Based on the results of that inspection,the Barnstable Health Department finds that the dwelling is unfit for human habitation. Pursuant to M.G.L c. 127B and 105 CMR 410.831 (D),the Health Department further finds that the conditions within the dwelling life or health of the occupants such that the danger to the 1 ants of the subject dwelling is so P are s immediate that no delay may be permitted in making this finding. The following violations of 105 CMR 410.00, State Sanitary Code II: Minimum Standards Of Fitness For Human Habitation were observed: 105 CMR 410 750 Conditions Deemed to Endanger or Impair Health or Safety (I) "Failure to comply with any provisions of 105 CMR 410.600,410.601, or 410.602 which results in any accumulation of garbage,rubbish,filth or other causes of sickness which may provide a food source or harborage for rodents, insects or other pests or otherwise contribute to accidents or to the creation or spread of disease. There was a large accumulation of garbage, rubbish, filth and other causes of sickness present at the location, including large amounts of human feces. There was a large amount of flies also present at the said location. Based upon these'fmdings any and all occupants are hereby ordered to vacate and the landlord/owner is ordered to secure the subject dwelling within 48 hours of receipt of this order. Actions Taken/Results: SW investigated complaint. Meals on Wheels called Hyannis Fire worried because no one answered door for food delivery. Hyannis Fire and Barnstable Police responded to find both tenants, William Branton and Marjorie Durkin in house which was in extreme neglect. Human and cat feces and urine on floor throughout house, un-countable number of oversized fruit flies everywhere. Entire house filthy. Tenants have been roomates for 8 years. Mr. Branton is 70 years old and Ms. Durkin 55 years old. Both are in poor health with Mr. Branton mostly confined to a bed and Ms. Durkin in use of a walker. Ms. Durkin states she is an EMT and takes care of Mr. Branton, but it appears she is possibly dilusional and is not telling the truth. Lt. Rick Knowlton of Hyannis Fire informed the ' tenants that Elder Services would be called regarding the condition of the house. Animal Control was on site to remove the cat. Original call was.for two overdosed,victims at residence... Upon arrival, there were.no overdosed people, it was made up by the caller. The older gentlemen was in a state.of confusion. The removed the people against there will to the hospital. The house was unsanitary,with feces all over the house. There was a small dog present that was the major cause of this. There were also a lot of small flies. The feces were tracked all over the house, and smeared into the bed. There were.several diapers from the older gentlemen lying around throughout the house. Actions Taken/Results: Residents were taken to the.hospital against their will at the discretion of the rescue team. Social services was being contacted to assess. the.situation. The.son of the gentleman.was contacted to take care of the dog. Craig from the fire department was onsite,.as well as officer Haggerty to take the report. Photos were taken by the police department.
