Dear Mr. Gralton:
On' April . 7, 1997, the Department of Environmental Protection,
Bureau of Waste Site Cleanup (the Department) , received a report
titled "Unit' 3 Group, Barnstable Aquifer Protection Project, Phase II
- Comprehensive Site Assessment Report" (the Phase II Report) dated
March 24 , 1997, prepared by SEA Consultants, Incorporated. The Phase
II Report was accompanied by BWSC Form-104 titled "Response Action
Outcome (RAO) Statement & Downgradient Property Status Transmittal"
prepared on your behalf by William J. Mallio, the Licensed Site
Professional of record for the property located at 201 Old Yarmouth
Road (the site)
The Phase II Report indicated that process waste (i . e . , spent
inks, paints, solvents and thinners) associated with the Former
Cotton Pick' n Tees screening process was discharged to the on-site
septic system located west of the building and a dry well . The
process waste contained heavy metals, aldehydes, phthalates and
corrosive and organic solvents . The Report also indicated that
groundwater flow is east/northeast toward the Maher Municipal
Wellfield and petroleum compounds (i .e . , benzene, toluene,
ethylbenzene, xylene, total petroleum hydrocarbons, and ethylene
,. dibromide) were the only constituents identified in the monitoring
wells located upgradient and at the site . In addition, the Report
indicated that a release of oil occurred at a Sunoco Service Station
(formerly known as -the . Charter Service Station) , an Exxon Service
Station (formerly the BP Station) and Nelson Coal and Oil Company are
located west of .and hydrogeologically upgradient of the site on
Iyanough Road.

Based on the information specified above, the Licensed Site
Professional (LSP) of record for the site, Mr. William J. Mallio,
provided an opinion that the presence of petroleum products in the
groundwater beneath the property located at 201 Old Yarmouth Road
resulted from a release from upgradient sources . The Department
reviewed the Phase II Report and concurs with this opinion. The
Downgradient Property Status shall be limited to the release of
petroleum products described herein and to the KAM Appliance property
boundary.
Please be advised, that the Downgradient Property Status for
this site shall terminate if :
1 . new information becomes available which indicates that the
criteria in 310 CMR 40 . 0183 (2) are no longer met;
2 . the person providing the Downgradient Property Status
Submittal fails to meet the requirements specified in 310
CMR 40 . 0185 for maintaining such status;
3 . the person providing the Downgradient Property Status
Submittal notifies the Department in writing that such
person intends to perform Comprehensive Response Actions in
accordance with 310 CMR ,40 . 0800 ;
4 . the Department establishes Interim Deadlines in accordance
with 310 CMR 40 . 0167 and/or issues an order requiring the
performance of response actions pursuant to Massachusetts
General Law c . 21E, Section 9 or 10 .

The Department of Environmental Protection, on January 4 ,
1991, conducted a follow-up inspection of the property located at
201 Yarmouth Road, Hyannis, Massachusetts, formerly operated by
Cotton Pickin' T' s. The purpose of the inspection was to verify
that as custodian of the property, Cape Cod Bank and Trust has
complied with the deficiencies outlined in the Department' s two (2)
"Notices of Noncompliance" dated May 7 and July 10, 1990, relative
to the Massachusetts Hazardous Waste Regulations as contained in
310 CMR 30. 000.
At the time of the follow-up inspection a one gallon container
of photochemical waste remained on site. On January 24 , 1991, a
copy of manifest MAF031235 was received by this office indicating
that the remaining one gallon of photochemical waste had been
shipped off site on January 7, 1991.
The follow-up inspection, in conjunction with manifest
MAF031235 confirmed that all hazardous waste has. been properly`
removed from the property.
As a result of this corrective action and in view of your
current operational status, the Department has determined that Cape
Cod Bank and Trust has complied with the two Notices of
Noncompliance issued on May 7 and July 10, 1990.

Dear Ms. Dogon:
The Town of Barnstable Health records were reviewed by
Edward Barry, Health Inspector, and the following
information is noted for the indicated properties:
a. 201 Yarmouth Road, Hyannis, Ma. , Assessor's Map 328,
Parcel 137, formerly Cotton Picking T's - is listed as a
priority site by DEP where oil and hazardous materials
discharge in with the wastewater from the silk screen
process into the septic system and into a dry well on
property. The property is now owned by Cape Cod Bank and
Trust.
b. 180 Iyanough Road (Rte. 28) Hyannis, Ma. , Assessor's Map
328, Parcel 131, 1.2 - is the main office of the Nelson Coal
and Oil Company. The Barnstable Water Company of Hyannis,
has three wells (entitled the Maher Wells) located one-half
mile east of this property which were found to be
contaminated with volatile organic compounds. Test wells in
the vicinity of Nelson Coal and Oil Company showed same
contamination and became a potential Responsible Party
(PRP) . This site is now considered a priority site in Phase
I of the Massachusetts Contigency Plan. In addition in
1990, there was an overfill of #2 fuel while filling one of
the three 10,000 gallon above ground tanks. The spill was
about 50 gallons and was contained in one bay of the cement
enclosure below the three tanks. About four (4) cubic yards
of contaminated soil was removed from site.
c. 156 Rte. 28 (Iyanough Road) Hyannis, Ma. Assessor's Map
328 Parcel 151.57A - is the Mobil Gas Station. As of this
date, this location is considered by DEP as priority
petroleum release site in Phase I of the Massachusetts
Contingency Plan.
d. Brooks Road, Hyannis, Ma. , Assessor's Map 328, Parcel
125,76A - is an unclassified site for a petroleum release in
Phase I of the Massachusetts Contingency Plan.
e. 287 Iyanough Road, (Rte. 28) Assessor's Map 328, parcel
210 - is the site of the former Remada Inn and the Sand
Dollar. The Health Department has no records of any
hazardous waste spills at this site.

1. The inspection revealed that you are a Small Quantity
Generator (SQG) of hazardous waste but you have not notified
the Department of such status nor obtained a site specific,
permanent EPA identification number, in violation of 310 CMR
30.351(10) (c) which references 310 CMR 30. 303. An SGQ is one
who generates greater than 100 kilograms (approximately 27
gallons) but less than 1000 kilograms (approximately 270
gallons) of hazardous waste in any calendar month. The
Department acknowledges that you have submitted a registration
form for status as .a Very Small Quantity Generator, but this
status is not accurate.
Therefore, you must immediately comply with the Regulations
by notifying the Department of your status as a Small Quantity
Generator and obtaining an EPA identification number. The
notification shall be on the enclosed form, prescribed by the
Department, which you must complete, sign and submit to the

the completed form shall be submitted to the attention of
Stephanie Syler of this Regional Office. You are advised that
an SGQ may not accumulate greater than 2000 kilograms of
hazardous waste nor store such waste on site for a period
greater than 180 days.
2 . You are accumulating waste on site without having determined
whether or not the waste is hazardous, in violation of 310 CMR
30. 351 (10) (b) which references 310 CMR 30. 302 . Said waste
included, but is not necessarily limited to, two (2) drums of
unidentified liquid material, located in the basement.
Therefore, you must, within thirty (30) days of receipt of
this Notice, identify the waste material observed in the drums

during the inspection and determine whether or not this waste
and any other unidentified waste stored or accumulating on
site is hazardous waste pursuant to the Regulations.
3 . You are accumulating hazardous waste on site in containers
which are not properly labelled, in violation of 310
CMR. 30 (351) (8) (a) which references 310 CMR 30. 340 (1) (b) . Said
waste includes, but is not necessarily limited to, seventeen
(17) pails of photochemical wastes located in and adjacent to
the dark room.
Therefore, you must immediately clearly mark all containers
of hazardous waste with the following:
a. The words "Hazardous Waste";
b. The hazardous waste identified in words (i.e. ,
silver) ;
C. The type of hazard associated with the waste (i.e. ,
toxic) ;
d. The date when accumulation in each container begins.
Furthermore, any other waste presently accumulating which has
yet to be determined as hazardous, and all hazardous waste
generated and accumulated in the future, must be in properly
labelled containers.
4. You are accumulating hazardous waste in containers which are
not covered, in violation of 310 CMR 30.351(8) (a) which
references 310 CMR 30. 340(1) (a) and 30.685. Said containers
included, but are not necessarily limited to, six (6) pails
of photochemical waste.
Therefore, you shall. immediately cover all containers of
hazardous waste. Furthermore, any other waste presently
accumulating which has yet to be determined as hazardous, and
all hazardous waste generated and accumulated in the future,
must be secured in containers which remain closed except when
said waste is being added or removed.
5. You are accumulating hazardous waste in areas which are not
properly designed or designated as hazardous waste storage
areas, in violation of 310 CMR 30. 351(8) (b) which references
310 CMR 30.340( (1) (j) (k) .
Therefore, you shall immediately establish a designated
storage area for your hazardous waste which is distinguishable
at all times from other areas (such as virgin product storage
areas) . In addition, the area shall be posted at all times
with a sign which includes the words "Hazardous Waste" in

capital letters at least one inch high. Hereafter hazardous
waste shall be stored only in such designated areas in
compliance with the Regulations.
In addition, Department personnel observed that you had
greater than 100 pails of various inks accumulating on site which
you have yet to determine as usable product or waste. Be advised
that once you define which inks are usable in your process and
which inks are considered waste which must be disposed of, you must
further determine if the waste inks are hazardous waste pursuant
to the Regulations. All such hazardous waste must then be managed
in compliance with the Regulations for Small Quantity Generators.
Furthermore, relative to the unpermitted discharge to a dry
well, which was observed by Department personnel during , the
inspection, you are advised that said discharge is being referred
to the appropriate regulatory division within the Department.
Relative to this Notice of Noncompliance the Department
requires a written response, within fifteen (15) days of receipt
hereof, indicating actions taken in order to achieve and maintain
compliance with the regulations.

NOTICE OF RESPONSIBILITY

Gentlemen:
This letter concerns the existence of volatile organic
compounds (VOCs) in the environment surrounding the Cotton Pickin
T's facility located at 201 Yarmouth Road, Hyannis, Massachusetts,
(hereafter, the site) . The Department of Environmental Protection,
Bureau of Waste Site Cleanup (hereafter, the Department) , has
determined that the site is a priority disposal site for oil and
hazardous materials within the meaning of the "Massachusetts Oil
and Hazardous Material Release Prevention and Response Act"
(M.G.L. , c21E) . The site is located within the zone II
(approximately 600 ' upgradient) of the public water supply well
field known as Maher Wells 1,2 and 3 , owned by the Barnstable Water
Company.
The Department is investigating the sources) of
contamination affecting the water quality at the water supply
wells. On April 4, 1990, Department personnel conducted an
inspection of the site. At that time, discharges of waste water
from the silkscreen process to the septic system and a dry well on
site were documented.
Information regarding conditions at the site prepared and
submitted on your behalf by K.V. Associates, Inc. 'to the Department
include the following:
- "Site Report Relative to Hazardous Material", February 1988 .
- "Supplemental Work Relative to a Site Report on Hazardous
Material" , March 1988.

observation wells installed at the site confirm the presence of
VOCs.
The assessment and cleanup of disposal sites, areas where oil
or hazardous materials have been released or come to be located,
is governed by M.G.L. , Chapter 21E, and by 310 CMR 40. 000, the
Massachusetts Contingency Plan (hereafter, the MCP) .
Based upon the available information, the Department has
reason to believe that you are a potentially responsible party
(PRP) with liability under M.G.L. , c. 21E, Section 5. Section 5
makes the following parties liable to the Commonwealth: current and
past owners and/or operators of a site; any person who arranged for
or transported, stored, disposed of or treated hazardous materials
to or at the site; or any person who in any way caused the release
or threat of release of oil or hazardous materials. The nature of
this liability is joint and several and without regard to fault.
The Department is authorized pursuant to M.G.L. , c. 21E,
Sections 3A (j) and 4 to take such response actions at the site as
it deems necessary should you fail to respond to these releases in
an appropriate and timely manner. Any response actions taken by
the Department will be dictated by the individual characteristics
of the site and by the time lines set out in M.G.L. , c. 21E,
Section 3A and the MCP.
The Department encourages potentially responsible parties to
take response actions to assess and cleanup contamination at sites.
By taking the response actions you make it unnecessary for the
Department to have its contractor perform the work. If you do not
take the necessary response actions the Department is authorized
by M.G.L. c. 21E sections 3A(j) and 4 to have the work performed
by its contractor and recover up to three (3) times its costs from
you.
Regardless of who performs the necessary work at the site, you
may be liable for all the Department's response action costs.
Response action costs include the cost of direct hours for work
performed by Department employees in overseeing or arranging for
response actions, any expenses incurred by the Department in
support of those direct hours, as well as payments to the
Department's contractors (for more details see the cost recovery
regulations at 310 CMR 40. 600 et sea. ) .
In addition to your liability for up to three (3) times the
response action costs incurred by the Department, you may also be
liable for damages for loss of natural resources, and interest on
the total outstanding liability at the rate of 12% compounded
annually. To guarantee payment of this debt the Department may

place a lien on all of your property within the Commonwealth. To
recover the debt the Department may foreclose on the lien or the
Attorney General may bring a court action against you.
As a party potentially liable for releases at the site, the
Department requires that you take the steps outlined below:
1. Provide the Department with a written response within
fourteen (14) days of your receipt of this Notice,
indicating whether you intend to take the necessary
actions.
2 . Contract with a consultant knowledgeable in hazardous
waste site assessment and abatement to conduct the
following work in accordance with the MCP:
a. Complete and submit, within forty-five (45) days of
receipt of this Notice, a Preliminary Assessment
Report (copy enclosed) meeting the requirements of
40.541 of the MCP.
b. Complete the Phase I-Limited Site Investigation and
Report as outlined in 40.543 of the MCP. All items
must be addressed. Note that in order to determine
the source and extent of contamination at the site,
additional observation wells (deep and shallow) need
to be installed in the area downgradient of the on
site septic system and dry well. To determine the
depth of the wells and the length/location of the
screen, split spoon samples should be taken
continuously to be tested for the presence of VOCs
utilizing a field gas chromatograph or similar
instrument.
The Phase I Report shall include, at a minimum, the
following:
1. Boring logs, well construction specifications, a
description of the drilling method;
2. , A listing of all chemicals (generic names) and
quantities used, stored and disposed of at the
site;
3 . Maps drawn to scale showing the location of the
observation wells, catch basins, utility lines,
septic system, dry well, floor drains and
associated piping;
4. A current ground water and contaminant plume
contour map; and,

5. Characterization of the contents of the septic
system and the dry well by sampling and testing
for the chemicals listed under item 2 above; and,
6. Results of laboratory and field testing data.
Ground water from all wells (existing and new) w
should be sampled and analyzed for VOCs utilizing
EPA Method 624. In addition, the sampling plan
should include the chemicals listed in item 2 for
soil and ground water samples. All laboratory
data must comply with the Department's "Minimum
. Standards for Analytical Data for Remedial
Response Actions Under M.G.L. , Ch. 21E, Policy
#WSC-89-004" (copy enclosed) .
C. Complete the Interim Site Classification Form (copy
enclosed) in accordance with 40. 544 of the MCP.
Because the site is located within the zone II of
public water supply wells and contamination was found
in ground water at the site, the site has been
classified as a priority disposal site, in accordance
with 310 CMR 40.544 (2)-(c) . However, due to the lack
of sufficient information available to the Department,
the remaining criteria have to be addressed.
The Phase I -Report documenting all Phase I activities
shall be prepared and submitted, in conjunction with
the Interim Site Classification Form, to the
Department within 90 days of receipt of this Notice;
and,
d. The consultant shall also evaluate the need for a
Short Term Measure (STM) as defined in 40.542 of the
MCP. If at any time an imminent hazard is discovered
at the site, you must immediately notify the
Department and submit a proposal for a STM. This
evaluation shall continue throughout the assessment
process for the site.
Depending on the information generated by the above work, the
Department may require additional investigations, studies and
actions.
Be advised that the site has been placed on the Massachusetts
Hazardous Waste Site List in accordance with M.G.L. , C. 21E,
Section 3A, resulting in the tracking of the progress of this site
by the Department.
