This letter contains information from that visit: that will help you become compliant with Chapter 108 of the Town of Barnstable Ordinance: Hazardous Materials. Enclosed are copies of the Chapter 108: Hazardous Materials ordinance, an application for permit to store and/or utilize 111 gallons or more of Hazardous Materials, a copy of the Toxic and Hazardous Materials On-Site Inventory form from the visit to your business, and a copy of a contingency plan. Please note the problems identified at your place of business during the hazardous materials inspection and their corresponding recommendations listed below: PROBLEM: q• Buckler's is in violation of Section 108-9 of Chapter 108: Hazardous Materials, which states, "The release of any hazardous materials and/or acutely hazardous materials upon the ground, or into any surface...within the Town of Barnstable,is prohibited." • ere were many areas showing releases throughout the service areas due to stained ` c crete and oily absorbents. ' • Large amounts of Speedy dry were observed around the base of the waste oil drums inside the garage. ORDER: o„ • Section 108-513 of the Town of Barnstable General Ordinance states, "Provisions shall be made to contain the product(i.e. hazardous materials)in the case of an accidental V" release." 1 f • Plan and conduct additional staff"refresher"training in hazardous materials identification, handling,PPE and proper spill response. • Please instruct your staff to focus on taking a few moments during their workday to implement safety measures in order to prevent hazardous materials spills and releases of -K any kind. Utilize a spill kit that is easily accessible to all staff members in the event of a spill or release. • Continue to use absorbents on and around the bases of the drums. CTI)P, • Dispose of the hazardous waste, the used absorbents and used oil filters,by containing in a closed drum that is labeled"Hazardous Waste"and have a licensed hauler perform a pick up. (Refer to Chapter 108-5C. Storage controls). \ P BLEM: • There were open or uncapped containers being improperly stored throughout the p`- servicing areas. This violates the Town of Barnstable General Ordinance, Chapter 108: Section 108-5C. Storage Controls. ® ORDER: • Keep all hazardous and flammable materials stored in capped containers.,This is recommended for health reasons as well as fire hazard prevention. P OBLEM: ' • Housekeeping in the service areas, the storage rooms, and outdoors needs to be a priority. ORDER: Housekeeping.is.a -get around your facility,the..•.. .:..,..- ,\` , less of a chance for you to experience a worker's compensation claim. Clean areas in your storage rooms and keep all materials off the floor. This will prevent possible slips and falls. { `' • All hazardous materials should have a home. Keep all flammables in a metal fire proof cabinet, keep all oxidizers away from heated areas and continue to chain up the gas `L cylinders. "1 • Remove all tires from outside, any amount of 10 or more is considered stock piling. "\ Tires, exposed to the elements, also attract mosquitoes which can carry the West Nile Virus. Q • Clean up trash(i.e.propane tanks, batteries)that is located outside within your land line. These specific items are a fire hazard and an environmental hazard. n Keep all areas in and around the air compressor shed clear. R PROBLEM: • Smoking is taking place inside the building in the repair areas. Observed cigarette butts and staff smoking. ORDER: • Immediately stop smoking and inform staff that smoking is prohibited in those areas due to high risk of fire. PROBLEM: • Parts cleaner lid was open when not in use. RECOMMENDATION: • Keep lid closed when not in use to prohibit vapors and fumes from exiting the system. This is a fire and health hazard. PROBLEM: ^ • Used shop rags were on the floor and on storage containers. RECOMMENDATION: • Used shop rags must be picked up and stored in a metal container with a lid at all times. Containing your shop rags properly can prevent a fire hazard. Continue to have shop rags recycled by Unifirst. On Site Inventory Total The Toxic and Hazardous Materials On-Site Inventory from February 17, 2005 shows that you have approximately 1,847 gallons of toxic and hazardous materials being used, stored, generated and disposed of at Buckler's GMC, Inc,Ridgewood Ave,Hyannis(Please see enclosed Toxic and Hazardous Materials On Site Inventory sheet). The Board of Health has determined that the using, storing, generating and disposing of over 111 gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain an annual Hazardous Materials License. This license should be purchased within the next 30 days from the Town of Barnstable Town Offices, 200 Main Street,Hyannis,MA 02601 (application enclosed). Please refer to the Town of Barnstable General Ordinance: Chapter 108, Section 6 (A-H). A Contingency Plan must be submitted with your license application. Reviewing your contingency. plan for hazardous:materiats spills arid:related emergencies(and its location throughout*the:store).;.: is highly recommended at this time. Why are these recommendations being made for Buckler's GMC? • This information is intended to educate you, a business owner/operator in the Town of Barnstable,in order to keep your business operations in compliance with local, state and federal toxic and hazardous materials laws so that you can avoid future regulatory problems. • Complying with the Hazardous Materials ordinance (Chapter 108)can prevent contamination of Barnstable's existing and future drinking water supply, prevent environmental contamination which can bankrupt site owners, lower or destroy land values, drive out residents and industry, depress local economies and endanger public health. A representative from the Public Health Division will re-visit your business during the next 30 days as a follow up to further advise you on your compliance. If you have any questions about these problems, the orders and recommendations, or you need further information, guidance or assistance, please do not hesitate to contact the Public Health Division. PRORI.EM.'elu ,. • There were open or uncapped containers being improperly stored throughout the servicing areas. This violates the Town of Barnstable General Ordinance,Chapter 108: Section 108-5C. Storage Controls. ORDER: • Keep'all hazardous and flammable materials stored in capped containers. This is recommended for health reasons as well as fire hazard prevention. OBSERVATION May 11,2005: • No visible open or uncapped containers. • Storage of the flammable materials when not in use shall be in a metal flammables cabinet. • Obtain absorbent pads and place on the top of the drums to absorb the excess hazardous materials. PROBLEM February 17,2005: • Housekeeping in the service areas, the storage rooms, and outdoors needs to be a priority. ORDER: • Housekeeping is a controllable expense. The easier it is to get around your facility, the less of a chance for you to experience a worker's compensation claim. • Clean areas in your storage rooms and keep all materials off the floor. This will prevent possible slips and falls. • All hazardous materials should have a home. Keep all flammables in a metal fire proof cabinet, keep all oxidizers away from heated areas and continue to chain up the gas cylinders. i • Remove all tires from outside, any amount of 10 or more is considered stock piling. Tires, exposed to the elements, also attract mosquitoes which can carry the West Nile Virus. • Clean up trash(i.e.propane tanks, batteries)that is located outside within your land line. These specific items are a fire hazard and an environmental hazard. • Keep all areas in and around the air compressor shed clear. OBSERVATION May 11,2005: • Housekeeping has improved and is a continual process in the service areas, storage rooms and outdoor. These areas of concern are clearer and easier to maneuver around. Continue to improve these areas. • The outdoor areas where trash was found still need to be cleaned up and organized. Improvement in the weather will allow this process to become complete. PROBLEM February 17,2005: • Smoking is taking place inside the building in the repair areas. Observed cigarette butts and staff smoking. ORDER: • Immediately stop smoking and inform staff that smoking is prohibited in those areas due to high risk of fire. OBSERVATION May 11,2005: • No smoking inside the building, all smoking takes place outdoors. PROBLETWFebruary 17 2005-` a . • Parts cleaner lid was open when not in use. RECOMMENDATION: • Keep lid closed when not in use to prohibit vapors and fumes from exiting the system. This is a fire and health hazard. OBSERVATION May 11,2005: • Parts cleaner lid was open upon arrival and closed upon departure. PROBLEM February 17,2005: • Used shop rags were on the floor and on storage containers. RECOMMENDATION: • Used shop rags must be picked up and stored in a metal container with a lid at all times. Containing your shop rags properly can prevent a fire hazard. Continue to have shop rags recycled by Unifirst. OBSERVATION May 11,2005: • Shop rags were being used and not on the floor or on storage containers. • Metal can was said to be present, did not observe before departure. Will determine compliance upon next visit. In addition, a screening inspection was performed relative to the Industrial Wastewater and the Toxic Use Reduction Act program. The inspection revealed the following violations relative to Air Quality: 1. Buckler GMC conducts automotive spray painting operations resulting in Volatile Organic Compound emissions to the atmosphere. The company has not applied to the Department for approval and does not maintain any records to document exemption from Department approval requirements. The Department currently finds Buckler GMC, in noncompliance with 310 CMR 7.02(4)(a)for not maintaining records to document exemption from the Department's Plan Approval requirements for the above referenced construction and alteration. 310 CMR 7.02(4) indicates that 310 CMR 7.02(2), (plan application requirements), applies to any person constructing, substantially reconstructing or altering any facility, where the construction, substantial reconstruction or alteration would result in an increase in potential emissions equal to or greater than 1 ton per year of any criteria or non-criteria air contaminant. 310 CMR 7.02(4)(a) outlines the requirements to document exemption from the Air Quality Plan Approval regulations and states in relevant part that a recordkeeping system shall be established and maintained on-site in sufficient detail to document that the thresholds established in 310 CMR 7.02(4)(a) 8 & 10 are not exceeded. Therefore, the Department requires the following actions to be taken: A. Compliance Schedule:.Within thirty(30)days of this Notice l. Review all of the plan approval exemption criteria referenced in 310 CMR 7.02(4) (copy enclosed),then identify and notify the Department of the specific exemption r -2- criteria applicable to your company. Immediately upon receipt of this Notice, begin fulfilling the requirements of 310. CMR 7.02(4)(a) to meet the plan application exemption requirements and send to this regional office at the end of forty-five (45) days, copies of all records in sufficient detail (including supporting calculations) to document that the requirements of the above-referenced regulation have been satisfied. Please be advised that if Buckler GMC is unable to demonstrate to the satisfaction . of the Department that the company is exempt from the 310 CMR 7.02(2) permitting requirements, then the company may be subject to additional enforcement for failure to comply with said regulation. The following violations were observed relative to Hazardous Waste: 1. Buckler GMC was accumulating containers of hazardous waste and waste oil, which were either not labeled or incompletely labeled. This constitutes a condition of noncompliance with 310 CMR 30.353(6)(g) and 310 CMR 30.253(5)(b), which references 310 CMR 30.351, which in turn references 310 CMR 30.340(1)(b). Therefore, within five (5) days of receipt of this Notice, Buckler GMC shall ensure that all waste containers are labeled with the following: a. The words "Hazardous Waste", b. The name of the waste in words (e.g.toluene, acetone, waste oil) C. The type of hazards associated with the waste identified in words(e.g.toxic, ignitable etc.); and d. The date accumulation begins. 2. Some of the containers referenced above in item #1 were not closed, in violation of 310 CMR 253(5)(b),which references 310 CMR 30.351,which in turn references 310 CMR 30.685(1). Therefore, within one (1) day upon receipt of this Notice, and thereafter, Buckler GMC shall ensure that all containers remain closed except When waste is added or removed. 3. The hazardous waste accumulation area was not posted with.the words "HAZARDOUS WASTE" in violation of 310 CMR 30.353(6)(h),which references 30.340(1)0). Therefore, within five(5)days,upon receipt of this Notice, and thereafter, the Department requires that the accumulation area be posted with the words "HAZARDOUS WASTE" in capital letters at least one inch high. 4. The hazardous waste accumulation area was not clearly marked in violation of 310 CMR 30.353(6)(h), which references 30.340(1)(k). Therefore, within ten (10) days, upon receipt of this Notice and thereafter Buckler GMC shall ensure that all areas where wastes are accumulated are clearly marked (e.g. visible line, piece of tape on the floor). 5. A review of the manifests revealed that a temporary EPA identification number was being used on some of the manifests. This constitutes a condition of noncompliance with 310 CMR 30.314. Therefore Buckler GMC shall ensure that their EPA ID#: M4,D065156275 is used on future manifests and that the manifest's be completed in an accurate manner. 6. Buckler GMC did not meet all of the emergency notification procedures. Specifically, Buckler GMC, did not have an up-to-date list posted next to each telephone at the site of generation. This constitutes a condition of noncompliance with 310 CMR 30.253(5&6)(b) which reference 310 CMR 30.351(9)(c)(6). The company has not applied to the Department for approval.and does not maintain any records to document exemption from Department approval requirements. The Department currently finds Buckler GMC, in noncompliance with 310 CMR 7.02(4)(a)for not maintaining records to document exemption from the Department's Plan Approval requirements for the above referenced.construction and alteration. 310 CMR 7.02(4)(a) outlines the requirements to document exemption from the Air Quality Plan Approval regulations and states in relevant part that a recordkeeping_system shall be established and maintained on-site in sufficient detail to document that the thresholds established in 310 CMR 7.02(4)(a)8& 10 are not exceeded. Therefore, the Department requires the following actions to be taken: A. Compliance Schedule: Within thirty(30)days of this Notice l. Review all of the plan approval exemption criteria referenced in 310 CMR 7.02(4) (copy enclosed);then identify and notify the Department of the specific exemption • r -2- criteria applicable to your company. [Example: actual under one (1) ton per year (7:02(4)(a)(8), and federal potential less than "major" (7:02(4)(a) and (c)(4)]. You have to meet both conditions to be exempt. 2. Immediately upon receipt of this Notice, begin fulfilling the requirements of 310 CMR 7.02(4)(a) to meet the plan application exemption requirements and send to this regional office at the end of forty-five (45) days, copies of all records in sufficient detail (including supporting calculations) to document that the requirements of the above-referenced regulation have been satisfied. The type of hazards associated with the waste identified in words(e.g.toxic, ignitable etc.); and .d. The date accumulation begins. 2. Some of the containers referenced above in item #1 were not closed, in violation-of 310 CMR 253(5)(b), which references 310 CMR 30.351,which in turn references 310 CMR 30.685(1). Therefore, within one (1) day upon receipt of this Notice, and thereafter, Buckler GMC shall ensure that all containers remain closed except when waste is added or removed. 3. The hazardous waste accumulation area was not posted with.the words "HAZARDOUS WASTE" in violation of 310 CMR 30.353(6)(h),which references 30.340(1)(j). Therefore, within five(5)days,upon receipt of this Notice, and thereafter, the Department requires that the accumulation area be posted with the words "HAZARDOUS WASTE" in capital letters at least one inch high. -3- 4. 5. A review of the manifests revealed that a temporary EPA identification number was being used on some of the manifests.: This constitutes a condition of noncompliance with 310 CMR 30.314. Therefore Buckler GMC shall ensure that their EPA ID#: N AD065156275 is used on future manifests and that the manifest's be completed in an accurate manner. Therefore, within ten (10) days, upon receipt of this Notice and thereafter, the following information shall be posted: a. The name(s) and telephone number(s)of the emergency coordinator; b. Buckler GMC was not conducting weekly inspections of the hazardous waste accumulation area. This constitutes a condition of noncompliance with 310 CMR 30.340(1)(a)(1)(d), which references 30.686. Therefore, within five (5) days, upon receipt of this Notice, and thereafter, Buckler GMC shall begin conducting the weekly inspections. The Department requires a written response within fifteen (15) days of receipt of this Notice, addressing each of the items above and indicating the. actions to be taken in order to achieve .and maintain compliance with the'Regulations. The property was inspected as part of the annual Hazardous Material Registration Program. At that time floor drains and an Metropolitan District Commission(MDC)trap was observed at the property. Due to the presence of the MDC trap, the discharge point is considered "underground injection control system or UIC. Please review the following options for your property. All options below include the proper"closure"of the UIC, according to 310 CMR 27.00. c As mandated under the Federal Safe Drinking Water Act, the state UIC regulation's prohibit potentially polluting discharge to injection wells. Vehicle maintenance operations commonly use unauthorized injection wells, such as floor drains leading to a septic system, dry well,or oil/water'separator which leads to any subsurface leaching structure. Under the State Plumbing code(248 CMR 2.09 (1)(c)(3),owners/operators of facilities with floor drains tied to injection wills(or discharging to any surface point)have three options: • tAf _ f 1. Seal the floor drain. Contact your local phmibing inspector for the appropriate filing form. If choosing this option, all previous discharges to the drain must be eliminated at their source. For example, cars should no longer,,be washed and floors should no longer be hosed down. 2. Connect the floor drain to a holding tank. Thetank will need DEP approval. The DEP approves two types of holding tanks for this waste: new installations and conversions of existing ' structures (e.g. oil/water separators). These tanks are for non-hazardous,industrial wastewater. If solvents, antifreeze, oil and other fluids are washed down the drain, the waste is likely to be hazardous. 3. Connect the floor drain to a municipal sewer system,if available. An oil/water separator is required to be installed under this option. This requires a permit from DEP and the Town of Barnstable Department of Public Works along with the sewer connection application. The amount of discharge shall not exceed ten parts per million(10 PPNI). 4. The"closure"of the UIC includes verifying the location and type of discharge facility, sampling/analyses of wastewater, sludge and soils, backfilling of discharge facility, and notification to proper authorities. A copy of DEP's recommended guidelines are enclosed for your review. In all cases, the owner must file a UIC NOTIFICATION FORM with DEP. You are directed to comply with the state's UNDERGROUND INJECTION CONTROL regulations (310 CMR 27.00)by informing this department in writing of your intentions within ten(10)days of receipt of this notice and completing the work within thirty(30)days. These variances will allow you to install an onsite sewage disposal system at the corner of Ferndoc Street and Joaquim Road, Hyannis listed as Assessor's Map 344, Parcels 38, 39 and 57, with the following conditions: (I The septic system must be installed in strict accordance with the submitted plan. (2) The designing engineer must be onsite and supervise construction. of the onsite sewage disposal system and must certify in writing to the Board of Health that his design has been strictly adhered to prior to the issuance of a Certificate of Compliance. (3) The building must be connected to public water. (4) The building must be connected to town sewer when the Board determines its availability. (5) All outside catch basins shall have gasoline and oil separators fitted with petroleum sorbent pads. A copy of a contract schedule for the periodic cleaning of the catch basins by a licensed hazardous waste transporter must be furnished and approved prior to final approval. (6) Floor drains shall not be installed inside the building. However, if the -plumbing or building inspector deems floor drains with oil and gasoline separators necessary; the floor drains and the oil acid gas separators shall be connected to a holding tank. A copy of a contract schedule for the periodic cleaning of the oil and. gasoline separator and holding tank must be furnished prior to approval of the building permit. However, by copy of this letter we would request a variance from an interpretation of the State Plumbing Code that would require floor drains and a oil and gasoline separator. We have been assured that the building would not be used for any type Charles and Bruce Buckler October 22, 1987 Page 2. of truck or automobile maintenance. It would be used for the storage of tow trucks and vehicles only. This business is located in close proximity to public water supply wells. Drains and gasoline end oil separators inside the building would only encourage maintenance of vehicles and contamination by solvents. All of Cape Cod is considered special in regards to protecting groundwater inasmuch the Federal Government has given the Cape a desgination of "A Sole Source Aquifer." The Towns entire drinking water supply is derived from groundwater. We have indications that certain hydrocarbons pass right through oil and gasoline separators contaminating our groundwater. (7) It shall be recorded on the deed that the occupancy of the building shall not exceed five (5) employees. . This conditional approval was granted because you stated the first floor of the proposed building would only be used for parking six (6) tow trucks and a small office with no washing or maintenance of any vehicles. The second floor of the proposed building would only be used for dry goods "dead" storage and two bathrooms. Your designing engineer, Peter Sullivan, stated in his letter to the Board of Health dated September 24, 1987, that with this usage the estimated flow would be less than 330 gallons per day per acre. Mr. Sullivan further stated in the letter dated October 15, 1987, that this facility will not have an adverse effect on the water resources if his plan is, adhered to. The plan does not show floor'drains or an inside gasoline and oil separator. In addition, the Department of Public Works stated it would not be possible to include this area for sewering because the environmentally sensitive areas that are planned for sewering will use up all of the present capacity of the Town Sewer Plant.
