Based upon my review of the Zoning Ordinance of the Town of Barnstable and the attached affidavits from the tenant of the back portion of the property and one of the owners of the property,it is my opinion that the use of the premises located at 163 Barnstable Road for parking cars is a legal pre-existing nonconforming use. According to research provided by town staff, the property. at 163 Barnstable Road was zoned Business B until 2005. Parking of cars was an allowed use in the Business B Zoning District. In 2005, the zoning classification was changed to Hyannis Gateway.District. The Hyannis Gateway District does not allow parking facilities as a use within the zoning district. However, as stated in the attached affidavits, use of the property at 163 Barnstable Road by.Demetrius J. Atsalis, Monika I: Atsalis, and/or HMI Parking Services, Inc. pre-dates.the zoning change and has been continuous and uninterrupted since 2003. Furthermore,Mr. Atsalis, Mrs.,Atsalis, and/or HMI Parking Services, Inc. have been obtaining licenses from the Town of Barnstable for the use of a portion of the propety at 163 Barnstable Road since 2008. At least as early as 201.5,,a surveyed site plan was prepared by Atsalis/HMI and.approved by both-the Building Department and the Licensing Department of the Town. . According to M.G.L. c.40A§7,.`.'if real property has been improved and used in connection with the terms of the original building permit,.no criminal or civil.action intended to compel the abandonment, limitation or niodification of the use allowed by the permit...by reason of an alleged violation of this chapter...shall be maintained unless the action, suit or proceeding is commenced...within 6 years of the commencement of the alleged violation. The use of the property at 163 Barnstable Road for parking of vehicles was an allowed use up until 2005. The town has been aware of the nonconforming use since at least 2008 when a license to park cars was first issued. Licenses have been issued each year since. J • Based on the foregoing,.I respectfully submit that the use of the.property for parking vehicles by Atsalis/HMI has existed and been allowed to continually exist without appeal for well over six years, and should therefore be considered a lawful pre-existing nonconforming use under M.G.L. c.40A§7. Heritage Builders are our abutting neighbors and they are illegally using our access way and blocking the gate to our property at 163 Barnstable Road. We are no longer able to use our property due to the blocked gate,which has various items in front of it,such as supplies, equipment,vehicles,etc.I have enclosed a copy of the land court plan that is currently filed with land court in Barnstable,MA. As mentioned our property has the authority proven in the Land Court Title;to enter and exit out of our backyard gate and proceed through to Washington Avenue Extension without barriers. The current lay-out is a forty foot(40')wide,straight away that goes out all the way to Charles Street in Hyannis. The documented land court title gives us the right of way out of our back gate and the road should not be blocked with equipment,lumber,saw horses and other items on any given day. This important document states that we and our heirs will have full use of our property and we are currently unable to do this due to their items. Our other concerns are as follows: They are using our land and we are unable to use our gate to enter or exit,they have no drainage on their property and therefore their water runs on to our property,they are storing large lumber cubes without permit,3 businesses are operating atone location and finally they are using a public road as their personal land. l O Some possible solutions are to add a drain,clear the area and paint a four inch line on the edge of the property area to serve as a visual reminder that they need to keep that area clear at all times and keep out of this marked area. I can explain this further when you call. Our property at 163 Barnstable Road has been in my wife's family since 1930,her father; William H.Madden ran a new and used car dealership and a towing business. This property is still owned by my wife,Barbara Medeiros and her sister Elizabeth Madden. I would like you to correct this matter immediately and cease their illegal activities. Re .PROPOSED BUSINESS USE Cape Cod Auto Rentals,Inc. plans on using existing office and use it as rental office for customers to come in and rent vehicles. They will be picking up and dropping off at this location only. We will transport the vehicles to one of our three other locations for service and for storage/garage. We are able to project what we need as reservations are made in advance through our reservations center and we are able to use these numbers and predict what we need for vehicles. Additionally,we have several other locations in which we operate from and are currently in negotiations with another with in the Hyannis location,which we will use to evenly distribute our inventory within the community. No changes will be made to the existing building or to the existing parking. The building was once a car dealership. The building has 54 parking spots. We are proposing to use a maximum of 20 for parking at one time. No maintenance will be performed on the grounds. Outside vendors will be used for this service or we will. use are own facilities located in the Towns of Falmouth and Bourne. Mr. Geissler .had reported to Officer Haussman that the registration plate to his boat ailer had been stolen while it was stored behind Lumber Liquidators at 20 Charles Street from June 14th until ie 19th. NOTE: During my site visit with Chief Zoning Enforcement Officer Anderson on.June 17th, I had noted i unregistered boat trailer in the lot. my conversation with Mr. Geissler, I learned that he lived in Vermont and had been on the Cape this past eek, specifically to go. to Nantucket. He added that he had obtained Demetrius' name and number from a iend of his relative to parking in Hyannis last year and that he had utilized his services then. I asked Mr. Geissler explain what that entailed and he stated that he had parked in the same lot last year after calling Demetrius id meeting him in the same parking lot (behind Lumber Liquidators). ;Mr. Geissler did not recall what he paid st year but advised me that he had paid $200.00 this past week for parking. He added that Demetrius had had m meet an employee of his named Will at the lot this year. SUPPLEMENTAL NARRATIVE FOR PTL THERESE M GALLANT Ref: 16-1192—OF Entered: 06/29/2016 @ 1023 Entry ID: 209 Modified: 07/01/20.16 @ 0921 Modified ID: 209 III On June 28, 2016 at 12:45 hours, Chief Zoning Enforcement Officer Robin Anderson and I followed up on an investigation initiated on June 17, 2016 regarding an unlicensed parking lot operation as well as other zoning violations that were occurring at 20 Charles Street in Hyannis. On our arrival, I noted that there were eleven MV's and one unregistered dump truck parked in the area; similar in manner as to what had been previously observed on June 17, 2016. NOTE: Three of the vehicle documented today (6/28) as well as the unregistered dump truck, had been observed there on the previous visit (6/17). Eight "new vehicles had since been added to the "lot", despite the service of Cease and Desist order(s). These orders were hand delivered to Luke Ehlers on June 20, 2016 as Tobias Leary's representative and denoted the aforementioned zoning ordinance violations observed on June 17th, which included the use of the area as a private parking lot/satellite parking, I and valet parking. NOTE: I had also had a phone conversation with Mr. Leary about these issues prior to the service of the orders. Mr. Leary is the owner of the property located at 20 Charles Street. NOTE: I had researched the Barnstable Police log and located an incident documented on 7/26/14 at 10:17 a.m. (see call number 14-37177). The reporting party refused to provide their information but registered a complaint about illegal parking in the lot at 20 Charles Street, Following this call, Barnstable Police Officers responded to the area and were unable to locate the reporting party. The call log documented that the 'vehicles appear to be associated with Hy Line.' The log goes on to note that the overflow parking was for Atsalis, identifying him as a. Hyline parking subcontractor and that employees there stated they own the lot and park there regularly. Of new concern this day (6/28), 1 noted that there were ten vehicles,four of which had out of state plates, parked in a_ non-enclosed fenced lot located behind the building complex located at 163 Barnstable Road. This property abuts the above-mentioned dirt area behind 20 Charles Street. Photos of this fenced lot with the vehicles were taken at this time. I later contacted the owner of the property located at 163 Barnstable Road and spoke via the telephone with Donna Medeiros on June 28, 2015 at 2:50 p.m. Ms. Medeiros confirmed that the property belongs to her family and that the back portion of the fenced lot has been leased out to.Demetrius Atsalis, d/b/a HMI Parking Services, LLC for over ten I years. Ms. Medeiros added that she rents out the back portion of the lot on a yearly basis to him, explaining that it's prorated, dependent on the season. I would meet with Ms. Medeiros on June 30, 2016 at 10:00 a.m. at the property located at 163 Barnstable Road in Hyannis. Ms. Medeiros confirmed that she. has a written lease.with Demetrius Atsalis and that they have had this business arrangement(his leasing the space for parking purposes)for over ten years. At this meeting, I noted that some of the motor vehicles previously observed on the 28th had been moved and that the dashboards of these cars displayed a blue "Parking Claim Check" stub. Photos of the vehicles and the blue stubs were taken. NOTE: I had an opportunity to review the Building Commisioner's approved site plan for 163 Barnstable Road and confirmed that this parking operation is in compliance with the Regulatory Services. However, there are no records or plans that include the "auxilary" parking area behind 20 Charles Street. l 1 would later report my findings to Consumer Affairs Supervisor, Elizabeth Hartsgrove. Ms. Hartsgrove advised me that there are no Parking Lot licenses associated with Demetrius Atsalis; any member of the Atsalis family,:or HMI Parking Services, LLC for the Charles Street location. Parking lots must comply with all Town of Barnstable Ordinances and Regulations and shall meet the requirements of zoning, including the site plan review process. A detailed plot plan of the premises specifying the area to be used for parking must be submitted with the application. The plot plan must be approved by the Fire Chief and the Town Engineer before the license shall be approved. A copy of the plot plan shall be retained by the Town Engineer and a copy shall at all times be available for inspection on the premises by any town officer. Any violation of these Rules and Regulations or violations of any Town of Barnstable Ordinance or Regulation, or Massachusetts General Laws, shall be cause for rejection, suspension or revocation of a Parking Lot License.
