For the purpose of this Department's comment on the proposed variance pursuant to 310 CMR 15.410 through 15.415, Title 5 of the State Environmental Code,this letter constitutes a denial in that the Department has determined that approval of the proposed variance(s) will not provide the same degree of environmental protection as required under Title 5. However, in accordance with 310 CMR 4.04(2)(b)2.a.iii and 310 CMR 4.10(7)(a)(3) (Category BRPWP59c) of the Timely Action and Fee Provisions, the application may be supplemented by the applicant to address the following deficiency: The applicant has not demonstrated that the requested variance from 310 CMR 15.211(2) will provide an equivalent degree of environmental protection or that manifest injustice will result from failure to grant this variance. The information provided in this application, indicates that the proposed soil absorption system cannot be located outside the Zone I of a public water supply well. Accordingly,the Department is of the opinion that maximum feasible compliance requires that the applicant must provide a five(5),foot separation,to groundwater and enhanced treatment F;As.3.1,0,CMRr4.1,0(7.)(a)(3)3b states, the applicant has sixty (60) days from the date of this letter (*see below) to address the listed deficiencies. If the applicant cannot accommodate the schedule of the Board of Health within the sixty (60) day period, or for any other reason requires additional time, the applicant may, by written agreement with this Department, extend this schedule in accordance with 310 CMR 4.04 (2) (f). The applicant is also advised that if he elects to proceed on the record as it now stands, this letter constitutes a denial of the variance. This variance determination is an action of the Department. If the applicant is aggrieved by this determination, s/he may request an Adjudicatory Hearing in accordance with 310 CMR 1.00 and M.G.L. C30A. A request for an Adjudicatory Hearing must be made in writing and postmarked within 30 days of the date of issuance of this determination. YARMOUTH, MA 02675 r Based upon its review of the application, and in accordance with 310 CMR 15.410, the Department has determined both of the following: a) The applicant has established that enforcement of 310 CMR 15.211 would be manifestly unjust, considering all of the relevant facts and circumstances of this case. Strict adherence would deprive the applicant of existing use of the property. b) The applicant has established that a level of environmental protection that is at least equivalent to that provided under 310 CMR 15.000 can be achieved without strict application of 310 CMR 15.211. The applicant has established equivalent environmental protection as follows: The applicant has maximized the setback distance between the soil absorption system and the public water supply well. The Department, therefore, approves the Board of Health's grant of•a variance from 310 ZC Mi 15.211 subject to the following: 1. It is not possible to purchase or acquire an easement on adjacent property where either the new leaching facility or a new well could be located to meet the requirements of Title 5. 2. There is to be no increase in sewage flow to the repaired subsurface sewage disposal system and no increase in square footage to the existing structure served by the sewage disposal system which will result in an increase in flow. 3. A Disposal System Construction Permit must be obtained from the Barnstable Board of Health prior to the start of construction. 4. Approval for the proposed system will be dependent upon the recording in the appropriate registry of deeds of a notice that discloses the existence of a variance for the sewage disposal system and the involvement of the Department of Environmental Protection in said system. An attested copy of this notice shall be submitted to the Department and the Board of Health prior to,the issuance of the Certificate of Compliance. 5. The soil absorptionY l�s stem shall be redesigned to incorporate pressure distribution. This variance determination is an action of the Department. If the applicant is aggrieved by this determination, s/he may request an Adjudicatory Hearing in accordance with 310 CUR 1.00 and' MG.L. C30A. A request for an Adjudicatory Hearing must be made in writing and pos;�arked within 30 days of the date of issuance of this determination. The variances requested fall under Title 5's permits Maximum Feasible Compliance regulation and the Town of Barnstable regulations. The site is unique in that it is bordered to the north and west by a pond and stream, lies mostly within a floodzone, and only contains about 0.50 acre. These site constrictions contribute to the necessity of requesting multiple variances. The proposed system is located in the area of the lot which is furthest away from the relevant resource areas. It is also positioned in the highest portion of the lot. It is designed based on the existing 4 bedrooms(no additional habitable space is proposed.) A 40 mil liner is proposed to the street side of the system,as well as to the east of the system(this side backed by a supporting landscape tie wall),as re-grading is not an option because of the limitation of space. The construction of a concrete retaining wall would be,unsightly,cost prohibitive to the owner further delaying the repair of the system, and problematic due to the groundwater levels and the limited area in which to work and construct it. The system is proposed at 4' above the adjusted water elevation of 7.0'. Based on conversations with the Water Commissioner(George Wadsworth)as well as the owner of the property, the pond elevation does not vary any significant amount due to the non-manipulated culverted outlet at the southwest corner of the lot from the proposed leach facility). As well,the proposed system is down-gradient from the BWC well: Based on this information,the pond elevation was used for design purposes,as the groundwater elevation would be directly related to the pond elevation- Groundwater was observed to be 0.40' lower than the pond elevation at the test hole. The Town of Barnstable well at the abutting pumping station is about 350' from the closest point of the proposed leach facility. It is my understanding that the water company in the past was trying to swap this parcel with land elsewhere outside the j c4o 400' radius to the public well. This deal fell through, and now it is time to upgrade this septic system to the maximum extent feasible. The 3 cesspools now in use intercept groundwater. The proposed system is a vast improvement over what exists there now. The aforementioned site constrictions dictate the need for requesting variances. We are of the opinion that the proposed system meets the criteria for no variance under Title 5's"Maximum Feasible Compliance". We feel that,to enforce Title 5 and Town of Barnstable Regulations to their fullest extent in this case would be an extreme hardship as to make the house uninhabitable. We feel that by granting the variances,the same degree of environmental protection can be achieved without strict application of the Town's regulations and Title 5 regulations. The variances requested fall under Title 5's permits Maximum Feasible Compliance regulation and the Town of Barnstable regulations. The site is unique in that it is bordered to the north and west by a pond and stream, lies mostly within a floodzone,and only contains about 0.50 acre. These site constrictions contribute to the necessity of requesting multiple variances. The proposed system is located in the area of the lot which is furthest away from the relevant resource areas. It is also positioned in the highest portion of the lot. It is designed based on the existing 4 bedrooms(no additional habitable space is proposed.) A 40 mil liner is proposed to the street side of the system,as well as to the east of the system(this side backed by a supporting landscape tie wall), as re-grading is not an option because of the limitation of space. The construction of a concrete retaining wall would be, unsightly,cost prohibitive to the owner further delaying the repair of the system, and problematic due to the groundwater levels and the limited area in which to work and construct it. The system is proposed at 4' above the adjusted water elevation of 7.0'. Based on conversations with the Water Commissioner(George Wadsworth)as well as the `owner of the property,the pond elevation does not vary any significant amount due to the non-manipulated culverted outlet at the southwest corner of the lot(220' from the proposed Ieach facility). As well,the proposed system is down-gradient from the BWC well. Based on this information,the pond elevation was used for design purposes,as the groundwater elevation would be directly related to the pond elevation- Groundwater was observed to be 0.40' lower than the pond elevation at the test hole. The Town of Barnstable well at the abutting pumping station is about 350' from the closest point of the proposed leach facility. It is my understanding that the water company in the past was trying to swap this parcel with land elsewhere outside the 400' radius to the public well. This deal fell through, and now it is time to upgrade this septic system to the maximum extent feasible. The 3 cesspools now in use intercept groundwater. The proposed system is a vast improvement over what exists there now. The aforementioned site constrictions dictate the need for requesting variances. We are of the opinion that the proposed system meets the criteria for no variance under Title 5's"Maximum Feasible Compliance". We feel that,to enforce Title 5 and Town of Barnstable Regulations to their fullest extent in this case would be an extreme hardship as to make the house uninhabitable.
