Right after the fire there were homeless people living in the basement, the tenants are concerned they will show up again and are concerned for rodents entering.The old cesspool is filled with dirt and dug down 3 feet, and there are bricks, construction, and old fencing sitting on top of the hole. One of the doors going into the property is lockable, but the tenants do not have the key for it. The following violations of 310 CMR 15.000, the State Environmental Code, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage and the Town of Barnstable Code were observed: 310 CMR 15.303(1) (a): Septic system is in hydraulic failure. Raw sewage was observed ponding on the ground Town of Barnstable Code 4 353-9, Discharge of sewage onto the ground. } (1) You are directed to keep the on-site sewage disposal system pumped as many times as necessary(daily if needed)to keep it from overflowing onto the ground. 310 CMR 15.354: Abandonment of Systems: Cesspool present at said location. You are directed to correct the violation listed above within thirty (30) days of your receipt of this notice by obtaining a septic abandonment permit from the Town of Barnstable Health Department and properly abandoning the septic system. As a result of the current conditions inspectional services was notified. A follow-up inspection of both buildings was performed on the afternoon of Feb. 28, 2018. Although it is apparent that the rear building, having suffered direct fire damage is in no condition to be occupied, what was not immediately apparent was the condition of the front building. This dwelling also suffered some damage as it is located in close proximity to rear of the 1 story building accessed through Spring St. Inspectors were advised that the occupants of this building were relocated to a motel, however it was determined that the tenant in the first floor unit was still in residence there accompanied by several relatives and a baby. We found the interior access to the 2"d floor to be impeded by several locking mechanisms, one of which was difficult to operate. Staff found the second story to be an independent rental unit containing 4 bedrooms, 2 baths and a kitchen. The former garage was converted into a workshop and is currently rented independently of the tenants for a commercial use. The subject property is located in the SF—single-family zoning district governed by Chapter 240 Section24.1.4 of the Town of Barnstable zoning code. 1 The following items were identified and must be addressed: The Single-Story Dwelling The former living room/den in the single-story dwelling was converted into a bedroom without proper permits and the corresponding required upgrade to fire prevention provisions. This unit operates as an unlicensed-unpermitted lodging house containing 4 adult occupants and at least one child. Two-Story Structure Building permit#33537 dated 3/1/1990 was issued for a 2nd story addition containing 4 bedrooms and 2 baths. The original floor plan is on file. Staff found this structure to be operating as duplex with 2 complete and segregated units on first and second floors. The dwelling must be returned to a single family home by obtaining a building permit to restore it according to the original design and permitted floor plan. A licensed plumber and electrician will be necessary in order to cut and cap the utilities on the second floor in the kitchen. All utility connections must be rendered non accessible with a finished wall. Locking mechanisms located on the 15t floor kitchen door must be removed to restore access and flow to the single family structure. The garage space is required to be finished in accordance with the building code as directed by Local Inspector Jeff Lauzon and its use must revert back to storage for the residents of the single family dwelling. We found tenants using a multi burner hot plate in the former kitchen area.The tenant using it agreed to stop. Appears to be an internal dispute among second floor tenants. Mr. Hodgson (508-737-3358) admitted to subletting rooms on the second floor after other tenants left. It appears that the total number of tenants in the building has not changed. The back of the building is still fire damaged from the February fire and one window is still boarded up.Tenants complain of rain water entering the building on the first floor.The attempt at a wooden handicap ramp on the South side of the building is falling apart and suffering from water damage. Indications are that no separation work has been done in the work shop (though we could not access it) and the interior window separating the shop from the back egress corridor/stairs is still in place. The single family one story building located immediately to the rear of this structure is still fire damaged and unsecure. There are piles of debris in the yard as well as a large roll of dumpster filled with debris.There has been no activity here for a while.The sheet rock has been removed from this structure so it remains as a unsecured pile of tinder.
