Town of Barnstable Zoning Board of Appeals Decision and Notice Appeal2002-102 - Gluck Special Permit - Section 4-4.3 Nonconforming Buildings & MGL Chapter 40A, Section'6 Demolition and Reconstruction on an Undersized Non-conforming Lot Summary: Granted with Conditions Petitioner: Clifford D.&Lisa Gluck Property Address: 20 Bay Shore Road,Hyannis,MA Map/Parcel:. Map 326,Parcel 084 Zoning: Residential B Zoning District Relief Requested& Background: The subject property is located along Bay Shore Road in Hyannis and fronting on Hyannis Inner Harbor. According to the Assessor's record,the lot is a .31-acre lot developed with a one-story, one-bedroom single-family dwelling built in 1950, and has a living area of 840 sq.ft.. The property also has an attached garage of 280 sq.ft., wood deck of 208 sq.ft.,patio of 160 sq.ft. and an unfinished basement and attic area of 1,680 sq.ft. The total gross area adds to 3,168 sq.ft The applicant had proposed two options. One was to partially demolish and alter the existing dwelling on the lot. The second alternative was to completely demolish and remove the existing house and reconstruction of a new single-family dwelling. In either case, the initial proposals was to retains the pre- existing non-conformities of structure setback of 8 feet on the southwesterly side of the lot where 10 feet is required and further extends the structure's penetration into the 50-foot Setbacks from Wetlands/Great Ponds with a 14 by 19.5 foot addition on the northeasterly side of the existing structure. The existing dwelling is already setback approximately 35 feet from Mean High Water of Lewis Bay. The proposed new single-family dwelling was to have a total'of 3,004 sq.ft. of living area according to the application. Plans show the'dwelling to be a four-bedroom, 2.5-storyes home. The half story is identified as an unfinished attic. The applicant is before the Board seeking finding as required under MGL Chapter 40A, Section 6 to determine whether the new dwelling is a"reconstruction" as that term is used in the "second except" clause of the first sentence.of MGL Ch. 40A, Section 6. Under that section,the reconstruction may be allowed if the Board finds that the proposed new dwelling does not intensify the alleged nonconformity. However, if the Board.should find that it does intensify the nonconformity, the Board must than make findings comparing the proposed new dwelling to the former dwelling and its detriment to the neighborhood. Procedural & Hearing Summary: This appeal.was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 12, 2002. A public hearing before the Zoning Board of Appeals was duly advertised'and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 07, 2002, and continued to September 04, 2002, at which time the Board found to grant the reconstruction with conditions. Board members deciding this appeal were, Gail Nightingale, Richard L. Boy, Ralph Copeland, Ron S. Jansson, and Chairman Daniel M. Creedon. Attorney John R. Alger represented the applicant who was also present during the hearings as was Peter Sullivan,the,project engineer. Mr. Alger explained proposed reconstruction, noting that.the basement would not be used as habitable space as the State Building Code would not permit it given the location of the dwelling within the FEMA V15 Zone. The dwelling would be reconstructed in the same location with an addition to the northern side of the dwelling and a second floor. The third level would be used for mechanical equipment. The Board noted that the proposed dwelling was located on the same non-conforming footprint as the existing.structure. The Board requested that the structure be brought into compliance with required yard setbacks. The Boards desires were based upon the fact thet the entire structure was being demolished and that, in the Board's opinion should require all setbacks to be complied with. The Board was also concerned with the plans presented and noted they wished a more refined plan to be presented for clarification. The hearing was continued to September 04 to permit the applicant to reconsider the location of the. ' proposed dwelling and present clear plans of the proposed structure. At that continuance, new plans were presented. However,the plans still retained the non-conformity in setback. The Board and applicant discussed this setback and the proposed out-door shower area that was to be covered with a trellis and light roof area. The Board requests that the proposed dwelling be relocated to conform and that the covering over the shower area be removed. The Board and applicant'reviewed the area of the lot and the floor area of the structure. It was determined that the First floor was 1,183 sq.ft.,the second 1,443 sq.ft. and the third floor of 900 sq.ft. for a total gross area of 3,526 sq.ft. Findings of Fact: At the hearing of September 04, 2002;the Board made the following findings of fact: 1. Appeal 2002-102 is that of Clifford D. &Lisa Gluck seeking a Special Permit in accordance with° Section 4-4.3 Nonconforming Buildings and MGL Chapter 40A, Section 6, to allow for the demolition and reconstruction of a single-family dwelling on a non-conforming lot. The property is shown on Assessor's Map'326, Parcel 084, commonly addressed 20 Bay Shore Road,Hyannis, MA in a Residential B Zoning District. 2. The property is a.:31-acre lot. However,the area from the top of the coastal bank is 7,922 sq.ft.. The lot is developed with a one-story, one-bedroom single-family dwelling built in 1950, and has a living area of 840 sq.ft: The property also,has an attached garage of 280 sq.ft., a wood deck of 208 sq.ft., a Ratio,of 160 sq.ft., an unfinished basement:and attic area of 1,680 sq.ft. The total gross area is 3,168 sq.ft. The construction of the dwelling predates the adoption of zoning in this part of Hyannis. The existing structure and undersized lot are,pre-existing legal non-conformities. " 2 a 3. The applicant is now proposing to completely demolish and remove the existing house and reconstruction of a new single-family dwelling on the undersized lot. The reconstruction"will have to conform to the required setbacks for the district and may be allowed to further extends into the 50- foot Setbacks from Wetlands/Great Ponds with a 14 by 19.5 foot addition on the'northeasterly side of the existing structure. The existing dwelling is already setback approximately 35 feet from Mean High Water of Lewis Bay. 4. The reconstructed single-family dwelling is to have a total of 3,526 sq.ft. of total gross area. The property is connected to Town sewer and served by public water. 5. The property is located within a FEMA V15 Zone- a velocity zone with elevation 15. A V15 zone is an area identified as being within the. 100-year coastal flood with wave action of 15 feet: There is an existing stone revetment on the lot that transitions from the beach to a land elevation of 12-13 feet. The new dwelling will have to conform to the provision of Section 3-5.1.-Flood Area Provisions of the Zoning Ordinance and any applicable federal and state requirements. 6. The application has been before the Conservation Commission and an Order of Conditions was issued on April 11, 2001. The plan approved by the Conservation Commission is that plan that shows the proposed reconstruction on the existing non-conforming footprint. 7. The proposed new dwelling is a"reconstruction" as that term is used in the "second except" clause of the first sentence of MGL'& 40A, Section 6. The proposed new dwelling will have to conform to the required setbacks and as such will not intensify the alleged nonconformity with respect to yard setbacks. Although the proposed new dwelling is larger in size and a significant increase in building area, the proposed new dwelling would-not be substantially more detrimental to the neighborhood than the former dwelling. Ron S.Jansson, Decision: Based on the findings of fact,, a motion wag,duly made. and seconded to grant the permit for the demolition and reconstruction with expansion of a single family dwelling in conformance to yard setbacks on an undersized non-conforming lot subject to the following conditions: 1. Location of the dwelling shall conform to the required front and side yard setbacks for the district. A plan show the location of the structure in conformity has been submitted to the Board's file, entitled"Site Plan = Proposed House Improvements at 20 Bay Shore Road, Hyannis, Mass. For Clifford Gluck", showing the existing and proposed additions to the dwelling, dated January 19,2001, last revised date of 09/10/02, and drawn by Sullivan Engineering, Inc. 2. The dwelling shall be built substantially in conformance to plans presented to the Board entitled "Gluck Residence", drawn by Annino Associates, dated February 15, 2002, lasted revised date of July 20, 2002 and consisting of three sheets,Al-First Floor Plan,A2-Second Floor Plan and Attic Plan and A4-Exterior Elevations. Except that the 8'-2" sideline setback shall be increased to 10.5 feet as shown on the plot plan identified in condition 1 and the illustrated trellis and roof structure over the outdoor shower area shall not be built. 3. The structure shall not exceed 2.5-stories. The total living area of the structure shall not exceed 2,892 sq.ft. and the total number of bedrooms shall not exceed four. The basement, attic and .garage areas shall not be finished as livable area and are not to be included in the 2,892 sq.ft. calculation. 4. The property is connected to Town sewer and served by public water. 5. Demolition and reconstruction shall comply with Health and Building Divisions without variance. 6. The applicant shall resubmit to the Conservation Commission for their a roval; PP • a copy of the corrected plan cited in Condition No. 1 showing conformance of the structure to the setbacks and the proposed building height of 2.5 stories identified on the plan, and . • . copies of the elevation and floor plans of the proposed dwelling. 7. Reconstruction shall comply with any Order of Conditions issued by the Conservation Commission. 8. This principal building—the single-family dwelling with an attached garage and outdoor deck— shall be considered full build-out of the lot. This buildings shall not be expanded in area or footprint and no accessory building is to be added on the lot without further permission from the Zoning Board. 9. The grant of this special permit does not authorize any exception from the flood regulations of Section 5-3 of the Zoning Ordinance. The reconstruction shall conform to all requirements of that section, including compliance with all applicable building codes, federal and/or state approvals and requirements The vote was as follows: AYE: Gail Nightingale, Richard L. Boy, Ralph Copeland, Daniel M. Creedon NAY: Ron S.Jansso,n Mr.Jansson explained his no vote citing that the usable lot area is only 7,922 sq.ft. and the overall gross area of the building to be built on'the lot was over 3,526 sq.ft. of total gross area. He also noted that the building at 58.5 feet in height on the small lot was an over massing of structure on the lot. He noted that the Local Comprehensive Plan also discourages the overbuilding on undersized lots. I Ordered: Special Permit 2002-102 is granted with conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Appeals of this decision;if any, shall be made pursuant to MGL Chapter 40A,Section 17, within twenty. (20) days after the date of the filing of this decision. Although this expansion was denied at the meeting that I attended, such,expansion is proceeding at this time. The board was very specific that an additional deck area,patio, or accessory building would not be allowed. In knowing this, the Mr. Gluck installed triple patio doors with every intention of building a deck and/or patio, even though he knew this was not allowed. Also, in the original approval of the board, stairs to a deck and/or patio were never allowed. We feel that the engineer, at Mr. Gluck's request, added the stairs onto the revised blue print after the original decision was made by the Zoning Board of Appeals. Mr. Gluck is well aware of conservation and building department codes. It is clear that Mr. Gluck had no regard for the zoning or building department decision and that he had his own agenda in what he would build on his property. Mr. Gluck's contractors poured a concrete patio, constructed a four foot high cinder-block wall, and a shale stone wall to cover the cinder- blocks. The property has a higher elevation after the re-construction and we are now extremely concerned about the damage that water run-off onto our property will cause. The dwelling would be reconstructed in the same location with an addition to the northern side of the dwelling and a second floor. The third level would be. used for mechanical equipment. The Board noted that the proposed dwelling was located on the same non-conforming footprint as the existing structure. The Boards desires were based upon the fact thet the entire structure was being demolished and that,in the Board's opinion should require all setbacks to be complied with. The Board was also concerned with the plans presented and noted they wished a more refined plan to be presented for clarification. The hearing was continued to September 04 to permit the applicant to reconsider the location of the proposed dwelling and present clear plans of the proposed structure. At that continuance, new plans were presented. However, the plans still retained the non-conformity in setback. The Board requests that the proposed dwelling be relocated to conform and that the covering over the shower area be removed. The new dwelling will have to conform to the provision of Section 3-5.1 - Flood Area Provisions of the Zoning Ordinance and any applicable federal and state requirements. 6. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill.Any fill shall contain no trash, refuse; rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe,tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or water body. If deemed necessary by the Shellfish Constable,shellfish shall be removed from the work area to a suitable site and/or replanted at the locus following construction. The foregoing measures for shellfish protection shall ensue at the expense of the applicant. II]C. The following additional conditions shall govern the project once work.begins. 6. General conditions No. 12 and No. 13(changes in plan)on page 3 shall be complied with. p.4.1 7.' The Conservation Commission,its employees,and its agents shall have a right of entry to inspect for compliance with the provisions of this Order of Conditions. 8. This permit is valid for 3 years from the date of issuance,unless extended by the Commission at the request of the applicant. 9. Any fill used for this project shall be clean fill. Any fill shall contain no trash,refuse,rubbish,or debris, including but not limited to lumber,bricks,plaster,wire,lath,paper,cardboard,pipe tires,ashes, refrigerators,motor vehicles,or parts of any of the foregoing. 10. All areas disturbed during construction shall be revegetated immediately following completion of work at the site. No areas shall be left unvegetated for more than 30 days. Mulching shall not serve as a substitute for the requirement to revegetate disturbed areas at the'conclusion of work. 11. Herbicide,pesticide and fertilizer use is discouraged on lawns within Conservation Commission jurisdiction. If fertilizer is used,only Aw-release low-nitrogen fertilizer shall be applied. Over-fertilizing shall be avoided. 12. There shall be no disturbance of the existing salt marsh. 13. All work shall follow the approved plan. 14. The as-built top of sheeting elevation shall be certified by the project engineer. 15. No creosote treated materials shall be used. 16. Work shall occur during the off-season only: October 15 through May 1. 17. No dredging(including but not limited to effects of propeller wash)is permitted herein. 18. The seasonal storage of floats shall be at a suitable upland site. Floats shall not be stored on banks,marshes or dunes. 19. Piling shall be driven into place. The following special conditions in italics shall govern boat use at the approved pier.These conditions shall continue over time. Note: For purposes of this Order of Conditions,the term"pier" shall refer not only to the linear pile-supported structure,but also to any of its components or appendages such as the float(s),ell,tee,ramp,outhaul piling,etc. 20. Boats berthed at the pier shall not ground at low tide. -- 21. Boats shall only be berthed at the float. p.4.2 22. No boat shall be used or berthed at the float approved herein such that at any time less than one foot of water resides between the bottom of the boat(or engine in drive position)and the substrate. 23. Any desired'pier lighting shall receive prior approval of the Conservation Commission or Department. 24. Lead piling caps shall not be used. 25. Work on the pier shall ensue mid-tide rising to mid-tide falling or as otherwise necessary to prevent the grounding of the work barge on the substrate. 26. The applicant may maintain in conformance with the plan of record the proposed pier and other structures given in the Notice of Intent application for the longevity of the Order of Conditions(3 years).Thereafter, maintenance may be extended through any forthcoming Certificate of Compliance. The spoil will be barged to the Town landing located at the end of Pleasant Street, where it will be placed directly into a truck and hauled to the Boure Landfill. The material will be dewatered in a fill pit adjacent to the lined landfill, and then beneficially used as cover or grading material as needed. 5. Provide copy of grain size analysis.If grain size is compatible for beach nourishment purposes,the Department recommends that the dredged material be used as beach nourishment for public beaches.
