The occupant has been removed and according to the owner,Janice Ford, has taken everything he wants from the property. He now has a no trespassing order against him and is not allowed on site to do any addition cleaning/clearing. You received an order letter from the Public Health Division dated April 3, 2018, directing you to remove various items from the yard. During the hearing, you testified that the landlord is evicting you and plans to increase the rent. You also testified that she failed to provide proper notice to you to inspect the property. This property was viewed on April 2, 2018 by Health Inspector James Parziale, R.S. due to a complaint. On that date, multiple items including broken wooden chairs, toolbox, window air conditioner, wooden rocking horse, plastic buckets, plastic plant containers, wooden headboard, metal shelving, were observed outdoors on the ground at this property. These items were not screened from public view and were not stored within an enclosed structure as required by Section 54-3 of the Town of Barnstable Code. During this public hearing of the Board of Health, the Board voted unanimously to grant you a thirty (30) day extension to remove the broken wooden chairs, toolbox, window air conditioner, wooden rocking horse, plastic buckets, empty plastic plant containers, wooden headboard, metal shelving and various other items. On Friday,I e-mailed Mr. Sochinski at his work to have documentation that I had indeed set an appointment in advance with the tenant, and remind him of our appointment. On my way to the appointment, I picked up the letter marked exhibit A and also an e-mail from Mr. Sochinski in response to my previous e-mail setting up this appointment, exhibit B. Kindly read these letters and you will understand Mr. Sochinski's mind set. The accusation of my breaking and entering are all fiction and totally in Mr. Sochinski's mind. The Barnstable Police will be happy to inform you of his constant complaints with out basis. Please find exhibit C that shows the plumber coming to assess separating water lines, never going near 52 Oak Neck, but in front of 60 Oak Neck. I had to defend myself on a trespass charge from Mr. Sochinski, and it was thrown out of court. The Police officer of the day was there to tell the court, without my asking, how Donald came into the police station and demanded they arrest me. They were quite astounded by his behavior, and told me they would gladly testify to that. Also, I was told not to ever go near Donald Sochinski wilthout police assistance. Exibit D shows the trash that Donald repeatedly has you fine me for,that he was compensated by Judge Reardon in amount $250.00, which was outrageous to me. You need to make him clean up this trash,he was paid to remove it in Sept. 1999. Your own records confirm how Donald removes the posted owners name and address that in required, exhibit E. This is the 3rd time I have bought outlet covers. The outside of the property, as well as the other three houses located there, were repaired and painted last summer-2000. This past Friday, June 8th, we all met at 52 Oak Neck Road. Donald refused to allow the inspector and me inside the house due to a camera I wished to use to take photos of the water damage, if any. He claimed I had enough evidence from Breaking and Entering!! I then asked to see inside the cellar. He again refused because I had my camera. I put it into the car and walked back to Mr. Barry and Mr. Sochinski. Donald tried to grab my brief case,he claimed I must have hidden a camera inside!! All this time he kept telling us our time of 10 minutes was running out. Mr. Barry wanted to call the police, but we didn't know the number. I got my cell phone because Mr. Barry stated, "I hope you don't intend to lock us inside the cellar". At that thought,I told Donald we just wanted to go into the house. He kept stalling for time, and finally said, "This appointment has ended. i i I Zj kA Your 10 minutes are up!" He was extremely agitated, and I was fearful of him as he came towards me aggressively on several occasions. Donald Sochinski went inside his house, put a blanket over the glass on the door, came out and dead bolted one lock, padlocked another lock, and locked the 3rd lock on the front door. Three locks on the front door! The bulk head door was also padlocked with his lock. He removed my lock 2 years ago, and has refused to give me keys to my property. There is something very wrong with this picture. He also harassed at Mr. Barry and threatened court to him! I completely renovated the exterior of the house last summer. Sochinski 52 Oak Neck Road Hyannis,MA 02601 (508) 778-2364 June 10,2001 Re: 52 Oak Neck Road, Hyannis, MA Dear Tom McKean, It has been almost two years since I first called the Board of Health regarding the conditions at 52 Oak Neck Road. The BOH first inspected this house on August 10, 1999. The landlord retaliated against me for calling the BOH by trying to evict me, falsely claiming in court that I did not pay rent. In court it was later shown that she lied when cancelled checks were produced and her case was dismissed with prejudice against her. The document that shows this from Superior Court is attached. This will show that any judgements that Judge Reardon made that she has been telling you about were overturned. The house was again inspected on Sept. 20, 1999. The landlord had made no attempt to make any repairs. Seven citations were issued to the landlord on Sept. 22, 1999. Sometime later the landlord had only supplied a trashcan and posted an index card with her name and address on it. Only these two minor things were done out of the seven citations issued. The landlord repaired none of the major problems that affect the living conditions.After it was obvious to me that the landlord had no intention on repairing the house,I repaired the huge hole in the living room floor, covered the broken and missing window panes with plastic, and fixed the storm windows that were either dangling from the frames or laying around on the ground. The house was inspected again on March 21, 2000 and all of the bad conditions still remained with the exception of repairs that I made. Glenn Harrington told me that criminal charges would be brought against the landlord. In following up I was told that the case was passed on to Jack Gillis who would bring the charges against the landlord. I had called and spoke with Lois Lamba and Jack Gillis and was told to be patient cause these things take time. I called them several times and offered to be a witness and offered evidence that I had. I had not heard anything else from them. The house was supposedly inspected again in Mid July 2000 at my request because-the windows were removed from the house and the exterior paint of the house was sanded. Poisonous lead paint dust blew into the house and contaminated my belongings.Nothing was ever done by the BOH. More on this later. The house was inspected again on April 12, 2001. Many of the same bad conditions still existed and were noted. I had called Ed Barry about 10 times over the last two months and left messages. My calls were returned only twice. Over time I have also called Glenn Harrington many times where my calls were mostly never returned. In between all these inspections I periodically called the BOH to get an inspector to see the house while it was raining so that the roof leaks can be documented.No one ever came. During this whole time,twenty six months now, I had to live with a badly leaking roof, broken and missing windows,garbage in the basement left by prior tenants(I rented this house because I had use of the basement to store belongings), a front door that does not seal shut,holes in the exterior walls that allow the cold air from outside to blow through, house doesn't heat,bathroom sink does not drain, oven doesn't work properly,and no refrigerator supplied that was suppose to be. Why hasn't the Barnstable Board of Health seen to it that these conditions were repaired? Nearly two years after I first called the BOH most of these bad disgusting conditions still exist. Why is that? The landlord told me many times during the early months of me renting this house,that she would be over to make repairs. She NEVER showed up when she said she would. I had taken a lot of time away from work in the past to let her in, and she never showed up. She would then appear on days when she wasn't expected. I was glad that she was there in any case,hoping repairs would get done,but she always had some excuse why she couldn't do anything that day. When I told her about the leaking roof she merely said, "Yeah,the last tenant said that too." Then for a very long time,the landlord wouldn't talk to me and made absolutely no attempt to contact me or to make any repairs on the house. During this time I was waiting patiently for the BOH to enforce it's laws. I found out recently after making some calls that Jack Gillis resigned a long time ago and the charges against the landlord were never followed up on. Glenn Harrington told me that the landlord had told the BOH many times that she was selling the four houses so that she wouldn't be pressured to make the repairs. The whole time that I have lived in this house,the house was NEVER shown to prospective buyers. The house hasn't been listed and no For Sale sign was ever posted.A For Sale sign was put up just recently but oddly not where it would be easily seen from the road but hidden behind cars. I don't believe the owner has any intentions of selling and this has only been another one of her lies to get out of her responsibilities as a landlord. I ' r In May 2000 the landlord hired men to paint all four houses that she owns. The work went on for three months as they only worked one or two days a week. During this time I had always let them have access into the house whenever they needed it. In June,the landlord dropped off three out of the six outlet covers that were needed but without the screws needed for installing the covers.Now she claims that she dropped off all six covers,another lie. The workers removed the storm windows that I had repaired while they worked on the house and since there were interior windows that were missing and/or broken there was nothing to seal the inside from the outside,no screens either.The workers told me that there were actually a total of thirty windows that were broken/missing among the four buildings that the landlord owns. There were eight broken/missing windows in my house alone. Before painting the house they sanded almost all the paint off the house. Since there were many windowpanes missing,much of the paint dust blew into the house. I complained to the men working and it was only after the sanding was completed that they fixed the broken and missing windowpanes. By that time all my belongings were covered with paint dust which I later discovered after having paint samples tested at the State Lab, that all my belongings were contaminated with poisonous lead paint dust. The report from the state lab attached shows 44 times the allowable level of lead. Less then 0.5%is allowable and 21.9%was found in the paint samples. The State Lab even made a special phone call to me to alert me to the extreme levels. While the sanding was being done and blowing into my house,I called the BOH and supposedly Glenn Harrington came to the house while I was not there. The BOH did not take any action. I asked Glenn to do something about this several times and nothing was ever done. I have since called all over the state in search of getting my house cleaned from the poison and I am always referred back to the BOH. The BOH did nothing about the lead poison that has filled my house. Glenn told me it wasn't a problem and just clean it up myself. I since have developed a chronic cough and have trouble breathing. Later in court the landlord presented the exterior painting bill for all four houses as if it was the bill for repairs made to just my house. She attempted to make it look in court that the bill was for making repairs that the BOH required when the bill was really mostly for exterior painting. She was caught lying in court again. In August 2000,the landlord started entering my house while I was at work. I would arrive home at the end of the day and find the door unlocked and open. I called the police several times about this and have changed the locks three times. The police caught her at the house on October 5, 2000. She told the police that she brought a plumber to do work in the house. The so-called plumber was really her boyfriend pretending to be a plumber. No work was done in the house and again I returned home to find the doors left open and unlocked that day. In October 2000 the landlord started calling me again,making appointments and then not showing up for the appointment. Several times I took off from work to let her in and she didn't show up. The only time since the day that I moved into this house that she was legally in my house while I was present was on October 13, 2000. Her appointment was made through the attorneys and she agreed to be there at 7:45am and leave promptly at Sam so that I could leave for work. Her boyfriend arrived about 7:57 and barricaded the driveway with his car and would not move it. The landlord arrived at 8:05am after the time that she was scheduled to leave. Her boyfriend wouldn't move his car and allow me to go to work. Then he started to cause trouble with his wise mouth, so I called the police.After the police arrived I ended up letting her into the house anyway for a short time but she had no interest in repairs that needed to be made. Instead she proceeded to deny and contradict anything that I tried to show her that was wrong with the house. She argued, called me names,proceeded to abuse me, and would not leave when she was asked to. I was one hour late for work. This is typical for the atmosphere and situations that she creates whenever she comes to the house. On November 20,2000, she made an appointment and didn't show up again. I made a long distance phone call at the time that she was suppose to be there in order to document that I was at the house. She has made appointments several times recently and never showed up. She would then show up on a different day and time expecting to get into the house. She would then create a scene and abuse me similar to what was described above. Because the landlord had NEVER shown up when she made an appointment,I have asked her to limit her appointments during non-business hours.Naturally, I understand that a BOH inspector can only come during business so I will be there for the BOH. The landlord is not allowed to take pictures in the house due to court evidence that will be compromised by her doing that. I expect the BOH to also do nothing that will destroy evidence. If the landlord wants pictures,I have many pictures (9 rolls)that I have taken of the house over time. She is welcome to pick what she wants. The landlord is welcome to the house also but I will not tolerate any abuse from her and I expect the BOH to back me up and not expect that I should have to be subjected to her abuse. This landlord is the worst of slumlords,very spiteful and a huge liar. She will say anything. I have watched her do many unscrupulous things over the years and change her stories many times. She has told Glenn Harrington that she completely cleaned the basement from the trash and that the trash remaining is trash I created.After inspecting the trash Glenn found documents of previous tenants that go back to 1964. She convinced Judge Reardon that she cleaned all the garbage and what is left is all my garbage. Why would Reardon give me $200 to remove my own garbage?A different day in court she said that I said that it was alright that she leaves the remaining garbage from the previous tenants.All this and more are recorded in the transcripts from before different judges on i different days. You are welcome to compare them all. The last time that the landlord broke into my house was on April 9, 2001. This time she stole business cards. I am also concerned about Edward Barry.He is treating this as if this is a new claim,and not as if the landlord has been VIOLATING THE LAW FOR TWO YEARS now. He is many steps behind this situation. This is no disrespect toward Ed, but this landlord is a very bad person and I'm concerned whether Mr.Barry is up to the landlord's manipulation. Ed is trying to act like a mediator,but lawyers have tried to resolve this situation with her for two years now,and she is totally unreasonable, gets very irrational and is bent on getting even with me for calling the BOH. It is impossible to deal intelligently with her. The landlord was not cooperative at all for the appointment on Friday June 8, 2001 other then the fact that this was the FIRST time that she ever showed up for an appointment. She would not leave her camera in the car and started the inspection off by arguing and name-calling. She tried to confuse the inspection. When I had the front door open for her and Ed to enter she said "No, let's see the basement first." When we went around the house to the basement door and I unlocked it she said "No, let's go into the house first." She was obviously playing her games again and wasting everyone's time. All the while she was clinging on to a bag very suspiciously which I feared contained something bad. Ed just stood there all confused instead of taking charge and telling her to stop the games. If the landlord had any REAL intent on doing the repairs she would just hire someone to do it. Given the landlord's history of abuse and not showing up for appointments, I do not appreciate that the BOH suggest that I am not cooperative in having to take yet more time off from work for more inspections. I have had to take off from work many many days over the past two years due to this landlord. She knows this and tries to cause as much trouble for me at work as she can by causing me to take off from work as much as she can. I expect the BOH to see through her act. I do not appreciate having to write these long letters in response to the landlord's lies. I have had to write a letter like this many times over the past two years. It takes me a very long time to write these letters and sort through all the evidence that I have. It is very depressing and draining to write these letters and relive the abusive events from the past two years. This letter only describes a portion of all that has transpired in the past two years too. The landlord has not taken care of her responsibility for two years now. The Barnstable Board of Heath has not enforced its laws for two years now. I have been waiting patiently for the BOH to do its job. Do not call me uncooperative on one day two years after the landlord and the BOH has done nothing. Do not expect me to be subjected to repeated abuse from this slumlord, and put my job in more jeopardy as a result of her games. I expect the BOH to do it's job and prosecute this landlord for all her violations,the lies she has told to everyone,and her retaliations toward me for expecting her to live up to her responsibilities and agreements.
