The septic permit was issued in error, so the project cannot move forward until it complies with the code. This is being placed on hold to prevent any further costs or issues until the problem is resolved. The following are issues to be resolved: 1. The State does not allow an increase in flow to a septic system with a sieve analysis. 2. This septic permit is associated with another property which was once a single lot. When the property was divided, it created variances for the new septic system to be installed at the main house (#62 Wachusett Ave.) These variances must be granted by the Board of Health. If the said properties remained as a single lot, a variance before the Board of Health would not be required. A title V inspection was not submitted to the Health Division for the property transfer. My purpose in writing is to request a determination from you that the property in question consists of two (2) separate legal lots, each containing a single family residence, that will allow the title to be split for zoning, title and assessing purposes. The property consists of Lot 25 and Lot 26, as shown on a plan entitled "Plan of Seashore Lots Belonging to the Hyannis Land Company In Hyannis Barnstable County Mass. R. Cook Surveyor Scale 200 ft. to an inch 1872." Each of the lots measures on the plan to be fifty (50') feet by one hundred (100") feet, and are both located on Wachusett Avenue next to each other. At all times, the properties were conveyed by deeds with separate designations of the lots and with separate descriptions of the lots. Lot 25 is improved with a single family residence that was constructed in 1890. Lot 26 is improved with a single family residence that was constructed in 1950. Both lots have been in common ownership since 1947 and previously were owned by the same woman from 1927 until she combined ownership of the lots into herself and her husband through straw deeds in 1946. Massachusetts General Laws Chapter 41 Section 81 K was enacted in substantially its present form in 1953. At its enactment, it validated all sub- divisions recorded before February 1, 1952 to the extent the lots in question have been sold and ways appurtenant to them established before that date. Clearly, Lot 25 and Lot 26 are located on a valid subdivision plan. Wachusett Avenue has serviced the home on Lot 25 for over one hundred years. My client's intentions are to create a perimeter plan (81X plan) of each lot separately and to record the plans. After that, Mr. Gremer will bring copies of the recorded plans to Barnstable Assessing Department to have the Town start to tax the lots separately. . For lots held in common ownership, the second sentence of M. G. L. Chapter 40A Section Paragraph 4 now reads: Any increase in the area, frontage, width, yard, or depth requirement of a zoning ordinance or by-law shall not apply for a period of five years from its effective date or five years after [January 1, 1976] whichever is later, to a lot for single and two family residential use, provided the plan for such lot was recorded or endorsed and such lot was held in common ownership with any adjoining land and conformed to the then existingrrequirements as [January 1, 1976] and had less area, frontage, width, yard or depth requirements than the newly effective zoning requirements but contained at least seven thousand five hundred square feet of area and seventy-five feet of frontage.... An earlier version of this second sentence was added to the old Zoning Enabling Act by 1961 Mass. Acts. 435, which allowed residential construction for five years after the date of the recording or endorsement (of the zoning change) if, at the time of such recording or endorsement, the lot conformed to existing requirements and contained at least 5,000 square feet of area and 50 feet of frontage. The Town ByLaws indicate that the first sub-division control laws pertaining to area and frontage in the Village of Hyannis Port were recorded in 1949 (Article 75), Hyannis Port being among the first villages where such restrictions applied. The house on Lot 25, which is a one-bedroom cottage, was finished in 1950, well before the lot's grandfathering rights lapsed. Therefore, no merger of Lot 25 and Lot 26 occurred. This building is separated metered for electricity and natural gas. It contains the original kitchenette, a full bathroom, a bedroom and a sitting room. Over the course of some years, it was rented out, in conjunction with the house on Lot 26 under the name of Hillcrest-by-the-Sea. Otherwise, it was used by the owner as a•residence. Both of the residences on Lot 25 and Lot 26 have been used regularly since their construction. mainly as Summer homes. Regarding#62 this was an existing 5 bedroom house (one on first floor, 4 on second floor), going to a four bedroom design, so not "new construction" which would require the perc test, so sieve should be o.k. with local approval. (properly assessed as 5 bedroom). The variances for#62 are clearly stated on the plan,they need to be applied for under maximum feasible compliance, as no increase in septic flow, they have been applied for(see attached). Regarding#2 The dwellings are on two separate legal developed lots, shown as Lot 25 and 26 on Plan Book 26 Page 95, and later on the attached perimeter plans. The Town Building Commissioner confirmed the owners position that the properties were always separate developed lots protected through all zoning changes, (see attached letter).They were formerly improperly merged for assessing purposes, causing the below confusion. Not sure on the Title 5 inspection, I think the new owners just conceded to upgrade the systems using these designs? Thanks, Daniel A.
