M. O'REILLY AND ASSOCIATES, INC. is submitting the attached Notice of Intent for the above referenced property. The project proposes to reconstruct the existing parking lot and walkways,and to reconstruct an existing retaining wall. The Notice of Intent is for the retaining wall reconstruction and fora small portion of the parking lot and walkway reconstruction. Please refer to the Existing Condition Plan and Proposed Site Plans(three pages). Wetland Resources: The property directly abuts Bordering Vegetated Wetlands(BVWs)to the Southwest and North. Please refer to the Plans for the location of the resources and the associated Buffer Zones. Existing Conditions The Adams Court development consists of 4 low-rise, elderly, 2-story buildings on a site of approximately 3 acres. Construction of the development was completed.in 1970. There is a total of 64 dwelling units, with a 1-story community building with maintenance shed on site. The existing paved parking lot and walkways are in poor condition and are in need of replacement.The existing retaining wall,which runs along the Southwest portion of the property within the 100' Buffer to the adjacent BVW, is in poor condition and requires replacement. Property management reports no issues related to the performance of the existing drainage systems on site. Proiect Description: The project proposes to reconstruct the existing parking lot and walkways, and to reconstruct an existing retaining wall.The entire proposed retaining wall is within 100'of the BVW to the Southwest of the property. Portions of the proposed parking lot and walkway also fall within 100' of the BVWs to the Southwest and North, as shown on the Site Plans. No work is proposed within either of the BVWs.All work proposed within the 100' Buffer to BVWs is for reconstruction of existing infrastructure. The project will not result in any changes to structure or hardscape coverage within the wetland resource areas and their associates Buffer Zones.All disturbed areas shall be loamed and seeded with a drought tolerant grass seed mix per Cape Cod Cooperative Extension's list of approved plant species for wetland resource areas. 1573 MAIN STREET,P.O.BOX 1773,BREWSTER,MA 02631 ' PHONE: (508) 896-66oi ' FAx: (5o8) 896-6602 WWW.JMOREILLYASSOC.COM 2 Alternative Analysis&Variance Request: The project requires a variance from Massachusetts 310 CMR 10.0 — Wetlands Protection Act to allow for the. reconstruction of the retaining wall and a portion of the parking lot and walkways.J.M.O'REILLY&ASSOCIATES,INC. hereby requests a variance from the regulations of 310 CMR 10.0 to allow work to be completed within the 50' no disturb zone. As such we are providing the following Alternatives Analysis for the proposed work. Alternative One: Do Nothing: This option will maintain the existing condition of the parking lot, walkways and retaining wall. Condition for each will continue to deteriorate, increasing the chances of failure, and potentially increasing repair costs significantly in the future.Potential damage to wetland resources could occur if retaining wall is allowed to fail. Alternative Two;Repair Retaining Wall:This option will make repairs to the retaining wall instead of replacing it.Due to the likely age of the retaining wall(property developed in 1970),repairing or reinforcing the retaining wall is likely to be infeasible or impractical. Additionally, a similar amount of disturbance near the BVW would be required in order to make the repairs. Any repairs could not be expected to have the same level of structural strength and durability as a newly constructed replacement retaining wall. -Alternative Three; Current Proposal:This option, as outlined,will reconstruct the existing retaining wall, as well as the parking lot and walkways, a portion of which is within the 100' Buffer to the BVW. 310 CMR 10.00 Performance Standards: 310 CMR 10.55 Bordering Vegetated Wetland: (4)General Performance Standard (a-c) Not applicable, no work shall be conducted within The BVW. Work to be conducted within Buffer Zone only. Conclusions: The owners and project proponents have considered and are meeting the state wetland performance standards for the Bordering Vegetated Wetland.The proposed retaining wall will protect the BVW from erosion and stabilize the bank surrounding it. Completing all needed infrastructure reconstruction concurrently will thereby minimize disturbances to the BVWs as a result of construction activities. A representative from our office will present the project at the next Conservation Commission Public hearing, currently scheduled for 8/20/2019. Failure to complete any of the items in this checklist may result in your application being denied. Applicant or applicant's agent should check each box denoting that the task has been completed or in certain instances,like field staking,denoting that the task will be completed. The following submission checklist covers the requirements of Chapter 237,Wetlands Protection,of the Part I General Ordinances of the Code of the Town of Barnstable.This checklist shall be submitted to the Barnstable Conservation Division with the NOI application. 1. Requirements a. The cost of the legal ad will be pre-calculated and posted on the hearing agenda prior to the hearing. 5. Minimum Documentation for a Complete Application: 10/ a. Provide a completely filled-out(in all parts)NOI application as locally adopted for the Town of Barnstable,including DEP Vegetated Wetland Field Data Form. M. 0 REILLY AND ASSOCIATES, INC. is submitting the attached Stormwater Report as part of the Notice of Intent filing for the above referenced property. The project proposes to reconstruct the existing parking lot and walkways, and to reconstruct an existing retaining.wall. The Notice of Intent is for the retaining wall reconstruction and for a small portion of the parking lot and walkway reconstruction. Please refer to the Existing Condition Plan and Proposed Site Plans(three pages). The proposed project does not significantly alter the dimensions,size or elevations of the existing parking lot and walkways. A few additional parking spaces and walkway areas are proposed to replace existing flat, landscaped areas,however this will not result in significant changes to the overall hardscape coverage of the lot. Also, no increase in structure or hardscape coverage is proposed within the 100' Buffer Zones to either of the Bordering Vegetated Wetlands(BVWs)that abut the property.There will be no change or increase in use associated with this reconstruction; the additional parking spaces are being added to replace grass and dirt areas that are currently used for parking due to lack'of sufficient parking spaces. The site is currently served by 5 leaching catch basins,see Existing Condition Plan for locations. Barnstable Housing Authority has not observed stormwater issues within the parking lot areas, which are served by the catch basins. The Housing Authority has observed stormwater runoff accumulation in the front entrance ramp areas for each of the four apartment buildings. To address this issue, proposed stone drainage swales have been proposed for each of the entrance ramps, see Site Plan and Drainage Detail for further information. Prior to the start of construction, 3 total limit of work lines consisting of staked 9" straw waddles shall be installed as shown on the Site Plan. Limit of work lines shall be inspected weekly throughout construction, repaired as needed, and shall remain in place until construction activities are complete and vegetation has reestablished. Existing catch basins shall remain in use, with filter fabric installed underneath the grates so as to prevent organic and/or fines infiltration into the subsurface stormwater systems. It is our opinion that this redevelopment project is providing stormwater runoff protection for the abutting Bordering Vegetated Wetlands and abutting properties to the maximum extent feasible. A major contributing factor to the recent condemnation(May 2003) was the fact that Ms.Dunham had a dog that was not let out when needed and as a result defecated and urinated in the dwelling. This contributed to odors and very unsanitary conditions in this unit. Ms.Dunham has re-occupied the unit as of Monday,June 9,2003 along with her cat. A professional cleaning company, Service Master,cleaned the unit after discussion with myself and Harriet's family. Mr.Dunham called me from Delaware at 8:20 am on June 9,2003 to state that the work was done. Service Master,called at 12:30 pm that same day to state that the work discussed was completed thereby allowing Ms.Dunham to return. Mr.Dunham stated that Elder Services was helping out Harriet and when asked to what extent he stated that she would have services on a daily basis. Upon re-inspection of the dwelling on August 1,2003 it was found that the cat's litter box was not being properly maintained and that her services were greatly reduced if not eliminated. The nurse has discontinued her services to Ms.Dunham and her home care through Elder Services has been decreased to on hour of service twice a week. This falls drastically short of the services that were agreed upon by Ms. Dunham's brother,Mr. Charles Dunham. The second means of egress is once again blocked by furniture and large 50-lb.bags of Sunflower seeds to feed the birds. There were many paper plates of cat food on the floor along with open food left out along with unsanitary conditions in the refrigerator and microwave. Ms.Dunham's vials of insulin and syringes were once again stored on the bathroom baseboard heating unit. Many flies were also swarming in the unit which are an indicator of filth and breed disease. The dwelling also exhibits objectionable odors due to a general lack of sanitation. (A) Failure to provide a supply of water siff cient in quantity, pressure and temperature, both hot and cold,to meet the ordinary needs of the occupant in accordance with 105 CMR 410.180 and 410.190 for a period of 24 hours or longer.
