The existing dwelling consists of 1,326 sq.ft. of living area. The structure's footprint is 1,864 sq.ft. including an open porch and patio. The existing structure complies with current zoning setbacks. %1% The property is a 0.22-acre lot located on Lewis Bay accessed from Bay Shore Road. It is within c' flood zones, A9 and B. It is connected to public water and Town sewer. br The applicant proposes to demolish the existing structure arid reconstruct a new single-family dwelling on the undersized lot. The new single-family dwelling is to be a two-story, 2,092 sq.ft. three-bedroom structure. The proposed reconstruction conforms to all setbacks and maintains a 50' a buffer to the wetlands/great ponds as required in Section 2-3.7. Procedural &Hearing Summary: This,appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 27, 2002. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened July 24, 2002, at which time the Board found to grant the appeal. Board members deciding this appeal were Daniel M. Creedon,Richard L. Boy, Thomas A. DeRiemer, Randolph Childs and Gail Nightingale,Vice Chairman. Attorney Mark H. Boudreau represented the petitioner who was also present. Mr.Boudreau stated that the applicant seeks to demolish a single-family dwelling on an undersized lot and reconstruct a new dwelling. The residence will comply with all setback requirements and will be connected to ra` Public water and Town sewer. The new structure will be built in accordance with Conservation Commission's Order of Conditions and will comply with the requirements of FEMA. Mr. Boudreau stated that the lot is similar in size to other lots in the neighborhood and several new two- story homes have been built in the neighborhood recently. Public comment was requested and no one spoke for or against the petition Findings of Fact: At the hearing of July 24, 2002,the Board unanimously made the following findings of fact: 1. Appeal Number 2002-95 is that petition of Carlos Mariscal seeking a Special Permit in accordance with Section 4-4.3(2)Nonconforming Buildings and MGL Chapter 40A, Section 6,to allow for the demolition of a single-family dwelling on a non-conforming lot and reconstruction of a new single-family dwelling in compliance with the required setbacks The property is shown on Assessor's Map 325, Parcel 080, commonly addressed 132 Bay Shore Rd.,Hyannis, MA in a Residential B Zoning District. 2. The property is a 0.22-acre lot located on Lewis Bay within a FEMA designated flood zones,A9 and B. The existing dwelling consists of 1,326 sq.ft. of living area and is a 7-room,3-bedroom, one-story ranch style single-family dwelling constructed in 1958. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal for reconstruction that complies with all setback requirements including the 50 foot buffer to wetlands/Great Ponds and subject to the following conditions: 2 I - 1. Location of the dwelling shall be as shown on a plan entitled"Site Plan of Land in Hyannis, Massachusetts depicting the Mariscal Residence, dated March 04, 2002, last revised date of 04-09- 02, prepared by Stephen J. Doyle and Associates. 2. The dwelling shall be built substantially in conformance to plans presented to the Board that are not titled but are dated 5/2/02 and drawn by Devlin Custom Designs and scaled l/o"—1'. The building shall not be higher than 18 feet to plate nor 24 feet to ridge of the roof. 3. The dwelling shall be connected to public water and Town sewer. 4. The total area of the dwelling shall not exceed 2,092 sq.ft. and shall not exceed 3-bedrooms. 5. This reconstruction shall comply with Health, Building and Conservation Divisions regulations without variance and to any Order of Conditions issued by the Conservation Commission. 6. This reconstruction shall be considered full build-out of the lot and there shall.be no.expansioni (in area or in footprint without further permission from this Board, and there shall be no accessory building added to this property. Any change to the plans identified in Condition#13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 15. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order,and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 16. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order, 17. Prior to the start of work,and if the project involves work adjacent to a Bordering Vegetated Wetland,the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging.Once in place,the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or water body.During construction,the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed,The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission,which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 19. BMPs intended to be converted to post construction operation for stormwater attenuation,recharge,and/or treatment,the conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and stonmwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and,if applicable,the Stormwater Pollution Prevention Plan required by the National Pollutant Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility,the landowner,or owner of any drainage easement,assumes responsibility for maintaining each BMP.To overcome this presumption,the landowner of the properly must submit to the issuing authority a legally binding agreement of record,acceptable to the issuing authority,evidencing that another entity has accepted responsibility for maintaining the BMP,and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 19(f)through 19(k)with A shrub buffer 6-8 in width across the parcel landward of the seawall shall be planted and maintained in just shrubs in consultation with the Conservation Agent. 18. Drywells or graveled trenches along the drip lines shall be installed to accommodate roof runoff. 19. All areas disturbed during construction shall be revegetated immediately following completion of work at the site. No areas shall be left unvegetated for more than 30 days. Mulching shall not serve as a substitute for the requirement to revegetate disturbed areas at the conclusion of work. 20: All proposed lawn areas shall be underlain with a minimum of 4 inches of loam. p.4.2 f 21.
