O'Connell because of a complaint. The following violation of the Town of Barnstable Board Code was observed: § 353-1 Responsibilities of Owners: Garbage and rubbish observed in the back and side yard not within proper receptacles. You are directed to remove the garbage and rubbish from your property and dispose of it properly within 7 days of your receipt of this notice. You may request a hearing before the Board of Health if written petition requesting same is received within ten (10) days after the date the order is served. Valerio 73 Walnut Street, Hyannis, Ma 02601 BAR# 76464 To Whom It May Concern: On April 15,2008 in response to a complaint myself and another Barnstable Board of Health Inspector, Timothy O'Connell inspected the above property and observed Rubbish, debris in the yard and garbage not contained in watertight and rodent proof containers. The inspectors spoke to the owners/occupants sister who came to the door and informed her that if the debris and garbage were not removed in twenty four(24)hours a citation would be issued as there had been three previous nuisance complaints at this location. After a follow up visit where I observed no improvements I was instructed by my Department Head to issue a citation to the owner Sheryfa Valerio. (BAR# 76464) for violations of Board of Health Regulation, Chapter 353: Nuisances, Article 1, Storage of Rubbish and Garbage, Section 353-1. - Responsibilities of owners and occupants. The owner of any building,vacant or otherwise,or parcel of land shall be responsible for maintaining such building or land in a clean and sanitary condition,free from garbage,rubbish, or other refuse. Garbage, or mixed garbage and rubbish, shall be stored in watertight receptacles with tight fitting covers. said receptacles and covers shall be constructed of metal or other durable,rodent proof material. Rubbish means combustible or non-combustible waste materials,except garbage,including,but not limited to such material as paper,rags,cartons,boxes,wood,bottles,plastic,rubber,leather, tree branches,yard trimmings,grass'clippings,tin cans,metals,mineral matter,glass,crockery, dust,-and residue from the burning of wood,coal,coke, and other combustible materials. Garbage means the animal,vegetable,or other organic waste resulting from the handling, preparing,cooking,consumption or cultivationof food,and containers and cans which have contained food unless such containers and cans have been cleaned or prepared for recycling.
