Your recent hazardous materials inspection conducted at my place of business
made some findings that are in error.
Each and every instance of a violation was perpetrated in.the bay next to mine
which is controlled by DC Utilities and a Mr. Scott Cond.inho. The only infraction we can
agree on is the non-placement of A workplace notice. Which,is currently being rectified.
Otherwise we are not in violation nor do we need to apply, fill out or corespond,
with any regulation that you suggest or mandate in your letter dated to me April 28, 2005.
I ask that you make note of this letter and act accordingly.

Dear Mr. Boyle:
Thank you for your time and'cooperation during the hazardous materials inventory and site visit
at King's Coach on April 27, 2005. This letter contains information from that visit that will help
you become compliant with Chapter 108 of the Town of Barnstable Ordinance: Hazardous
Materials.
Enclosed are copies of the Chapter 108: Hazardous Materials ordinance,an application for permit
to store and/or utilize 111.gallons or more of Hazardous Materials, a copy of the Toxic and
Hazardous Materials On-Site Inventory form from the visit to your business, and a copy of a
contingency plan. Please note the problems identified at your place of business during the
hazardous materials inspection and their corresponding orders or recommendations listed below: .
PROBLEM:
• King's Coach is in violation of Section 108-9 of Chapter 108: Hazardous Materials,
which states, "The release of any hazardous materials and/or acutely hazardous materials
upon the ground, or into any surface...within the Town of Barnstable,is prohibited."
• There was a spill of oil located in the garage adjacent to the"service"garage. An open
container of oil was lying in the puddle as a result of it being tipped over.
• Observations of stained concrete from small releases throughout the garage area.
ORDER:
• Section 108-5(B)of the Town of Barnstable General Ordinance states, "Provisions shall
be made to contain the product(i.e.hazardous materials)in the case of an accidental
release."
• Plan and conduct staff training in hazardous materials identification,handling,personal
protective equipment(PPE)and proper spill response.
• Obtain a spill kit that is easily accessible to all staff members in the event of a spill or
release.
• Place used materials from the spills or releases(i.e. speedy dry)in an approved container
and label as"Hazardous Waste".
PROBLEM:
• The 55 gallon drum of waste oil is not labeled as Hazardous Waste.
ORDER:
• Label all waste drums with"Hazardous Waste"and the contents of the drum(i.e."Waste
Oil").
• Dispose of the hazardous waste through a licensed hauler. Failure to remove and dispose
of in accordance with the Massachusetts Hazardous Waste Management Act could result
in costly fines. (Refer to Chapter 108-5(C).Storage controls).
PROBLEM:
• A plastic funnel was inserted into the opening of the waste drum. Around the funnel was
an oily rag to catch spills or releases. This is a fire hazard and in violation of the Town of
Barnstable General Ordinance Section 108-5(B)which states,"Provisions shall be made
to contain the product(i.e.hazardous materials)in the case of an accidental release."
ORDER:
• Obtain absorbent pads to place on the top of and around the bases of the drums to
prope bsorb the spills or releases.
PROBLEM.-......
CU� There were en or uncapped:contamers being improperly stored throughout the
servicing ar s. This violates the Town of Barnstable General Ordinance,Chapter 108:
Section 10 -5(C) Storage Controls.

ORDER:
' • Keep hazardous and flammable materials stored in capped containers. This is
re mended for health reasons as well as fire hazard prevention.
PROBLEM:
___ • Housekeeping in the "storage rooms"is unsatisfactory.
ORDER:
• Housekeeping is a controllable expense. The easier it is to get around your facility,the
less of a chance for you to experience a worker's compensation claim.
• Clean areas in your storage rooms and keep all materials off the floor. This will prevent
possible slips and falls.
• All hazardous materials should have a home. Keep all flammables in a metal fire proof
cabinet; keep all oxidizers away from heated areas.
PROBLEM:
• Two cylinder tanks are sitting kept unchained in the"storage garage"
ORDER:
• You must chain these cylinder tanks to prevent them from tipping and causing a leak or
an explosion.
ROBLEM:
;�� • Used shop rags are being stored in a cardboard box.
ORDER:
• Used shop ra s must be picked up and stored in a metal container with a lid at all times.
Containing y ur shop rags properly can prevent a fire hazard. I recommend you have
rags r ycled by Unifirst.

• No Mat rial Safety Data Sheets on location.
ORDER:
• Please o tain Material Safety Data Sheets immediately for all hazardous materials stored
on site.
• The terial Safety Data Sheets shall be made available upon request of the Health
De ment and/or the Fire Department. See Chapter 108: Section 108-4(B).

On Site Inventory Total
The Toxic and Hazardous Materials On-Site Inventory from April 27, 2005 shows that you have
approximately 174 gallons of toxic and hazardous materials being used, stored, generated and
disposed of at King's Coach, 86 Ridgewood Ave,Hyannis(Please see enclosed Toxic and
Hazardous Materials On Site Inventory sheet).
The Board of Health has determined that the using, storing, generating and disposing of over 111
gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain
an annual Hazardous Materials License. This license should be purchased within the next 30
days from the Town of Barnstable Town-Offices;200 Main Streets Hyannis,MA 02601
(application enclosed).
Please refer to the Town of Barnstable General Ordinance: Chapter 108, Section 6 (A-H). A
Contingency Plan must be submitted with your license application. Reviewing your contingency
plan for hazardous materials spills and related emergencies (and its location throughout the store)
is highly recommended at this time.
Why are these recommendations being made for King's Coach?
• This information is intended to educate you, a business owner/operator in the Town of
Barnstable,in order to keep your business operations in compliance with local, state and
federal toxic and hazardous materials laws so that you can avoid future regulatory
problems.
• Complying with the Hazardous Materials ordinance (Chapter 108)can prevent
contamination of Barnstable's existing and future drinking water supply,prevent
environmental contamination which can bankrupt site owners, lower or destroy land
values, drive out residents and industry,depress local economies and endanger public
health.
A representative from the Public Health Division will re-visit your business during the next
30 days as a follow up to further advise you on your compliance. If you have any questions
about these problems;the orders and recommendations, or you need further information,
guidance or assistance,please do not hesitate to contact the Public Health Division.

This letter is to inform you in advance of an upcoming re-visit to your establishment by the Town
of Barnstable Health Department,Hazardous Materials Specialist. The purpose of coming to
your business is to take inventory of all hazardous materials stored,generated,handled and
disposed of on-site. The previous inspection that was performed on April 27, 2005,by Alisha _ -
Parkef,Ilk zardousMWrials Specialist;has.been voided and"removed fromm'you business files
due to the fact that all the areas inspected were not owned or operated by you,the business
owner. I would like to re-visit your place of business during a time you will be available for the
inspection. The Hazardous Materials inventory is a routine function of the Public Health
Division requiredby the Town of Barnstable Ordinance, Chapter 108: Hazardous Materials-'the
310 Code of Massachusetts Regulations, Section 30:Hazardous Waste Regulations and the
federal Emergency Planning and Community Right to Know Act(EPCRA). Copies of these laws
are available for your reference at the Town Offices.
The essential functions of the Hazardous Materials Specialist are as follows:
• Inventory types and quantities of hazardous materials at business establishments.
• Enforce Town Ordinance and State Codes in regards to proper storage,handling and
disposal methods of hazardous materials.
• Educate workers and business owners regarding proper storage,handling and disposal of
hazardous materials.
• To assist businesses with regulation compliance through on-site inventory recording,
information packets, guidelines and referrals.
• Perform site inspections to ensure conformance with the regulations mentioned above.

WE RECEIVED A TELEPHONE REPORT FROM THE POLICE OF A SPILL OF SOME SORT THAT STARTS AT THE BURGER KING
AT ROUTE 6 AND CONTINUES DOWN ROUTE 132.THE POLICE FURTHER STATE THEY HAVE LOCATED THE TRUCK NEAR
PUFFERBELLIES AT THE REAR OF 82 RIDGEWOOD AVENUE.CAPTAIN C.FARRENKOPF RESPONDED IN CAR 803 TO THE
ROUTE 132 AREA WHILE ENGINE 826 RESPONDED WITH FIREFIGHTER CLOUGH DRIVING,FIREFIGHTER LANMAN IN THE
JUMP SEAT,AND MYSELF.THE ROUTE 132 SPILL WAS COVERED BY A TOWN SANDER AT THE REQUEST OF CAPTAIN
FARRENKOPF.THE BURGER KING END OF THE SPILL WAS HANDLED BY WEST BARNSTABLE F.D.UPON ARRIVAL AT THE
REAR OF 82 RIDGEWOOD AVENUE WE FOUND A 1994 PETERBUILT TRACTOR MODEL 739 WITH A WET HYDRAULIC
SYSTEM.THE RESERVOIR TANK HAD A PARTIALLY SHEARED QUICK CONNECT COUPLING THROUGH WHICH A STEADY
FLOW OF OIL WAS LEAKING ONTO THE SANDY GROUND.FIREFIGHTER LANMAN UTILIZED THE WHEEL VALVE ON THE
BOTTOM OF THE TANK TO STOP THE FLOW.A PLASTIC PAIL WAS PLACED TO COLLECT THE DRIPPING OIL.
EVENTUALLY,THE OPERATOR WHO WAS DRIVING DURING THE SPILL ARRIVED. UPON BEING QUESTIONED,THE
OPERATOR WAS IDENTIFIED AS ANTONE PAUL MEDEIROS, D.O.B. 08-16-54, LIC.#S96465256, CDL CLASS A EXP.
08-16-03.MR.MEDEIROS STATED HE DROVE FROM RIDGEWOOD AVENUE TO BURGER KING.WHILE AT BURGER KING HE
"HEARD AND SAW THE LEAKING OIL BUT DIDN'T KNOW WHAT TO DO,SO I JUST DROVE IT BACK AND LEFT TO CALL
THE OWNER." WE REQUESTED THE BOARD OF HEALTH TO THE SCENE AS THE SPILL SIZE IS ESTIMATED AT 25 TO 35
GALLONS.THE BOARD OF HEALTH AGENT GLEN HARRINGTON ARRIVED AT 2037.THE OWNER OF THE TRUCK,MR.MARK
LAMBERT ALSO ARRIVED AT THIS TIME. AT THE REQUEST OF AGENT HARRINGTON,WE COVERED THE MAJORITY OF
THE POOLED SPILL WITH PLASTIC,HAD THE OWNER MOVE THE TRUCK,AND COVERED THE REMAINDER OF THE SPILL
WITH SPEEDY DRY.AGENT HARRINGTON WILL NOTIFY D.E.P.
THE TRUCK WAS A 1994 PETERBUILT TRACTOR MODEL379. MASS PLATE 38188 APPORTIONED VIN
1XP5DB9X4RN355547. IT WAS ATTACHED TO A GREAT DANE BOX TRAILER MAINE PLATE 03-33539.
