Dear Mr. Duarte:
On May 7, 2007, Health Agent Meredith Morgan and I conducted a site visit at 120 Sea Street,
Hyannis,MA 02601 to determine if the aboveground storage tank had been removed from the
garage behind the main house. Upon arrival, a gentleman was not able to assist us and you were
not present. The tank was found in the garage behind the main house propped up against the
wall. You were given 30 days to remove the tank from the property on April 14,2007.
At this time, the tank shall be removed from the property by a licensed hauler. The hauler shall
pull a permit from the Hyannis Fire Department to remove the tank from the property'. Upon
removal of the tank a receipt shall be presented to the Fire Department and Health Division with a
location of disposal. Failure to properly remove this tank will result in fines.
Another option for removal is to have the contents of the tank cleaned out by a licensed hauler.
The tank may then be cut in half by the licensed hauler and hauled to the Town of Barnstable
Transfer Station in Marstons Mills,MA. There is no fee to dump the tank there. This option may
be less expensive. Notification to the Health Division upon removal of the tank is required.

11/20/06-ALP went to said location to speak with John Manoog about the issues and options
he has regarding the UST. It has been recommended to Mr. Manoog,by me,to have the product
removed by a licensed waste hauler, retrieve an LSP to be on site for soil sampling at the time of
removal, if soils are contaminated, a determination will be made at that time for the next steps
(dig up tank and soils-open asphalt up to remove tank). The building permit may need to be held
until the tank and its contents have been removed.

12/1/2006 ALP arrived on site after seeing work being done at the location on the unidentifiec
UST. Upon arriving at the site, Steve Dennison (Enviro-Safe) had just finished pulling product froi
the identified oil water separator(OWS). There were approximately 275 gallons of oily solids
removed and 125-150 gallons of straight liquid oil removed from the OWS. The OWS is a beehive
style. The output from the building was proven to be closed off. The age of the OWS is unknown,
t` an LSP was called on site to complete soil sampling. The floor bed of the OWS looked porous and
was broken up by the LSP to collect samples. Steve checked the output into the town sewer
.h system and said that there wasn't enough gravity with the oily sludge liquid to allow the gravity t(
push out product into the sewer system. He stated the sewer looked ok. ALP spoke with Steve
after LSP collected samples and readings will be provided to the Health Division upon completion.
Will not close until readings are received and reviewed. ALP will notify building regarding a hold c

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY
CODE II — MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND THE TOWN OF BARNSTABLE CODE CHAPTER 170.
The property owned by you located"at 120-Sea Street (upper uiut) Hyannis,was inspected
on February 21, 2009 by Timothy O'Connell R.S., Health Inspector for the Town of
Barnstable. This inspection was conducted on the basis of the rental registration in
accordance with Chapter 170 of the Town of Barnstable Code.
The following violation(s) of the State Sanitary Code were observed:
105-CMR 410.500 Owner's.Responsibility to Maintain Structural'Elements. It was ,
observed during inspection that the fire escape located on the northern side of this
dwelling was not in good repair. This fire escape is missing top landing and has
excessive rot and constitutes an accident hazard.
You are ordered to correct the violations listed above within thirty (30) days
of your receipt of this notice by pulling any required building permits (if
applicable); by dismantling fire escape so it no longer-constitutes an accident
hazard. Although it is not required to reconstruct fire escape due to.age of building.
It is advised by the Town of Barnstable Building Department that you do
reconstr-oct fire escape: If you choose to rebuild a fire.escape at said location you
must construct it in accordance-to 780..CMR 1025.0.of state building code(s):
Non-compliance will result in a fine of $100.00 per .violation. Each day's failure'to
comply with an order shall constitute a separate violation.
Should you have any questions regarding the above violations, please contact the.Town.
Health Division and ask to speak with the inspector who performed the inspection.
