N I Summary: Granted with Conditions Petitioner: Joseph Zenovic 9 Property Address: 153 Bay Shore Road, Hyannis, MA Assessor's Map/Parcel: Map 325 Parcel 098 Zoning: Residence B Zoning District S C Relief Requested & Background: In this appeal the applicant is seeking a special permit to demolish an existing dwelling on an S undersized lot consisting of less that 10,000 sq.ft. and to rebuild a new, four bedroom, single-family 9 dwelling. According to the Assessor's record, the lot is developed, with a 699 sq.ft. one-story, two- bedroom, single-family dwelling that dates back to 1954. The lot was created by Land Court Plans p 7615-B Sheet 2 and 7615-1 recorded May of 1926. The lot is shown as Lot Nos. 70 and 69B. J Section 240-91.H of the Zoning Ordinance, requires all lots consisting of less than 10,000 sq.ft. to secure a special permit in order to demolish and rebuild a new dwelling on the lot. That permit DO requires that the new building conform to the 20% lot coverage limitation, the 0.3 floor area ratio and 1 the 2.5-story/30-foot height limitation. T ,zj Procedural & Hearing Summary: S 5_7' This appeal was filed at the Town Clerk's Office and at the office of the Zoning Board of Appeals on August 30, 2006. A public hearing before the Zoning Board of Appeals was duly posted and 4- advertised in accordance with MGL Chapter 40A. The hearing was opened December 6, 2006, continued to January 17, 2007,January 31, 2007 and to March 28, 2007 at which time the Board r. found to grant the special permit subject to conditions herein. Board Members deciding this appeal (� were, Randolph Childs, Daniel M. Creedon,James R. Hatfield,John T. Norman, and Vice Chairman - Ron S.Jansson. At the opening of the hearing on January 17, 2007, Chairman Gail C. Nightingale stated the issue with regards to the mailing of notices to abutters. Mr. David Sauro who was representing the applicant stated that he understood the issue and that after receiving the November 30, 2006 staff report he wished to continue the hearing to provide the additional time for re-notification and to revise the plans. The hearing was continued to January 17, 2007, January 31, 2007, and again to March 28, I ' I Town of Barnstable-Zoning Board of Appeals Special Permit-2006-102—Zenovic 2007. At the March 28, 2007 hearing, revised plans were received and the Board was constituted. At that hearing, Chairman Nightingale was absent and Vice Chairman Ron S.Jansson acted as Chairman. At that continuance, Mr. David Sauro-Construction Manager, again represented the applicant, Mr. Joseph Zenovic who was also present. The revised plans were presented and it was stated that the structural footprint was 19.7%, the building floor area ratio was .255, the height to ridge was 26.6 and 1.5-stories, and the location of the structure met current setback's. Therefore, the proposal satisfied the requirements of Section 240-91.H(2). The Board reviewed the area of the building and it was noted that the 352 sq.ft. garage was included in the total gross building area consisting of 2,193 sq.ft. The height of foundation was requested and Mr. Sauro stated that it had not yet been set by the engineer. It was noted that information regarding the foundation height would be required as the Board did not want an exposed foundation that would increase the building height higher than that represented nor would add habitable area in the basement. The Board questioned the use of the dwelling and Mr. Zenovic stated that it was for his personal family use only. It is not to be used for lodging or rented on a short term basis. He stated that he was amenable to any condition on renting. Public comment was requested and no-one spoke either in favor or in opposition to the request. Findings of Fact: At the hearing of March 28, 2006 the Board unanimously made the following findings of fact: 1. Appeal 2006-102 is that of Joseph Zenovic,for property addressed as 153 Bay Shore Road, Hyannis, MA. That property is shown on Assessor's Map 325 as Parcel 098. It is in a Residence B Zoning District. Mr. Zenovic is seeking a special permit pursuant to Section 240-91.H(2) for the demolition of the existing dwelling and the rebuilding of a new, larger, single-family dwelling on a lot that is less than 10,000 sq.ft. 2. According to surveyor's plans, the subject lot is 8,494 sq.ft. According to the Assessor's record, the property is developed with a 699 sq.ft., one-story, two-bedroom, single-family dwelling that dates back to 1954. The subject lot was created by Land Court Plans 7615-B Sheet 2 and 7615-1 recorded May of 1926. The lot is shown as Lot Nos. 70 and 69B. The locus is a "fan" shaped lot fronting onto Bay Shore Road and Old Fish Hill Road in Hyannis. 3. The proposal conforms to the requirements of Section 240-91.H(2), in that: • The.site plan submitted shows that the proposed location of the structure will comply with the setback requirements for the district which are 20 feet frontage and 10-feet rear and side yards. • The plans and information submitted states that the footprint (buildings and deck(s)) of the proposed structure is to be 1,677 sq.ft. for a lot coverage of 19.7% and would conform to the 20% maximum lot coverage permitted. 2 It Town of Barnstable-Zoning Board of Appeals Special Permit-2006-102—Zenovic o According to information submitted, the gross area of the building on the lot (dwelling and garage) calculates to be 2,193 sq.ft. resulting in a floor area ratio of 0.26 and conforms to the maximum floor area ratio of 0.3. • From the elevations submitted, the height of the building to the highest plate is 20 feet, and the height to the highest ridgeline is 26.5 feet. The elevations conform to the zoning requirements. 4. The locus is served by public water and Town sewers. The applicant has indicated that the dwelling will be connected to those services. According to the Assessor's record the building is not over 75 years of age and therefore would not trigger a demolition delay order. 5. The proposed new dwelling would not be substantially more detrimental to the neighborhood than the existing dwelling. 6. This application falls within Section 250-91.H of the Ordinance for the granting of a special permit, and after an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. ' Decision: Based on the findings of fact, a motion was duly made and seconded to grant the special permit for the demolition and reconstruction on an undersized lot subject to the conditions herein: 1. Redevelopment of the property shall be as proposed in plans submitted to the Board and initialed and dated by the Acting Chairman. The proposed site plan is entitled "Plot Plan of Land located at:.153 Bay Shore Road Hyannis, MA., prepared for Joseph Zenovic" dated April 24, 2006 with a last revised date of March 6, 2007 as drawn by Yankee Land Surveyors & Consultants. 2. The Architectural Plans for the new structure to be built are entitled "Custom Home and Residence for:Joseph Zenovic" as drawn by Kenneth Sadler Jr. with a last revised date of March 13, 2007 and consisting of 6 sheets to be initialed by the Acting Chairman. 3. The dwelling, as conditioned by the referenced plans above, shall be limited to a maximum of four bedrooms. 4. The dwelling shall be connected to public water and Town sewer. Construction shall comply with all applicable building and fire codes. 5. Only one curb cut shall be permitted on the lot. That curb cut shall not exceed 22 feet. 6. During all stages in the demolition and reconstruction of the dwelling, all vehicles, equipment and materials associated with the demolition/reconstruction shall be required to be located off the right of ways of Bay Shore and Old Fish Roads except as may be required to install utilities and landscape and then only on a temporary basis. 7. All mechanical equipment associated with the dwelling (air conditioners, electric generators, etc.) shall be located so as to conform to the minimum required setbacks for the district. All mechanical equipment shall be screened from neighboring homes and ways. 8. The development allowed in this permit shall be considered full build-out of the property. The structures authorized shall not be expanded nor other buildings and structures added without prior permission from this Board. 9. Prior to the issuance of any building permit, the applicant shall submit an engineered plan showing the proposed elevation of the foundation and finished elevation of the lot. That plan shall be reviewed by staff and approved only if those elevations conform to the representations made to this Board on the building height and use of the basement area as non-habitable area. 10. If the dwelling is ever rented, it shall be rented as a single-family dwelling to one family unit and only for a period of rental of not less than 6 months. 11.This decision must be recorded at the Barnstable Registry of Deeds and a copy of that recorded document must be submitted to the Zoning Board of Appeals Office and to the Building Division before any demolition or building permit is issued. The relief authorized must be exercised within one year of the granting of this permit. The vote was as follows: AYE: Daniel M. Creedon, Randolph Childs,James R. Hatfield,John T. The plans and memorandum both stated that the gross floor area to be built was 2,193.2 sq.ft. • Growth Management Department—Staff Report to the Zoning Board of Appeals Appeal 2007-095—Zenovic-Modification of Special Permit 2006-102 for a Demolition/Rebuilding on Nonconforming Lot The second Staff Report dated March 23, 2007, reiterated the gross floor area cited by the applicant and stated that "According to information submitted the gross area of the building on the lot (dwelling and garage) calculates to be 2,193 sq.ft. ft., for a floor area ratio of 0.26 and conforming to the maximum floor area ratio of 0.3." According to the decision, at the public hearing the Board specifically asked about the gross floor area. The Decisions' "Hearing Summary section states 'The Board reviewed the area of the building and it was noted that the 352 sq.ft. garage was included in the total gross building area consisting of 2,193 sq.ft. " The special permit was issued on April 11,2007, citing that the gross floor area of the building to be built was 2,193 sq.ft., and that igure included the garage. The permit also cited the approved plans. The permit was mailed to Mr. Mauro as he represented the applicant. No notice was received of any error in script or misinterpretation in the decision and on May 2, 2007, the Town Clerk signed the special permit. On June 18, 2007, the Building Division issued Building Permit 2007-02564 for the construction of the new dwelling.' The permit clearly indicated the building to be built would be 2,193 sq.ft., in full compliance with the special permit. In reviewing the plans for this modification, Staff noted that the Mar ch 13, 2007, approved plans measured to have a total gross area of 2,589.5 sq.ft.', and not the 2,193.5 sq.ft. cited on the plans and throughout the appeal and permit process. Our application is scheduled to be before the board on October 24, 2007. Attached you will find the revised plans along with the following; 1. Structure Certification Plan by Yankee Engineering stamped September 6,' 2007; stating that the proposed structural footprint (buildings and decks) conform to the 20%maximum lot coverage permitted. 2. Affidavit from ERT Architects stating that the proposed square footage would be in compliance with the Town of Barnstable Code requirement that the gross area of the building on the lot (dwelling and garage)results in a floor area ratio that conforms to the maximum floor area ratio of 0.3. 3. The height of the building to the highest plate and the height to the ridgeline conform to zoning requirements are shown on the revised house plans. We have two questions that we ask of you. First, when you have an opportunity, to review these plans to confirm that we are in compliance and not missing anything. Second, whereas the revisions conform to the intent of the zoning by-law our question is that the"Stop Work Order" would be lifted so that we could proceed to get the house at least somewhat (roof on and shingled) tight to the weather. The,board felt that the following changes made were minor as long as the ratios of floor area and gross living area were in compliance with the requirements of section 240- 91.H(2) • Flipping the house on the foundation • Cantilever of the front and rear of the main house However,the board felt that the change made to the second story is a major modification. The original plans submitted and approved were for a story and one half to be built. The existing structure has two full stories. The board has asked that we make additional modifications to the building design plans, drawn by Kenneth Sadler Associates, to bring the structure back to a story and one half. They have also asked that we show the proposed driveway on the plot plan. This will be completed by Yankee Land Surveyors. The hearing has been continued until November 7, 2007. With that understanding, we ask for approval from the Building Department to continue work at the property. We were issued a stop work order on August 21, 2007: The house has been open to the weather since then. We understood from the hearing, as one of the board members mentioned, any work done there is at our own risk.
