My clients submitted an application for Site Plan Review last year relative to the proposed addition of a third by to the automobile repair facility. I understand a question has arisen as to the intended use of the third bay, including whether or not contemplated work in the third bay could constitute an intension of the pre-existing, non-conforming uses. By way of background, the property has been site.of a gas station, used car lot, rental car business and repair facility for many decades. Since approximately 1980"various owners have continuously done motor vehicle inspections- at the property. My clients propose adding a third bay to the building and agree to eliminate five (5) parking spaces as per the plan filed with the building permit application. At present, the used of the property are as a repair facility, used car dealership and motor vehicle inspection business. The application for Site Plan Review was approved informally by the previous Building Commissioner, Thomas Perry. I met with Mr. Perry several times to address some of his concerns and the plans changed. My clients agreed to eliminate two (2) additional employee parking spaces at the rear of the building. My understanding is that Mr. Perry approved the addition of the third bay for both inspections and repairs. The new third bay will used solely for inspections and motor vehicle repair work that does not include the use of hazardous materials such as oil, transmission fluid and brake fluid. The repair work in the new third bay will be limited to such work as light bulb and windshield wiper replacement, tire rotation and replacement, and the replacement of brake pads. This is work that is typically done following the inspections of automobiles and trucks. My understanding is that lifts will soon be required for inspection bays which is the reason a lift is shown on the plan for the new bay. In order to better ensure compliance with the restrictions on the uses in the new third bay, my clients are agreeable to modifying their,plans to show a six (6) foot from the front of the building and a six (6') foot wall from the rear of the building, each projecting inward, between the second bay and the new third bay. This will limit the access between the two bays but still allow with middle to be open for heat to flow through, and for extra room to open,the doors of the vehicles being inspected in the new-third bay. My understanding is that Mr. Perry approved the addition of the third bay for both inspections and automobile repair. While my clients initially wanted to use the new bay for inspections and automotive repair, they are agreeable to a.lesser use. The third bay will be used solely for inspections and motor vehicle repair work that does not entail the use of hazardous material such as oil, transmission fluid and brake fluid.
