Please refer to Figures 1 and 2:in. Attachment A for.a depiction,of the site.and surrounding area. + LO RELEASE.DESCRIPTION ' On December 1,2006, an ESC representative eollectedj samples for laboratory analysis as part of.a pre-characterization for the disposal of impacted soils related to. the removal of an. oil/water,separator. The laboratory 'analytical results revealed the presence of Total ' Petroleum Hydrocarbons in,the pre-characterization. soil sample at a concentration.in excess of the•applicable reporting>category.RCS-.1 standard. Based on these' release concentrations, .a condition requiring 2 hour or 72 hour notification to the Massachusetts'Department of Environmental Protection(MA DEP) did ` not exist, pursuant to 310 CMR*40.0361. However, it was assumed that the release would ' require notification to the:MA DEP within 120.days of the release date, pursuant to 310 CMR 40.0360 and310 CMR.4o.1600; 2.0 ASSESSMENT AND REMOVAL ACTIVITIES Based on the assessment data,collected on,January 11 2007, ESC recommended that'.a 1` `Limited Removal Action be conducted as the:'most direct means to achieve regulatory, closure.for. the impacted soil associated with the,historic operations of the oil/water. ' separator. An LRA is a removal action that is limited in size and scope in which' -notification to the MA DEP would not be required. Pursuant to 310 CMR 40.0000, the Massachusetts Contingency Plan (MCP), specifically 310 CMR 40.0318, the 31 .Granite Street Milford, MA 01757 PH ('508) 634 9800 FX (508) 634 8259 ' Limited Removal Action Report 450 South Street Hyannis,MA Page 2 of 3 ' requirements for co an LRA.are: q g • That conditions requiring either a 2 hour'notification or 72 hour notification to the' ' MA DEP are not present; Y • Response actions are completed within 1.20 days of obtaining knowledge of the 120 day release condition; ' • The release condition is limited to soil only;and • The removal action is limited,to less than 100 cubic yards for releases of petroleum hydrocarbons. The description of the assessment and remediation activities described below demonstrate that response actions were conducted within'the requirements for conducting a LRA and that notification to the MA DER is not required. t' 2.1 Assessment, Soil Sampling and Soil Removal Activities On January 12, 2007, ESC representatives supervised ,the removal of the oil/water separator and the excavation of'impacted soils! The structural integrity of the oil/water ' separator,_composed of brick and mortar, appeared to be in good condition and intact with an approximate depth of seven feet. - It should be noted that during excavation activities a concrete foundation and inactive underground conduits were within the ' footprint of the excavation. Please refer-to Attachment B for photo-documentation of the site excavation activities. During excavation.activities, personnel from ESC conducted field screening of soils for the presence of petroleum hydrocarbons using headspace.screening methodologies. A ' photoionization detector(PIO) was calibrated to read volatile organic compound (VOC) concentrations on a parts per million by volume (ppm' v) basis, benzene referred. The PID readings for in-situ samples ranged from 0.0ppmv to 3.5 ppmv. Personnel from ESC and Robert Childs Inc.,excavated impacted soil to a maximum depth of approximately twelve feet. The size of the completed excavation was approximately 20 feet by 15 feet, with a depth of approximately 12 feet. The size of the completed excavation is shown on Figure ESC transported impacted soil (approximately 36.83 tons) under a Bill-of-Lading (BOL) to Aggregate Industries in South Dennis, MA. Following soil removal activities in the release area, ESC collected two in-situ samples (ES and Bottom), and one composite soil sample (Comp SW). The composite soil sample was made up of multiple.aliquots collected from the north, west, and east. The ' PID Field Screening results'of each post excavation soil sample PID did not exhibit and VOCs above the instrument detection limit. The soil samples were kept cool and delivered by courier to Alpha Woods Hole Labs of Westborough, MA, for analysis of, extractable petroleum hydrocarbons (EPH) and volatile petroleum hydrocarbons (VPH) by MA DEP Method 04-1 and Method 04-1.1 respectively, RCRA 8 metals, volatile organic compounds by MA DEP Method 8260B, and/or PCBs by MA DEP Method 8082. Laboratory analysis indicated that the target petroleum analytes were non-detect and/or ' Limited Removal Action Report 450 South Street Hyannis,MA Page 3 of 3 ' detected at concentrations less than the reportable concentrations. The complete p p laboratory analytical report is included in Attachment C. 2.2 Remediation Waste Management As previously noted, approximately 36.83 tons of petroleum-impacted soil (as measured by the receiving facility) was transported to the Aggregate Industries facility under a Bill of Lading (BOL) on January 12, 2007. A complete copy of the BOL is included as ' Attachment D. 3.0 CONCLUSIONS Based on the results of completed LRA.activities, petroleum-impacted soil associated with the removal of the oil/water separator at the Site has been remediated to levels that iare well below the reportable RCS-1 soil standards within the 120 days required for the execution of a LRA. Accordingly, no further response actions are required in association with the.removal of the oil/water separator. Pursuant to 310 CMR 40.0318 (7)(b) the Responsible Party undertaking the Limited Removal Action shall retain this LRA document for a minimum of five years. The Phase II Report/Class A-3 RAO dated December 1997, failed to utilize the appropriate laboratory analytical test method approved by the Department for testing soils contaminated with petroleum compounds. This is a violation(Class II)of 310 CMR 40.0191(2). 2. During a site visit on October 16, 2000, conditions were observed at the site that failed to comply with the terms of the Activity and Use Limitation. This is a violation (Class I).of 310 . CMR 40.1070(2). DESCRIPTION OF REQUIREMENTS NOT COMPLIED WITH 1. In Section 1.2 of the Department's policy "Characterizing Risks posed by Petroleum Contaminated Sites: Implementation of MADEP VPH/EPH Approach" the following is clearly stated"On and after October 31, 1997, MADEP expects that all sites that have not been closed out in accordance with MCP provisions will be characterized using the VPH/EPH approach. There are no grandfathering provisions applicable to sites currently under evaluation." Pursuant to 310 CMR 40.0191(2),RAPS shall be employed during the performance of response actions conducted pursuant to 310 CMR 40.0000, and shall include, without limitation, the following: (a) consideration of relevant policies and guidelines issued by the Department and EPA; (b) use of accurate and up-to-date methods, standards and practices, equipment and . technologies which are appropriate, available and generally accepted by the professional and trade communities conducting response actions in accordance with M.G.L.. c. 21E and 310 CMR 40.0000 under similar circumstances; and (c) investigative practices which are scientifically defensible, and of a level of precision and accuracy commensurate with the intended use of the results of such investigations. Section 3.0 of the Notice of Activity and Use Limitation recorded for the Property, sets forth Obligations and Conditions in order to maintain a condition of No Significant Risk. Obligations and Conditions set forth for the Property include "The prompt repair and maintenance of any pavement cracks or frost heaves". Pursuant to 310 CMR 40.1070(2), Activity and Use Limitations imposed pursuant to 310 CMR 40.1012 shall be implemented and adhered to by the owner and holders of interest in the property and/or a license to use the property subject to the Activity and Use Limitation, and/or the RP, PRP, or Other Person conducting response actions at the disposal site or portions of a disposal site in accordance with the procedures established in 310 CMR 40.1070 through 310 CMR 40.1099. DEADLINE AND DESCRIPTION OF ACTIONS TO BE TAKEN Within sixty (60) days of receipt of this Notice you are required to: 1 a) Conduct further assessment with analytical data provided from an appropriate test methodology and submit a revised Risk Characterization for the Class A-3 RAO that supports a conclusion of No Significant Risk; or, 1 b) Retract the Class A-3 RAO and continue response actions until an RAO is resubmitted that accurately characterizes the impact of the site to human health and the environment,and demonstrates that a condition of No Significant Risk has been achieved. NOTE: If you can document the achievement of a Class A-1 or A-2 RAO at the site you may then terminate the existing AUL,utilizing Form 108413. 2) Repair the cracks and frost heaves observed in the pavement and submit documentation detailing the repair. FAILURE TO COMPLY MAY RESULT IN FURTHER ENFORCEMENT If you fail to correct the violations identified above and provide documentation of such action to the Department,you may be subject to further enforcement action by the Department. The Department may conduct a follow-up audit to determine whether the required actions have been taken. Former Exxon Facility,Hyannis,4-1301 2 Audit Memorandum III. SITE SUMMARY\SITE INSPECTION The property is located at 484 South Street in Hyannis, Massachusetts. It is comprised of 0.42 acres of land containing an unoccupied single-story building that was formerly operated as a gasoline retail and service station. The site is zoned for business use. Nearby properties include residential buildings to the south across South Street, commercial buildings to the north, residential homes, commercial businesses to the west and also to the east and across Sea Street. The site is located within an area of Hyannis where the groundwater resources are classified as "NON Potentially Productive Aquifer"i.e. GW-3. (Massachusetts GIS Map Quadrangle for Hyannis). In the direction of groundwater flow(south), the NON Potentially Productive Aquifer extends a distance of approximately 3400 feet. Located within this GW-3 area is a narrow band(approximately 100 feet) of GW-1 groundwater that surrounds the Oak F Grove Cemetery approximately 1600 feet to the south. Groundwater depth at the site ranges from 17' to 24'. When in operation the facility stored 26,000 gallons of gasoline in one 10,000 gallon and two 8000 gallon Underground Storage Tanks (USTs); 1,000 gallons of fuel oil in one 1,000 gallon UST and waste oil in one 1,000 gallon UST. The site was first listed as a confirmed disposal site on October 1, 1993, as a result of petroleum contaminated groundwater identified in a Phase I Site Assessment. The Phase I investigation revealed elevated concentrations of benzene,toluene, ethylbenzene and xylenes in monitoring wells MW-1 and MW-4. Positive PID readings were obtained in soils from the MW- i boring; the highest being 452 ppm obtained from a depth of 14'-16'. Positive PID responses Were not obtained from soils tested from the remaining borings. The concentrations of total benzene,toluene, ethylbenzene and xylenes (BTEX)ranged from 5,923 ug/1 in groundwater from MW-l.to,less than the Method Detection Limit(MDL)in MWs 2, 3 and 5. MW-4 exhibited only slightly elevated levels of BTEX. Analytical results from soil samples obtained from the monitoring well borings exhibited total BTEX concentrations ranging from 6,672 ug/kg at the MW-1 location to less than the MDL in the remaining borings. In July 1993 the USTs were removed from the site under the supervision of Geologic Services Corporation(GSC). The UST removal activities, documented in the October 1993 UST excavation report, described each of the USTs as being in good condition. Soil samples obtained from the UST grave were screened for VOCs. The readings ranged from None Detected (ND)to 95 ppm.PID readings from excavated soils ranged from ND to 183 ppm. However, laboratory analyses of soil samples obtained from the tank grave revealed no detectable concentrations of VOCs by EPA Method 8020. t The site was granted a waiver of approvals on May 3, 1994. In April 1995, an Immediate Response Action(IRA)was undertaken to "evaluate subsurface conditions at the downgradient portion of the subject property, and to document past and present site activities and uses in the vicinity of the site." The results of the IRA revealed that BTEX compounds had,migrated off the property and exceeded Method 1 GW-1 standards in several monitoring wells. However,the entire area of the site is classified as GW-3 due to its redesignation as a"NON Potentially Productive Aquifer". A Substantial Release Migration(SRM) evaluation was also conducted Former Exxon Facility,Hyannis,4-1301' 3 Audit Memorandum and revealed that the groundwater velocity at the site was approximately 704 feet per year. A SRM condition is considered to exist when it is determined that the groundwater velocity at the site exceeds or is likely to exceed 200 feet per year. Since no sensitive receptors were identified in the vicinity of the site and Method 1 GW-3 had not been exceeded the SRM condition was not considered significant. In December 1997 the Phase II-Comprehensive Site Assessment was completed at the site. A contaminant plume was identified extending southward from the property approximately 600 feet(within the"Non Potentially Productive"aquifer). Concentrations of benzene, ethylbenzene, xylenes, and MTBE were identified at the leading edge of the plume at levels below Method 1 GW-1 standards. Concentrations of toluene were above Method 1 GW-1 standards but below Method 1 GW-2 /GW-3 groundwater standards. Since the concentrations of benzene, ethylbenzene,xylenes and MBTE had significantly attenuated well below Method 1 GW-1 groundwater standards, and the concentration of toluene was below Method-1 GW-2 standards, no additional wells were installed. During the Phase II investigation, three monitoring wells on the former Exxon Station property were also evaluated for the presence of EDB and lead. None was identified at a concentration above the method detection limits of 0.02 ug/l.and 0.005 mg/l, respectively. Laboratory analyses of soil samples obtained from the tank excavation that were tested by EPA Method 8020 revealed no detectable concentrations of petroleum compounds in excess of Method 1, S-1 soil standards, Therefore, based on these analytical results, an AUL was not specifically required to maintain a condition of no significant risk. However, since the property was for sale at the time the Phase H was completed, a Class A-3 RAO was filed for the property to "impose the A UL for internal risk management purposes, thereby limiting ground intrusive activities and future uses at the former Exxon property". The Activity and Use Limitation.was recorded at the Barnstable Registry of Deeds on July 18'', 1996. It should be noted that prior to the completion of the Phase H in December 1997,the Department had already implemented the VPH\EPH test method in lieu of EPA Meth 2 p Y p Method 80 0 for analyzing soils contaminated with petroleum compounds. The effective date for the implementation of the VPH\EPH test method(October 31, 1997)was clearly indicated in Section 1.2 of the Policy. The Policy states that sites that had not closed out pursuant to 310 CMR 40.0000 by this date were expected to use the EPH\VPH test methodology for soils contaminated with petroleum compounds. On February 3, 1998 the Department received a report titled"Monitoring Well Abandonment Site.Closure Activities" indicating that all the monitoring wells used for the Phase I and Phase II investigations had been decommissioned. On February'5, 1999, Mr. Mark Panni of the Department conducted a site walkover. During this site visit it was observed that the.entire surface of the property was either paved or covered by the former gas station building. During a follow-up site visit on October 16, 2000, Mrs. Kathryn Carvalho noted that although the site was covered by pavement, it had not been maintained, as required in the Activity and Use Limitation. In carrying out this mandate, the Department has established special procedures for reviewing AULs recorded on or before October 29, 1999, including the ALL submitted as part of the Response Action Outcome (RAO) for your site. The Massachusetts Contingency Plan (310 CMR, 40.00) establishes procedures for assessing and remediating sites where there has been a release of oil or hazardous materials. The Massachusetts Contingency Plan requires that six specific reports be submitted to the Department during the response action process. The Department must approve each of the reports before the next phase of work can be conducted (310 CMR 40. 536) .
