This area is part of the well head protection zone of the Town of Barnstable. As such the storage of fuel trucks is a prohibited use however, since this use has been in existence for a number of years this office would recognize the storage of 13 vehicles with the capacity of 52, 000 gallons total. This amount is based on the records of the Hyannis Fire District. This office also understands and realizes that at any time there could also be up to 8 trucks on site for servicing. In meeting with Mr. Bill McNamara, on two occasions in my office this past spring, . these vehicles for servicing would be,there with minimal fuel in the storage/delivery tank, given the fact that the lifts in the service bay are incapable of lifting a loaded truck. For many years the property has been utilized by Scudder Taylor Oil Company to maintain, store and otherwise keep its heating fuel business for the Cape overall. It is my understanding the property is currently owned by R. F. and R. M. LLP, the Scudder family. In view of the longterm non-conforming use of the lot, it is my client's belief that the property has been and is continued to be used as a legal pre-existing non-conforming use. My client intends to continue the existing uses on site basically to the same degree for the purposes stated therein as well as the re-location of its principal office to the site. I am providing you with the Affidavit of Frederick Scudder, the owner of the property, outlining the current uses of the property indicating that the average number of fuel delivery trucks on site for purposes of delivering fuel oil is 13 vehicles having a total capacity of 52,000 gallons. I believe this has been corroborated in the most recent past year by the Hyannis Fire Dept. In addition to the fuel oil delivery trucks, Mr. Scudder's Affidavit states there is an average of eight fuel delivery oil trucks serviced and maintained on the site on a daily basis, all of which have an average capacity of approximately 40,000 gallons of fuel. I M client intends to continue the use on the site f 1 y o fuel delivery, fuel truck maintenance and office with a total capacity of the fuel trucks on the site not to exceed 92,000 gallons per day. I am informed that no records have been kept on a daily basis showing the total capacity of all of the vehicles on site and in most instances, the actual amount of fuel oil on site is significantly less than the actual capacity of the trucks on site. In order to go forward, my client has submitted the affidavit of Frederick Scudder as previously indicated and would request you to confirm that the continuation of the use for maintenance and storage of fuel delivery vehicles as well as the contemplated office use, will not be violative of zoning and will constitute the continuance of the existing non- conforming use. We would also like to confirm that the uses as outlined herein will not trigger any further review or permitting from the Town of Barnstable other than the ongoing licenses of the Hyannis Fire Dept. In view of the fact that an early November closing is contemplated, I would appreciate whatever you can do to confirm to me in writing that the uses as proposed will not trigger any zoning violations based upon the uses outlined herein. Based on first person disclosure from Scudder-Taylor, I believe their fleet includes fifty-four(54) fuel oil trucks with many of the trucks registered elsewhere. I have knowledge and have observed many of the trucks. brought on-site for service and maintenance. I have knowledge and have observed the door of these trucks stating they are either domiciled in Hyannis, Kingston or Braintree. As a result, Scudder-Taylor has anywhere from six(6)to ten (10)fuel oil delivery trucks on-site for service and maintenance on a recurring;daily basis that I have observed. These would average forty thousand (40,000) gallons of capacity per day. 8. Accordingly at any one time during Scudder-Taylor's fuel oil delivery season,the average number of fueling trucks onsite on a daily basis at 55 Bodick Road, Hyannis, MA are as follows: a. Average number of fuel oil delivery trucks onsite for purposes of delivering fuel is thirteen (13)vehicles having a total capacity of fifty-two thousand (52,000) gallons. b. The average number of fuel oil delivery trucks maintained on a weekly basis is eight(8) having an average capacity of forty thousand(40,000)gallons. c. Accordingly, the average number of fuel oil delivery trucks on-site during the past three(3) years to support normal operations is twenty-one(21) having a total capacity of ninety thousand (92,000) gallons. For several years, this property was the place of business of Scudder & Taylor Oil Co. , Inc. In this regard, I am informed, that this company conducted a fuel oil business at this location for sever- al years, storing anywhere from six to eight oil trucks on the property, servicing these trucks, as well as providing oil burner service. As you may or may not be aware, the Scudder family sold their business to Cape p Cod Oil Service, Inc. , which business still carries on the fuel oil business as well as oil burner service and repair. Cape Cod Oil Service, Inc. , apparently has retained the name of Scudder & Taylor Oil and therefore is cur- rently still known as Scudder & Taylor. The current proprietor of Scudder & Taylor Oil would like to sublease approximately 5200 square feet of its space to my cli- ent, Point Oil of Cape Cod, Inc. for the purposes of providing an extra garage/warehouse space for the servicing and storing of my client's six to eight oil trucks as well as for the purposes of my client conducting his oil burner repair service as well as the office space in conjunction with these uses. According to the zoning map of the Town of Barnstable, it is my understanding that the property in issue lies within the Business District. I am not quite so sure that I can fit in nicely a description of the current nature of the properties use in conjunction with what is required under the Zoning By-Laws. `w In any event, it is apparent that this use has been there for some time and may very well qualify as a business use within the context of what is allowed under Section 3-3. 1 of the Town of Barnstable Zoning By-Laws. It is not the intention to change the use that is currently being made of the property now. However, the proposed sublease would allow for the same type of -use on the property as is currently being utilized. Instead of one oil company located on the premises, there will be two. However, .my major concerns at this time relate to the fact that the property in issue is located within a well protection overlay district whose permitted uses are governed by Section 3-5.2 (7) . In particular, prohibited uses include parking and/or storage of transport vehicles for fuel including but not limited to oil, coal and gas. In view of the fact that this district was created on November 7, 1987, at town meeting and that the current use existed prior to the passage of this article, it would appear that the current use is protected as a pre-existing, non-conform- ing use. The issue. that I ask you to address is whether or not a 'e,• .. It may very well be your position that this would consitute an expansion of a pre- existing- non-conforming use under Section 4-4.2 of our Zoning By- Law. However, you as building commissioner have the right to exercise your discretion in terms of determining whether or not the proposal of Point Oil Company of Cape' Cod, Inca to sublease a portion of the premises from the current occupant who conducts a fuel oil business is, in and of .itself such an expansion as would require a special permit. As you are probably already aware,, a three-pronged' test has been adopted by the Courts in determining whether or not an -existing non-conforming use allows other similar related ' activities upon the locus, without the benefit of further action by a Zoning Board of Appeals. In this regard, this test is set forth in the case of Powers, ,• et al v. Building Inspector of Barnstable, 296 NE 2d 491 (1973) . You may or may not recall this case in view of the fact that it was decided -approximately twenty years ago. This case involved the old Harbor Candle Company's property located on Scudder Avenue in Hyannisport. In . partiruar, 3averca; abutting res�uer,�o ii�c d a ..rat �f i1a:7.'.arit'as to compel the towns- building inspector to enforce the Zoning By Law. One of the buildings in issue had been used prior to the adoption of zoning for the ,manufacture and wholesale/retail of candles which such use became non-conforming when the Zoning By- Law was passed. As you probably recall, successive owners con- the use involving the manufacture and 'sale at wholesale and retail as well ascertain gift shop items which previously had not been sold, despite the fact that there had been a signif- icant increase in the volume of business conducted. on the proper ty which subsequently -resulted in ,increased .traffic. In reaching it's decision to deny the Writ of Mandamus with , reference .to one of the buildings located on the parcel . of land _ involved, the Court applied a three-pronged test for determining whether the current use of the property fits within the exemption granted to non-conforming uses. These tests are as follows: 1. Whether the use reflects the nature and purposes of the use prevailing when the Zoning By-Law took effect. 2. Whether there is a difference in the quality or charac- ter as well as the degree of use. 3. Whether the current use is different in kind in its effect on the neighborhood. As building commissioner, you have the authority to- deterime whether or not the use contemplated by Point Oil of Cape Cod, Inc. comports with this three-pronged test. In making this determination, you must evaluate the condi- tions as-they existed in Wovember of 1987 when the well field protection overlay district was created. With reference to the first criterion, there is no; attempt to* seek to change the use on the property at all. The current occupant of the property, Cape Cod Oil Service, Inc. , . d/b/a Scudder & Taylor Oil, has been conducting a fuel oil business and oil burner service at the property location prior to the adoption of the well field protection overlay district. If you feel you need affidavits or other information to establish the nature of these uses at that time, please let me know. In any event, it is my contention that the said tenant, Point Oil of Cape -Cod, will in fact be carrying on the same use. This use would reflect the nature and purpose of the use that was prevailing at the time the new Zoning By-law took effect in November of 1987. In view of the fact that the proposed subtenant's use is . identical to the primary tenants use, there would not be a difference in the quality or character of this proposed addition— al use, although, arguably there could be a difference in the degree of the type of use. There . is nothing to indicate at this time that the doubling of the use ` will- be deleterious or harmful to the neighborhood affected. The area in issue is a business zoned area and is surrounded °by many other business, some of which provide transportation services to and from their- premises for various business uses. This would lead me to comment upon the third criterion as to -- whether the current use is different in kind in its effect upon the neighborhood. I would submit to you that this is not in fact the case based upon the large amount of commercial activity being conducted within this area. Accordingly, I would ask you to rule that the uses' contem plated by Point Oil of Cape Cod, Inc. at 55 Bodick Road, Hyannis, does not require any further zoning relief from the Town of Barnstable, that such use complies with -the three pronged test described herein.
