However, I would like to initially proceed with a cursory review of the history of the use of the Property as a lodging house so as to establish that any current or future use of the Property as a lodging house pre-exists the enactment of the current regulations and is therefore a permitted use of the Property pursuant to M.G.L.c 40A, §6, which relevant part reads as follows: Except as hereinafter provided, a zoning ordinance or by-law shall not aptLly to ... uses lawfullyin existence or lawfully`begun, ... before the first publication of notice of the public hearing on such ordinance or by-law required by section five, but shall apply to any change or substantial extension of such use ... (emphasis added). The structure serving as the lodging house that currently exists on the Property was constructed on or about 1950 for the purpose of accommodating lodgers and tenants during the summer tourism season. The current owner, Esther Lavallee, inherited the Property upon the death of her husband in 1993, who in turn had inherited the Property upon his mother's death. Ms. Lavallee the elder first purchased the Property on or about 1960 and continued its then existing operation as a lodging house doing business as The Lantern Motel. The nature and purpose of that use has not changed since its inception, however, the use of the Property expanded to year-round use sometime in the 1960's. There have been no alterations to the Ms. Linda Edson October 17, 2005 Page 2 of 2 structure since its construction beyond normal and customary repair and maintenance. For your reference, I have enclosed copies of a Plan of Land delineating the structure on the Property dated July 1958; a copy of a photograph of the lodging house with a sign identifying it as the "The Lantern Motel;"and correspondence from the Commonwealth of Massachusetts addressed to The Lantern Motel dating back to July 1969. It is my sincerest desire to resolve this matter in a manner that does not result in my client incurring extensive legal costs and,therefore, I have not undertaken a chronological review of the applicable building and zoning regulations affecting the Property. If,upon your review of the enclosed, you are unsatisfied with the establishment of the Property as a pre-existing use as a lodging house,my client reserves the right to proceed in an expeditious manner in resolving this matter through further research to establish the prior use of the Property and the regulations that have historically applied to the Property.
