On December l 1,2004 at 6:30 am.the Department of Environmental Protection(the'Department")
received oral notification from Response Environmental Inc.,on behalf of Cape Cod Oil Service Company
a release of 2000 gallons of diesel fuel at the Hy-Lille Cruse dock The fuel delivery person from Scudder
&Taylor Oil Co.had a fatal heart attack while refueling the high-speed ferry,"Gray Lady"owned and
operated by Hy-Line Cruise_ Since Hy-Line persormel were not monitor the rcfuelir,,approximately 45
minutes had passed while fuel was exiting the fuel tank vent and discharging from the ferry directly into
the harbor.
The Massachusetts Oil and Hazardous Material Release Prevention and Response Act M.G.L_
c.21E, and the Massachusetts Contingency-Pl n (the"MCP"), 310 CMR 40.0000,require the performance
of response actions to prevent harm to health, safety,public welfare and the environment which may result
from this release and/or threat of release and govern the conduct of such actions. The purpose of this notice
is to inform you of your legal responsibilities under State law for assessing and/or remediating the release at
this property. For purposes of this Notice of Responsibility,the tens and phrases used herein shall have
the meaning ascribed to such terms and phrases by the MCP unless the context clearly indicates otherwise..
The Department has reason to believe that the release and/or threat of release which has been
reported is or may be a disposal site as defined by the M_C.P. The Department also has reason to believe
that you (as used in this letter, "you" refers to Cape Cod Oil Service Company) are a Potentially
Responsible Parry(a"PRP")with liability under M.G.L. c.21E §5,for response action,costs. This liability

transporter, disposer or other person specified itt M.G.L. c.21T§5. This liability is also"johit and several",
meaning that you may be liable for all response action costs incurred at a disposal site regardless of the
existence of any other liable parties.
1be Department encourages parties with liabilities under M.G.L. c.21E to take prompt and
appropriate actions in response to releases and threats of release of oil and/or hazardous materials.By taking
prompt action, you may significantly lower your assessment and cleanup costs and/or avoid liability for
costs incurred by the Department in taking such actions. You may also avoid the imposition of,the amount

of or reduce certain permit and/or annual compliance assurance fees payable under 310 MR 4.00. Please
refer to M.G.L.c.21E for a complete description of potential liability. For your canvenicnce,a summary of
liability under M.G.L.,c.21E is attached to this notice.
You should be aware that you may bane claims against third parties for damages, including claims
for contribution or reimbursement for the costs of cleanup. Such claims do not exist indefinitely but are
governed by laws which establish the time allowed for bringing litigation. The Department encourages you
to take any action necessary to protect any such claims you may have against third parties.
Cape Cod Oil Company and Hy-Line Cruise Inc.hired Fleet Fmviroamental and Clean Harbors,
respectively_ The predominant wind direction that morning was out of the southwest causing the fuel to
move across the harbor and collect along the Steamship Authority bulkhead for Shp#2,the bulkhead of
the Inn at Hyannis Harbor,and Docks A D of the Hyannis Marina. Recovery of floating oil occurred
within these three areas. More string of absorbent booms were added throughout the morning to control
the floating oil while the tides changed from high (I I am)to low(5 pm). Five vacuum extraction trucks
operated continuously throughout the day at Slip#2 and the docktbulkhead of the Ilan at Hyannis Harbor.
Absorbent pads were placed on top of the floating oil between the slips of the four impacted docks of the
Hyannis Marina. By the next morning,approximately 1100 gallons of oil was recovered using the
vacuum tricks and 300 gallons of oil recovered using absorbent pads and booms(estimated to be 1
vallon of oil per bag of waste generated),.
The Department approved the following response actions in the field as an Immediate Response
Action(IRA):
Deployment of absorbent/containment materials..
• installation of temporary booms_
• Removal of oil contaminated seawater as required..
• Removal and disposal of oil contaminated absorbent media as required_
All Remediation Waste must be properly stored/handled and disposed of within 120 days
from the date of generation per 310 CMR 40.0030.

in addition to oral notification, 310 CMR 40.0333 requires that a completed Release
NotificationForm(BWSC-103, attached) be submitted to the Department within sixty(60)calendar days of
December 11,2004. You must employ or engage a Licensed Site Professional(LSP)to manage,supervise
or acnaally perform the necessary response actions at this site,.
Additional submittals are necessary with regard to this notification including,but not limited to,the
filing of a written IRA Plan, IRA Completion Statement and/or a Response Action Outcome (RAO)
statement. The MCP requires that a fee of$1,200 be submitted to the Department when an IIAO
statement is filed greater than 120 days from the date of initial notification. Specific:approval is
required from the Department for the implementation of all IRAs pursuant to 310 CUR 40.0420.
Assessment activities, the construction.of a fence and/or the posting of signs are actions that are exempt
from this approval requirement,
Unless otherwise provided by the Department, potentially responsible parties ("PRP's") have one
j year from the initial date of notification to the Department of a release or threat of a release,pursuant to 310
CMR 40.0300, or from the date the Department issues a Notice of Responsibility,whichever occurs earlier,
to file with the Department one of the following submittals: (1) a completed Tier Classification Submittal;
(2)an RAO Statement or, if applicable, (3)a Dowromdicnt Property Status. The deadline for either of the
first two submittals for this disposal site is December 11,2005. If required by the MCP,a completed Tier I
Permit Application must also accompany a Tier Classification Submittal.
This site shall not be deemed to have had all the necessary and required response actions taken
unless and until all substantial hazards presented by the release and/or threat of release have been eliminated
and a level of No Significant Risk exists or has been achieved in compliance with M.G-_L. c..21E and the
MCP.

Fire Alarm rec'd a report from Harbormaster's Asst. Joe Gibbs of a possible oil spill at the Bismore Park
Docks in the area of the Hyline docks. Mr. Gibbs rec'd this inof via phone and was not on site. I responded:-
in C-802. As I arrived on scene HyFD Fireboat 808 also arrived as well as HE-tYbormaster's Asst. Gibbs.
We investigated and found a spill contained in the Hyline dock area with Hyline employees, Harbor
Master's asst's and the Driver of a Riedell Oil Co truck (Mr. Robert Davies) using spill pads and booms '£
from the truck and the Harbormaster office to contain and pickup a diesel oil spill. the estimated quantity
is between 1 to 3 gallons of product. Boat 808 firefighters joined in the effort to recover as much oil as
possible. We also found oil in the water and on the bulkhead in the Town transient dock area. Pads and
Pink water was deployed here to clean up this spill.
I spoke with the driver and Harbormaster's assistant on scene and learned the following;
The Riedell truck operator was fueling the vessel "Nansea" from Centerville at the transient dock. The
driver/operator Rober Davies stayed with the truck and the boat operator used the fueling nozzle to fuel
with. Upon completion of the fueling operation the boat operator sign ed the required paperwork, and paid u£
the docking fee to the Harbormaster's Asst. he then tossed the nozzel up on the bulhead ( apparently.
causing the small spill in the parking lot. He told the Harbormasters Asst that he had spilled a gallon or so"
of fuel in the harbor. He then left and another vessel was allowed to tie up at the transient dock to fuel.
The truck driver seeing the small spill in the lot, and learning of the spill in the water refused to fuel this
vessel until he could clen-up the spill. HyFD notified the USCG MSO Cape Cod, and Harbormaster'a Asst
Gibbs notifed the Town Board of Health. There was no response from either agency.
We were able to clean up as much product as possible. The driver of the oil truck took all of the dirty pads
and booms for disposal. HyFD utilized pink water to treat the residual oil on the bulkhead and on the
Hyline float (where dirty pads had originally been placed prior to buckets becoming available. Hyline (M.
DeMar w'a tino) �made awre of the spill and the remaing sheen that was not able to be cleaned up. All
agencies albare d die scene. Reidell Oil Co. was given permission.by HyFD and the Harbormasters to resume '
fueling operations

RECEIVED A CALL FROM HY-LINE CRUISE LINES AT 22 CHANNEL POINT ROAD REPORTING AT THE BULKHEAD
AT HYANNIS HARBOR IN THE AREA WHERE THE HY-LINE BOATS ARE DOCKED A CONSIDERABLE FUEL SPILL.
RESPONSE ENGINE 822 ONLY WITH MYSELF AND FIREFIGHTERS SIMKINS AND BLACK.
UPON ARRIVAL AT THE OCEAN STREET DOCK SOUTHWEST CORNER,BEGAN INVESTIGATING A SHEEN
COVERING THE TOP OF THE WATER WITH A RAINBOW EFFECT TO IT.THIS SHEEN WENT OVER PAST THE DOCK
MASTER'S OFFICE AND ACCORDING TO THE CAPTAIN OF THE GREY LADY II OUT IN HYANNIS HARBOR TO
ABOUT RICHARD SCUDDER'S HOUSE AT THE END OF CHANNEL POINT ROAD.AT THIS TIME THROUGH THE FIRE
ALARM OFFICE I REQUESTED A CHIEF OFFICER,THE UNITED STATES COAST GUARD MARINE SAFETY OFFICER,
AND ALSO THE TOWN OF BARNSTABLE HARBOR MASTER.
RESPONDING FROM THE REQUEST:HYFD DEPUTY CHIEF MELANSON,FROM THE US COAST GUARD MSO JASON
WISHART.FROM THE TOWN OF BARNSTABLE HARBOR MASTER'S OFFICE.THE ASSISTANT HARBOR MASTER
ERIC SHUFELT.ALSO THE DEPUTY REQUESTED THE BOARD OF HEALTH AND KORIN SCHEIBLE OF THE HEALTH
DEPARTMENT RESPONDED TO OUR LOCATION.LOW TIDE WAS AT 0836 HRS.
AFTER BEING ON THE LOCATION WE STARTED TO GET A BLACK OIL WITH SOME SLUDGE AND SEAWEED
SOAKED WITH OIL UP AGAINST THE HY-LINE BOATS THAT ARE DOCKED.THERE WAS ALSO A BROWN SLUDGE
AND WHAT APPEARED TO BE TOILET PAPER COMING IN WITH THE DARK BLACK OIL.WE USED A BAG OF
ABSORBENT PADS AND PIKE POLES AND TRASH HOOKS AROUND THE BACK OF THE HY-LINE BOATS AND
WERE ABLE TO RECOVER MOST OF THE SLUDGE.WE ALSO SCOOPED UP WHAT APPEARED TO BE A SEA CLAM
THAT HAD THE BLACK OIL ON IT.
THE COAST GUARD TOOK SAMPLES OF THE SLUDGE AND ALSO SAMPLES OF THE FUEL SHEEN.THE COAST
GUARD MSO,THE HARBOR MASTER,AND THE BOARD OF HEALTH WILL BE DOING A FOLLOW UP
INVESTIGATION ON THIS INCIDENT.THE COAST GUARD REPLACED THE PADS WE USED,AND THE HARBOR
MASTER IS HANDLING THE DISPOSAL OF THE THREE BAGS OF PADS WASTE SOAKED(VIA CLEAN VENTURES
I SPOKE WITH THE REPORTING PARTY KERRY EGAN OF HY-LINE 778-0404 EXT.220. SHE STATES THAT THE
CAPTAIN OF THE GREY LADY II VIA RADIO REPORTED FINDING THE SPILL AS THEY WERE LEAVING ON THEIR
FIRST RUN TO NANTUCKET,MS.EGAN CALLED THE FIRE DEPARTMENT RIGHT AWAY.WE RECEIVED THE CALL
AT 0637 HRS.DEPUTY MELANSON ALSO HAD LIEUT.HUBLER OF FIRE PREVENTION OFFICE COME DOWN AND

Dear Mr. Hutchinson:
Enclosed you will find a non-criminal ticket for$75.00 for disposing of hazardous waste,
seven 20-lb. propane tanks, at the Town of Barnstable Ocean Street docks on Monday,
May 19, 2003. This is a violation of the Town of Barnstable's Article XXXXIX: Control
of Toxic and Hazardous Materials.
Enclosed also is a bill payable to the Town of Barnstable-Solid Waste Division for the
costs incurred in the disposal of seven(7)propane tanks. The total bill for disposal costs
are $54.96.
The propane tanks came from your commercial fishing vessel known as the "Courier".

On May 19, 2003 at approximately 1:05 pm Donna Miorandi, RS, Health Inspector for
the Town of Barnstable was called by the Hyannis Fire Department to respond to a
hydraulic oil spill at the Ocean Street Docks.
Hyannis Fire Department was on the scene along with Bob Lovell and Mike Perry of
Barnstable DPW. While I was on the scene with them some people walked over towards
us and just started dropping propane tanks. They left 7-201b. propane tanks in all. It
shocked all of us that someone would actually do this and expect that someone else
would just clean it up. Harbormaster, Marty Flynn, came over at that time and told us
that the propane tanks came off of the vessel named the Courier and that it had left to go
to Gloucester.
Donna Miorandi had Harbormaster, Dan Horn, check the records for the ownership of
this vessel. Upon receiving that information we sent Ms. Heather Soininen, owner of
record, a ticket for violating the Town of Barnstable's Toxic and Hazardous Materials
Regulation. The ticket was for$75.00 and we also sent them the bill for disposal of the
propane tanks at the landfill.
