Anderson RE: Complaint Illegal Apartment Over garage LOCUS: 75 Betty's Pond Rd,Hyannis Reported to this site with Bob McK by appointment with the current owners. The property record was flagged before it was conveyed to the current owners. Recently, CapeWide was hired to do some work on the property including a sewer connection and pump alarm requiring an electrical permit. I contacted the owner and requested a quick inspection. Kathy Varjian of ReMax also met us at the site with Marlene Hecht and her partner. We were permitted into the garage unit by the side door and up a staircase into the subject space. The unit is a small but spacious studio ad even had a secondary means of egress at the rear exiting onto a deck leading directly to the ground level. An unmade bed(no bedding)was nestles in on one side of the room. The other side presumably available for living room furniture and entertainment. Directly in front on the front exterior wall was a kitchen including cabinetry, kitchen sink and a small red, two door refrigerator. There was no oven or stove and no counter top cooking devices not even a coffee pot visible. The general appearance of the space was more akin to storage and not of any recent use. The owner's have a teenage daughter who has expressed desire to claim this space as her own. At this time,the space is unused. They declared that they do not want any tenants and treasure their privacy. They use this for storage and perhaps in the future may have visiting family sleep here as the main house is a two bedroom dwelling. I was informed by all parties that a conversation with Tom Perry-occurred shortly after the property conveyed and as a result of a"confrontation"with Linda Edson concerning the property's status. They indicated Tom required a letter from them stating they are riot renting, had no desire to rent it and its use was accessory to the main the dwelling. I explained that I did not see the letter and Kathy promised to email me a copy. (She did later that afternoon and I installed copies in the street file). I discussed the zoning restrictions, the criteria of an independent living unit and the family apartment provision. I stated if the BC required a letter and that satisfied him— the space could remain as is until or if circumstances change. The copy I have is not signed, as Marlene sent it to me and to her closing attorney (Stacey Curley), for review prior to sending it to the Building Dept. For your records, I've also attached a copy of the email between me and Stacey Curley dating back to 2010 when Marlene first sought to resolve this issue. I do hope this "puts to bed" any question regarding the home being used as a multi-family property. The subject property is a hidden gem and a lovely sanctuary!. With regards to the garage, I must go on record to state that the space above the garage bay does meet the required criteria for an independent living unit. I understand from our conversation at the site this morning that this area is reserved for personal use and there is no intention to ever the rent it to an outside party. In fact, we also discussed its potential as a viable family apartment. If and when that may be desired, a special permit will be required as it is a detached unit and not connected to the main the structure in any fashion. In the current situation, I found the unit to be obviously unused and therefore not in violation. I concluded this carefully based on the information presented this morning as well as my assessment of the unit in its current condition. That being said, I will keep a copy of the letter you provided declaring the use to be personal only and not intended to be rented. Please keep in mind that if circumstances change staff is available to advise you concerning whatever objective is proposed. If the property is ever offered for sale (however unlikely that may be) there must be a clear declaration of its single family status. We would ask that any interested party consult with us before a formal agreement is drawn in order to also advise or qualify a buyer for any available avenues of zoning relief. I have removed the restriction from the property record and informed your contractor directly as well. Most of the parcel is wetlands. It is developed with a 1.5-story,two-bedroom single-family dwelling of 1,128 sq.ft. and a detached garage. An accessory shed building is also located on the property. A new Title V septic system has recently been installed on the property. The applicant purchased the property in August of 2000, and proposes to improve the property by demolishing the existing one car garage located within,the wetlands and constructing a new two car garage in conformance with zoning and according to the order of conditions issued by the Conservation Commission on January 25, 2002. The applicant also proposes to add an open-air porch to the first floor of the dwelling and expand the second floor by adding a new dormer and truant to create a usable second floor bedroom suite. The existing structure is a very small building with a footprint of 764 sq.ft. The building was constructed sometime around 1935, predating zoning. At its closet point, which is the deck,the structure is 4.2 feet off the property line. The Residential B District requires a 10-foot setback. The applicant's proposal cannot meet the requirements of Section 4-4.3 (1) Nonconforming Buildings or Structures Used as Single and Two Family Residences. That section requires any infringement into the 10-foot setback to require a special permit as an intensification/expansion in structure. The proposal infringes further into the established 4.2 by the creation of the first floor roofed porch. The proposed second floor.area does not extend over the roof of the porch. However, the expansion of the second floor is also within the 10-foot setback. It is developed with a 1.5-story, two-bedroom single-family dwelling of 1,128 sq.ft. and a detached garage. A new Tide V septic system has recently been installed on the property. According to the order of conditions issued by the Conservation Commission on January 25,2002, the applicant purchased the property in August of • 2000, and proposes to improve the property by demolishing the existing one car garage located within the wetlands and constructing a new two-car garage. The applicant also proposes to add an open-air porch to the first floor of the dwelling and expand the second floor by adding a new dormer and turret to create a usable second floor bedroom suite. The existing structure is a small building with a footprint of 764 sq.ft. The building was constructed sometime around 1935,predating zoning. At its closet point,which is the deck,the structure is 4.2 feet off the property line. The Residential B District requires a 10-foot setback. The applicant's proposal cannot meet the requirements of Section 4-4.3 (1)Nonconforming Buildings or Structures Used as Single and Two Family Residences. That section requires any infringement into the 10-foot setback to require a special permit as an intensification/expansion in structure. The proposed porch,built over the existing footprint remains at die established 4.2-foot setback. The proposed second floor area does not extend over the roof of the porch. However,the expansion of the second floor is estimated to be 6.5 feet from the property line,within the 10-foot setback minimum imposed by.Section 4-4.3(1) and therefore requires a special permit. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 31,2002. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened March 20,2002, at which time the Board found to grant the special permit with conditions. Board'Members deciding this appeal were Daniel M. Creedon, Gail Nightingale,Jeremy Gilmore,Randolph • Childs and Chairman Ron S.Jansson.The applicant Peter Mandravelis represented himself during the hearing. rI V �T • He explained his proposal to add to the dwelling. The Board reviewed the elevations and plan submitted by the applicant with the appeal. Questions were raised concerning-the setback of the proposed garage from the wetlands. It was determined that the structure does not meet Section 2-3.7 of the Zoning Ordinances that requires a 35 foot setback for a structure from wetlands. The Board noted that additional relief would be needed for the garage to be completed. The Board however decided to go forward with the Appeal before them in so far as it relates to the dwelling only. The Public was invited to speak and on one spoke in favor or in opposition to the granting of relief. Findings of Fact: At the hearing of March 20,2002, the Board unanimously made the following findings.of fact: 1. The applicant is Peter Mandravelis. The property is commonly addressed 75 Betty's Pond Road, Hyannis,MA,as shown on Assessor's Map 290,as Parcels 090 and 109. It is in a Residential B Zoning District. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the appeal with the following conditions: 1. The dwelling shall be located substantially in compliance with plans presented and entitled"75 Betty's Pond Road,Hyannis,MA"prepared for Peter Mandravelis dated Nov. 12,2001,last revision date of 12/11/01. 2. He stated that he had proceeded with the improvements to the property in full compliance with necessary,permits that were issued. He did not know that any zoning relief was required for the garage.
