U-shaped driveway. There were only two �

410.750: Conditions Deemed to Endanger or Impair Health or Safety
The following conditions, when found to exist in residential premises,shall be deemed conditions which may endanger or
impair the health, or safety and well-being of a person or persons occupying the premises. This listing is composed of those
items which are deemed to always have the potential to endanger or materially impair the health or safety, and well-being of the
occupants or the public. Because Chapter 11, 105 CMR 410.100 through 410.620 state minimum requirements of fitness for
human habitation, any other violation has the potential to fall within this category in any given specific situation but may not do so
in every case and'therefore is not included in this listing. Failure to include shall in no way be construed as a determination that
other violations or conditions may not be found to fall within this category. Nor shall failure to include affect the duty of the local
health official to order repair or correction of such violation(s) pursuant to 105 CMR 410.830 through 410.833 nor shall failure to
include affect the legal obligation of the person to whom the order is issued to comply with such order.
(A) Failure to provide a supply of water sufficient in quantity, pressure and temperature, both hot and cold, to meet the ordinary
needs of the occupant in accordance with 105 CMR 410.180 and 410.190 for a period of 24 hours or longer.
(B) Failure to provide heat as required by 105 CMR 410.201 or improper venting or use of a space heater or water heater as
prohibited by 105 CMR 410.200(B)and 410.202.
(C) Shutoff and/or failure to restore electricity or gas.
(D) Failure to provide the electrical facilities required by 105 CMR 410.250(B), 410.251(A), 410.253 and the lighting in com-
mon area required by 105 CMR 410.254.
(E) Failure to provide a safe supply of water.
(F) Failure to provide a toilet and maintain a sewage disposal system in operable condition as required by 105 CMR
410.150(A)(1)and 410.300.
(G) Failure to provide adequate exits,or the obstruction of any exit, passageway or common area caused by any object,
including garbage or trash, which prevents egress in case of an emergency 105 CMR 410.450, 410.451 and 410.452.
(H) Failure to comply with the security requirements of 105 CMR 410.480(D).
(1) Failure to comply with any provisions of 105 CMR 410.600, 410.601 or 410.602 which results in any accumulation of gar-
bage, rubbish,filth or other causes of sickness which may provide a food source or harborage for rodents, insects or other pests
or otherwise contribute to accidents or to the creation or spread of disease.
l (J) The presence of leadbased paint on a dwelling or dwelling unit in violation of the Massachusetts Department of Public
Health Regulations for Lead Poisoning Prevention and Control, 105 CMR 460.000. (See M.G.L. c. 111 @@ 190 through 199.)

(K) Roof, foundation,or other structural defects that may expose the occupant or anyone else to fire, burns, shock, accident or
other dangers or impairment to health or safety-
(L) Failure to install electrical, plumbing, heating and gas-burning facilities in accordance with accepted plumbing, heating,
gas-fitting and electrical wiring standards or failure to maintain such facilties as are required by 105 CMR 410.351 and 410.352,
so as to expose the occupant or anyone else to fire, burns, shock, accident or other danger or impairment to health or safety.
(M) Any defect in asbestos material used as insulation or covering on a pipe, boiler or furnace which may result in the release

Dear John Klimm,
We believe that the officials and employees of the Town of Barnstable,specifically the Building Division,
the Board of Health,and the Conservation Division,need to be more actively involved in the enforcement
of town ordinances directed at regulation of rental properties. The currant lack of enforcement has recently
caused us an increase in traffic safety concerns,a decrease in property security,and an overall deterioration
of a,heretofore,tranquil environment on our small,single lane street.
The property at 21 Stanley Place,Hyannis,was recently sold the week of June 19,2006. Since that time,
the new owner,Mr.Toby Russell,has continuously rented the property on a weekly basis to as many as 14
people at one time with as many as 8 cars in the driveway and adjoining road.This property has only three
bedrooms and three bathrooms listed on the Town of Barnstable assessment descriptor.The property also
has a small deteriorating dock and a storage shed that is infested with vermin and insects;both of which are
in violation of current codes and are not listed on the assessment sheet. Additionally,the owner has
trimmed the trees and shrubs on the wetlands to enhance his views of the water.
The owner,who has stated to neighbors that he has no intention of living in the residence,has listed the
property for rent on the Internet at www.gfeatrentals.com.For your convenience,the cover sheet for
property#139325 is attached. This listing clearly shows that the owner does not understand the current or
future ordinances of the Town of Barnstable. Mr.Russell's actions to date,and his public
acknowledgement of his future intent,are clearly in violation of several codes pertaining to renting
property. As a point of departure,we believe that the owner is,or will be, in violation of the following
sections of the ordinance: section 59-3, 59-6, 170-3, 170-4, 170-6, 170-7, 170-8, 170-10.
We understand that the official position of the town is to encourage property owners to rent their properties
in order to encourage tourism and house employees for Cape Cod's small businesses.The recent
promulgation of upgraded ordinances to regulate owners of rental properties,however,appropriately
demonstrates the concern of town management that those owners not destroy the peaceful environment of

CODE II — MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND THE TOWN OF BARNSTABLE CODE CHAPTER 170.
The property owned by you located at 21 Stanley Place Hyannis, was inspected
on March 16, 2007 by Meredith Morgan, Health Inspector for the Town of Barnstable.
This inspection was conducted on the basis of the rental registration in accordance with
Chapter 170 of the Town of Barnstable Code.
The following violations of the State Sanitary Code were observed:
105 CMR 410.503(C)—Protective Railings and Walls. Guardrail around back porch is
28" in height when required to be at least 36".
You are directed to correct the violations listed above within thirty (30) days
of your receipt of this notice by pulling building permits and raising guardrail
height.to a minimum of 36".
You may request a hearing before the Board of Health if written petition requesting same
is received within ten(10) days after the date the order is served.
Non-compliance will result in a fine of $100.00 per violation., Each day's failure to
comply with an order shall constitute a separate violation.

410.750: Conditions Deemed to Endanger or Impair Health or Safety
The following conditions, when found to exist in residential premises, shall be deemed conditions which may endanger or
impair the heaith, or safety and well-being of a person or persons occupying the premises. This listing is composed of those
items which are deemed to always have the potential to endanger or materially impair the health or safety, and well-being of the
occupants or the public. Because Chapter 11, 105 CMR 410.100 through 410.620 state minimum requirements of fitness for
human habitation, any other violation has the potential to fall within this category in any given specific situation but may not do so
in every case and therefore is not included in this listing. Failure to include shall in no way be construed as a determination that
other violations or conditions may not be found to fall within this category. Nor shall failure to include affect the duty of the local
health official to order repair or correction of such violation(s) pursuant to 105 CMR 410.830 through 410.833 nor shall failure to
include affect the legal obligation of the person to whom the order is issued to comply with such order.
(A) Failure to provide a supply of water sufficient in quantity, pressure and temperature, both hot and cold, to meet the ordinary
needs of the occupant in accordance with 105 CMR 410.180 and 410.190 for a period of 24 hours or longer.
(B) Failure to provide heat as required by 105 CMR 410.201 or improper venting or use of a space heater or water heater as
prohibited by 105 CMR 410.200(B) and 410.202.
(C) Shutoff and/or failure to restore electricity or gas.
(D) Failure to provide the electrical facilities required by 105 CMR 410.250(B), 410.251(A), 410.253 and the lighting in com-
mon area required by 105 CMR 410.254.
(E) Failure to provide a safe supply of water.
(F) Failure to provide a toilet and maintain a sewage disposal system in operable condition as required by 105 CMR
410.150(A)(1)and 410.300.
(G) Failure to provide adequate exits, or the obstruction of any exit, passageway or common area caused by any object,
including garbage or trash, which prevents egress in case of an emergency 105 CMR 410.450, 410.451 and 410.452.
(H) Failure to comply with the security requirements of 105 CMR 410.480(D).
(1) Failure to comply with any provisions of 105 CMR 410.600, 410.601 or 410.602 which results in any accumulation of gar-
bage, rubbish, filth or other causes of sickness which may provide a food source or harborage for rodents, insects or other pests
or otherwise contribute to accidents or to the creation or spread of disease.
(J) The presence of leadbased paint on a dwelling or dwelling unit in violation of the Massachusetts Department of Public
Health Regulations for Lead Poisoning Prevention and Control, 105 CMR 460.000. (See M.G.L. c. 111 @@ 190 through 199.)
(K) Roof, foundation, or other structural defects that may expose the occupant or anyone else to fire, burns, shock, accident or
other dangers or impairment to health or safety.
(L) Failure to install electrical, plumbing, heating and gas-burning facilities in accordance with accepted plumbing, heating,
gas-fitting and electrical wiring standards or failure to maintain such facilties as are required by 105.CMR 410.351 and 410.352,
so as to expose the occupant or anyone else to fire, burns, shock, accident or other danger or impairment to health or safety.
(M) Any defect in asbestos material used as insulation or covering on a pipe, boiler or furnace which may result in the release
of asbestos dust or which may result in the release of powdered, crumbled or pulverized asbestos material in violation of 105
CMR 410.353.

Despite such, I am a perpetual target of Town's investigations, mainly due to;th,e relentless
efforts of my unruly neighbors, who seem to have a significant amount of power and
influence in your office, which I find extremely troublesome, and completely improper. It is
readily apparent that our neighbors resent that fact that I am renting out my house. In so
doing, they have engaged in a series of malicious misconduct aimed to disrupt my and my
tenants enjoyment of the property. While meddTownl!sregulatory agenci neighbors are n ot a novel item,es into being the arm

They have advised my tenants that my house is condemned, and informed the same that
they could be evicted at a moment's notice. They have tormented the landscapers. They
have also instilled fear in the young lady who cleans the house.
In my humble opinion, the Town has empowered these neighbors, for each and every time
they contact your office, you rush over to my residence, unannounced, and conduct an

All in all, I truly am bewildered as to why you are immersing yourself in such a petty

responsibilities and obligations I owe the neighbors insofar as to the rental registration
process. How is this a Public Health issue? Is it the neighbors' responsibility to ensure
that I am compliant with the bi-laws? Please advise, for I did not find such upon my
examination of legislation.
Now, you seek to invade my privacy, and expose another member of my family to
harassment, which I find grossly negligent and egregious. Yesterday, I was advised that
the Public Health Division intends to disclose certain information, which I deem private, to
a neighbor who has a documented history of harassment. Please note that I wrote the
Public Health last week, and respectfully requested that this information remain private.
Evidently, the Town's counsel disagrees, and deems it appropriate to disseminate private
information to the public.
Prior to releasing such information, which includes my date of birth, cell phone number,
and various other items that is undoubtedly outside public domain, I would like for you to
reconsider your decision. Obviously, my name and address is public information, for such
are listed on the Town's website, and in so doing, the neighbors are well aware of the
information. In the wake of neighbor's penchant for harassment, and threats of violence, I
would prefer not to arm the neighbors with any more information. I think.they are volatile,
and as such, I worry what they might do. I am surprised that the Town willingly,
knowingly, and voluntarily elects to expose itself to such potential liability, for you just
never know what could happen. If the neighbors continue their campaign of harassment,
and/or their threats of violence materialize, the Town could be held responsible for
facilitating their misconduct.
Since you are not protecting me, and my rights, I must protect myself and my family. My
wife and I, who happen to be practicing attorneys, are currently discussing our options. I
would be happy to hear any insight you have to offer to resolve the issue.
In the interim, I highly recommend you reconsider disclosing my information to anyone
other than a Town Official or my tenant. I work in the Law Department of a government
agency in New York, and as such, I am privy to the protocols of disclosing "public"
information. Normally, we require a duly executed subpoena, or Freedom of Information
Request. Presumably, the same invasion of privacy laws pertain to the Town of
Barnstable.
Nonetheless, if you are so confident that such information is public, I would greatly
appreciate if you could provide me with copies of all the rental registration applications on
file for 2008. 1 am confident that these bi-laws are unconstitutional on their face as well
as how they are enforced, and consequently, I would like this information to contact the
other owners and attempt to have these bi-laws appealed. I would also appreciate if you
could send me an application for a 40-B housing development, and of course, you have my
permission to copy the neighbors on this particular correspondence.
For the record, I was raised on the Cape (Sandwich), most of my family still resides there,
my parents now live in. Hyannis too, and sometime soon, we intend to return. In other
words, I am a local, a Red Sox, Patriots and Celtics fan, but l sure do not feel like I am

The Town of Barnstable ordinance regulating rental property, chapter 170,requires that an owner of a
dwelling which is rented for residential use shall designate a resident agent to represent him within the
county if the owner does not reside within the Commonwealth of Massachusetts.
The owner of the property at 21 Stanley Place,Toby Russell,resides in New York State. We have had
several issues with his tenants and have requested the name and telephone number of his designated
representative from your office. We were told that the Public Health Department could not make that
information public. We are,therefore, officially requesting this information from you due to the following
reasons:
1) There is no privacy provision in the ordinance. In fact,publishing the ordinance and the resultant
Certificates of Registration is evidence that the Town of Barnstable wishes that the information
be public.
2) Insistence by your office that we deal with_a-no --resident owner, or the tenants,to resolve daily
(nightly)issues is inconsistent with th Odinance' requirement that a local resident agent be
identified.
3) Suggestions by your office that we notify the police department if we have issues with tenants
after hours is contrary to our desire to settle any issues amicably with the owner. Many of the
issues are not police department responsibilities and,therefore, cannot be resolved by them.
We are hopeful that dealing directly with the owner's local agent will result in timely solutions to any
problems that we might have without burdening your office or the police. We,therefore request that you
provide us with this information. We also request that you send us an updated copy of the Certificate of
Registration for the subject property.

summer rental has called and complained about cars and people. I have been there on several occasions
and have not seen any violations. Although, the person who has complained knows about section 170-7 and
wants this information incase of further problems. If there were any she would contact this agent. So my
question is. Is this information public record and if so can I furnish this to the requestor. I have two letters, one
from the person requesting this info. I also have a letter from owner of rental property requesting NOT to give
this info. out. Please advise!!!
Based on the questioned posed, I spoke with a lawyer in the Secretary of State's Office, Public Records Division
who confirmed that the name, address and telephone number of the rental agent did not appear to fall into any exception
to the public records law. I conveyed that information to you.
In Mr. Russell's letter, he raises concerns about releasing his date of birth and other similar personal information.
was unaware that such information was part of the information to be released. Certain personal information is not subject
to disclosure under the public records law. Accordingly, if you intend to release any information other than the name,
address and telephone number of the rental agent, please do not improperly interpolate the advice given on the release of
the name, address and telephone number of the rental agent to cover the release any other information collected under
the rental ordinance.

NOTICE TO ABATE VIOLATIONS OF 310 CMR: 15.000 THE STATE
ENVIRONMENTAL CODE TITLE V: MINIMUM REQUIREMENTS FOR THE
SUBSURFACE DISPOSAL OF SANITARY SEWAGE
The property owned by you located at 21 Stanley Place, Hyannis (Assessors Map\Parcel 325-
004) is documented as being connected to the municipal sewer system, account number 3405.
The following is a violation of the State Environmental Code:
310 CMR 15.354: Abandonment of Systems: Property connected to municipal sewer system,
and no septic system abandonment permit on file.
Town of Barnstable Health Department records indicate the property had a septic system
installed and compliance issued on 11/14/1978. No septic abandonment permit on file with the
Town of Barnstable Health Department.
You are directed to correct the violation listed above within thirty (30) days of your receipt
of this notice by obtaining a septic abandonment permit from the Town of Barnstable
Health Department and properly abandoning the septic system.
You may request a hearing before the Board of Health if written petition requesting same is
received within ten(10) days after the date the order is served.
Non-compliance will result in a fine of$1,00.00 per violation. Each day's failure to comply with
an order shall constitute a separate violation.

Place on August 30, 2006 for the purpose of conducting an inspection relative to your

The tenants invited the inspectors inside the dwelling and they were able to inspect inside as

children. The adult female indicated.to.us that they were on vacation. She also stated that there are four bedrooms.total.
within the.dwelling, all located on the first floor,without any bedrooms located.within the basement..
The lot consists of 4.31 acres, it is located outside.of any nitrogen sensitive areas,and the septic system,is.capable.of. .
handling up to seven (7)bedrooms.per the engineering plan on file.
In addition, there were no.garbage or rubbish violations observed.
It was my determination that no.health.code violations.existed at the time of the inspection.

the same time as the sewer hook-up. I am completely confident that the septic was filled
