The residents of the adjacent housing buildings are concerned about the smell of the dredge; the large quantity of dredge, the exhaust from the heavy equipment in the small low lying lot, and what exactly is in the dredge spoils, that has not been tested since 2009. The conditions required in the WQC state that: "the amount and location of the dredged material at the property of 77 Pleasant St. shall be recorded in the deed with the Registry of deed or the land court." Also, Mr. Kurker is required"to provide written confirmation that the BOH has been notified of his activity"-we have no evidence that either of these conditions have been met. Moreover, the unfortunate location of the dredge material adjacent to the Barnstable housing apartments raises some environmental justice issues, since Mr. Kurker purchased the property in 2011 and began dumping the dredge there shortly there after, instead of using the originally proposed dumping sites. Is there any way we can help the residents of the housing apartments to reduce the impact of the large qu4ntly of sediment being placed right under there noses? I just received an anonymous complaint for 77 Pleasant Street, Hyannis. The caller stated that the owner is in the midst of a construction project and has been bringing in large amounts of fill. She is concerned that the fill contains oil and other hazardous materials. She is also concerned that there is a large puddle of standing water in his backyard. I will be sure to enter this complaint as soon as the system is back up, that way you can update it with your findings. Fred also explained that Tom Perry had inspected the site and there should not be a zoning issue, He recommended I call DEP.Called DEP and spoke with Mark Dakers(508-946-2847)who recognized the project at Hyannis Marina(Wayne Kurker.) He said he would check on the size of proposed dredging (less than 100 cubic yards less permitting required)and check if appropriate permitting Citizen Web Request Page 2 of 2 had taken place for the disposal which would be included in 401 certifications.Also, possible Chp.91 involvement-Mark said he would speak with Tina Davies(DEP)to see. I expressed concern about the quality of the dredged soil due to the oil spill at Hyannis Marina in 2010/2011. Mark said under 401 there would be testing of the material to be dumped. 2PM-Carlos at DEP returned call-. the water Quality certificate did not seem to list 77 Pleasant St.as a dumping site...he will further research permits and call Kurker. Monday 3:30 PM visited site-77 Pleasant St. Hyannis.There was a slight sediment odor and lots of fill-aprox 7-10 ft high covering 3/4 of old parking lot. Received call from DEP and Kurker saying that there is an amended water quality certificate with approval to dump at 77 Pleasant Street will be forwarded to me. 5/2/12 Meet at site with regulatory staff and reviewed amended certificate. Odor does not constitute"Nuisance"at this time and fill may be preventing erosion of banking. Kurker's work crew,who are distributing fill,seem to be doing an appropriate job. However,stipulations of the amended Certification have not been followed. Mr. Kurker was to"Provide written confirmation that the Barnstable Board of Health has been notified regarding the placement of the dredge material at 77 Pleasant St." Such a document has not been found in the street file or is not known about by any staff or the director of the Health Division.I left a message with David Hill at Lakeville DEP(I also have concerns of the health conditions of the building on the property. Robin has already asked the Health Inspectors to do a rental inspection and it is in the works.)Called resident(Diane Schmitz and Sandy Perry Admin. of Housing at 100 Old Colony),to update them on the situation.They said the smell comes and goes,and they are glad we are following up on the situation. 5/4/12 Received e-mail from DEP (Dave Hill)who will forward our concern about non-compliance with WQC amend ment,conditions to Ken Chin in Boston who oversees WQ Certification projects. Spoke with Ken Chin on 5/10/12 he will follow up on conditions of WQ certificate and review if dredge from Marina has been retested after oil spill. New dredging and placement will not happen until next year if it is approved by the DEP. As requested,attached is the Water Quality Certification(W208196)-Amendment#1 to Dockside Marine c/o Wayne Kurker of Barnstable,to allow dredge disposal at 77 Pleasant Street,Hyannis. Read through it to make sure he has complied administratively and let my colleague David Hill know if not(he is in the cc:above and is the Ch91 analyst for Barnstable). Our WQ Cert reviewer is on vacation and may have already received the information David Hill will be in tomorrow to review the case. That Chapter 91 License 12880 contains conditions directing the dredge spoil to be disposed of at an approved site,which seems to be satisfied by the attached Amendment(aside from Administrative issues). I am not sure how much material was proposed or has been placed there,however,a requirement of the authorizaitons for 77 Pleasant Street require that information. Mr.Kurker has stated that today was his last day to dredge and that he'll try to meet with you or a representative from the Board of Health onsite to see if an oder problem exists and it was my understanding that if this was the case he'd look to your office for advice on eliminating it. Mark Dakers who forwarded your information to me informed me that he also spoke with Mr.kurker and he gave him your phone numbers. Mr.Kurker did inform me that he didn't notice anything out of the ordinary,aside from the what you would normally expect from dredged intertidal sediment(my words). As requested,attached is the Water Quality Certification(W208196)-Amendment#1 to Dockside Marine c/o Wayne Kurker of Barnstable,to allow dredge disposal at 77 Pleasant Street,Hyannis. Read through it to make sure he has complied administratively and let my colleague David Hill know if not(he is in the cc:above and is the Ch91 analyst for Barnstable). Our WQ Cert reviewer is on vacation and may have already received the information David Hill will be in tomorrow to review the case. That Chapter 91 License 12880 contains conditions directing the dredge spoil to be disposed of at an approved site,which seems to be satisfied by the attached Amendment(aside from Administrative issues). I am not sure how much material was proposed or has been placed there,however,a requirement of the authorizaitons for 77 Pleasant Street require that information. Mr.Kurker has stated that today was his last day to dredge and that he'll try to meet with you or a representative from the Board of Health onsite to see if an oder problem exists and it was my understanding that if this was the case he'd look to your office for advice on eliminating it. Mark Dakers who forwarded your information to me informed me that he also spoke with Mr.kurker and he gave him your phone numbers. Mr.Kurker did inform me that he didn't notice anything out of the ordinary,aside from the what you would normally expect from dredged intertidal sediment(my words). Conservation does not have jurisdiction over the disposal of the waste, because it is not being dumped in a wetland. Fred also explained that Tom Perry had inspected the site and there should not be a zoning issue. He recommended I call DEP. Monday 3:30 PM visited site777 Pleasant St. Hyannis.There was a slight sediment odor and lots of fill-aprox 7-10 ft high covering 3/4 of old parking lot. Received call from DEP and Kurker saying that there is an amended water quality certificate with approval to dump at 77 Pleasant Street will be forwarded to me. 5/2/12 Meet at site with regulatory staff and reviewed amended certificate. Odor does not constitute"Nuisance"at this time and fill may be preventing erosion of banking. Kurker's work crew,who are distributing fill, seem to be doing an appropriate job. However, stipulations of the amended Certification have not been followed. Mr. Kurker was to"Provide written confirmation that the Barnstable Board of Health has been notified regarding the placement of the dredge material at 77 Pleasant St." Such a document has not been found in the street file or is not known about by any staff or the director of the Health Division. This listing is composed of those items which are deemed to always have the potential to endanger or materially impair the health or safety, and well-being of the occupants or the public. Because Chapter II, 105 CMR 410.100 through 410.620 state minimum requirements of fitness for human habitation, any other violation has the potential to fall within this category in any given specific situation but may not do so in every case and therefore is not included in this listing. Failure to include shall in no way be construed as a determination that other violations or conditions may not be found to fall within this category. Nor shall failure to include affect the duty of the local health official to order repair or correction of such violation(s) pursuant to 105 CMR 410.830 through 410.833 nor shall failure to include affect the legal obligation of the person to whom the order is issued to comply with such order. (A) Failure to provide a supply of water sufficient in quantity, pressure and temperature, both hot and cold, to meet the ordinary needs of the occupant in accordance with 105 CMR 410.180 and 410.190 for a period of 24 hours or longer. (B) Failure to provide heat as required by 105 CMR 410.201 or improper venting or use of a space heater or water heater as prohibited by 105 CMR 410.200(B) and 410.202. (C) Shutoff and/or failure to restore electricity or gas. (D) Failure to provide the electrical facilities required by 105 CMR 410.250(B), 410.251(A), 410.253 and the lighting in com- mon area required by 105 CMR 410.254. (E) Failure to provide a safe supply of water. (F) Failure to provide a toilet and maintain a sewage disposal system in operable condition as required by 105 CMR 410.150(A)(1)and 410.300. (G) Failure to provide adequate exits, or the obstruction of any exit, passageway or common area caused by any object, including garbage or trash, which prevents egress in case of an emergency 105 CMR 410.450, 410.451 and 410.452. (H) Failure to comply with the security requirements of 105 CMR 410.480(D). (1) Failure to comply with any provisions of 105 CMR 410.600, 410.601 or 410.602 which results in any accumulation of gar- bage, rubbish, filth or other causes of sickness which may provide a food source or harborage for rodents, insects or other pests or otherwise contribute to accidents or to the creation or spread of disease. (J) The presence of leadbased paint on a dwelling or dwelling unit in violation of the Massachusetts Department of Public Health Regulations for Lead Poisoning Prevention and Control, 105 CMR 460.000. (See M.G.L. c. 111 @@ 190 through 199.) (K) Roof, foundation, or other structural defects that may expose the occupant or anyone else to fire, burns, shock, accident or other dangers or impairment to health or safety. (L) Failure to install electrical, plumbing, heating and gas-burning facilities in accordance with accepted plumbing, heating, gas-fitting and electrical wiring standards or failure to maintain such facilties as are required by 105 CMR 410.351 and 410.352, so as to expose the occupant or anyone else to fire, burns, shock, accident or other danger or impairment to health or safety. (M) Any defect in asbestos material used as insulation or covering on a pipe, boiler or furnace which may result in the release of asbestos dust or which may result in the release of powdered, crumbled or pulverized asbestos material in violation of 105 CMR 410.353. (N) Failure to provide a smoke detector required by 105 CMR 410.482. (0) Any of the following conditions which remain uncorrected for a period of five or more days following the notice to or knowledge of the owner of said condition or conditions: (1) Lack of a kitchen sink of sufficient size and capacity for washing dishes and kitchen utensils or lack of a stove and oven or any defect that renders either inoperable. (2) Failure to provide a washbasin and shower or bathtub as required in 105 CMR 410.150(A)(2) and 410.150(A)(3) or any defect which renders them inoperable. (3) Any defect in the electrical, plumbing or heating system which makes such system or any part thereof in violation of generally accepted plumbing, heating, gasfitting, or electrical wiring standards that do not create an immediate hazard. (4) Failure to maintain a safe handrail or protective railing for every stairway, porch balcony, roof or similar place as required by 105 CMR 410.503(A)and 410.503(B). (5) Failure to eliminate rodents, cockroaches, insect infestations and other pests as required by 105 CMR 410.550.
