FYI: I have not been in touch with the property owner, however, I am working with the BHA to inspect this property as it has .
a long history of an illegal basement apartment and construction without permits. As I am familiar with the reputation of
the new owner and now coupled with the available file history I remain concerned about the intended use of this property.
As an aside, my research determined that this property was part of an old 4OB. It subsequently went into foreclosure and
this fact is the catalyst for my general process question. With all of the recent foreclosures now being conveyed to
individuals (many of whom are purchasing for investment only)who is researching & monitoring the affordable
requirements as set forth in the original comp permit? I understand that many of those older decisions did not specify'in
perpetuity' but there may first refusal rights and/or sign-offs required to alleviate those requirements. Simply put, is there
a responsible party employed by the town to monitor this situation on behalf of the town? If so, who would this party be in
order that I can identify properties of interest and obtain the corresponding information to install in our street file? Please
advise.

Hi Carol,
The affordable housing restriction was lost on this unit at the first foreclosure in February 1996 when Timothy Clark
lost the unit.
However, there is a legal case that supports affordability surviving foreclosure because of the zoning -it was a 4OB.
Ruth thinks this might be a good case to"test"that on since it is not his primary residence and he only paid $140,000
for the unit, which is affordable (mortgage would not be underwater if we were able to impose a new deed rider). None
of this will be quick or easy. We plan to meet with Jo Anne about it when she returns from vacation.
As for it being his primary residence, Ruth feels it would be impossible to impose. Requiring primary residency is not
mentioned in either the Comp Permit or the original Deed Restriction.
We should expect that he must rent it to an income eligible tenant at an affordable rent, since, because it is a 40B, it is
an affordable unit. The Town must receive'011&review all the tenant income and lease information. Let me know how
you want to proceed. If Robin is in contact with Mr. Croston, he can be referred to me; if not I can try to contact him to
let him know what he got himself into.

Attorney John Kenney represented the applicants , Bayside
Affordable Home Division Incorporated, who are requesting a
Comprehensive Permit under Chapter 40B, to allow the construction
of thirteen ( 13 ) single-family detached low and moderate income
homes at Map 250 , Lots 66 , 67 , 68 and 69 , located at the northwest
corner of Old Strawberry Hill Road and Route 28, Hyannis in an RC-1
zoning district for a parcel consisting of 3 . 12 acres.
In conjunction with this application, plans were submitted
entitled, "Bishop' s Common , dated June 17 , 1987 , " prepared by Down
Cape Engineering, Inc. , as well as a Preliminary Subdivision Plan,
revised September 28, 1987 .
The intended project is. to be a HOP project . Mr. Kenney sub-
mitted a Site Approval Letter and a Funding Commitment Letter from
the HOP program which is the subsidizing agency under the program.
Also submitted was a letter from the Massachusetts Housing Partner-
ship, dated December 8, 1987 , indicating their approval of the
Bishop' s Common project for participation in the Homeownership
Opportunity Program. The applicant submitted evidence that it is a
limited dividend organization, as defined by 760 CMR 37 . 02 ( 8 ) tinder
the HOP Program as is set forth in the. petitioner' s Articles of
Organization and amended and approved by the Secretary of the
Commonwealth of Massachusetts. The petitioner, relying upon data
submitted by the Department of Planning and Development complies
with the town regulations for low/moderate income housing pursuant
to M.G.L . , Chapter 40B: The Town of Barnstable has not yet reached
its standing.
Evidence of interest in the site was submitted to the Board.
The Conservation Commission, Town of Barnstable, established that
there are no wetlands in the development , nor does the site abut
any wetlands . A letter dated November 6 , 1987 was received by the
Board from 'the Conservation Commission.

The petitioner seeks relief .from Section 3-1. 65 and 3-1. 66 of
our zoning bylaw dealing with the density requirements . The
petitioner also proposes to -dedicate 1.2 acres of the site to open
space as is shown on .said plans . The Department of Public Works ,
Town of Barnstable , submitted their `recommendations by letter dated
November 7 , 1987 .
A petition bearing 53 signatures of abutters in opposition to
the petition was also. submitted.
Also submitted was a• letter from .Lester D. Mason , Deputy Fire
Chief of the Hyannis Fire Department with his recommendations .
The proposed project is located within the Zone of Contribution
to number three ( 3) well. In this, .regard, . the Board of Health Ground-
water Protection Regulation limits sewage flow to not more than 330
gallons per day, per acre in this zone.. However;...a. letter from the
Board of Health, dated November 5 ,_ 1987 approved -"this `project , pro-
vided that the proposed- project is sewered.
Mr. Joseph Polcaro Chairman of the Cape Community Housing Trust ,
testified concerning' the Trust ':s support of the petition . He also
submitted a letter of support , indicating that the . project as proposed
follows the guidelines of the Trust, pertaining to affordable housing
and that the developer has agreed to comply with those guidelines .
The Site Plan ,submitted, shows a'n 'open space subdivision consist-
ing of 13 lots' which range ' in size from 5 , 000 to `9 ,000 square feet , with
approximately 400 of the .site ( approximately 1.2 acres ) left as OPEN
SPACE. The overall density of the project translates into 4 .17 dwell
ing3per acre. ;Each proposed -dwelling unit has 'its ,own gravel drive-
way.

Mr. David Martin, Chairman of the Planning Board and interim
Housing Cofordinator for the .Town of Barnstable, gave his support
of the project .
There were many people present at the hearing who spoke of their
concerns regarding traffic, the impact upon the sewer system, children
in the area and the lowering of property values., as well as the impact
on the environment .
Findings/Decision
Dexter Bliss found that the requirements of Chapter 4'OB for affordable
. housing have not yet been fulfilled by the Town of Barnstable. He
further found that this is the ,first project in which all of the
proposed units are affordable and detached. He also found that the
proposed project would be in harmony with the neighborhood in which
it would be located.
Ron Jansson made a motion to modify the findings by proposing
that the Board find that the developer is a limited dividend
organization as is required under 31 CMR; that the developer has
obtained. SITE APPROVAL from a subsidizing agency, as is required under
said regulations; and that the petitioner has submitted evidence of
his interest in the site as required. Having complied with these
requirements , the petitioner has standing, as required, to be before
the Board for a Comprehensive Permit .
Ron Jansson further found that the project as proposed and as
delineated on a Plan of Land entitled, BISHOP ' S COMMON HOME OWNERSHIP
OPPORTUNITY PROGRAM, HYANNIS, MA, JUNE 7 , 1987 , showing 13 individ-
ually owned house lots , and the manner in which this project will be
administered is, in fact , consistent with local needs.

Based upon these findings, Dexter Bliss made a motion to grant
the petitioner the relief sought . This motion was seconded by
Richard Boy. The petition for a .Comprehensive Permit under Chapter
40B was unanimously approved subject to the following conditions:
1. That the driveway that is shown on said plans from
Bishop' s Terrace to Strawberry Hill Road not be
continuous drive space. Lot 1 shall be accessed
only off Old Strawberry Hill Road and numbered one
for Town purposes;. Lots 2 and 3 shall only be accessed
from Bishop' s' Terrace;
2 . That a vegetated strip be initiated in the area to
prevent everyday use of vehicles over this "drive"
area, but providing an emergency access for emergency
vehicles.
3 . That the OPEN SPACE delineated on the Plan be kept
OPEN SPACE in perpetuity. The ownership of the open
space is to be worked out by the petitioner and
Town of Barnstable prior to. occupancy of the project .
4 . That all of the structures be constructed pursuant to

plans submitted subject to the first restriction herein.
5 . That the project be a HOME OWNERSHIP PROGRAM PROJECT;

1987 regarding connection to an interceptor line on
Route 28 be implemented as soon as it is placed in
operation. These conditions are as follows:
a) The four-bedroom units are restricted to
three-bedrooms , and the three-bedroom units

b) No action shall be taken to sewer the develop-

Information and Instructions
Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As quoted from the"law", an employee is defined as every person in the service of another under any
contract of hire, express or implied, oral or written.
An employer is defined as an individual, partnership, association, corporation or other legal entity, or any two or more of
the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the
receiver or trustee of an individual, partnership, association or other legal entity, employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required.
Additionally,neither the commonwealth nor any of its political subdivisions shall enter into any contract for the
performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have
been presented to the contracting authority. -

supplying company names, address and phone numbers along with a certificate of insurance as all affidavits may be
submitted to the Department of Industrial Accidents for confirmation of insurance coverage. Also be sure to sign and
date the affidavit. The affidavit should be returned to the city or town that the application for the permit or license is
being requested, not the Department of Industrial Accidents. Should you.have any questions regarding the"law"or if
you are required to obtain a workers' compensation policy, please call the Department at the number listed below.

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or
less and to allow homeowners to engage an individual for hire who does not possess a license,provided that
the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is, or is
intended to be, a one or two-family dwelling, attached or detached structures accessory to such use and/or
farm structures. A person who constructs more.than one home in a two-year period shall not be considered
a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the
Building Official,that he/she shall be responsible for all such work performed under the building 1permit.

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a
person(s)for hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see
Appendix Q Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in
serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the
unlicensed person as it would with a licensed-Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit
application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a
form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community.

'his property is housed in an affordable housing development consisting of 13 homes
_ 4ch having approx. 1/10 of an acre. The houses are in a development known as Bishops
Common.which sits on a cul-de-sac. Each house is afforded just enough space to house
vehicles.
Lis house which�-id a=single.:family; 2 bedroom home was sold several years `ago and is
currently being used as a multi-fental unit. There is a walkout basement which only has
a single exit.
Me front yard houses anywhere from 4 - 6 vehicles depending on the time of day which are
omed by the tenants.
It clearly appears that between 8 - 10 people are residing in this home, and that it is
clear#ybeing used as a rooming house. The prior owners finished off the basement to
include sectioned off rooms and a bathroom, Tbt -rental purposes. If you check fire dept.
records, you will discover that there was a fire in the basement several years ago as
a result of a lamp cord being run under a rug during the time that people were being housed
1m this basement. .Luckily, eveyone escaped injury. The fire department order the people
to evacuate and ordeged the owners to not allow tenants to live in this cellar. New
tenats are now living in this basement. By watching people enterrand exist the basement .i
would estimate between 5 - six people-a-r-e-fesiding in this basement illegally. The
first floor houses another 4 - 6 people. People are being 11picked up and dropped off
constantly at all hours�.of the day and night.
Tlis development was established as .-- single family homes to be purchased by moderate
income households in 1989. The rules governing this are stated in the legal documents
which were established by Mass Housing Authority, uhder the hop program. It also states
that under no condition, can these homes be rented. I can provide you with copies of this
11'you need them.
This property is. an eyesore due to the numerous cars being housed on the property, and our
neighborhoold property values have clearly been.affected .by this house and we demand a:-
full investigation into this matter, as residents of the Town of Barnstable.
During the wintertime in6nths as a result of the numerous cars, the culdesac becomes
a safety. hazard as the tenants. of this home will park in the culdesac. during inclement
weather, preventing snowplows, and fire/police and rescure to enter the development.
We have no knowledge to- tHenAAdExtify identity of these people and demand full disclosure
of names as this needs to be public knowledge. Because of the amount of people being
housed in this home as tenants we have no idea who are neighbors are.
My husband and i purchased our home in this development 17 years ago. We have raised our
children here, and are sb-, :': ashamed of the state of this neighborhood with multiple homes
being used .as flophouses and the Town of Barnstable doing nothing about it, We put the
burden of the Town of Barnstable^ to address and correct this problem.
I would like to know if a permit was obtained to finish this basement, and if so, why were
the neighboring residents not notified of this request.
