may be for
sale or lease. If you drive by the building you will see the lawn is overgrown, the paint is
chipping and furniture is still outside on the roof deck bar. Seeing the amount activity we see, it
will only be a matter of time before there is a fire, a fight over property being stolen or worse.
With summer right around the comer,there is no telling how many more incidents we will see at
72 North Street. Since the owner of this building will not do anything, all of us in this building
are hoping your department will step in_ If you would like to discuss this any further, please feel

free to give me a call. As a local business owner and a tax paying citizen, I would like to see
action taken to clean up this building. It pains me every day to look at the view out of my
window. I have witnessed people of all ages doing all sorts of things there. I am aware that there
is a homeless problem in Hyannis and I feel horrible for the people I see on a daily basis outside
of the shelter on Winter Street. However, this stairwell is not the solution to the homeless
problem that has plagued this area.
I hope you take this situation seriously and take action to help. If you are not the person or
department to handle this, please notify the appropriate department and please do it ASAP.

51 OF THE TOWN RENTAL ORDINANCE.
The property owned by you located at 72 North Street, Apt 7, Hyannis, was inspected on June 8,
2004 by David Stanton R.S., Health Inspector for the Town of Barnstable, because of a
complaint.
The following violation of the State Sanitary Code was observed:
105 CMR 410.201: Temperature Requirements: The room temperature was observed at 92
degrees F. The baseboard heater was on, and reading at 132 degrees F. on the surface.
It is also noted that the complainant had some cockroaches in a container that she had caught the
morning of the inspection. It is your responsibility to maintain the dwelling free of insects per
105 CMR 410.550(B) extermination of Insects, rodents, and skunks.
You are directed to correct the violations listed above within twenty four(24) hours of your
receipt of this notice, by turning off the heat, or down so that the room temperature doesn't
exceed 78 degrees F. and is at least 68 degrees F. during the day until June 15,2004.
You may request a hearing before the Board of Health if written petition requesting same is
received within ten(10) days after the date the order is served.
Non-compliance could result in a fine of $100.00 per violation. Each day's failure to comply
with an order shall constitute a separate violation.

complaint.
The following violations of the State Sanitary Code were observed:
105 CMR 410.500: Owner's Responsibility to Maintain Structural,Elements: Windows
were observed broken in the entrance stairwell.
105 CMR 410.500: Owner's Responsibility to Maintain Structural Elements: A hole was
observed in the wall in the entrance stairwell.
105 CMR 410.500: Owner's Responsibility to Maintain Structural Elements: A large crack
was observed in the upstairs bedroom ceiling,with much water damage present.

was observed in the living room ceiling,with much water damage present.

upstairs flooring is very soft.
It is also noted that the complainant stated that cockroaches are present in the dwelling.
Cockroaches were not observed during the inspection; however you are reminded that if they are
present, it is your responsibility to maintain the dwelling free of insects per 105 CMR 410.550(B)

surges occur in the electrical system and the water creates problems with the electrical baseboard
heating. The power surges and heating problems were not observed during the inspection(it was
not raining during the inspection.) You are reminded that you need to maintain the problems free
of defects under 105 CMR 410.351(A) Owners Installation and Maintenance Responsibilities.
You are directed to correct the violations listed above within thirty (30) days of your
receipt of this notice, by repairing the broken windows, by repairing the hole in the wall,
by repairing the leak in the building causing all the water damage, by removing any mold
or mildew caused by the chronic dampness, by repairing all the water damage in the
dwelling, by repairing the cracks in the ceiling and around the bathroom window, by
repairing the upstairs flooring so that it is structurally sound.
You may request a hearing before the Board of Health if written petition requesting same is

Complaint Description: Has eight streams of water running down her
wall in her upstairs bedroom and the streams r�
run down to the wall together. She said it must
be coming from the outside. She said that the
sheetrock and the ceiling was replaced but the
landlord doesn't want to fix the source of the
problem. She said it looked fixed when housing
came to inspect it. The seam of the wall is
moldy. She said the rug smells of mold and the !�
caller said that she's been sick because of the
mold. There are two areas in the floor that are
completely rotted out and the only thing that
keeps people from falling through is the rug. f 1
Where the radiator and the rug meet there is an
orangy rusty colored rubbery scalloped shell
edge fungus growing. She said her bathroom
ceiling looks like a jigsaw puzzle and water
pours through the ceiling there. She said the
landlord says he'll fix the roof but he hasn't.
She said she's forced to sleep downstairs.
She's calling on recommendation of Allison
Reid her housing worker.

The',property owned by you located at 72 North Street; Apt'7, Hyannis, was inspected on July 7,
2004 by David Stanton R.S., Health Inspector for the Town of Barnstable, because of a
complaint: Hyannis Fire, and Bill Amara, Town'Electrical Inspector, also visited site to assess
the situation at the request of the. Health Division. Fran Losi of American General Contracting
(subcontracted by Eric Reno who filed papers and permits) was onsite making the necessary roof
repairs that were causing the leaks into the dwelling as noted on previous order letter.
The following violation of the State Sanitary Code was observed:
105 CMR 410.351(A): Owner's Installation and Maintenance Responsibilities: Electrical
wiring in the ceiling of the bedroom upstairs was observed with a defect. The electrical wiring
insulation had a cut in it.
The following violation of Article 51,the Town Rental Ordinance was observed:
Article 51, Town Rental Ordinance, Section 4-4: Owner's name, address and telephone
number were not posted.
Section 4-4 of the Town Rental Ordinance specifically reads as follows:

(5)'feet of the main entrance'or within five (5) feet of the mailbox(es), at least four(4) feet and
not greater than six (6) feet above ground level, a notice constructed of durable material, not less
k than twenty square inches in' size,bearing his/her correct name, address and telephone number.-If
the owner is a realty trust or partnership,the name, address, and telephone number of the

managing trustee or partner shall be posted. If the owner is a corporation, the name, address, and
telephone number of the president of the corporation shall be posted. Where the owner employs a
manager or agent who does not reside in such dwelling, such manager or agent's name, address,
and telephone number shall also be included in the notice.
You are directed to correct the state violation listed above within twenty four (24) hours of
your receipt of this notice, by hiring an electrician to make the necessary repairs to the
electrical wiring so it meets current standards. You are also directed to correct the town
violation listed above within thirty (30) days of your receipt of this notice, by properly
posting the building as required above by section 4-4 of article 51, the Town Rental
Ordinance.
It is noted that per the phone conversation July 61h, 2004 between Health Director Thomas
McKean, R.S. and Jean Durkin, you would hire an electrician to make the necessary repairs as
soon as possible.
You may request a hearing before the Board of Health if written petition requesting same is
received within ten(10) days after the date the order is served.
Non-compliance could result in a fine of $100.00 per violation. Each day's failure to comply
with an order shall constitute a separate violation.

Dear Mr. McKean:
In response to a letter from you dated June 1,2004, I would like to request another 30 day
extension before your inspection of unit#7 at 72 North Street, Hyannis, MA 02601. The
Building Department finally issued a building permit today, on 7/7/04 to finish the new
roof. Because a new roof had to be completed before all leaking stopped, we need
additional time to address the damage that the roof had caused.
Eric Lino recently completed the new roof and has an appointment with the tenant of unit
#7 on 7/13/04 along with the list of items from your letter dated June 1, 2004. He will be
maintaining the list of problems free of defects as soon as possible.
Please respond in writing as to granting us another 30 day extension for repairs,
seeing as we had to wait for the Town of Barnstable to submit us with a building permit.
Another letter from the Town of Barnstable dated June 9, 2004 in regards to the room
temperature being observed at 92 degrees has been fixed,now that we have access to the
heat controls at Kendrick's. You may have learned that Kendrick Mooney,passed away in
an automobile accident the weekend that the heat was turned up, and we were unable to
contact another key to get to the beat control,which is located in Kendrick's,due to
funeral arrangements with family members and staff. The tenants at 72 North Street tell
me that the heat has been fine since then.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY CODE II
- MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION AND ARTICLE
51 OF THE TOWN RENTAL ORDINANCE.
The property owned by you located at 72 North Street, Apt 7, Hyannis, was inspected on July 7,
2004 by David Stanton R.S., Health Inspector for the Town of Barnstable, because of a
complaint. Hyannis Fire, and Bill Amara, Town Electrical Inspector, also visited site to assess
the situation at the request of the Health Division. Fran Losi of American General Contracting
(subcontracted by Eric Reno who filed papers and permits) was onsite making the necessary roof
repairs that were causing the leaks into the dwelling as noted on previous order letter.
The following violation of the State Sanitary Code was observed:
105 CMR 410.351(A): Owner's Installation and Maintenance Responsibilities: Electrical
wiring in the ceiling of the bedroom upstairs was observed with a defect. The electrical wiring
insulation had a cut in it.
The following violation of Article 51,the Town Rental Ordinance was observed:
Article 51, Town Rental Ordinance, Section 4-4: Owner's name, address and telephone
number were not posted.
