The Department of Environmental Protection(MassDEP)personnel, on June 14, 2007, conducted a BAT Presence inspection and have observed or determined that activity occurred at Centerville Cleaners in noncompliance with one or more laws, regulations, orders, licenses, permits, or approvals enforced by the MassDEP. Based on MassDEP's investigation on June 14, 2007, noncompliance occurred or was observed at Centerville Cleaners in noncompliance with one or more laws, regulations, orders, licenses, permits or approvals enforced by the MassDEP. This Notice of Noncompliance describes (1) the requirement violated, (2) the date and place the MassDEP asserts the requirement was violated, (3) either the specific actions which must be taken in order to return to compliance or direction to submit a written proposal describing how and when you plan to return to compliance, and (4) the deadline for taking such actions or submitting such a proposal. If the required actions are not completed by the deadlines specified below, an administrative penalty may be assessed for every day after the date of this Notice that the noncompliance occurs or continues. Air Quality 1. Centerville Cleaners was not measuring and recording the dry cleaning unit's temperature at the end of cycle on the outlet side of the refrigerated condenser on a weekly basis (missing May 19, 2007 thru June 11, 2007). This constitutes a condition of noncompliance with 310 CMR 7.26(14)(a)(1) and 7.26(15)(d)(5), which is referenced in Appendix C-4,page 41 in the Dry Cleaners Environmental Certification Workbook. f 2 2. Centerville Cleaners was not performing weekly (missing May 19, 2007 thru June 11, 2007) leak checks on the dry cleaning equipment or keeping a written log of leak checks. This constitutes a condition of noncompliance with 310 CMR 7.26(13)(i) & 0) and 7.26(15)(d)(6),which is referenced in Appendix C-2,page 39 in the Workbook. B. Hazardous Waste 1. Centerville Cleaners was not conducting weekly inspections of the hazardous waste accumulation area. This constitutes a condition of noncompliance with 310 CMR 30.351(8)(b) which references 30.342(1)(d)(1&2&3) which in turn references 30.686. See Item C-34,page 21 in the Workbook. 2. Centerville Cleaners did not meet all of the emergency notification procedures. Specifically, the facility has not posted the names and telephone numbers of emergency coordinators, locations of fire alarms and extinguishers, fire department telephone numbers and evacuation routes. This constitutes a condition of noncompliance with 310 CMR 30.351(9)(c)(6)(a-d). See Item A-9,page 7 in the Workbook. 3. Centerville Cleaners had not designated the storage area for hazardous waste with a visible line, floor tape or fence. This constitutes a condition of noncompliance with 310 CMR 30.351(8)(a)which references 30.341(5). See Item C-25,page 20 in the Workbook. 4. Centerville Cleaners had two containers of hazardous waste that were open when not in use. This constitutes a condition of noncompliance with 310 CMR 30.351(8)(b)which references 30.342(1)(c), which in turn references 30.685. See Item C-22,page 19 in the . Workbook. ACTION(S)TO BE TAKEN AND THE DEADLINE FOR TAKING SUCH ACTION(S): The following action(s)to be taken have individual deadlines associated with them. Your company shall take the necessary steps to correct the violations within the specified deadlines as noted and shall return to compliance with the requirements described below. The MassDEP's regulations at 310 CMR 5.09 presume receipt of this Notice of Noncompliance,if delivered by regular mail, three business days after its date of issuance. A. Air Quality 1. Within five (5) days of receipt of this Notice and thereafter, Centerville Cleaners shall completely document the results of weekly temperature monitoring from the outlet side of the refrigerated condenser. 2. Within five (5) days of receipt of this Notice and thereafter, Centerville Cleaners shall conduct weekly leak checks and completely document the results of weekly leak checks on the dry cleaning equipment. 3 B. Hazardous Waste 1. Within five (5) days of receipt of this Notice and thereafter, Centerville Cleaners shall conduct weekly inspections and document the results of the inspections of the hazardous waste accumulation. 2. Within ten (10) days of upon receipt of this Notice, and thereafter, Centerville Cleaners shall post next to a telephone: a. The name(s) and telephone number(s) of the emergency coordinator; b. The location(s) of the fire extinguisher(s) and spill control material(s), and if present, the fire alarms; C. The telephone number of the fire department, or, if there is a direct alarm system, instruction on how to activate it, or both; and d. Evacuation routes,where applicable. 3. Within five (10) days of receipt of this Notice and thereafter, Centerville Cleaners shall designate the storage area for hazardous waste with a visible line, floor tape or fence. 4. Within one (10) day of receipt of this Notice and thereafter, Centerville Cleaners shall ensure that all containers of hazardous waste shall remain closed when not in use.
