The subject accessory unit was installed without permits or approvals. Subsequently, it was determined that the property at 10 Alicia is an undeveloped pork chop shaped lot without a qualifying principal use. The site is accessed through a gated driveway situated between two developed lots. The owner claimed the site is utilized in conjunction with the dwelling he also owns situated behind 10 Alicia and identified as 379 Falmouth Rd. As a result of the investigation, several notices of the complaints and the violation were sent to the occupants of 349 Falmouth in 2017. On Aug. 30, 2018, a Notice of Zoning Violation was sent directly to the owner of both properties, Augusto Netto. Mr. Netto responded in person on 12/14/2018. The property owner,Augusto Netto also owns the adjacent lot located at 379 Falmouth Rd, Hyannis. He purchased both properties in June 2013.The Alicia Road property is a pork chop shaped lot lacking any real frontage on Alicia other than the unpaved access which is sandwiched between two developed lots. The subject lot backs up to the rear yard of 379 Falmouth Rd. An electronic gate restricting free access to the site has been installed at the end of the driveway where the lot opens up into the yard. Visually, .. this area appears to be the rear of 379 Falmouth Road. The investigation of the original complaint revealed that Mr. Netto installed a large hoop house (approx.24'X 40')without a permit. The unit has been set on a cement pad less than 10'from the rear property line on the Alicia Rd side of the subject lot and away from the dwelling at 379 Falmouth. As determined during the initial inspection on Oct. 28, 2015,the unit has been outfitted with a permanent locking door, is served by power as well as containing a solid fuel burning appliance (coal/wood burning stove)as a heating source. No permits were obtained for these utilities or applicances. The following provisions were noted to be present during that inspection:various tools,tool boxes, shelves, a sitting area,table, antique truck, recreational vehicle and a jeep. In 2017—2018 several complaints of noise emanating from this structure and lot were filed with the building department. A cease&desist order was issued on Oct.22,2015 for the operation of WLO Home Improvements including any and all other businesses operating from the subject address as the original complaint included allegations of auto repair. Augusto Netto is affiliated with Harbor Auto Sales at 367 Yarmouth Rd., Hyannis. On Dec 14, 2017,the property owner came into the town offices and had a discussion at the counter with the Building Commissioner about the hoop house complaint. This conversation included the concern that the vacant lot at 10 Alicia Road may.have merged under zoning with the developed adjacent lot at 379 Falmouth Rd due to the common ownership of both lots. As explained to Mr. Netto, this occurs when the accessory structure on a vacant adjoining lot( in this case 10 Alicia) is used in an accessory fashion by the occupants of the developed lot(in this case 379 Falmouth). Subsequently, a second cease &desist order was issued on 3/27/2018 pertaining to the building code violations caused by the failure of the owner to obtain the necessary permits . This notice also served to inform the property owner how to abate the matter by removing all unpermitted work or in the alternative to obtain the necessary permits and file with the ZBA for relief if required.
