RE: Anchor-In, Lifeguard Modification for the Swimming Pool
Dear Mr. Simpson,
We will allow you to employ "qualified swimmers," in lieu of the requirement to -
employ fully certified lifeguards, at your swimming pool located at the Anchor-In,
located at One South Street, Hyannis, MA. This includes persons in your pools
and includes all other persons within the pool enclosure.. The following
conditions must be complied with:
(1) The pool must be supervised by a "qualified swimmer all times the pool
is open. We wish to make it clear that this swimmer must be at the pool
and cannot be observing from the desk unless another swimmer is
provided and physically present at the pool. . This swimmer must be
certified in adult, child, and pediatric CPR by the American Red Cross,
American Heart Association or equivalent, be familiar with lifesaving
equipment and knowledgeable in first aid procedures.
(2) All qualified swimmers shall wear orange colored hats or orange colored
visors with the words "POOL STAFF" in 15 millimeter (5/8 inch) black V
colored lettering on the front of the hats.
(3) The maximum capacity of the swimming pool is reduced to nineteen (19)
persons.
(4) You shall maintain a permanent record on a form prescribed by the Board
of Health listing each swimmer supervising the pool when it is in use. The
attached form must be posted at the pool site in a convenient location to
be viewed by the Health Inspector any time inspections are conducted.

(5) You shall submit a copy of the applicant's insurance policy naming the
Town as coinsured in the amount of$1,000,000.
(6) All other regulations contained in Chapter V, Minimum Standards for
Swimming Pools, must be strictly complied with.
(7) The qualified swimmers must hold a current American Heart Association,
American Red Cross, or equivalent CPR certificates with training in adult,
child, and pediatric CPR.
(8) The swimming pool water must be tested for coli form bacteria at least
monthly by a certified laboratory.
Please be advised that if you exceed this capacity of 19 persons, your
modification will be invalid and you will be required to cease operation of the
pool.
This modification expires December 31, 2009. It is your responsibility to ensure
that you request renewal of the variance from the lifeguard requirements each
year prior to opening the pool.

This appeal for a Special Permit under the provision of the
Zoning Bylaw, Section 3-3 . 2 ( 3 ) (A ) Conditional Use
Hotel /Motel , has under gone the process of a Repetitive
Petitions (MGL, Chapter 40A , Section 16 ) . It was determined
by the Zoning Board of Appeals on March 08 , 1990 , that
substantial changes have been made in the proposal from the
original Appeal # 1989-03 . The Planning Board conferred with
this decision on May 08 , 1990 .
APPLICANTS PROPOSAL:
The applicant has proposed to construct eight ( 8 ) new units
to an existing thirty-seven ( 37 ) unit motel for a total of
forty-five (45 ) units . The proposed construction is to the
west wing of a "U" shaped motel . The new units are to be
constructed by a 32 ft . extension of the west wing and the
addition of a second floor to this one story wing . Four ( 4 )
existing units , . Iocated in the wing are , to be remodeled .
One ( 1 ) of the remodeled units within has been identified as
a handicapped unit .
According to information supplied , it appears that the
applicant proposes to construct a total of 5 , 206 sq . ft . and
to remodel an .add.itional 1 , 872 sq . ft . of existing space .
The drawing illustrates all three sides to be covered in
clapboard . The forth is attached to the existing office
wing of the motel . . All rooms have access to exterior raised
decks except two with grade level access . Three exterior
doors are provided on the first floor plus access to the
office and to the basement .
DEPARTMENT CONCERNS :
Site Plan Review:
At present there is no approved and signed site plan as
required by Section 5-3 . 3 ( 2 ) (A) Special Permit Provision of
the Zoning Bylaw.
Parking :
The department would suggest the following parking
requirements for the proposed motel and uses associated with
the site .
45 motel units @1 . 2 spaces/unit 54 parking spaces
6 employees @1 space/2 employed 3 parking spaces
Motel and employee parking requirements is in accordance
with Section 4-2. 7 of the Zoning Bylaw.
11 bout slips @ 1 spaces/slip 11 parking spaces
ITE Parking Generation Manual proposes boat slip parking
ratio of 0. 3 to 0. 6 parking spaces/slip, the Town has
used a ratio of 1 . 5 parking spaces/slip (Michael Aselton
Memorial Park) . The department would suggest that a
ratio of 1 space/slip should be sufficient .
Traffic :
According to Cape Cod Commission traffic data , the
intersection o.f Lewis Bay Road and South Street ( station
40134 , 1985 data ) had peak hourly traffic flows of 654
vehicles/hour occurring between 3 and 4pm . The average
daily traffic flow was measured at 6 , 975 vehicles/day .
The department has estimated that the eight ( 8 ) new motel
units will generate an additional 81 vehicle trips/weekday
and 5 additional vehicle trips/hour at peak hours of 4 to 6
pm, based on ITE Trip generation Manual ( Land Use Motels
#320 Average trips/weekday rate of 10 . 189 and peak traffic
per hour rate between 4 and 6 pm of 0 . 625 )
RECOMMENDATION :
Should the Board' grant this appeal as per Section 5-3 . 3 of
the bylaw, it may wish to consider the following condition
in its decision :
1 ) Site Plan Review and approval as a condition for its
granting of the special permit .
2 ) Compliance with all town regulations , including , but
not limited to , Board of Health , Licensing and
Building Department .
