128 Bishops Terrace—(Tivey) RA inspected with CAO Gallant—saw nothing for zoning
to address. COA Gallant left card so she can discuss 1 unreg truck. Property is littered with
recyclables. Missing section of fence to side/rear yard serves as a driveway. On this
occasion,there was nothing to address. No signage, no commercial vehicles—no one was
home. Although property was not neat and had piles of misc. items,there was nothing that
triggered a violation.

I received a complaint concerning a landscape business operating from a residential
address at 128 Bishop's Terrace. The caller stated the property owner has rented out his
yard to a landscaper. The traffic, noise and storage of equipment are making it difficult
for the caller to sell his/her house at an asking price that(according to the caller)would
normally be suggested by the real estate agent.
Our street file contains an interesting reference to Owen Flood, a landscaper who was
once the subject of a similar complaint at 31 Security Lane, Hyannis. During that
investigation, Owen Flood advised that he would be relocating his equipment to 128
Bishop's Terrace. I advised him to find a commercial location as this address was limited
to a residential use. Owen Flood claimed the owner told him he had non-conforming
rights. I explained that his use of 128 Bishop's Terrace would result in a complaint and
both parties would be subject to enforcement.
Now comes the neighbor of 128 Bishop's Terrace to complain about the exact scenario
identified in a conversation with Owner Flood on 10/8/14. As I was informed by the
caller that the Tivey's are renting out their yard to a landscaper and in light of Mr.
Flood's admission coupled with a letter addressed to Russell Tivey explaining the
limitations of the residential property at 128 Bishop's Terrace (dated 12/15/2010), 1
issued a citation to Mr. Tivey.
It should be noted that on 1/3/11, Rusell Tivey's son, Ryan (508-241-0464) called to
explain to me that he works for a landscaper and is simply bringing home his employer's
truck as a means of transportation. This call was in response to the letter dated 12/15/10
referenced above and addressed to Russell Tivey.
At the end of the day, it is clear that Mr. Tivey has been made fully aware that a full scale
business operation is not allowed in a single family residential zone.

Dear Gentlemen,
May the residents of Bishop's Terrace, Hyannis point out that there is a house at the corner of Kitsy Lane
and Bishops Terr. (#27 Kitsy)where 8 unrelated men reside.They are currently running 2 or 3 businesses
out of the house. Several dump trucks and multiple vehicles are parked on the lawn and corner of the
street. Several of the 8 are picked up by different vendor trucks throughout the morning.
The house is a rental and was owned by a Clyde Dupee (?). Recently there was a for-sale sign on the
property but it has been removed.The lot is in deplorable condition. Do long time home owners in the
area have any recourse to a situation like this? If any ordinances could be enforced to improve this
situation it would be greatly appreciated. People have a right to rent a house, of course, but to trash a
property with no regard to the neighborhood is downright.sad.
The health department may want to check•128 Bishop's Terr..We sincerely hope that no children live at
that disaster site I I

House looks neglected. Didn't notice trash on this occasion.

Large garage—overhead door was open. '
Building materials were stacked on the side of the drive way.
Property looks used and abused.
No activity during afternoon 1` ,

Found evidence that several people reside here.
Two driveways.
Lawn mowers and trailers on left`side driveway.
Found older male tenant on bike just departing.
He advised this is a single family and he is sole tenant.
I left my business card and asked him to have owner call me:
I said Tuesday would be fine as today is Friday (Memorial Day week-end).

Found Two Brothers Flooring sign posted on front of lawn:
Also noted another sign(exact sign) stored on side of house. . t
Non-English speaking woman answered the door.
I left my card.

Dear Mr. Tivey:
I have received a complaint about your property located at 128 Bishops Terrace
concerning the operation of a landscape/construction business from this address.
You should be aware that your property is located in the RC-1 Single Family Residential
Zone under Chapter 240 Section 13 A (1) of our local zoning code.
A review of,our street file for this property failed to locate any documentation pertaining
to the approval of a home occupation at this address nor was a copy of a completed DBA
(Doing Business As) form found. Please take immediate steps to rectify this and cease all
outdoor storage of equipment and•materials.
I must hear from you by Dec. 31, 2010 in order to avoid enforcement,action that could
result in daily fines of$100.00 for each violation. I maybe reached directly at 508=862-
4027. Your quick response is both anticipated.and appreciated.
