Director, Public Health Division Town of Barnstable 200 Main Street Hyannis, MA 02601 Subject: Proposed Septic System Repair, 279 Yarmouth Road, Hyannis Dear Tom, I am writing to discuss the matter of the repair of the failed septic system located at 279 Yarmouth Road, Hyannis, MA. I have been retained by the property owner, Mr. John Robichaud (Robles Heating—Cooling— Refrigeration)to address this matter, and develop a reasonable solution, satisfactory to you. As you probably know, I was the design engineer who prepared the original septic system repair plans, which are signed and dated 10 November 1996- 1 prepared these plans when I worked for Horsley&Witten, Inc. (now Horsley Witten Group)_ It is my understanding that your Department will still accept the original design, provided a distribution box is added to the design plans- between the proposed septic tank and leaching trench - and a new application for subsurface sewage disposal system is provided. Unfortunately, the original digital files for the design plans cannot be found. In lieu of that I have attached a revised system profile sketch with the D-Box added, and the invert elevations shown or revised as appropriate. I hope this will serve as an adequate substitute to allow the repair to be completed. Mr_ Robichaud has recently pumped the existing cesspool, and has assured me that he will continue to do so until the system is repaired. Unfortunately, Mr. Robichaud has informed me that this is the worst time of year to conduct this repair. The refrigeration and cooling part of his business is in peak demand, and the area needed for the septic repair would cause extreme disruption to his business. Additionally, he feels that the relocation of his repair van fleet during the construction will cause traffic difficulties on Yarmouth Road during the present peak summer season. He is requesting a new deadline for the installation of a new system of September 30, 2005. He has asked me to monitor the existing cesspool it with him until the repair is made, and has agreed to pump it monthly, as necessary. It is my understanding that your Department will still accept the original design, provided a distribution box is added to the design plans- between the proposed septic tank and leaching trench - and a new application for subsurface sewage disposal system is provided. Unfortunately, the original digital files for the design plans cannot be found. In lieu of that I have attached a revised system profile sketch with the D-Box added, and the invert elevations shown or revised as appropriate. I hope this will serve as an adequate substitute to allow the repair to be completed. Mr. Robichaud has recently pumped the existing cesspool, and has assured me that he will continue to do so until the system is repaired. Unfortunately, Mr. Robichaud has informed me that this is the worst time of year to conduct this repair. The refrigeration and cooling part of his business is in peak demand, and the area needed for the septic repair would cause extreme disruption to his business. Additionally, he feels that the relocation of his repair van fleet during the construction will cause traffic difficulties on Yarmouth Road during the present peak summer season. I Report, M.G.L. , Chapter 21E and 310 CMR 40. 000 Gentlemen: This letter concerns the existence of volatile organic compounds (VOCs) in the environment surrounding the Robie's Refrigeration facility located at 279 Yarmouth Road, Hyannis, Massachusetts, (hereafter, the site) . The Department of Environmental Protection, Bureau of Waste Site Cleanup (hereafter, the Department) , has determined that the site is a priority disposal site for oil and hazardous materials within the meaning of the "Massachusetts Oil and Hazardous Material Release Prevention and Response Act" (M.G.L. , c21E) . The site is located within the zone II (approximately 500 ' upgradient) of the public water supply well field known as Maher Wells 1,2 and 3, owned by the Barnstable Water Company. The 'Department is investigating the source(s) of contamination affecting the water quality at the water supply wells. In an attempt to determine the source of contamination, the Barnstable Water Company obtained ground water samples at the site and downgradient of the site. Results of the analyses of the samples indicate the presence of volatile organic compounds (VOCs) including Dichlorodifluoromethane, a compound commonly used in the refrigeration industry. The assessment and cleanup of disposal sites, areas where oil or hazardous materials have been released or come to be located, is governed by M.G.L. , Chapter 21E, and by 310 CMR 40.000, the Massachusetts Contingency Plan (hereafter, the MCP) . Based upon the available information, the Department has reason to believe that you (as used in this letter you refers to Original Printed on Recycled Paper . r -2- Robie' s Refrigeration) are a potentially responsible party (PRP) with liability under M.G.L. , c. 21E, Section 5. Section 5 makes the following parties liable to the Commonwealth: current and past owners and/or operators of a site; any person who arranged for or transported, stored, disposed of or treated hazardous materials to . or at the site; or any person. who in any way caused the release or threat of release of oil or hazardous materials. The nature . of -this liability is joint and several and without regard to fault. The Department is authorized pursuant to M.G.L. , c. 21E, Sections 3A _(j) and 4 to take such response actions at the site as it deems necessary should you fail to respond to these releases in an appropriate and timely manner. Any response actions taken by the Department will be dictated by' the individual characteristics of the site and by the time lines set out in M.G.L. , c. 21E, Section 3A and the MCP. The Department encourages potentially ,responsible parties to take response actions to assess and cleanup contamination at sites. By taking the response actions you make it unnecessary for the Department to have its contractor perform the work. If you do not take the necessary response actions the Department is authorized by M.G.L. c. 21E sections 3A(j) and 4 to have the work performed by its contractor and ,recover up to three (3) times its costs from you. Regardless of who performs the necessary work at the site, you may be liable for all the Department's response action :costs. Response action costs include the cost of direct hours for work performed by Department employees in overseeing or arranging for response actions, any expenses incurred by the Department in support of those direct hours, as well as payments to the Department's contractors (for more details see the cost recovery i regulations at 310 CMR 40.600 et sea. ) . In addition to your liability for up to three (3) times the response action costs incurred by the Department, you may also be liable for damages for loss of natural resources, and interest on the total outstanding liability at the rate of 12% compounded annually. To guarantee payment of this debt the Department may place a lien on all of your property within the Commonwealth. To recover the, debt the Department may foreclose on the lien or the Attorney General may bring. a court action against you. As a party potentially liable for the release at the site, the Department requires that you take the steps outlined below: 1. Provide the Department with a written response within fourteen (14) days of your receipt of this Notice, indicating whether you intend to take the necessary actions. -3 2 . Contract with a consultant knowledgeable in hazardous waste site assessment and abatement to conduct the following work in accordance with the MCP: a. Complete and submit, within forty-five (45) days of receipt of this Notice, a Preliminary Assessment Report (copy enclosed) meeting the requirements of 40. 541 of the MCP. b. Complete the Phase I-Limited Site Investigation and Report as outlined in 40.543 of the MCP. All items must be addressed. Note that in order to determine the source and extent of contamination at the site, observation wells (deep and shallow) need to be installed. To determine the depth of the wells and the length/location of the screen, split spoon samples should be taken continuously to be tested for the presence of VOCs utilizing a field gas chromatograph or similar instrument. The Phase I Report shall include, at a minimum, the following: 1. Boring logs, well construction specifications, a description of the drilling method; 2 . A listing of all chemicals (generic names) and quantities used, stored and disposed of at the site; 3 . Maps drawn to scale showing the location of the observation wells, catch basins, utility lines, septic system, dry wells, floor drains; 4. A current ground water and. contaminant plume contour map; and, 5. Results of laboratory and field testing data. Ground water from all wells (existing and new) should be sampled and analyzed, for VOCs utilizing EPA Method 624. In addition, the sampling plan should include Dichlorodifluoromethane and the chemicals listed in item 2 for soil and ground water samples. All. laboratory data must comply with the Department's "Minimum-- Standards for Analytical Data for Remedial Response Actions Under M.G.L. , Ch. 21E, Policy #WSC-89-004" (copy enclosed) . C. The consultant shall also evaluate the need for a Short Term Measure (STM) as defined in 40.542 of the MCP. The MCP, which took effect in October 1988, is a set of regulations which spells out specific site cleanup requirements. Of the ten sites, four were given "priority" designations; the remaining six were given "non- priority" status. DEP' s Southeast regional office has classified 356 sites to date: 141 priority and 215 non-priority. Other confirmed hazardous waste disposal sites will be classified after further Department review. Priority sites pose the greatest potential threat to public health or the environment and are the focus of agency resources. Non-priority sites may qualify for waivers from DEP approvals, required throughout the cleanup process, allowing work to move more quickly and may be subject to Department audit upon completion. Amendments to the State Superfund law, approved by voters in 1986, gave DEP specific timetables for locating, assessing and cleaning up hazardous waste sites. The 1988 MCP serves as a blueprint for these activities. The Department publishes a classification for each site where a petroleum or hazardous materials release is confirmed.
